CHILD PORN CASE

BY JALELAH AHMED

jahmed@centredaily.com

All 1,508 additional

charges against a State
College man accused of
possessing child pornography were bound over by
District Judge Allen Sinclair
after a preliminary hearing
Wednesday.
David M. Buckley, 28,
was taken away from the
Centre County Courthouse
in handcuffs Wednesday
and transported back to the
county jail where he is
being held on $50,000
bail.
Ferguson Township Detective Devon Michael
Moran testified that 1,893
images were found on
Buckleys computer, including 33 videos.
Moran testified that that
images displayed underage
girls exposing their genitals.
Moran also testified that
all of the images were in

Felony
charges
tossed
BY JALELAH AHMED

District Judge Allen

Sinclair threw out charges
against a Bellefonte man
accused of stealing from
his employer last week.
Jason A. Moyer, 37, was
charged with two felonies
burglary and criminal
trespassing along with
two misdemeanors receiving stolen property and
theft by unlawful taking
after allegations that he
stole money from his employer Jack Houser Amusement.
Moyers defense attorney, Steve Trialonas,
argued that the two most
serious charges should be
thrown out.
And they were.
This case involves alle-

er contained letters that

Moran testified are wellknown to investigators as
signifiers of underage porn.
Moran testified that
Buckley gave him the password for his computer after
a search warrant was executed.
Buckleys defense attorney, Joe Amendola, told
the court that he believed
each image, which Buckley
is being charged in possession of as individual
counts, needed to be
viewed to see if they constitute a child pornography charge.
Parks Miller objected to
Amendola as she argued
that Moran was qualified as
a detective to know what
constitutes child pornography and what does not.
Amendola also argued
that the commonwealths
burden of proof includes
demonstrating that his
client intentionally viewed
the images. Amendola
argued that the commonwealth had not done
that.
Parks Miller objected to
Amendolas interpretation
of the law, stating the statute of possession does not
call for that. Thats silly,
he clearly exercised control
over the pornography,
said Parks Miller.
Sinclair agreed with the

The case will proceed to
a pretrial conference.

gations of employee theft,

not burglary, Trialonas
said.
We asserted a defense
of privilege and the court
properly dismissed the two
felonies. It was the proper
result based on the evidence presented, Trialonas said.
Moyer was accused of
stealing $550 from his
employer, Houser Amusement in Bellefonte.
According to the affidavit of probable cause, surveillance footage provided
to police by Houser Amusement shows Moyer carrying a tan money bag from
the business, through the
front door.
The two lesser charges,
receiving stolen property
and theft by unlawful taking, were bound over.
Moyer is being held at
the county jail on $75,000
bail. This case will likely
proceed to a pretrial conference.
