Step6:Publicationoftheapplication
Uponfilingthecompletespecificationalongwithapplicationforpatent,theapplicationis
publishedafter18monthsoffirstfiling.
Anearlypublicationrequestcanbemadealongwithprescribedfeesifyoudonotwishto
waittilltheexpiryof18monthsfromthedateoffilingforpublishingyourpatentapplication.
Generallythepatentapplicationispublishedwithinamonthformrequestformearly

Uponreceivingthisrequestthecontrollergivesyourpatentapplicationtoapatentexaminer

Theexaminercreatesafirstexaminationreportofthepatentapplicationuponreviewingit

applicationbeforegrantofpatentisgenerallycalledaspatentprosecution.
Thefirstexaminationreportsubmittedtocontrollerbyexaminergenerallycontainspriorarts
(existingdocumentsbeforethedateoffiling)whicharesimilartotheclaimedinvention,and
sameisreportedtopatentapplicant.
Step8:respondtoobjections
Majorityofpatentapplicantswillreceivesometypeofobjectionsbasedonexamination
report.Thebestthingtodoitanalysetheexaminationreportwithpatentprofessional(patent
agent)andcreatingaresponsetotheobjectionsraisedintheexaminationreport.
Thisisachanceforaninventortocommunicatehisnoveltyoverpriorartsfoundinthe
examinationreport.Theinventorandpatentagentcreateandsendaresponsetothe
examinationthattriestoprovetocontrollerthathisinventionisindeedpatentableand
satisfiesallpatentabilitycriterias.
Step9:clearingallobjections
Thiscommunicationbetweencontrollerandpatentapplicantistoensurethatallobjections
raisedinthepatentapplicationareresolved.(ifnotthepatentwillnotbegranted)andthe
inventorhashisfairchancetoprovehispointandestablishnoveltyandinventivestepover
existingpriorarts.
Uponfindingthepatentapplicationinorderofgrant,itisgranttothepatentapplicantas
earlyaspossible.
Step10:Grantofpatent
Theapplicationwouldbeplacedinorderforgrantonceitisfoundtobemeetingall
patentabilityrequirements.Thegrantofpatentisnotifiedinthepatentjournalwhichis
publishedtimetotime.
