COMES NOW, ACCUSED, through the undersigned counsel
most respectfully manifests that:
1. All accused are charged with the above-titled case which is
under Summary Procedure;
2. The Information charges all the accused for different sets
of facts which violates Section 13 of Rule 110 of the Rules
of Court which proscribes duplicity of offense in one
Information;
3. The Court can moto propio dismiss the instant case
considering that under Section 15 (a) on Rule on Summary
Procedure in Special Cases, Motion to dismiss or to quash
is a prohibited pleading;
WHEREFORE, premises considered, it is most respectfully
prayed that the Court notes this Manifestation.
