COVERAGE
Agreement.TheseTermsandConditionsshallformpartofthespecifictermsandconditionsofEastWest
Bank'sindividualproductsandservicesandsuchotherrulesandregulationsgoverningyouraccount/swith
theBankandshallbeapplicabletoanyfutureaccountthatyoumayopenwithus.
Asusedinthesucceedingparagraphs,"we","our","us",the"Bank"and"EastWestBank"refertoEastWest
BankingCorporation.Theterms"you"and"your"refertoeverypersonwhohasanaccountoropensan
accountwithEastWestBank.
Acceptance.Insigningourrelationshipinitiationforms,signaturecards,issuedcardsorbyusingour
servicesandfacilities,youagreetobeboundbytheseTermsandConditions,whichshallgovernyour
relationshipwithusonallaccountsopenedandmaintained,aswellasalltransactionsfromtimetotime
concludedwithorthroughyou.
RELATIONSHIPINITIATIONANDCUSTOMERINFORMATION
RelationshipInitiation.Relationshipinitiationorapplicationwillbesubjecttoourminimumcustomer
information,minimumandmaximumloanorcreditamounts,initialdepositandmaintainingbalancesandany
otherapplicablerequirement,beitforeachproductorservicetypeorforthetotalrelationshipthatyouhave
withus.YouunderstandthattheextensionofanyBankproductorservicetoyouisdependentontheresults
ofanyandallprocessesandscreeningrequirementsofeachindividualproductorservicethatyouare
applyingforandthatanyaccountopeningshallbeatthesolediscretionofEastWestBank.
DisclosureofInformation.Youcertifythatallinformationthatyouhaveprovidedorwillprovidetous
(throughBankDocuments,supportingdocuments,etc.)arecomplete,trueandcorrectandthatallsignatures
onthesedocumentsaregenuine.
Youagreetowaiveconfidentialityofinformationandrecordsrelatingtoyouthatwemayobtainfromthird
parties,includinggovernmentagencies,youremployer,businessassociatesandotherentitiesaswemay
deemproperandsufficientintheconductofourbusiness.
Youconsenttoususinganddisclosinginformationordatarelatingtoyou,yourapplications,loanaccounts
andBanktransactionstoanyofoursubsidiariesandaffiliates,agents,membersoftheFilinvestgroupof
companies,otherbanks,creditcardcompanies,financialinstitutionsandcreditinformationbureaus,third
partyserviceprovidersandtoselectedpersonsinconnectionwithsalesandmarketingprograms(including
otherproductsoftheFilinvestgroup)aswellasotherthirdpartiesauthorizedbyustoreceivesuch
information,whereversituated(includingoutsideofthePhilippines),forconfidentialuseinconnectionwithour
exerciseofourfunctionsorforanybusinesspurpose(includingbutnotlimitedtosalesandmarketing,credit
investigationandcollection,informationtechnologysystems,dataprocessingandstorage,andstatistical,
risk,productutilizationandotheranalysisandotherpurposes).Youagreethatsuchdisclosureorexchangeof

informationwillnotbethebasisofanyclaimagainstusorthepersonsreceivingsuchinformation.Youfurther
agreethatsuchpersonorentitytowhichdisclosureismademayusesuchinformationordatainthecourse
ofanybusinesscarriedbyhimorit.
Youacknowledgethatwemayberequiredbylaw,competentcourtsorgovernmentorregulatorybodiesor
otherofficesoragenciesauthorizedbylawtodiscloseinformationordatarelatingtoyou,yourapplications,
bankaccountsandtransactionswithus.Youunderstandandagreethatwemayberequiredtoreportyour
accounts,includingthehandlingthereof,totheBangkoSentralngPilipinas,AntiMoneyLaunderingCouncil,
creditbureausand/oranyothergovernmentalorregulatorybody.Youauthorizeustoreportand/ordisclose
informationasrequiredtoanybankorcreditcardassociation,creditbureauorinstitutionorotherappropriate
person,ifanyofyourloanaccountsbecomedelinquentoranyofyourdepositorloanaccountsarenot
operatedappropriately.
CustomerInformationUpdate.We,atoursolediscretion,mayupdateanyand/orallyourexistingrecords
withususingthelatestcustomerinformationthatwederivefromyou.Latestcustomerdatamaybereceived
bytheBankthroughanyofthefollowingmeans:(i)applicationoraccountopeningformsofanyoftheBank's
productsand/orservicesand(ii)customerrecordupdatesreceivedthroughdulysignedcustomerinformation
updateforms,facetofacecontact,postalmail,phone,facsimile,email,internetbankingandotherelectronic
means.
DEPOSITPRODUCTSANDSERVICES
CheckingAccounts.Issuanceofchecksshallbegovernedbytherulesandregulationsimposedbythe
PhilippineClearingHouseCorporation(PCHC)andtheBangkoSentralngPilipinas(BSP).
a.DocumentaryStampsTax.Costofchecksanddocumentarystampswillbeforyouraccount.
b.Returned/DishonoredChecks.Returnofchecksdrawnagainstinsufficientfunds(DAIF),drawnagainst
uncollecteddeposits(DAUD),orduetotechnicaldefectswillbegovernedbytherulesandregulationsof
thePCHCandtheBSP.Wemaydishonorchecksinaccordancewithapplicablelaws,regulationsandbank
policies.Wewillhavenoliabilitiesarisingfromthesaiddishonor.
c.MishandledAccounts.Weareauthorizedtocloseaccount/sevenwithoutpriornoticeincasesaid
account/saremishandledbytheissuanceofunfundedorinsufficientlyfundedcheck/sorinvolvementin
anyfraudulentorillicitactivitiesandtoreportsuchclosureandreason/sthereoftotheBSP,theBanker's
AssociationofthePhilippines(BAP),ortoanycentralmonitoringentityorbodyestablishedbytheBAPto
keeprecordofandmonitormishandleddepositaccountsofmemberbanks.Youshallkeepusandour
officersandemployeesfreeandharmlessfromallliabilities,claimsanddemandsofwhateverkindin
connectionwithorarisingfrom:(a)theclosingofaccount/s(b)thedishonorofanycheck/sthereunder
whichmaybepresentedtousaftertheclosingoftheaccount/sand/or(c)thereportingoftheclosureof
account/sandthereason/sthereoftotheBAPortoanycentralmonitoringentityorbodyestablishedby
theBAP.

d.MICRChecks.YouruseofMICRchecksthatwerenotissuedtoyoubytheBankandwereprintedor
securedfromentitiesotherthanthoseaccreditedbyboththeBankandtheBAPAccreditationBoardfor
drawingagainstyourcurrentaccountwithus,shallconstituteawaiveronyourpartoftherightstoclaim
reimbursement/refundordamageofanykindarisingtherefrom.
TimeDeposit.TimedepositscannotbeassignedortransferredbyendorsementoftheCertificatesofTime
Deposit(CTD).Thetimedepositcertificateisnonnegotiableandwillbepayableonlytotheperson/snamed
therein(accountname)ortohis/her/theirheirs,incaseofdeath,subjecttotherulesandpoliciesondeceased
depositors.
Timedepositproceedsaredeemedautomaticallyrenewedatmaturitydate.Presentationofthecertificatewill
nolongerbenecessarytoeffectautorenewal.However,pursuanttoyourinstructions,timedepositmaybe
paid/terminatedorcreditedtoadepositaccountatmaturitydate.Ifthedepositiswithdrawnbeforematurity
date,theapplicablepreterminationratesshallbeusedasbasisforcomputation.Certificatespresentedtothe
BankonoraftertimedepositaccountclosurewillbecancelledandforfeitedbytheBank.
WereservetherighttochargeyouwiththepaymentoftheDocumentaryStampTax(DST)andother
applicabletaxesimposedonyourtimedepositswithus.
ForeignCurrencyDeposits.YouwarrantthatyourForeignCurrencyDeposits:(a)shallnotbefundedby
foreigncurrencyrequiredtobesoldand/orsurrenderedundertherulesandregulationsoftheBSPthenin
effectand(b)shallbefundedpurelybyforeigncurrencyreceiptseligiblefordepositundertherulesand
regulationsoftheBSPthenineffect.Youshallholdusfreeandharmlessfromliabilityforanydepositsyou
makeinviolationofanylaw,rulesorcirculars.
a.ItemsforCollection.Checksdenominatedinforeigncurrencyreceivedasdepositsandsenttoaforeign
correspondentbankforcollection/clearingshallbegovernedbythefollowingspecialconditions:(1)weare
actingonlyasyourcollectionagent(2)weshallnotbeliableforanyloss,damage,ordelayduetocauses
beyondourcontrol,actsofGod,civildisturbances,maildelays/fraud,equipment/systemsfailures,or
othereventsofforcemajeureand(3)weshallnotbeliableforanyclaimfornonpaymentofanyitem
unlessthenonpaymentresultsfromourprovengrossnegligenceorwillfulmisconduct.
Checkdepositspreviouslypresentedandsubsequentlyreturnedbythedraweebankscannotbere
deposited.Wereservetherighttochargeclearingand/orcollectionchargesforchecksdenominatedin
foreigncurrencyfordeposit/collection.Youauthorizeustoimmediatelydebitanyofyourforeigncurrency
orpesoaccountsforreturnedchecks,ourminimumchargesandotheramountstheforeigncollectingbank
mayimposeforanyreturnedcheck.
b.IncomeTax.InterestincomefromforeigncurrencydepositsofPhilippinesresidentsissubjecttotaxin
accordancewithPhilippinelaw.

RebatesandRewardsPoints.Whenapplicable,youmayonlyredeemrebatesandrewardspointsin
relationtoyourdepositaccountsandyouruseofdebitcardsandotherelectronicbankingserviceslinkedto
youraccountsifsaiddepositaccountsareactiveinstatus(i.e.notdormantorescheated)andarenotbelow
therequisiteminimummaintainingbalanceuponactualredemption.Saidrebatesandrewardspointswill
automaticallybeforfeitedinourfavoruponyourorourinitiatedaccountclosure.
Joint"OR"Accounts.Thefundsinyourjoint"or"account(s)areownedentirelybyanyoneofyoujointlyand
severally,andshallbepayabletoandcollectablebyanyoneormoreofyou.
a.Transactions.Yourjoint"or"accountauthorizesustoallowdeposits,withdrawals,checktransactionsor
writtenpaymentorders,withanynumberoralloftheindividualswhoarejointaccountholdersandwhose
signaturesareindicatedinthespecimensignaturecard,andautomaticallyvestsinanyofyoutodo
whateverisdesiredwiththefundswithouttheconsentoftheothercoaccountholders.Thesemayinclude
checksorcreditsinfavoroftheonewhosignedforthesewithdrawals.Ifwereceiveanyofthesewithout
anendorsement,weshallendorsethemonyourbehalfandcreditthesetoyouraccount.Wewillprocess
allthesewithoutinquiryorregardtodisposition,evenincaseswhereyouraccountisoverdrawnasaresult
ofbankcharges,andyouagreetoholdusfreeandharmlessfromanyliabilityarisingtherefrom.Any
numberorallofyouwillbejointlyandseverallyliableforanyoverdraftsonyouraccount,aswellasother
interestchargeswemayhavetoimposeinthecourseoftheoperationofyouraccount.Wemay,however,
requirethewrittenconsentorapprovalofanyorallofyouforfundtransfersfromyourjointaccounttoany
individualaccount(s)withus,whetherownedbyany,allornoneofyou.
b.ClientInstructions.Atourdiscretion,andintheabsenceofinstructionstothecontrary,weshallcreditany
andallfundswereceive,whichpurporttobelongtoanyoneormoreofyou,toyourjoint"or"account.
Incasewereceivecontradictoryinstructionsfromyourcoaccountholder(s),wemay,atouroption,require
allcoaccountholderstoprovideuswithcommoninstructions.Intheabsenceofthelatter,wemayoptto
eitherfreezetheaccountuntilallcoaccountholdersarriveatcommoninstructionsordelivertheproceeds
oftheaccounttotheappropriatecourtinanactionforinterpleadertoresolveyourrespectiveclaims
thereat.Youagreetoreimburseusforthecostofsuit,attorney'sfees,andotherexpensesthatweincurin
doingso.
Allofyouherebyholdusfreeandharmlessfromandagainstanyandallliabilitieswhichmayariseby
reasonofourimplementationofanyofyourinstructionsorrefusaltopayanyproceedsofyourjoint"or"
accountwithouttherequisitedischargebyallofyougiventooursatisfaction.
c.Withdrawals.Wheneveroneormoreofyouwithdrawfromyourjoint"or"account,youaredoingsowith
theexplicitandsworndeclarationunderpainofperjury,thatallyourcoaccountholdersarestilllivingonthe
dateofwithdrawal.
Uponthedeathofacoaccountholder,thewithdrawalorreleaseofthefundsinyourjoint"or"accounts
shallbesubjecttoapplicablePhilippinelaws,regulations,andordersofcourtsofcompetentjurisdiction.

d.InternetBankingTransactions.Itisunderstoodthatalltransactionsmadebyanyonetoyourjoint"or"
accountsviaourinternetbankingfacilityaredonewiththeconsentofallcoaccountholders.
Joint"AND"Accounts.Thefundsinyourjoint"and"accountarecoownedbyallofyouequally,andshallbe
payabletoandcollectiblebyallofyoujointlyduringyourlifetime.Allofyouwillbejointlyandseverallyliable
foranyoverdraftsonyouraccount,aswellasforotherinterestchargeswemayhavetoimposeinthecourse
oftheoperationofyouraccount.
a.Transactions.Yourjoint"and"accountsauthorizeustoallowdeposits,withdrawals,checktransactionsor
writtenpaymentordersonlywithwrittenconsent,approvalorsignatureofallthecoaccountholdersofthe
Joint"and"Account.
b.ClientInstructions.Weshallonlyactontheinstructionsgivenoragreedbyallofthecoaccountholder(s)
ofthejoint"and"account.Intheeventthatnocommoninstructionsaregivenbyallofthecoaccount
holder(s),wemay,atouroption,eitherfreezetheaccountuntilallcoaccountholdersarriveatcommon
instructionsordelivertheproceedsoftheaccounttotheappropriatecourtinanactionforinterpleaderto
resolveyourrespectiveclaimsthereat,itbeingunderstoodthatyoushallreimburseusforthecostofsuit,
attorney'sfees,andotherexpensesthatweincur.
Allofyouherebyholdusfreeandharmlessfromandagainstanyandallliabilitieswhichmayariseby
reasonofourimplementationofanyofyourinstructionsorrefusaltopayanyproceedsofyourjoint"and"
accountwithouttherequisitedischargebyallofyougiventooursatisfaction.
c.Withdrawals.Wheneveroneormoreofyouwithdrawfromyourjoint"and"account,youaredoingsowith
theexplicitandsworndeclarationunderpainofperjury,thatallyourcoaccountholdersarestilllivingonthe
dateofwithdrawal.
Uponthedeathofacoaccountholder,thewithdrawalorreleaseofthefundsinthejointaccountshallbe
subjecttoapplicablePhilippinelaws,regulationsandordersofcourtsofcompetentjurisdiction.
d.InternetBankingTransactions.Joint"AND"accountholdersarenotallowedtoaccesstheirdeposit
accountsviaourinternetbankingfacility.
FortheAccountOf(FAO)orInTrustFor(ITF)Accounts.InopeninganFAOorITFaccount,youdeclare
andacknowledgethatthefundscoveredbytheFAO/ITFaccountarebeingheldbyyouastrustee,intrustfor
andforthesolebenefitofthebeneficiary(ies)namedintheaccountopeningformoftheFAO/ITFaccount.
Youshallprovidealldocumentsthatwerequiretoestablishtheidentityofthebeneficiary(ies),thecreationof
thetrustandthepurposeoftheopeningoftheFAO/ITFaccount.TheFAO/ITFaccountshallbesubjectto
suchothertermsaswemayrequire.Weshallbeentitledtodiscloseanyinformationregardingtheaccountto
yourbeneficiary(ies).

YouwarrantandrepresentthattheFAO/ITFaccount,includingpaymentorreleaseofthefunds,isestablished
foralegitimatepurpose.Youshallholdusfreeandharmlessfromanyandallclaimsofwhateverkindor
naturearisingoutoforinconnectionwiththeestablishment,releaseand/ordispositionoftheFAO/ITF
account.
a.Revocability.YoumaydesignatetheFAO/ITFaccountasrevocableorirrevocable.Underarevocable
FAO/ITFaccount,youreservetherightatanytimetocloseorterminatetheaccountorwithdrawany
amounttherefrominaccordancewiththeseTermsandConditions,withouttheconsentof,ornoticeto,any
beneficiary.UnderanirrevocableFAO/ITFaccount,yourelinquishyourrighttocloseorterminatethe
accountandnopartofthefundsthereinshallreverttoyouormaybewithdrawnbyyou.Intheabsenceof
yourwritteninstruction,weshallprocesstheFAO/ITFaccountasrevocable.
b.DeceasedDepositor.WhateverfundsremainintheFAO/ITFaccountuponyourdeathshallbe
beneficiallyownedbythebeneficiary(ies)andshallaccordinglybereleasedbyustothesaid
beneficiary(ies)ortothelatter'slegalguardiansorrepresentative(s)uponpresentationoftheappropriate
identificationandtherequiredtaxclearance.Wemayrequireyourbeneficiary(ies)toprovideuswithan
acceptableindemnityagreement,courtorderonappointmentoflegalguardian,andanyotherdocument
thatwemaydeemnecessary.
CorporateandPartnershipAccounts.Inopeningapartnershiporcorporateaccount,youshallsubmittous
aSecretary'sCertificateofaResolutionofthePartnersofyourpartnershiporoftheBoardofDirectorsofyour
corporation,inaccordancewithyourarticlesofpartnershiporincorporationandbylaws,designatingusas
thedepositorybankofyourpartnershiporcorporationaswellasthenameandtitleofthesignatories
authorizedtosignonbehalfofyourpartnershiporcorporation.Youshallprovideuswithcertifiedtruecopies
ofyourRegistrationCertificatewiththeSecuritiesandExchangeCommission(SEC)andyourarticlesof
partnershiporincorporationandbylaws,whichwewillretaininourrecords.
TreasurerInTrustFor(TITF)Accounts.Anaccountopenedbythetreasurerintrustforacorporationinthe
processofincorporationmaybeterminatedbyusshouldthecorporationfailtosubmittoustherequisite
documentswithinsix(6)monthsfromtheopeningoftheaccount.Duringtheperiodfromtheopeningofthe
accountuntilthesubmissionofrequisitedocumentsorclosureoftheaccount,wemay,atourdiscretion,
declineanytransactionsontheaccount.Noticeoftheterminationoftheaccountsshallbesenttothe
treasurerintrustathislastknownmailingaddressappearinginourrecords.Thefundsintheaccountshall
bereleasedtothetreasurerintrustwhoopenedtheaccountandpaymenttosuchtreasurerintrustshallbe
sufficienttodischargeusfromanyresponsibilityfortheaccount.
NonResidentAccounts.Asanonresident,youshallcomplywithallapplicablelaws,rulesandregulations
forthefundingandregistrationofyouraccounts,outwardremittanceoffundsfromyouraccounts,foreign
exchangeinvestmentsandallothertransactionsrelatingtoyouraccountswithus.Youshallassumeanyand
alltaxeswithrespecttotheaccountsthatyoumayopen,whichshallbedeductedandwithheldfromthe
appropriateaccounttowhichtheypertainto.

AcceptanceofDeposits.Cashandcheckdepositswillonlybecreditedafterourverification.Checkswillbe
acceptedonacollectionbasisonlyandmaybewithdrawnonlyaftertheprescribedclearingperiodunderthe
existingBSP/PCHCorinternationalclearinghouserulesandregulations,asapplicable.Untilsuchtimethat
wereceiveactualpayment,wemayimmediatelychargebacktoyouraccountanydefectiveorlostitem
creditedtotheaccount,regardlessofthetimeelapsedwhetherornotthedepositeditemcanbereturned.
Wewillnotbeliableforlossofitemsintransitnorforchecksdrawnonuswhicharenotpaidbecauseof
insufficiencyoffunds,forgery,stoppageofpayment,oranyotherreason.
Youassumefullresponsibilityforthegenuinenessandvalidityofallitemsdepositedandallendorsements
thereof.Youalsoassumefullresponsibilityfortheaccuracyoftheinformationfilledoutinthedepositslipor
transactionscreensoftheBank'selectronickiosks,internetbankingfacilityorotherelectronicbanking
channelsandagreetoholdusfreefromanyliabilityforlossesresultingfrominaccuratelyfilledoutdeposit
slipsortransactionscreens.Weshallnotbeliableforclaimsofforgeryand/oranyotherdefectonhonored
checksifnotreportedwithin(10)daysfromyourreceiptofthestatement.
WaiverofProtest.Youagreetowaivepresentment,protestandnoticeofdishonoronallchecks,ordersfor
payment,billsofexchange,promissorynotes,securities,notes,electronicdebitsorcreditsoranyother
paymentinstruments("Instrument/s")thatwereceiveinanywayfordiscount,deposit,collectionor
acceptanceonyouraccount.YouareliabletousforanyInstrumentreceivedforyouraccountasifitwere
presented,protestedandgivennoticeofdishonorintheusualway.
Withdrawals.Overthecounterwithdrawalsmustbemadepersonallybyyouorbyyourdulyauthorized
representativeduringbankinghours.Youlikewisehavetheoptionofwithdrawingfundsthroughourandother
banks'(subjecttoapplicablecharges)AutomatedTellerMachines(ATM)withinandoutsideregularbanking
hours.
FundsTransfer.Inavailingyourselfofourfundstransferfacility,youareboundbythetermsandconditions
embodiedhereinandinanyotherfundstransferagreementoftheBank.Onlycollected,cleared,and
unencumberedfundscreditedtoyouraccount(s)shallbeavailablefortransfertoyourotheraccount(s)orto
anyotherbankaccount,aswemayallow.
AutoDebitArrangement.Youmayenterintoanautodebitarrangementwithuswherebyweshall
automaticallydebitfromyourenrolledregularsavingsorcurrentaccounttheamountduetous(e.g.,for
EastWestBankloanamortizations,etc.)ortocompaniesorestablishmentsenrolledinourautodebit
arrangementfacility.Youshallberequiredtoprovideuswithyourwrittenauthorizationthroughourautodebit
authorizationform.Incasethebalanceinyourdesignatedaccountisinsufficient,wemay,atouroption,not
makeanydebit/deductionordebitanyamountthatwecanfromyouraccount.You,ontheotherhand,shall
directlyberesponsibleforpayinganyamountstillduetotheconcernedparty.

ForeignExchangeTransactions.Fortransactionsthatinvolveanexchangeofforeigncurrencies(e.g.,
buyingandsellingofU.S.dollars),theexchangerateshallbedetermined/providedbyusinaccordancewith
theapplicablerulesandregulations.Youshallberesponsibleforalltaxes,fees,andchargesdueonthese
transactions.
BankChecks.Weshallnotissuemanager'schecks,certifiedchecks,cashier'schecksorsimilarinstruments
payabletocash,bearer,fictitiouspayeeornumberedaccounts.
LostChecks.IncaseaManager'scheck,certifiedcheck,cashier'scheckorsimilarinstrumentissuedbyus
islost,stolenordestroyed,youshallexecuteanAffidavitofLossbyPurchaser/Payeedetailingtheincident
andprovideuswithanindemnityagreementoranacceptableindemnitybondbeforeweissueareplacement
checkorarefundoftheamountonthechecktoprotectusfromanyliabilitythatmayarisefromthelost,
stolenordestroyedcheck.
CheckbookReorder.Checkbooksmaybelinkedtoyourdepositaccountorcreditlinemaintainedwithus.
UponreceivinganycheckbookissuedbytheBank,youshallpiececountthecheckstoascertainits
completenessandimmediatelynotifyusofanydiscrepancy.Youmustensurepropersafekeepingofyour
checkbooktoavoidlossand/orusagebyunauthorizedindividuals.
Checkbooksmaybeorderedthroughdepositorybranchrequest,internetbankingrequestorthroughany
otherelectronicbankingservicethatprovidesyouwiththisoption.Checkbookdeliverymaybethrough
depositorybranchpickuporthroughcourierdeliveryatyourlatestmailingaddressperourrecords.You
agreetohaveusdebityourdepositaccountorcreditlineforthecostofcheckbooksreorderedonorderdate.
Shouldtheavailablefundsinyourconcernedaccountbeinsufficienttocoverforthiscost,wereservetheright
todebittheamountfromanybankaccountthatyoumaintainwithusatanyothertime.Youfurtheragreethat
ifyouaretosendarepresentativetopickupyourrequestedcheckbook(s),saidrepresentativeshouldeither
havealetterofauthorizationfromyouoracheckreorderslipwithhisnameonitdulysignedbyyou.
Youagreetoholdusfreeandharmlessfromanyandallclaimsandliabilitiesandundertaketo
reimburse/indemnifyusforallsuchcosts,payments,damagesandexpenseswhichwemaybeliableforor
whichwemayincurorhaveincurredbyreasonofourimplementationofyourcheckbookreorder(s).You
furtherundertaketonotifyuspromptlyinwritingofanychangeintheconditionswhichgiverisetoyour
requestforcheckbookreorder.
StopPaymentOrders(SPO)willbemadebyyouinwritingthroughourbranches.SPOrequestsmayalso
becoursedthroughourCallCenter,internetbankingoranyotherelectronicchanneluponavailability,subject
toourdefinedSPOproceduresperchannel.UponrequestingforanSPO,youagreetothefollowing:
a.Youwillholdusfreeandharmlessfromanyliabilitywhatsoeverandhowsoevercaused.

b.Youshallreimburseusforallcosts,damages,expensesandinjuryforwhichwemaybeliablebyreasonof
(1)nonpaymentofthecheck(2)paymentcontrarytotheSPOifsuchpaymentoccurredthrough
inadvertence,accidentoroversight(3)paymentmadebeforedateandtimewhentheSPOwasreceived
bytheBank.
c.Weshallreturnthecheck/sforthereason"SPODAIF"(drawnagainstinsufficientfunds)ifsuchwillbethe
case,regardlessofSPO.
d.WeshalldebityouraccountforpaymentoffeesandchargesinrelationtotheSPO.Youmaylikewiseopt
topaytheseincash.
e.Youwillnotifyuspromptly(subjecttotheapplicableSPOcancellationprocedures)ifthecheck/sis/are
paid,recoveredordestroyedorifforanyreasontheSPOmaybecancelled.
f.Fordatedchecks,theSPOwillbeineffectforsixmonthsfromthedateofthecheck/sunlessyouearlier
cancelorrenewit,ascheckdatedmorethansixmonthsuponpresentationshallautomaticallyberejected
forthereason"staledated".
g.Forundatedcheck/s,theSPOwillbeineffectforone(1)year,reckonedfromthedateoftherequest,
unlessotherwisecancelledorrenewed.
SPOrevocationorcancellationthroughourbrancheswillalsobeinwriting.SPOcancellationrequestsmay
alsobecoursedthroughourCallCenter,internetbankingoranyotherelectronicchanneluponavailability,
subjecttoourdefinedSPOcancellationproceduresperchannel.RequestsforSPOcancellationwithinthe
SPOperiodwilltakeeffectonlyuponourreceiptofyourinstructions.
WereservetherighttochargeafeeforthefillingoftheSPOrequestandforanSPOcancellationorder.
Checksdrawnagainstaclosedaccountwillbereturnedforthereason"AccountClosed"regardlessofSPO
instructions.
PaymentofInterest.Wheretheaccounttyperequiresthepaymentofinterest,wewillcomputetheinterest
basedonthecollecteddailybalanceattheprevailingandapplicableratesthatweprescribe.Interestearned
willbecreditedattheendoftheproductdefinedpaymentperiod.Wereservetherighttochangetheinterest
rateandthebasisofthecomputationandmodeofpaymentatanytime.Theprevailinginterestratebasisof
computationandmodeofpaymentandanyamendmentstheretowillalwaysbepostedinaconspicuous
placeinourbranchesorinourwebsite.Nointerestwillbepaidtoanaccountclosedpriortooursetinterest
paymentdates.
Passbook.Youmaybefurnishedwithapassbookdependingonthetypeofcurrentorsavingsaccountthat
youopenwithus.Transactionsmadetoyouraccountshallberecordedinthispassbook.Youmustcarefully
keepandguardthepassbookissuedtoyou.

BankStatements.Foraccountswithbankstatements,thebankstatementsshallbegenerallyavailableona
monthlybasis,exceptwhenspecificallystatedintheaccountproducttype.Weshallsendyoustatements
throughpostalmail,emailoranyotherelectronicmeans.Shouldyourequestforstatementsofaccountat
othertimes,anominalchargeshallbecollectedfromyouforeachadditionalstatementfurnished.Ifno
complaintisreceivedfromyouwithinten(10)daysfromthetimethatwesendyouthestatement,said
statementandalltransactionsthereinwillbeconsideredcorrectandanyclaimagainstuswillbedeemed
waived.Printedcopiesofunclaimedbankstatementswithinanaggregateperiodofthree(3)monthswillbe
destroyed/disposed.Anyrequestforacopyofthesamemaybemadeonlywithinaperiodofsix(6)months
anduponpaymentofanominalcharge.Wemayentertainrequestsafterthesix(6)monthsperiodatour
discretionandforanominalcharge.
LostPassbooks,Checkbooks,CertificatesofTimeDeposit(CTD).Incaseyourpassbook,checkbookor
CTDislost,stolenordestroyed,youshallinformusimmediatelybysubmittingtousanAffidavitofLost
Passbook/Checkbook/CTDwhichshallserveasyourauthorizationforustoeitherclosetheaccountandopen
areplacementaccountorsimplyissueanewpassbook,checkbookorCTD.Youherebyagreetoholdusfree
andharmlessfromandtoindemnifyusforanylossthatwemaysustainbyreasonofsuchissuanceas
thereinrequested.
ChangeofAddressandContactNumbers.Youshallpromptlynotifyusofanychangeregardinganyof
youraddresses,contactnumbersorothernonfinancialdatathatwehaveonrecord.
SignatureUpdate.Youshouldupdateyoursignatureseveryfive(5)yearsorsoonerwhenrequiredbyus.
Shouldyouneedtoupdateyourspecimensignature/sorauthorizedsignatoriesearlier,awrittenrequestfrom
youintheformacceptabletouswillberequired.Forjointaccounts,thewrittenrequestshouldbesignedby
allcoaccountholders.Forcorporations,associations,clubsandotherunincorporatedorganizations,the

MinimumBalance.Youshallmaintain(a)therequiredminimumaveragedailybalanceasmaybeprescribed

closeanyaccountwithzerobalanceforoveraperiodprescribedbyus,whichmaychangefromtimetotime.
DepositAccountsforChildren.Depositaccountsshouldbeopenedbypersonsoflegalageforthebenefit
andunderthenameofchildrenbelowseven(7)yearsofage.Accordingly,all
indemnities/undertakings/representationsthataresupposedtohavebeenmadebythechildinrespectto
theseTermsandConditionswillbedeemedtohavebeenmadebythepersonoflegalageactingasPrincipal
tothedepositaccount.
Consequently,ifyouopenadepositaccountforaminor,youagree,confirmandundertakethat:
a.YouaresolelyandexclusivelyboundbytheseTermsandConditions

b.Youfurtheragree,confirmandundertakethatyouaresolelyandexclusivelyliableandresponsibleforall
charges/expenses/othermoniesincurred/dueandpayableonthedepositaccountanddebitedbyusfrom
thesaiddepositaccount.
Childrenfrom7to17yearsofagemaybeallowedtoopenasavingsortimedepositaccountasprincipal
depositor(subjecttoP.D.No.734).
PDICInsurance.IncompliancewithRegulatoryIssuanceNo.200903(DeterminationofBeneficial
OwnershipofLegitimateDeposits)ofthePhilippineDepositInsuranceCorporation(PDIC),youareinformed
ofthefollowing:
a.DepositsareinsuredwiththePDICuptoamaximumamountofFiveHundredThousandPesos
(Php500,000.00)perdepositor.
b.PDICshallrecognizetheregisteredowner/holderofaLegitimateDepositinourbooksasthedepositor
entitledtodepositinsurance,exceptwhereourrecordsshowthattheLegitimateDepositismaintainedin

3.Copiesofdocuments,whichshowthedetailsorinformationforthetransfer,suchasbutnotlimitedto
contracts,agreements,boardresolutions,auditedfinancialstatements,ordersofthecourtsorof
competentgovernmentbody/agency,areinourcustodyorpossessionupontakeoverbyPDIC.
ii.Thetransferee/sis/aretheQualifiedRelative/softhetransferor.QualifiedRelativesaretransferees

two(2)yearsforsavingsaccountsandone(1)yearforcheckingaccounts.Youmayreactivateyourdormant
accountsbygivingusyourpersonalinstructions.Youhavetobephysicallypresentatthebranchofaccount
toupdateyourspecimensignaturecardandtomakeanoverthecountertransaction(depositorwithdrawal).
Weneedtofullyestablishyouridentitybeforereactivatingyouraccountandwillthereforerequireyouto
presentvalidIDsbeforeprocessingreactivation,postinganytransactionorclosingyourdormantaccount.
Accountswhichremaindormantforten(10)consecutiveyearsshallbeescheatedinfavoroftheTreasurerof
thePhilippines.Ifthe"unclaimedbalance"hasbeendepositedbytheBanktotheTreasurerofthePhilippines,
youwillhavetogodirectlytothegovernmenttofileforanyclaimonthefunds.
GarnishedandFreezedAccounts.Uponourreceiptofanoticeororderfromacourtorothercompetent
authoritydirectingthegarnishment,attachment,freezing,sequestrationorreceivershipofyouraccounts,we
shallautomaticallyplacetheamountrequiredtobegarnishedinyouraccountsonholdandnowithdrawals
fromitshallbealloweduntilsuchorderislifted.Timedepositsthatareincludedinanygarnishment,freezing,
sequestrationorreceivershipordershallbetreatedasaregularsavingsaccountuponmaturity,inaccordance
withexistingregulations,andshalllikewisebeplacedonholduntilsaidorderislifted.
DeceasedDepositor.Wemayfreezeyourdepositaccountuponthenoticeofyouroryourcoaccount
holders'(forjointaccounts)deathuntilnecessarylegaldocumentsarepresented.Claimantsshalllikewise
complywithproceduresthatwesetforthinclaimingsuchdepositswithus.
BankInitiatedAccountClosure.Wemay,atanytime,returntoyouthewholeoranypartofyourdeposit(s)
togetherwithanyinterestduethereonminusanyunpaidcharges/obligationsdueorpayabletousandnetof
applicabletaxes.We,atouroption,maynotifyyoueitherpersonally,bymail,email,SMSoranyother
electronicmeans,ofourintentiononyouraccount,andinterest,ifanyisdue,shallceasefromthedateof

DebitstoAccount.Wereservetherighttodebit,withoutneedofpriornoticetoyou,youraccount/sforall
applicabletaxes,fees,duties,penaltiesandotherchargesduetousorasmayhereafterbecomedueatthe
rateandinthemannerprovidedbyapplicablelawsandtherulesandregulationsissuedbytheBureauofthe

PledgesonDepositAccounts.Youundertaketoadviseusinwritingofyourintentiontoassignorpledge
depositsascollateralforanobligation.Youagreetocomplywiththerequirementsthatwewillimposefor
suchassignmentsorpledges.
HoldDeposit.Shouldyoudesiretoputaportionorallyourfundswithusonholdforacertainperiodoftime,
youshallprovideuswithwrittenandsignedinstructionsintheformthatisacceptabletous.Duringthishold
period,youwillnotbeabletowithdraworcauseanywithdrawalagainstsaidfunds.Withdrawalshallinclude
butnotbelimitedtooverthecounter,internetbankingorATM/POStransactionsandtheissuanceordrawing
ofchecksthatwillreducetheamountonhold.Youherebyholdusfreeandharmlessfromanyandallliability
arisingfromourcompliancewithyourholddepositinstructions,includingbutnotlimitedtodishonoredchecks
madepayableduringtheholdingperiodandforwhichservicefeesshallbeautomaticallychargedagainst
yourdepositaccount.
ELECTRONICBANKINGSERVICES
ElectronicBanking.Morecommonlyknownasebanking,virtualbankingand/oronlinebanking,thisisa
serviceorfacilitythatallowsyoutoaccessinformationpertainingtoyourbankaccounts,conductfinancial
andnonfinancialtransactions,makedeposits,withdrawalsandpaybillsthroughtheinternetoranyother
electronicmeans(e.g.,AutomatedTellerMachineorATM,telephone,mobilephoneetc.)withouthavingto
physicallyvisitourbranches.
AccessCodes.ThefollowingarecollectivelytermedasAccessCodes:
a.AccountNumberasetofnumbersassignedtoyouraccounttoidentifyitinoursystem(s)
b.CardNumberasetofnumbersassignedtoidentifyyourcardinoursystem(s)

backyourdebit/prepaidcardthatprovidesacryptographiccheckoftheinformationembossedonyour
card.Thiscodehelpsascertainthatacustomertransactingviaanyelectronicchannelactuallypossesses
thecredit/debitcardandthatthecardaccountislegitimate.Eachcreditcardcompanyhasitsownname
fortheCVVcode,butitfunctionsthesameforallmajorcardtypes.
d.Passwordanunspacedsequenceofcharactersusedbyoursystem(s)toidentifyauserwhois
authorizedtotransactandgainaccesstoanyaccountmaintainedwithus.

e.PINPersonalIdentificationNumber.Similartoa"password",APINisalsoanunspacedsequenceof
charactersusedbyoursystem(s)toidentifyauserwhoisauthorizedtotransactandgainaccesstoany
accountmaintainedwithus.
CardsandAccessCodesSecurity.Youareresponsibleforthecareandcontrolof"Cards"(includingbutnot
limitedtoATMcards,debitcardsandprepaidcards)thatweissuetoyou.Youshalltreatandhandlesuch
Cardsas"cash."YouarelikewiseresponsibleforensuringthesecurityandconfidentialityofAccessCodes
thatallowyouaccesstoandcontrolofyouraccountsmaintainedwithus.
Atanygiventime,youshouldtakeeveryreasonableprecautiontomaintaintheconfidentialityandsecurityof
yourCardsandAccessCodesby:
a.KeepingpossessionofyourCardsatalltimes
b.NeverkeepingawrittenrecordofyourPasswordsandPINs
c.AvoidingPasswordsandPINcombinationsthatmaybeeasilydeterminedbyotherssuchasyourname,
birthday,phonenumber,address,SSSnumbers,etc.
d.NotdisclosingornotleavinganytraceofyourAccessCodestoanyoneelse,includingbutnotlimitedto
familymembers,friends,Bankemployeesorlawenforcementagencies
e.EnsuringthatnooneseesyourAccessCodeswhileyouarekeyingitinorloggingintoanyofour
ElectronicBankingServices.
LostorStolenCardorAccessCodes.Youshouldnotifyusimmediatelyif:
a.YourCardislostorstolenorifyoususpectthatitislostorstolenorsomeoneelsehasusedit.
b.YourAccessCodeshavebecomeknowntosomeoneelseoryoususpectthatithasbecomeknownto
someoneelseorthatyourAccessCode/shavebeencompromised.
ClientTransactionLiability.Youareabsolutelyandunconditionallyliableforthefullamountofallactivity/ies
onyouraccountcompletedthroughourElectronicBankingServicesresultingfrom:
a.YouruseofyourAccessCodesortheuseofthesebyanypersontowhomyouhavemadetheAccess
Codesavailable,directlyorindirectly,knowinglyorunknowingly
b.YourfailuretonotifyusassoonasyoubecomeawarethatyourPINorpasswordmayhavebeen
compromisedormayhavebecomeknowntosomeoneelseoryourCardhasbeenlost,stolenormisused
c.AnentryerrororafraudulenttransactionmadethroughourElectronicBankingService

PaymentFacilities.Thefollowingformthesuiteofourpaymentfacilities:(i)DebitCard,(ii)PrepaidCard,(iii)
ATM,(iv)InternetBankingand(v)MobilePhoneBanking.Thesefacilitiesallowyoutopayforservicesand
itemsavailedofwithfundsderivedfromyourdepositaccount/sorcreditline/swithus.Thesefacilitiesdonot,
inanyway,representthemerchantsfromwhichtheitemsandservicesweresourcedfrom.Assuch,any
disputethatyoumayhaveongoodspurchasedorservicesavailedofshouldberaiseddirectlywithsaid
merchant/s.
Wedonotguaranteethequalityofthemerchandiseorservicesubjectofanysales/transactionslip.Any
defectordamageonthemerchandiseorserviceshallnotaffectorexcuseyourobligationtopayforthe
transaction.
Wemay,atanytimeandatoursolediscretion,choosetoaddtoordiscontinueanyofthesepaymentfacilities
withoutneedofpriornoticetoyou.
INTERNETBANKINGFACILITY
AutomaticEnrollment.Youwillbeautomaticallyenrolledinourinternetbankingfacilityuponopeningany
typeofdepositorcreditcardaccountoruponavailinganytypeofbankservicethatmaybeaccessedviaour
internetbankingfacility.Toactivatethisserviceforthefirsttime,youwillreceiveanactivationcodetogether
withtheactivationproceduresthroughyourrecordedemailaddresswithus.
AuthenticationandIdentification.Youherebyacceptallthetermsandconditionsgoverningtheuseofthe
internetbankingfacilityandagreetoauthenticateintheprescribedformatmanuallyorelectronicallyorin
suchothermanneraswemay,fromtimetotime,specify.Youfurtheragreetoprovideinformationaswemay
reasonablyspecifytoidentifyyou.
Systemavailability.Youcanaccessyouraccountsinourinternetbankingfacilitytwentyfourhoursaday,
sevendaysaweek(24/7).However,regularsystemmaintenanceactivitiesorotherunforeseenorfortuitous
eventssuchasbutnotlimitedtoprolongedpoweroutages,breakdownincomputers,software,operating
systemsandtelecommunicationfacilities,typhoons,floods,publicdisturbances,calamitiesandothersimilar
orrelatedcasesmayrendersomeortheentiresuiteofinternetbankingservicesunavailableduringcertain
periods.Systemdowntimeformaintenancemayoccurasearlyas7:00PM(Philippinetime).
Weshallpostanyonlinetransactioninitiatedthroughinternetbankingbeforesystemdowntimeonabanking
daytoyouraccountonthesameday.Allinternetbankingtransactionscompletedafterthissystemdowntime
onabankingdayorcompletedonaSaturday,Sundayorbankingholiday,willbepostedonthenextbanking
day.
OnlineTransactions.Internetbankingisanadditionalchannelthatweprovideyoutoallowyoutoaccess
yourfundsandtransactwithusoffsite.Alltransactionsdoneusingourinternetbankingfacilitywillbesubject

TheCardisnottransferrableandyoushallberesponsiblefortheCardfromreceiptthereof.TheCardshall
remainvaliduntilthelastdayofthemonthindicatedthereon,unlessotherwisesuspendedorterminated.You
willimmediatelysurrendertheCardtousuponrequest.Unlessearlierterminatedorcancelled,theCardshall
automaticallyberenewedandreplacedbeforeitsexpirydate.Wereservetherighttocollectfeesinrelationto
cardreplacementfromyou.
CardandPINMailerDelivery.Youmaypersonallyorthroughanauthorizedrepresentativereceiveyour
debitorprepaidcardthroughanyofthefollowingmeans:

b.Deliverytoyourlatestmailingaddressperourrecords
IftheCard/PINmaileristobedeliveredtoyou,itisunderstoodthatyouauthorizeusorourofficialcourierto
delivertheCard/PINMailertoyouor,inyourabsence,toanymemberofyourhousehold,anyauthorized
representativeorthirdpartythatweallowunderourexistingdeliverypolicy.Yourrepresentativewillbe
requiredtopresentaletterofauthorizationfromyoutogetherwithrequiredgovernmentissuedidentification
(ID)cardsuponclaimingyourCard/PINmailer.Youagreetoholdusfreeandharmlessfromanyclaim,lossor
liabilitywhatsoeverarisingfromthedeliveryoftheCard/PINMailertoyourauthorizedrepresentatives.
CardActivation.ActivationofyourCardissubjecttoouractivationpolicyandprocedures.Wereservethe
righttodeclineyourCardactivationrequestwithoutanyobligationtodisclosethereasontherefore.Youshall
holdusfreeandharmlessforanyclaimarisingfromthenonactivationofyourCard.
DebitCard.Adebitcardisacardlinkedtoyourdepositaccountwithusthatallowyouaccesstoyour
depositedfunds24/7throughwithdrawals,purchasesandothertransactionsdonethroughtheinternet,ATMs
orPointofSale(POS)terminals.Debitcardsmayeitherbeautomaticallysuppliedwithcertaindeposit
accountsoftheBankorsupplieduponyourrequest.
a.LinkedDepositAccounts.Youmayrequestforadebitcardthatmaybelinkedtoasingleortomultiple
depositaccountsand,incaseofthelatter,subjecttoamaximumnumberofaccountsandamaximum
numberofdebitcardsperaccountaswemayallow.

PointofSale(POS)iftheavailablefundsinyourlinkeddepositaccountaresufficienttocoverforthefull
purchasepriceoftheitem/servicebeingpurchased.Shouldyouravailablefundsbeinsufficient,the
transactionwillbedeclined.Installmenttransactionswillbepaidintheprescribedinstallments(e.g.equal,
successive,staggered,monthly,semiannually,etc.),intheamountandforthetenorindicatedinthe
installmentapplicationformorinstallmentsalesslip.Thefirstmonthlyinstallmentdueshallbedebitedfrom
yourdepositaccountimmediatelyuponcompletionoftheinstallmenttransaction.Theremaining
installmentbalancewillbeputonholdinyourdepositaccountuntilsucceedinginstallmentsbecomedue,
aredebitedagainstandfullyconsumethisholdamount.
PrepaidCard.Aprepaidcardisapaymentcardthatispreloadedwithyourownmoney.Similartoadebit
card,theprepaidcardallowsyouaccesstoyourmoneyloadedintothecard24/7throughcashwithdrawals,
purchasesandothertransactionsdonethroughtheinternet,ATMsorPointofSale(POS)terminals.
a.NonTransferability.Yourprepaidcardisnontransferable.
b.PDICInsurance.Unlikeadebitcard,aprepaidcardisnotlinkedtoanyofyourdepositaccountsand
thereforefundsloadedintoitarenotconsidereddepositsandarenotinsuredwiththePDIC.

c.InterestandRewards.Prepaidcardbalancesmayonlyberedeemedatfacevalue.Thebalancewillnot
earninterestnorrewardsandothersimilarincentivesconvertibletocash,orbepurchasedatadiscount.
d.LoadingofFundstoPrepaidCards.Youmayreloadfundstotheprepaidcardanytimewiththe
exceptionofnonreloadableprepaidcards,asweidentify.Theaggregateloadlimitperclientpermonthis
subjecttoapplicablelaws,particularlyBSPCircular649(GuidelinesGoverningtheIssuanceofElectronic
Money)andanyamendmentsthereto.Wemayrefusetoacceptadditionalreloadingiftheresulting
monthlyloadwouldexceedthesaidmonthlyaggregatelimits.Wereservetherighttochargeafeefor
reloadtransactions.Methodoffeecollectionwillbedependentonthereloadchannelandwillbecharged
toyouontopofyourdesiredreloadvalue.
Reloadingisvia:
i.Overthecounter(OTC)cashreloadingthroughanyEastWestBankbranch
ii.FundtransferthroughEastWestBankInternetBanking,EastWestBankATMsorBancNetATMs
iii.Otherchannelsaswemayintroduceinthefuture
e.ReloadingLimits.Thereloadinglimitreferstothemonthlyaggregateamountthatyoumayloadtoany
andallofyourPrepaidCards.Shouldyouexceedthisloadlimit,wewillplacetheexceededamounton
holdforsubsequentreleaseonthefirstbankingdayofthefollowingmonth,oncethemonthlyloadlimitof
thePrepaidCardfallsbelowtheloadlimit.
f.PrepaidCardissuancetoMinors.ThePrepaidCardaccountshouldbeopenedbytheParent/Guardian
forthebenefitandunderthenameoftheminorclientconcerned.Accordingly,all
indemnities/undertakings/representationsthataretobemadebytheminorclientinrespecttotheseTerms
andConditionswillbedeemedtohavebeenmadebytheParent/GuardianactingasPrincipaltothe
PrepaidCard.
Consequently,shouldyouopenaprepaidcardaccountunderthenameofaminor,youagree,confirmand
undertakethat:
i.WeareissuingthePrepaidCardtotheminorclientsolelyuponyourspecificinstructionandatyoursole
riskandliability
ii.Youarethebiological,legallyadoptiveparentorthelegalorcourtappointedguardianoftheminor
iii.YouaresolelyandexclusivelyboundbytheTermsandConditionsfortheissuanceofthePrepaidCard
totheminorandyoufurtheragree,confirmandundertakethatyouaresolelyandexclusivelyliableand
responsibleforallcharges/expenses/othermoniesincurred/dueandpayableonthePrepaidCardthat
wedebitfromthePrepaidCardaccount

g.Inactivity,AutoClosureandCardCancellationofthePrepaidCards.YourPrepaidCardaccountswill
becomedormantiftheyareinactive(noclientinitiatedtransactions)forone(1)year.Chargingofthe
inactivityfeeshallstartfromthe13thmonthofinactivity.Intheeventthatthebalancecoveringyour
PrepaidCardbecomesnegativeduetothechargesofinactivityfees,yourPrepaidCardshallbe
automaticallyclosed.Prepaidcardsthatremaindormantforten(10)consecutiveyearsshallbeescheated
infavoroftheTreasurerofthePhilippines.
h.AccountClosure(PagsarangAccount).YoumayredeemtheremainingbalanceofyourPrepaidCard
accountthroughourbranchthatissuedyoutheprepaidcard(overthecounter)oranyofourorBancNet's
ATMs.Redemptionswillbesubjecttotransactionfees,aswedetermineandasdeterminedbythe
internationalnetworkthroughwhichthetransactionwascoursed.Suchtransactionfeesshallbesubjectto
theexchangerateprevailingatthetimeofthetransaction.(KungnaismongipasaraangiyongPrepaid

ATMNetwork.YouunderstandthattheCardmaybeusedinourATMs/POSterminalsandintheATM/POS
terminalsoftheATMnetworkparticipants.Youunderstandthatwedonothavecontrolovertheparticipantsof
theATMnetworkthroughwhichyoumayaccessyouraccount/s,theirATMsandtheirproceduresorcontrols
inregardtodata/informationprocessing.Hence,weshallnotbeliableforanylossordamageofwhatever
kindornaturethatyouincurasaresultoforinconnectionwith(1)yourinabilitytouseordelayintheuseof
yourCardorinabilitytoavailyourselfofordelayintheavailabilityofanyATMserviceduetodisruption,
breakdownorfailureoftheATMorothernetworks,communicationfacilitieslinkingthesame,or(2)
unauthorizedorfraudulentaccessorutilizationofyourCardoranyATMservice.Youunderstandandagree
thattransactionscoursedthroughanyofthesenetworksshallbesubjecttotransactionfeesasdeterminedby
usandtheATMnetworkparticipantsthroughwhichthetransactionsarecoursed.
InternationalTransactions.Wehaveexistingagreementswithourcorrespondentbanksandcardnetworks
(e.g.VISA,MasterCard,etc.)abroad.Thisallowsyoutomakewithdrawalsand/orpaymenttransactionswith
theuseofyourCardinATMs/POSlocatedinothercountries,fromyourorinvolvingyouraccountwithus.Any
withdrawalorpaymenttransactionthatyoumakeoutsidethePhilippinesthroughtheuseofyourCardagainst
yoursaidaccountconstitutesadisbursementfromsaidaccountandaremittancetothecountrywherethe
withdrawalorpaymenttransactionwaseffected.Thesetransactionswillthereforebesubjecttotheapplicable
laws,governmentrulesandregulationsofboththePhilippinesandthecountrywherethewithdrawalor
paymenttransactionwasmade.CashwithdrawalsorpaymenttransactionsoutsidethePhilippinesusingyour
CardwillbeinthecurrencyallowedbytheinstitutionthatownstheATM/POSterminalfromwherethe
withdrawal/paymenttransactionwasmadeanduptothemaximumamountpermittedbyandsubjecttoother
limitationsimposedbythatinstitution.Cashwithdrawalsorpaymenttransactionsarealsosubjecttoany
exchangecontrols,regulationsorlimitationsineffectinthecountrywheretheATM/POSterminalissituated
andwillbeconvertedattheexchangerateineffectonadatedeterminedbyus,whichmaybedifferentfrom
thedatewhenyouperformthetransaction.Transactionsshallbesubjecttotransactionfeesasdeterminedby
bothusandtheinternationalnetworkthroughwhichthetransactionwascoursed.Suchtransactionfeesshall
alsobesubjecttotheexchangerateineffectonadatedeterminedbyus,whichmaybedifferentfromthe
datewhenyouperformthetransaction.Shouldtherebeaneedtoreverseaforeigncurrencytransaction,you
agreethatyouwillberesponsibleforanycostandabsorbanylossorgain,orchargesassociatedwiththe
currencyexchangeandwemaychargeanyofthesecoststoyouraccount.
TransactionCorrectionsandReversals.Youfurtherauthorizeus,ouremployeesandourrepresentatives,
toeffectcorrectionorreversalofanyconfirmederrorormispostingontheaccountwithoutusincurringliability
asaconsequencethereof.
ClientinitiatedCardSuspensionorTermination.Youmayrequestustoterminateorsuspendtheuseof
yourCardthroughanyofthefollowing:

a.Yourdulysignedwritteninstructionsdeliveredtoandreceivedbyus
b.Phoneinstructionsgiventoourauthorizedrepresentative
c.Facsimile
d.Email
e.Internetbanking
f.Otherelectronicmeans
Wewill,onabesteffortsbasisandtotheextentpracticable,immediatelyeffecttherequestedcancellationor
termination.Youwillremainresponsibleforanytransactionmadeonyouraccount(s)untilthetimethatwe
effecttheterminationorsuspensionoftheuseofyourCard.
BankinitiatedCardSuspensionorTermination.WemayterminateorsuspendtheuseofyourCardatany
time,withorwithoutnoticetoyouandwithoutusincurringanyliabilityasaconsequenceofsuchtermination
orsuspension,if:
a.YouhavebreachedtheseTermsandConditions
b.If,inourreasonableopinion,youraccountismishandledasdeterminedpursuanttoourexistingpolicies
andprocedures,orifyouraccountoryourCardisbeingusedforanyunlawfulorillegalactivityor
transactions
c.Incaseofclosure,termination,suspension,garnishment,holdoutorothersimilarrestrictionsonyour
account
d.IfwehavereasontobelievethatyourCardoraccounthasbeencompromisedorthattherehasbeen
fraudulentorunauthorizeduseofyourCardoraccountoranyinformationpertainingtheretoor
e.Weconsiderthatthereexistsotherreasonableground/stodoso.
InternationalCreditCardCorporations.Wehaveagreementswithdifferentinternationalcreditcard
corporationswherebyyourCardbearingthelogos/labelsofsuchcorporationsshallbehonoredatalltheir
accreditedestablishmentsworldwideatalltimes.However,weshallnotbeliabletoyouif,foranyreason,any
oftheiraccreditedestablishmentsdonothonoryourCard.Youagreetoholdusfreeandharmlessfromany
andallclaimsorliabilitiesasaresultoftherefusalofanyaccreditedestablishmenttohonoryourCard.
LiabilitiesbeyondCardTermination.Thesetermsandconditionsandanyandallofyouraccruedbut
unpaidobligationstouswillsurvivetheterminationofyourrighttouseyourCard.
PRODUCTANDSERVICEOFFERS
ProductandServiceOffers.Wemay,fromtimetotime,introduceproducts,programs,privileges,benefits,
facilitiesorservicestobegovernedbytheirspecifictermsandtheseTermsandConditions.Theintroduction,
termsandconditions,restrictions,terminationorwithdrawal,durationand/orchangeofsuchprogramswillbe
atoursolediscretionandyoumaynotcompelustoofferanyprogramstoyou.Youagreeandauthorizeusto
sendpromotionaladvertisementsofourproductsandservicestoyouthroughpostalmail,shortmessaging
services,multimediamessagingservices,emailandotherformsofelectroniccommunication.

CLIENTTRANSACTIONS
ClientInstructions.Youwillbeliableforanyrisk,lossorexpenseresultingfromourimplementationofyour
instructions.Neitherwenoranyofouremployeesandagentsmaybeobligedtocompensateyouforsuch
lossesorexpenses.
ElectronicCommunications.Theterm"electroniccommunication"referstoanycommunicationof
instructionsbytelex,telephone,wire,electronicmail("email"),shortmessagingsystem("SMS"or"text"),
chatting,socialmediapostings/messagingorothermethodoftelecommunicationorelectronictransmission,
includingafacsimiletransmissionorpersonalcomputer.
Wewillconsiderelectroniccommunicationthatweauthenticateandreceivefromyouorinyournamethrough
anyofourofficialelectronicchannelstobedulyauthorizedbyyou.You,ontheotherhand,agreetoauthorize
ustorelyandactonanysuchcommunication.Ifwetrytoverifythevalidityofanyinstructionelectronically
communicatedbyyou(thoughwearenotobligedtodoso)andareunabletodosotooursatisfaction,we
maydelayinactingonorrefusetoactonsuchinstructions.
Wemay,uponyourrequest,forwardcopiesofanystatements,instrumentsorotherdocumentsbyfacsimile
orotherelectronictransmissiontoyouusingthenumberoraddressthatyouprovideusfromtimetotime.
Forourmutualprotection,wemay,atoursolediscretion,recordalltelephonecallsthatrelatetotheuseofor
includeinstructionsforusingourproductsandservices.
Youagreethatourrecordsregardinganyelectroniccommunicationwillbeadmissibleinanylegal,
administrativeorotherproceedingsasifsuchrecordswereoriginalwrittendocuments.Ourrecordswillbe
conclusiveproofoftheinformationcontainedinsuchelectroniccommunications.
Youunderstandthatwe,inanyelectroniccommunicationemanatingfromus,willneveraskyoutodisclose
yourusername,PINoranyotherelectronickeytoaccessyouraccountsand/ormaketransactions.Should

FaxandEMailIndemnity.Wemayberequestedandauthorized,butarenotobliged,torelyuponandactin
accordancewithanynotice,instructionsorothercommunicationthatyoumaygiveusbyfacsimileorbye
mail("Fax/EMailInstructions").Wearenotobligedtoinquireorlookintotheauthorityoridentityoftheperson
makingorpurportingtomaketheFax/EMailInstructionsortheconditionspertinenttoorcircumstances
prevailingatthetimeoftheFax/EMailInstructions.WeareentitledtotreatFax/EMailInstructionsasfully
authorizedbyandbindinguponyou.Weshallbeentitled,butnotbound,toperformsuchactsinreliance
uponFax/EMailInstructionsaswemayingoodfaithconsiderappropriate,whethersuchFax/EMail
Instructionsincludeorderstopaymoneyordebitorcreditanyaccount.Youwillholdusfreeandharmless

fromanyandalllosses,claims,actions,proceedings,demands,damages,costsandexpensesthatweincur
orsustainofwhatevernatureandhowsoeverarising,outoforinconnectionwithFax/EMailInstructions,
providedonlythatweactingoodfaith,exceptifsucharisefromourwillfulnegligence.
FEESANDCHARGES
FeesandCharges.Wewillchargeyouwithourcurrentfeesandchargesforproductsandservicesthatyou
availyourselfof.Scheduleoffeesandchargesmaybefoundpostedinourwebsiteorinourbranches.You
agreetopayservicechargesofanyotherfinancialinstitutionorentityasmaybeimposedasaresultofany
Bankproductorservicethatyoumayuse.Youauthorizeustodebittheappropriateaccountwiththeamount
oftax,fee,chargeorexpensepayablebyyou.Ourfeesandchargesaresubjecttochangefromtimetotime
withnoticetoyouinaccordancewithClause83oftheseTermsandConditions.
Deposits.Anaccountthatfallsbelowoursetminimumbalancewillbesubjecttoaservicecharge.Dormant
accountswillbesubjecttoadormancycharge.Theminimumbalancerequiredandtherulesandratesof
service/dormancychargeswillbesubjecttochangefromtimetotimewithpriornoticetoyouandwillbe
postedinaconspicuousplaceinourbranchesorinourwebsite.
CardFees.WeshallprovideyouwithaFeeSchedulepriortoorupondeliveryofyourCardtoyou.Youwill
paythefollowingfeesandchargesinamountsorratessetforthintheFeeSchedule.
a.RetrievalFee.Thismaybechargedfortheretrievalofanychargesliporsalesinvoicecopy.
b.ForeignCurrencyConversionFee.Thiswillbechargedontransactionsmadeinforeign
currencies/merchants.Thepostedpesoequivalentamountofyourforeigncurrencytransactionsis
inclusiveoftheForeignCurrencyConversionFee.
c.AnnualMembershipFee.ThiswillbechargedfortheCardfacilitiesandservicesthatareorthatwemay
makeavailabletoyouwhileyourCardisnotcancelledorterminated.
d.CardReplacementFee.ThiswillbechargedperreplacementCard.
e.OtherFeesandCharges.Youagreetopaysuchotherfeesandchargesthatmaybeimposedonyour
Cardaccount.
CostsandLegalFees.Youagreetorecompenseusforcostsincurredinourefforttorecoveramountsthat
youoweus.Theseincludebutarenotlimitedtocollectionfeesandattorneys'fees.Youagreetoindemnifyus
forattorneys'feeofatleast10%oftheamountdueplusaccruedinterest.Shouldyoubeunabletopay,these
costsandfeeswillbechargedagainstyouraccount.
REGULATORYCOMPLIANCE
AMLA.Youauthorizeustomakethenecessaryverifications,records,reports,submittalsandother
processes,aswellastoperformsuchactsforthepurposeofcomplyingwiththeAntiMoneyLaunderingAct
(RepublicActNo.9160,asamended),itsimplementingregulations,andotherlawsorrulesregulatingyour

accountsandyouherebywaiveyourrightsunderRepublicActNo.1405,asamended,RepublicAct.No.
6426,asamended,Section55.1ofRepublicActNo.8791andotherapplicablelawsorregulationsinthis
regard.
Youagreetoindemnifyusagainstanylossesandclaimsinconnectionwiththeabove.We,ourownersand
ouremployeeswillnotbeliableforanydirectorindirectlossincurredbyyouoranyperson(includinglossof
anticipatedincomeorinterestpayment)ifsuchlossresultedfullyorpartiallyfromourfulfillmentofthe
requirementsrelatedtoAMLA.
GENERALPROVISIONS
RighttoSetoff.Youherebyirrevocablyconstituteandappointusasyourattorneyinfact,withfullpowerand
authorityandwithoutpriornotice,tosetofforapplytothepaymentofyourobligationsanyfundswhichyou
mayhavedepositedwithus,orwhichwemayhaveinourpossessionorcontrol,includingalloranyinterests
orotherincomewhichmayaccruethereon,includingbutnotlimitedtotimedepositaccountsand/orlongterm
investments,whichweareherebyauthorizedtopreterminateaccordingly,toconvertthefundsintoPhilippine
pesoifdenominatedinforeigncurrencyattheprevailingexchangerateatthetimeofsetofforpre
termination,itbeingunderstoodthatyoushallshoulderalltaxes,expensesandchargesarisingfromthepre
terminationoftheaccountorinvestment.
NoImpliedWaiver.Theexerciseoftherights,privileges,andremediesinanyagreementwithyoushallbeat
ourdiscretionandoption.Ouracceptanceofpaymentforanyloan,installmentoramountdueoranypart
thereofafteranyduedateshallnotbeconsideredasextendingthetimeforsuchpaymentsorasa
modificationoftheconditionsthereof.Nofailure,omission,ordelayonourpartinexercisinganyofourrights,
privilegesandremediesshalloperateasawaiverthereof.Nomodificationorwaiverofanyprovisionor
consentbytheBankshallbeeffectiveunlessthesameisreducedtowriting.
Tolerance,neglectorwaiverbyusintheenforcementoftheseTermsandConditionsshallnotprecludeus
fromthereafterstrictlyenforcingthesame.
Notice.Noticeiseffectivelygiventhroughbranchannouncements,mail(whetherregisteredornot),email,or
anyotherformofelectroniccommunicationatyourlatestcontactinformationinourrecords,regardlessof
yourreceipt.
Allcorrespondencesrelativetoanyofourproductsandservices,includingdemandletters,willbesenttoyou
throughanyofthemedialistedabove.Themereactofsendinganycorrespondencewillbevalidandeffective
noticetoyouforalllegalpurposesandthefactthatanycommunicationisnotactuallyreceivedbyyouorthat
ithasbeenreturnedunclaimedtousorthatnopersonwasfoundattheaddressgivenortheaddresscannot
belocated,shallnotrelieveyoufromtheeffectofsuchnotice.

Ifyoukeepanycard(e.g.debitcard,prepaidcard,etc.)thatweissue,includingrenewalorreplacement
cards,orusetheseoranyofyourAccessCodes,oravailyourselfofanyofourservicesafterwehaveposted
anynotice,thiswillmeanacceptanceofthechangesand/orconditionsinthenoticeasoftheeffectivedate
setoutinthesaidnotice.
DocumentAuthenticity.Whereanysuspicionsariseastotheauthenticityofdocuments,wewillbeentitled
tosendsuchdocumentstotherespectiveauthorizedbodyofexpertisetoproveauthenticity.Anyandallcosts
incurredforsuchauthenticationshallbeforyouraccount.Wewillnotbeliableforanylossthatyouincurdue
tothedelaycausedbysuchactions.
RighttoRefuseDocuments.Wereservetherighttorefusedocumentsthatyoupresentorsubmittousfor
anybanktransactionsolongasthesedifferfromtheonesweapprovedanduse.
SuspensionorTerminationofAccountorService.IfyoufailtoobserveandcomplywiththeseTermsand
Conditions,aswellasanysupplementtheretowhichformsanintegralpartofouragreement,wemay
suspendorterminateanyofyouraccounts,investmentsorourservicesandproductsprovidedtoyouand
yourobligationstousshallbecomedueandpayablewithoutdemandornotice.
Wemaycloseyouraccountincaseyouraccountisimproperlyhandledby:(a)usingittoperpetratefraudor
illicitactivities,(b)drawing,issuingorendorsingcheckstosaidaccountwithoutfundstosupportthechecks,
oragainstinsufficientfunds(c)yourissuanceofacheckinanamountthatisgrosslydisproportionatetothe
presentbalance/ADBoftheaccount(d)yourpreviousinvolvementinfraudoranattempttodefraudas
indicatedbyreportsofanynature(e)yourissuanceofcheckswithsignaturesthatdifferfromthespecimen
signaturesonfile(f)othersimilaroranalogousactsoromissionswhichwedeemunsatisfactoryor(g)for
othergroundsprescribedbylaw,clearinghouseregulation,orregulationofanygovernmentagency.Wemay
imposeanddeductfromyouraccountsanamounttocoverpenalties,finesandcharges.
Incasewesuspend,closeorterminateoneormoreofyouraccounts,orinvestments,orourservicesor
products,youagreetoholduscompletelyfreeandharmlessfromanyandallliabilities,claimsanddemands
arisingfromthesuspensionorterminationoftheaccount,investment,serviceorproduct,orthedishonorof
anycheckpresentedtousafteraccountclosing.
CancellationofAgreements.Wereservetherighttodiscontinueprovidinganyproductand/orservicetoyou
and/orrefusetoprovideyouwithanyproductand/orservicewithoutneedofpriornotice.Thediscontinuance
ofanyproductorservicenotwithstanding,youwill,inallcases,notberelievedofyourobligationstousuntil
allamountsowedtoushavebeenpaidinfullincludinganyinterest,servicecharges,penalties,feesorcosts
thatmaybeduetous.
LiabilityLimits.Wewillnotbeliableforanyloss,damage(includingspecial,indirectorconsequential
damages)ordelayresultingfromanyforcemajeurecircumstanceincludingfailure,error,malfunctionor
inaccessibilityofanyofoursystemsandmachines.

Ourliabilityforoversight,operatingerrorsandsimilaractsofinadvertenceshallbelimitedtoproveddamages
butinnocaseexceedPhp10,000.
Amendments.WemaychangeanyoftheprovisionsintheseTermsandConditionsandthefeesand
chargesofourproductsand/orservicesfromtimetotime.Weshallnotifyyouofsuchchangesandyoushall
bedeemeddulynotifiedofsuchchangesifwesendnoticethroughanyofthefollowingmeans,atoursole
discretion:(i)mailedand/oremailednotices(senttoyourmailingoremailaddressesindicatedinourrecords),
(ii)noticespostedatourbranchesor(iii)noticesinourwebsite.
CivilCodeArticle1250.TheprovisionsofArticle1250oftheCivilCodeofthePhilippinesshallnotbe
applicable.
ENFORCEMENTPROVISIONS
GoverningLaw.TheseTermsandConditionsaregovernedbyPhilippinelawandrulesandregulations
applicableonthemattersnowexistingorwhichmayhereinafterbeenacted,issuedorenforced,including
issuancesbytheBSP,BIR,PDIC,ChamberofThriftBanks,thePCHC,andsuchotheragenciesregulating,
monitoringorsupervisingbankingoperations.
Venue.VenueforactionsbroughtundertheseTermsandConditionsshallbeinthecitywhereourprincipal
officemaybelocated.
SeparabilityClause.IncaseanyportionoftheseTermsandConditionsisdeclaredinvalidorunenforceable
foranyreasonorshouldwedecidetoterminateorcancelanyoftheproductsorfacilitiesorserviceswhich
weprovide,itshallnotaffecttheotherprovisionsoftheseTermsandConditionswhichshallremainvalidand
binding.
