adroughtwatchdeclarationforfourmorePennsylvania
countiesChester,Cumberland,DelawareandPhiladelphia
duetolowstreamflows,declininggroundwaterlevelsand
lackofprecipitation.
Thedeclaration,whichbringsthenumberofcountiesunder
droughtwatchto38wasmadefollowingTuesdays
meetingofmembersoftheCommonwealthsDroughtTask
Force.
Allthecountiesnowinthedroughtwatchinclude:ArmstrongBedford,Berks,Blair,
Bradford,Cameron,Carbon,Centre,Chester,Clarion,Clearfield,Clinton,Cumberland,
Dauphin,Delaware,Elk,Forest,Fulton,Huntingdon,Indiana,Jefferson,Juniata,Lawrence,
Lebanon,Lehigh,Lycoming,McKean,Mercer,Mifflin,Northampton,Perry,Philadelphia,
Schuylkill,Snyder,Sullivan,Tioga,Union,andVenango.
The38countiesunderadroughtwatchdeclarationarebeingaskedtovoluntarilyreduce
nonessentialwateruseby5percent.
Onecounty,Potter,remainsinadroughtwarning.Citizensinthatcountyareencouraged
tovoluntarilyreducetheirwaterusebetween10to15percent.
Eightpublicwatersystemshaveinstitutedvoluntaryandmandatorywaterrestrictions.
Theyinclude:

BedfordBoroughWaterAuthority,BedfordCounty
DuboisWaterDepartment,ClearfieldCounty
GaletonBoroughWaterAuthority,PotterCounty
HuntingdonBoroughWaterDepartment,HuntingdonCount
PetersburgBoroughWaterSystem,HuntingdonCounty
ShinglehouseBoroughWaterDepartment,PotterCountyand
WellsboroMunicipalAuthority,TiogaCounty.
Belownormalprecipitationacrossmostofthestatehasresultedininstantaneousstream
flowsdeclininginthecentralandeasternpartofthestate,DEPActingSecretaryPatrick

McDonnellsaid.Wereaskingresidentstocontinuetoconservewaterinordertopreserve
adequatedrinkingwatersupplies.
OnAugust11,DEPnotifiedallwatersuppliersintheaffectedcountiesoftheneedto
monitortheirsuppliesandupdatetheirdroughtcontingencyplansasnecessary.Inadditionto
precipitation,groundwaterlevelsandstreamflows,stateofficialsalsomonitorsoilmoistureand
watersupplystorage.
DEPrecommendsthefollowingwaystoreducewateruse:
Runwateronlywhennecessary
Avoidrunningthefaucetwhilebrushingyourteethorshaving,orlettingtheshowerrunfor
severalminutesbeforeuse
Checkforhouseholdleaks.Aleakingtoiletcanwasteupto200gallonsofwatereachday!
Rundishwashersandwashingmachinesonlywithfullloads
Replaceolderapplianceswithhighefficiency,frontloadingmodelsthatuseabout30percent
lesswaterand40to50percentlessenergyand
Installlowflowplumbingfixturesandaeratorsonfaucets.

ChristopherThompsonaddressedtheCommitteeon
behalfofthePAAssociationofConservationDistricts.
Thompsonbriefedattendeesontheissuesconservation
districtsarenowfacingasaresultoftherebootstrategy.
InJanuary2016,conservationdistrictswereaskedto
assisttheDepartmentofEnvironmentalProtectionwithfarminspections.Theseinspections
wouldcheckfarmsformanuremanagementanderosionandsedimentationcontrolplans.
Localconservationdistrictboardsarefacedwiththedecisionwhetherornottogointo
theprogram.
However,fundingfortheirChesapeakeBayTechnicianstaffdependsupontheir
willingnesstoinspectfarms.
Someconservationdistrictsarehesitanttosignonbecauseitwouldchangethedistricts
rolefromtechnicalassistancetocompliance.
ConservationdistrictshavehadmeetingswiththeDEPinregardstothefarminspections
conservationdistrictshavebeenaskedtoconduct.Thishasbeenastepforwardsincemany
concernstheconservationdistrictshavewereaddressedbyDEP.
However,therearestillsomeissuesofconcernwithconsistencyandprivacyforthe

farmsthatareinspected.
Althoughmanyoftheconservationdistrictsconcernshavealreadybeenadequately
addressedbyDEP,therearestilltwooutstandingissuesthediscrepanciesbetweenthe
StatementofPolicy,theinspectionform,andthecontract,andprivacyconcernswhenadistrict
employeeobtainsinformationgeneratedbyfederalentities,saidThompson.
Anotherconcernstillunresolvedrelatedtoaprivacyissuewithdocumentationobtained
fromafederalagency,suchasU.S.NaturalResourcesConservationService.
Section1619oftheFederalPrivacyActprohibitsanyentityfromsharinginformation
obtainedfromfederaldocumentation,suchasaconservationplan.
BeforeanyinformationisobtainedbythedistrictemployeeandgiventoDEP,thefarmer
shouldsignanAuthorizationforReleaseofRecordsformasauthorizationtoreleasethe
records.
AttemptstoincorporatethefederalreleaseformintotheDEPinspectionformare
ongoingwiththegoalofstreamliningtheprocess.
HowmanyofPennsylvaniasconservationdistrictswilltakeonfarminspectionsaspart
oftheirduties?Onlytimewilltell,saidThompson.
FundingKeyToSuccess
ThePACDtestimonyalsohighlightedthecriticalrolefundingplaysintheinstallationof
farmbestmanagementpractices.
FundingisthekeytosuccessforBestManagementPractice(orBMP)installation.
Withoutadequatestateandfederalfunding,farmerscannotaffordtoinstalltheBMPsnecessary
tosignificantlyreducenutrientsgettingintoourlocalwaterways,andultimatelytheBay.
PACDproposesasignificantamountofpublicfundingdedicatedtowardwaterquality
improvement.Thisfundingshouldbedistributedatthelocallevelwithconservationdistricts
beinganintegralpartoftheplanningandimplementationprocess.
Theyknowtheareasgeology,thelandowners,andthelocalgovernmentleadersto
effectivelyandefficientlydistributethefunding.

nowavailable.
Managementofourstateforestsystemisan
everchangingundertaking,asthereareconstantlynew
challengesandbestpractices.Societycontinuestoplace
increasingneedsonstateforestlandsuchasrecreationaluse
andresourceextraction,andtheforestalsoisunder
environmentalstressorsincludingclimatechangeandinvasive
plantsandinsects,Dunnsaid.Thecarefulanddeliberate
approachtomanagementoutlinedintheplanwillhelpprotect
andsustaintheforestsecological,socialandeconomic
benefitsnowandforthefuture.
Since1955,DCNRsBureauofForestryhasbeendevelopingstatewideplansthatguide
stateforestmanagementandcommunicateprinciplesandgoalstothepublic.Theplanisupdated
approximatelyeveryfiveyears.
DCNRreceivedmorethan4,000commentsontheplan.About330peopleattendeda
seriesof12publicmeetingsthatprovidedanopportunityforcitizenstohaveasayinhowtheir
publiclandsaremanaged.
Wevelistenedtothepublictoproduceaflexible,dynamicguidancedocumentthatwill
continuetoevolveinordertoprotectthelongtermsustainabilityofourforests,Dunnsaid.
Enhancedcommunicationandpublicinputwillcontinuetobeapriorityasweimplementthis
plan.
Notablechangesintheplanasaresultofcommentsinclude:
TheintroductionofCoreForestandWildCharacterFocusAreastobetterimplementthese
valuesonstateforestland(seepages34and42oftheplan)
Asectiononwaterresourceprotectionandenhancement,and

Council,andGreenBuildingAlliance,wearewritingtoshareourconcernswithHouseBill568
(P.N.3705),whichwaspassedbytheSenateonJuly11,2016andisawaitingaconcurrence
voteintheHouse.
RepresentativeEvankovichgraciouslymetwithusinlateAugusttodiscussthis
legislation.WhileweagreethereisadefiniteneedtoamendthePennsylvaniaConstruction
CodeAct,andarethankfulforhisleadershipinbringingthisissuetowardsaresolution,we
remainconcernedthatHouseBill568,ascurrentlywritten,doesnotbestservethecitizensof
Pennsylvania.
Inparticular,wehavethefollowingconcerns:
CodeReviewandAdoptionTimelineIssuesWhilethebillinstitutesbuildingcodereview
everythreeyears,thetimelineforthereviewprocessensuresthatPennsylvaniawillalwaysbeat
leastoneversionbehindthemostrecentInternationalConstructionCode(ICC),adocumentthat
isupdatedeverythreeyears.
Becausecodeofficialtraining,requiredannually,isonlyofferedonthemostrecentICC,
Pennsylvaniamunicipalcodeofficialsdonothaveaccesstotrainingcoursesandmaterialsonthe
buildingcodetheyenforce.Codeofficialswhoarerequiredtoenforceaccessibilityandother
recentcodeupdatesmustbetrainedinmultipleversionsofthecode,whichisincredibly
onerous.
TheupdatesinHouseBill568,ascurrentlywritten,willnotaddressthisissue.The
legislationstimelinespecifiesthatcodereviewwillbegin21monthsaftertheICCisreleased,
andthatregulationsadoptedundertheactshalltakeeffect33monthsafterthebeginningofthe
reviewperiod.
Thisequatesto54monthsbetweenwhentheICCisreleasedandpossibleenactmentin
Pennsylvania,lockingourstateintoacycleofalwaysbeingatleastoneversionoftheICC
behind.
Further,thelegislationcurrentlyprovidesthatthe2015codewillbereviewedona
separateschedule,andanyregulationsadoptedasaresultofthatreviewshallbeeffectiveJune1,
2018.Atthatpoint,Pennsylvaniawillhaveoperatedunderthe2009codefornearlytenyears.
OppositiontoUpdatedCodeProvisionsAlthoughthebillremovestherequirementfora
twothirdsmajorityvoteforadoptionofeveryprovisionintheICCabarriertocodeupdates
presentlyitcontinuestorequireatwothirdsmajorityvoteforanyprovisionthathasbeen
opposed.
UnderHouseBill568,thewaybywhichaprovisionoftheICCcanbelabeled
opposedincludesreceiptofacommentfromthepublicorselectionbyamemberofthe
technicaladvisorycommittee,recommendingtheprovisionforindividualreviewbytheRAC.
Thissystemmakesitveryeasyforaprovisiontobemarkedasopposedandtherefore
subjectedtothesame,ineffectiveadoptionprocessthatthebillpurportedlyseekstoaddress.
RACCompositionAfinalconcernthatbearsmentioningisthemakeupoftheRACand

TechnicalAdvisoryGroups(TAG).WhilethecompositionofRACmembersisverywell
definedinthelegislation,itshouldbespecifiedthatmembersrepresentingassociationsare
nominatedbysaidindustryassociation,ratherthansimplybeingfromtheassociation,to
ensuretheRACmemberistrulyrepresentingtheinterestsofthatassociation.
Furthermore,thelegislationlacksanycriteriaforparticipationonaTAG,butrather
leavesittothediscretionoftheRACchair.
WhiletheRACactuallyvotesoncodeprovisions,theTAGmembershavesignificant
powerbecauseoftheirabilitytoopposeaprovision,subjectingittoamuchmoredifficult
reviewandapprovalprocess.
Therefore,arecommendedchangeistoincludegreaterspecificityofthemembership
compositionoftheTAGs.
Pennsylvaniaslackofupdatedcodeshurtsourcitizensinseveralways.Forexample,
ISO,anorganizationthatprovidesresearchanddatatotheinsuranceindustry,grades
municipalitiesonhazardprevention.
Thisdirectlyaffectsinsurancerates.Pennsylvaniaslackofuptodatefireprotection
standardslowersthisratingforallPennsylvaniacommunities,potentiallyleadingtohigher
insurancerates.
Inaddition,energyefficiencystandardsareparticularlyimportanttolowincome
households,whospendmoreoftheirincomeonenergyutilitiesthantheaveragepopulation.
InarecentACEEEstudy,PennsylvaniawastheonlystatewithtwocitiesPhiladelphia
andPittsburghinthetoptenlistofgreatestenergyburdenonlowerincomeindividuals.
Whilethereisanadditionalcosttomanyenergyefficiencyimprovements,a
PennsylvaniaspecificstudybytheBuildingCodesAssistanceProjectestimatedthiscosttobe
$1,403to$3,375perhomefortheenergyprovisionsinthe2012ICC,whichwillresultinenergy
savingsworth$7,623to$19,191overthelifeoftheir30yearmortgage,morethanpayingback
theinitialinvestment.
WhileHouseBill568isastepforward,itdoesnotadequatelyaddressseriousissueswith
Pennsylvaniasbuildingcodeadoptionprocess.Weurgeyoutoconsideramendmentstoaddress
theconcernsoutlinedabove,andwouldbepleasedtohelphoweverwecan.

safetytoournaturallandscapesandviewshedstolocalpropertyvalues,Sen.Dinnimansaid.
Mylegislationcallsforlocalhearingstogivecommunityleadersanopportunitytofully
considerthesizeofaproposedbillboardspacingandlightinghighwaysafetylightpollution
andotherpropertyanddevelopmentissues.
Sen.LisaBoscola(DLehigh),ChairoftheCommittee,added,Theseelectronic
billboardsarerelentlesslybrightespeciallyatnightandflashrotatingadvertisements
secondsapart.Theyareanoverwhelmingandoftenunsightlyvisualelementwherevertheyare
located.IapplaudSenatorDinnimanforintroducinglegislationthatwouldupdateourantiquated
billboardlaw,tightenrestrictionsonthesedevicesandgivelocalcommunitiesmoresayover
wherethesebillboardscanbelocated.
AfterDowningtownMayorJoshMaxwellwelcomedtheSenatecommitteetotheChester
CountyIntermediateUnit,thepublichearingfocusedonSen.Dinnimansbillandtheimpact
thatelectronicbillboardshaveonlocalhealth,safety,propertyvaluesandacommunitysappeal.
Sen.DinnimanestimatedthatChesterCountyalreadyhassevenelectronicbillboards.
TheSenatepanelheardfromanumberoflocalofficials,preservationistsandcitizensonthe
issue.
DowningtownresidentBobbiJoBroomelllamentedthatabillboardshinesdirectlyinto
herhome.Shesaidnooneintheneighborhoodknewthatthesignthesizeofadriveinmovie
screenwastobelocatedhoveringovertheirhomes.
Wehadnonotificationsowedidntevengetachancetofight,Brommellaboutthe
billboardbeingerected.Wehavenochoicebuttohavethishugemonstershiningdownonus.
Broomelladdedthatelectronicbillboardsaredestroyingourhealth.Shealsosaidthe
hugeelectronicstructureshurtpropertyandresalevaluesbecausenoonewantstobuyahouse
wherethereisahugesignshiningthroughtheirwindowdayandnight.
WilliamGladden,whoservesasdirectorofChesterCountyOpenSpace,saidthecounty
hasspent$190milliontowardpreservingapproximately25percentofthecountysnaturallands
andforests.

HeendorsedSen.Dinnimansbill,claimingitwouldbringpeoplelivingintheshadow
ofthesevisualimpairmentsandlocalgovernmentleadersintoamoreinclusivepermitting
process.
WestChesterAttorneyAnthonyVerwey,whohassuccessfullydefendedmunicipal
ordinancesthatregulatetheplacementofelectronicbillboards,saidhebelieveselectronic
billboardscanbeconstructedatlocationsthatprotectandrespecttherightsofpropertyowners
andtheCommonwealthsobligationtoprotectitsnatural,scenicandaestheticvalues.

Downingtown,wereinvitedtotestifyatthehearing,butdeclined.

quiteslowinpermeability,soitneverreallydriesout.
ButtheStahlsdidntshrinkfromthechallenges.In1975,grandfatherEverettput
contourstripsonsomeofthehilltopssohecouldgrowhayandcornandstillkeepthetopsoilin
place.
Everettscontourstripsremaintoday,wellmaintainedwithcroprotationandlimeand
manurespreading,andcontinuingtodoagreatjoboflimitingerosion.GrandsonJasonadded
hisownconservationcontributionaboutsixyearsagowhenhestartedusingnotillpracticesto
raisethefarmscorncrop.
Thefarmsmudproblemexacerbatedbyitssteepslopes,predominantsoiltype,anda
culvertthatdumpedwaterfromtheroadrightintotheStahlspasturepresentedanongoing
challengetotheircowcalfherd.Whenthecowsstoodinthefield,themudwasuptotheir
bellies,Jasonsaid.
DadDuaneputinadiversionditchsomeyearsago,butthewaterproblemwassobigthat
itneededalargescale,multiprongedeffort.Severalyearsago,theStahlswereabletoprocure

conservationfundingand,guidedbyconservationplansandexpertadvice,thatmajorwork
began.
Thefamilyaddedanapronofhard,angularrocksattheendoftheculverttodirectthe
water,anewundergrounddraintocarryitacrosstheproperty,andtworockoutletstosafely
releaseitintoeitherapondorstream.
Theyalsoreconfiguredalltheirpastures,creating10paddocks,eachwithafrostfree
hydrant,sotheycanrotatetheir100animalherd.
Anew40X130roofedheavyusebuildingprovidesshelterforthecowstohavetheir
calvesandspendthewinter.Partofthisroofedbuildingisusedformanurestoragesothat
excessnutrientsdontfindtheirwayintoeitherofthetwostreamsthatflowthroughtheStahl
propertyontheirwaytotheYoughioghenyRiver.
Anewanimalwalkway,astabilizedaccessroad,andastreamcrossingcompletedthe
majorfouryearconservationproject.

andconservationaccomplishmentsthatgreworganicallyfrom
theneedsofthepeopleofWestmorelandCounty.
Infact,hesayshisproudestmomentshavebeenthosein
whichhewasabletohelppeoplehaveabetterlife.
Larrygothisfirstchancetodothatveryearlyinhisearlycareerwhenhehelpedbring
municipalwaterservicetothecommunitiesofSalina,Truxall,andFitzHenry,whichintheearly
1970sstillhadeithernoreliablesourceofdrinkingwaterorhadonethatdidnotmeetminimum,
safedrinkingstandards.
BornandraisedinExport,Larryknewfirsthandtheimpactofthecoalindustryonour
naturalresourcesandheservedtwiceontheboardoftheTurtleCreekWatershedAssociation,
helpingwithitsworktocleanupstreamspollutedwithabandonedminedrainage.
Intheearly1980s,whenunemploymentinthecountyhit16percent,Larrysetoutto
growjobsbycreatingindustrialparkswithsitesthatwereeasyforcompaniestobuildon.
Today,thereare16industrialparksthroughoutthecountythatarehometo142
companiesemploying9,500workers.
Larrymadesureconservationwasamajorpartoftheindustrialparks,adding
landscaping,innovativestormwatermanagementfeatures,andpermanentlysettingaside25to30
percentofthelandineachparkasopenspacebecausecompaniesalsowantthethingsthat
contributetoagoodqualityoflife.
TheDistrictsconservationcampusisactuallyononeofthefirstcountyindustrialpark
sites,andtheorganizationislocatedtherethanksinlargeparttoLarry,whoalsooversawthe
reclamationoffourmajorbrownfieldsitesinotherpartsofthecounty.
LarryundertookWestmorelandCountysfirstcomprehensiveplanin2006,andwhen

focusgroupsrevealedthatthepublicsnumberonedesirewastoretaintheruralcharacterof
WestmorelandCounty,hehelpedtoformtheWestmorelandLandTrustwhich,ineightyearshas
conserved235acresofopenspaceinsixdistinctWestmorelandCountycommunities.
Larrysperseveranceovercamesignificantobstaclestocreateoneofthecountysfirst
trails,theFiveStarTrail,andhewasinfluentialinthegrowthoftheRegionalTrailSystem.
Mostrecently,Larrycontinuestobeagreatfriendtoconservationeveninhisretirement.
HehasbeenextremelyhelpfulintwoconservationprojectsontheWestmorelandCounty
CommunityCollegecampusthatareinvestingupwardsofahalfmilliondollarstoimprovewater
qualityinCherryCreek.

Enforcement(OSMRE).Projectsliketheseareextremelybeneficialtothecommunity,notonly
asaresultoftheefforttoputoutthefire,butalsothelongertermbenefitsofthereclaimedland
thatcanprovidefornewrecreationalareas,newhousing,newbusinesses,andmostimportantly,
newjobsforourpeople.
McDonnellandPizarchikvisitedthesitewithlocalleadersandotherstateofficialstosee
firsthandthecommencementofworkonsiteanddiscusstheeconomicandenvironmental
benefitsoftheproject.
EarthmoversUnlimited,Inc.outofKylertown,PAwasawardedan$8.9millioncontract
fortheworkinJune2015.Oncethelandisreclaimed,itwillbeusedfordevelopmentof
industryandopengreenspace.
Expectedtolastthreeyears,theprojectwilleliminatea25acreundergroundfire
believedtobehundredsoffeetdeep,dangeroushighwalls2,500feetlongand130feetdeepwith

anopenpitatthebottom,minesubsidence,crackingandsloughingrock,ventingofharmful
gasessuchascarbonmonoxide,anddangerouscoalspoilpilesfrompreviousunderground
mining.
Blastingwilloccurtoeliminatethehighwallsandexcavatetheminefire.Residentsare
beinggivena30daynoticeoftheblasting.Someresidentsmaynoticeanegglikeodorand/or
steam,whichmaybereleasedasthecontractorexcavatestheearthandexposesthehotand
burningmaterials.
DEPisconductingairqualitymonitoringasneededthroughouttheproject.Erosionand
sedimentcontrolhasbeeninstalledtocontrolrunoff.
ActivecoalminingonthePowderlyCreeksitebeganinthe1880s,withsurfacemining
continuingintothe1960s.PowderlyCreeksundergroundfirewasfirstdetectedbyresidentsin
thenearbyareain1995,althoughDEPbelievesthefirebeganearlier.
DEPandOSMREbeganworkthatyeartoextinguishtheblaze.
TheAMLEconomicRevitalizationPilotProgramGrantsalsohelpdemonstratethe
benefitstoPennsylvaniathatcouldberealizedacrossthecountryfrompassageoftheproposed
federalRECLAIMAct.
Thatact,whichmirrorsaproposalinPresidentObamasPOWERPlusPlan,partofhis
FY2016Budgetproposal,wasintroducedinCongresswithbipartisansupportincluding
PennsylvaniaCongressmenMatthewCartwright,MikeDoyleandCharlesDent.
Ifpassed,RECLAIMwilldirectapproximately$67millionoffederalAMLfundingper
yeartoPennsylvaniaoverthenextfiveyearsforreclamationprojectsthatdeliverlocaleconomic
benefitssimilartotheprojectsincludedinthepilot.
ThesefundswillhelpPennsylvaniaaccelerateeffortstocleanupabandonedminelands,
whilesimultaneouslysupportingeconomicdevelopmentinlegacycoalregionsthathavebeen
hardhitbyrecentdeclinesinthecoalindustry.
Gov.WolfhasbeenvocalinsupportoftheRECLAIMAct,andisurgingthe
PennsylvaniaCongressionaldelegationtosupportitspassage.

projectwillpermanentlyprotectviaconservationeasementa245acrehighprioritylandscapeof
forestedpropertyonanunnamedtributaryofAntietamCreek.Thisprojectwillcontributetothe
preservationandconservationofwaterqualitywithintheupperSchuylkillRiver.
NaturalLandsTrust,KulpProperty,$4,000:TheNaturalLandsTrustwillpurchasea
conservationeasementonthis30+acrepropertytoprojectimportantnaturalresourcesincluding
theheadwatersofPigeonCreek.Thisprojectwillalsoprovidepublicaccesstoatrailsystemin
theEastCoventryTownshipTrailNetwork.

proudofhowtheWyomingValleyralliedandhowlocalleaderspulled
togethertogetthisregionbackonitsfeet,saidSen.Yudichak.
Thefloodinginthefallof2011leftfortysixbusinessesandonehundred
eightyfourhomescompletelydestroyedinLuzerneCounty,while
anothereighthundredhomesandbusinesssufferedmajordamages.
PresidentBarackObamasignedanemergencydisasterproclamationanddirectedFEMA
anditsstatecounterpart,PEMA,togetassistancetohomeownersinthepathoftheflood.While
homeownersweresoongettingsomefloodmitigationassistance,smallbusinessowners
impactedbythefloodfoundthatfewifanyfederalorstateprogramswouldhelpthemrebuild.
WorkingwithCommonwealthFinanceAgency,theentireLuzerneCountyState
DelegationandwithbothChambersofCommerceinScrantonandWilkesBarrewedeveloped
theLuzerneCountySmallBusinessLoanProgramtoassistfloodimpactedbusinesswithquick
accesstoanew$4millionloanprogramthatofferedloansof$100,000perbusinessata1
percentinterestrate,saidSen.Yudichak.
TheLuzerneCountySmallBusinessLoanProgram,administeredbytheMetroAction
organization,aidedtwentytwobusinesseswith$1.6millioninassistancethathelpedthem
rebuildandpreserveovertwohundredfamilysustainingjobs.
RecognizingthevalueofajobcreatinginvestmenttoolinLuzerneCounty,acountythat
struggleswithhigherthanstateaverageunemployment,theLuzerneCountySmallBusiness
LoanProgramisnowapermanentresourcesforoureconomicdevelopmentpartnerstofoster
entrepreneurshipandspurthecreationoffamilyownedsmallbusinesses.
Inthepasttwoyears,theLuzerneCountySmallBusinessLoanProgramhasinvestedan
additional$1.7millioninthirtythreebusinessesthathavecreatedorretainedovertwohundred
jobsinLuzerneCounty.

MetroActioncelebratesthesuccessoftheLuzerneCountyFloodRecoveryProgram,said

MetroAction.Nearly$3.5millionworthofcapitalhasbeendeployedtosmallbusinessesinour

Gov.TomWolfandtheDepartmentofEnvironmentalProtectionThursdayannounced
completionofanew$2.179millionwaterlineforresidentsintheVillagesofStockton#6and#8
inHazleTownship,LuzerneCounty.
The2milelinenowconnects43villagehomestothemainwaterlineoftheHazleton
CityAuthoritypublicwatersystemwhichcurrentlyservestheCityofHazletonandsurrounding
communities.
ThewaterlinewasmadepossiblebyPAInfrastructureInvestmentAuthorityfunding.
DEPsefforttoworkwiththelocalcommunitytocompletethisnewwaterlinewill
servetheseresidentswellandIappreciatetheworkdonebyallinvolvedtoensurecleanwater
willbeavailable,Gov.Wolfsaid.
Oneofthemissionsofthedepartmentistoensuresafewaterforcitizensofthe
Commonwealthandthisnewwaterlinehelpsaccomplishthat,saidDEPNortheastRegional
DirectorMikeBedrin.Whenthedepartmentdeterminedtheoldsystemwasnolonger
sustainable,weteamedupwithotherstateandlocalagenciestomakesureresidentswereableto
getaresourcesthatwealldeserve.
Thelineistheculminationoftwoyearsworthofplanningandworkbythedepartment,
theHCA,andotherstoremoveresidentsfromanoldandunpermittedpublicwatersystemthat
didnotmeetstandardssetforthbytheSafeDrinkingWaterAct(SDA)andhadnoresponsible
partyoperatingit.
InJulyof2014,thedepartmentissuedaprecautionarywarningtobothvillagestonotuse
waterfromtheoldsystemforconsumptionbecauseitwasnotbeingproperlytreatedandthere
waspresenceofsomemicrobiologicalcontaminantssuchasE.colibacteria,giardiaandother

organismsthatcouldbeharmfultohumanhealth.
Thewatersystemalsodidnothaveastatemandatedtreatmentsystemassetforthinthe
SDA.
ThatorderpromptedstafffromthedepartmentsSafeDrinkingWaterProgramtobegin
workingwiththeHCA,HazletonCity,HazleTownshipSupervisors,theDepartmentof
Transportation,Sen.JohnYudichak(DLuzerne),MinorityChairoftheSenateEnvironmental
ResourcesandEnergyCommittee,andRep.TarahToohil(RLuzerne)tofindothersuitable
options.
InAprilof2015,PennVESTapprovedgrantmoneyfromtheInfrastructureGrant
Programforconstructionoftheline.

T.OHaraExcavating,Inc.ofMoscow,PAasthecontractorforconstruction.
TheoldwaterlinesservingthevillageswerecappedbytheHCAinAugust.Thevillage
residentsarenowservedbytheHCA.

Gov.Wolf,StateTreasurerActToEnsurePaymentOfMineSubsidenceInsuranceClaims

Pennsylvanianswithpropertydamagecoveredby
DEPsMineSubsidenceInsuranceProgramwillhave
theirclaimspaidwithoutdelay,thankstoanew
directivesignedrecentlybytheheadsofthe
departmentsofEnvironmentalProtectionand
Insurance,andthePennsylvaniaStateTreasury.
Previously,becauseminesubsidence
insuranceclaimsarepaidthroughastatefundthat
mustundergoareviewprocess,paymentofclaims,
onceapproved,wassometimesdelayedforupto30days.
WiththeactiontakenrecentlybytheActingDEPSecretary,InsuranceCommissioner,
andStateTreasurer,theseclaimswillnowbepaidimmediatelyuponapproval.
Some58,000Pennsylvaniapropertyownershaveminesubsidenceinsurance.When
subsidenceoccurs,thedamagecanattimesbesosevere,peoplecannotliveintheirhomesuntil
repairsaremade,DEPActingSecretaryPatrickMcDonnellsaid.
MorethanonemillionPennsylvaniahomessitaboveabandonedundergroundcoalor
clayminesin43ofPennsylvanias67counties.Homesandotherbuildingsontheseornearby
propertiescanbedamaged,sometimesseverely,bythemovementofthegroundsurfaceasa
resultofthecollapseofanundergroundmine,orfromasuddenbreakoutofwaterfroman
abandonedmine.
Toprotectpropertyowners,thestatecreatedtheMineSubsidenceInsuranceFundin
1961,toprovidelowcostcoverage.
Minesubsidenceinsuranceisvitalforpeopletoprotecttheirhomesagainstdamage
fromgroundmovementduetoanundergroundminecollapseorwaterrelease,andhomeowners
insurancetypicallydoesnotcoverthis,saidInsuranceCommissionerTeresaMiller.Itisvital
wegetthesefamiliesthemoneytheyneedquickly.
PATreasuryispleasedwewereabletoworkwiththeadministrationtoimprovethe

processsothatoncethesefundsareapprovedwecanpromptlygetthemoneytotheclaimants
whentheyneeditmost,saidStateTreasurerTimothyA.Reese.
Theaveragecostforminesubsidenceinsuranceis$85peryear.Theaverageclaimpaid
in2015wasforapproximately$20,000.Coverageofupto$500,000isavailable.

Thisisthefourthannualcleanup
coordinatedbythefouraffiliates.Duringthis
yearsevent,over100volunteerscollected12,048
poundsoftrashand693tires,weighingover
20,000pounds,fromsectionsoftheJuniataRiver.
Waterwaycleanupsareuniqueinthat
thereisaneverendingaccumulationoftrashdue
tofloodwatersandstormwaters.Fortunately,therearepeoplewillingtogivetheirtimeand
energytodosomethingaboutit.KeepPennsylvaniaBeautifulthanksouraffiliatesformaking
thisanannualevent,saidShannonReiter,PresidentofKeepPennsylvaniaBeautiful.
Sincetheinauguralrivercleanupin2012,thefourKeepPennsylvaniaBeautifulaffiliates
havecollectedover61,000poundsoftrashand2,500tires.Nearly500volunteershave
participatedintheevents.

inlengthandprovidesmanyrecreationalopportunitiessuchasfishing,boatingandsightseeing.

TheDepartmentofHealthlateThursdayannounced
PennsylvaniahasreporteditsfirstcaseofZikavirus
infectionbysexualtransmission.
"APennsylvaniaresidentcontractedtheZikavirus
fromamosquitowhiletravelingoutsideofthestateinan
areawhereZikatransmissionisoccurring,"saidSecretary
KarenMurphy."UponreturningtotheCommonwealth,the
personpasseditviasexualtransmissiontotheirpartner.

Inlightofthis,weremindresidentstopracticesafesex,especiallyiftheyhavetraveled
toanareawithZikainfectedmosquitoes,saidSecretaryMurphy.InfectionswiththeZika
virusmaybepresentwithoutsymptoms.IfyouhavetraveledtoanareawhereZikavirusis
present,condomsorotherbarrierprotectionmethodsshouldbeusedduringsexforeightweeks
uponreturntopreventsexualtransmission.Womenwhoarepregnantorplanningtobecome
pregnantshoulddiscusswiththeirdoctorsanytravelplanstoZikaaffectedlocations."
Zikaisamosquitobornevirusthatcancausemildsymptomsincludingfever,rash,joint
pain,andpinkeye.Zikararelykillsorcausesseriousdisease.
However,theviruspresentsamajorthreattopregnantwomenorwomenwhoplanto
becomepregnant.Zikainfectionduringpregnancyhasbeenlinkedtoseriousbirthdefects
includingmicrocephaly,whichcausesnewbornstobebornwithheadssmallerthannormal.

Atthistime,nocasesofZikainPennsylvaniahaveoccurredasaresultoflocalmosquito
transmission.Astemperaturesremainhighinthecommonwealththroughoutthelatesummer
months,thereremainsriskoflimitedlocaltransmissionofZikavirusbyanaffectedmosquito.
AlthoughtheAedesaegyptimosquitoistheprimarycarrieroftheZikavirus,Aedes
albopictuscanalsocarrythedisease.TheDepartmentofEnvironmentalProtectionhasnotfound
AedesaegyptiinPennsylvaniasince2002.
However,thedepartmenthasfoundAedesalbopictusthroughoutmajormetropolitan
areasofsouthernPennsylvania.

TheAlternativeFuelsIncentiveGrantProgram(AFIG)
providesfundingforprojectstoimproveairquality
throughalternativefueluse.Thewinningprojectswill
eliminatefromuseanestimated980,000gallonsof
gasoline.
Tengrantshavebeenawarded,mostlyforalternativefuelvehiclepurchasesandretrofits,
suchasthe41propanefueledbusesfortheUpperMorelandSchoolDistrictinMontgomery

County,andconverting20UnitedParcelService(UPS)truckstorunoncompressednaturalgas.
Thesevehiclesandinfrastructurepurchasedandbuiltwiththesegrantswillreduceair
pollutioncomingfromcarsandtrucksontheroad,andimprovetheairwebreathe,saidActing
DEPSecretaryPatrickMcDonnell.Theseareinnovativesolutionstoreducegreenhousegas

soyouhaveenoughfood,water,medicineandotheressentialsuppliestosustainyourfamily
includingyourpetswithoutanyoutsideassistanceforatleastthreedays."
Inparticular,peopleshouldthinkaboutlovedoneswhomayhavespecialneedsthat
couldinhibittheirabilitytohelpthemselves.
"Thebestdefenseduringanemergencyisknowingwhattodo,"saidSecretaryofHealth
Dr.KarenMurphy."Thisisespeciallyimportantforthosewhomayneedmorehelpduring
emergencies,likechildren,olderPennsylvanians,andindividualswithaccessandfunctional
needs."
Thosewhotakemedicineoruseamedicaltreatmenteverydayshouldalsobesureto
haveenoughonhandtolastforatleastoneweek,aswellaskeepalistofprescriptions,
includingthenameofthemedicine,dosageandanyotherdirections.
InsuranceCommissionerTeresaMillersaidPennsylvaniansshouldreviewtheir
homeownerspolicyandunderstandwhatwillbecoveredandstepsthatyouneedtotaketofile
claimsiftheirpropertyisdamaged.

TheNationalAssociationofInsuranceCommissioners(NAIC)recommendsthat
homeownersinsuretheirpropertyatreplacementvalueratherthanactualcashvaluetohelp
covercostsshouldextensiverepairsorafullreplacementbedeemednecessary.
Youshouldalsokeepaninventoryandphotosofyourpersonalbelongingssoyouhavea
detailedrecordifanyaredamagedafterastorm.
Ifyourentyourhomeorapartment,thepropertyowner'spolicythatcoverstherentalunit
maynotcoveryourpersonalbelongings.Itisimportantthatyouobtainarentersinsurancepolicy
toprotectyourbelongingsintheeventofstormdamage.
"Planningaheadandunderstandingwhatyou'llneedtoknowifyourpropertyisdamaged
caneasetherecoveryprocess,"saidCommissionerMiller."Itisimportantthatyouknowwhatis
coveredbyyourhomeownersorrentersinsuranceandwhetheryoushouldconsideradditional
coveragelikefloodinsurance."
Millersaiddamagefromfloodingisnotcoveredbyahomeownersinsurancepolicy.In
addition,rentersinsurancedoesnotcoverpropertydamagefromweatherrelatedfloods.Flood
insurancemustbeobtainedseparatelyandisavailablethroughtheFederalEmergency
ManagementAgency'sNationalFloodInsuranceProgram(NFIP)andthroughsomeprivate
insurers.

EnvironmentalProtectionrememberbetterthanmostbecause
theyplayedakeyroleintherespondingtotheSomerset
CountycrashsiteofFlight93.

sceneafterthecrashrelayinginformationaboutthesiteback
tothePAEmergencyManagementAgencyOperations

DEPEmergencyResponsepersonnelhelpedlocalfirstresponderssetuphazardous
materialssafetymeasurestomakesurethehundredsoflocal,stateandfederalofficialsatthesite
weresafeastheydealtwithjetfuelandotherhazards.
Waterqualitystaffmonitoredanearbypondandstreamforcontamination.
Stafffromtheminingprogramgaveinvestigatorsvaluableinformationonsitegeology
becausetheplanecrashedonpartofareclaimedsurfacecoalmine.Thesite,afterall,wasa
crimesceneandithadtobeinvestigatedcarefully.
DEPstafffrommanyprogramswererotatedinandoutofthesiteforweeksdealingwith
environmentalissuesthere.Therotationwasnecessarynotonlybecauseofthework,but

becauseitwasdifficulttobeatthesiteofsuchtragedyforverylong,especiallyduringvisitsby
thefamiliesofthosewhoperishedinthecrash.
Althoughasmalltowngrewupatthesiteofthecrashwithhundredsofpeople,trailers,
ATVsandequipment,everytimeacarorbuscarryingfamiliescametothelittlevillageit
becameveryquietandstillasthefamiliespassedthrough.
Oneincidentinparticularaffectedmanypeople.Onaroutineruntotakewatersamples,
twoDEPstaffersfoundanearlyintactBible,itselfamiracle,withanoteinside.Itwasfromone
ofthepassengerswritingtoalovedoneforthelasttime.
DEPandPennsylvaniaofferedstaffandequipmentsupporttoNewYorkCitytohelp
themdealwithairquality,wasteandotherenvironmentalissuesinandaroundtheWorldTrade
Centersite.
AgoodexamplewasfieldingarequesttoallowlandfillsinPennsylvaniatostayopen
longertoallowregulartrashfromthecitytobedisposedofhere.Regularserviceslikegarbage
pickupweresignificantlydisruptedbythemonumentalresponsetothetragedythere,something
basicthatyoujustdon'tthinkabout.
IntheweeksafterSeptember11,DEPemployeesagainplayedkeyrolesinhelpingto
respondtothescarecreatedbytheanthraxattacks,runningdownpotentialthreatstopublic
watersupplies,dams,nuclearpowerplantsandotherinfrastructure.
Emergencyresponseproceduresandlocalstateemergencymanagementpartnershipsput
inplaceinPennsylvaniaafterfloods,mineaccidentsandthe1979accidentatThreeMileIsland
servedtheCommonwealthwell,albeitafterthosehardlessons.
Manypublicemployeesandvolunteersfromfirstresponders,local,stateandfederal
governmentswillrememberthatday,butthosewhowerethereatthecrashsiteofFlight93on
thatdayandthemanydaysthatfollowedhaveaveryvividandpersonalmemoryofwhat
happened,justlikeallthoseattheWorldTradeCenterandthePentagon.
LittledidDEPemployeesknowthatin10monthstheywouldbebackinSomerset
CountydealingwiththeQuecreekMineRescue.

crashedinSomersetCounty,justasshewascomingupontheSomersetExit.
Somehowshefoundthecrashsiteandrelayeddetailsofthesiteanditsconditionviacell
phoneintotheEmergencyOperationsCenteratthePennsylvaniaEmergencyManagement
AgencyandtoDEP.
Shestayedonsitetohelplocalresponders,federalandstateagenciesandDEPsown
EmergencyResponseTeamsetupanddealwiththecrashsiteandthehundredsofreportersthat
descendedthere.
Thesitebecameasmallcityliterallyovernight.
Shecontinuedondutyforthenextfewdaysandweeksasthefamiliesofthevictimsof
Flight93cametovisitthesite.
BetsyandFredaTarbellfromDEPsNorthwestOfficealsotooktimetohelptheRed
CrossandSalvationArmymakered,white,blueandyellowribbonsforemergencyworkerson
sitetoshowtheirpatriotismandrespectforwhatthepassengersandcrewdidtoovercomethe
terrorists.
Flight93crashedonareclaimedsurfacecoalmine,soDEPstaffknewthegeologyofthe
areawellandhelpedguidetheFBIandfederalagenciesinvestigatingthesite.Investigators
literallysiftedthecrashsitedowntoadepthof45feet,butnothingmuchremainedoftheplane
thatwaslargerthanapersonsfist.
Eventhoughmostofthefuelwasconsumedintheinitialcrashandballofflame,some
remainedandposedapotentialthreattoinvestigatorsworkingatthesite.DEPstaff,alongwith
localfirecompanypersonnel,helpedorganizedecontaminationprocedurestokeepinvestigators
safe.
Itwastoughdutyworkinginandaroundthecrashsiteknowingwhathappenedtothe
peopleonthatflight,buteveryonedidtheirjob.
TwoDEPstafferswalkingbackthroughthesitehappenedtopickupapieceofpaper
lyingontheground.Itdidntseemtoospecialbecausethereweresmallpiecesofpaperallover
thesite.Thentheyrealizeditcontainedthelastfewwordsoneofthepassengerswrotetotheir
lovedones.
Inall,74agenciestotaling1,100peoplerespondedtothecrashsceneintheweeks
followingSeptember11.
ThedaysthatfollowedSeptember11wereequallydifficult.Chasingdownreportsof
contaminatedwatersuppliesandanthraxcontamination,securitythreatsatPennsylvanias
nuclearreactorsanddamsanddozensofotherincidentsallhadtobeinvestigatedandany
concernseliminated.
BetsyisjustoneofthousandsofpublicservantsinPennsylvania,theUnitedStatesand
aroundtheworlddoingherjobthatdayandthedaysthatfollowedinthefaceofunspeakable
evil.
LittledidBetsyandotherDEPstaffknowthatjust10monthslatertheywouldbebackin
SomersetCountytodealwithanothereventthatcapturedtheworldsattentiontheQuecreek
MineRescue.

Sumacthatcanbefoundaroundparkinglotsoralongtreelines.
Adultsoftenclusteringroupsandlayeggmassescontaining3050eggsthatadhereto
flatsurfacesincludingtreebark.Freshlylaideggmasseshaveagreywaxymudlikecoating,
whilehatchedeggsappearasbrownishseedlikedepositsinfourtosevencolumnsaboutaninch
long.

easternUnitedStatesandsouthernCanadatooverwinterin
theoyamelfirforestsinmountainswestofMexicoCity.
Thatisamorethan2,000milejourney,flownbyaninsect
weighinglessthanonehalfofagram.Bycomparison,a
pennyweighs2.5grams.
Inthe1990s,estimatesofuptoonebillionmonarchsmade
theepicflighteachfallfromthenorthernplainsoftheU.S.andCanadatoMexico,andmore
thanonemillionmonarchsfromthewesternU.S.overwinteredinforestedgrovesonthe
Californiacoast.
Now,researchersandcitizenscientistsestimatethatonlyabout56.5millionmonarchs
remain,representingadeclineofmorethan80percentacrossNorthAmerica.
WhereHaveAllTheButterfliesGone?
TheveryexistenceoftheeasternNorthAmericanmonarchmigrationisunderimmediate
threatduetoanumberofcauses.MiningandillegalloggingattheoverwinteringsitesinMexico
aredestroyingthefirforestsonwhichthemonarchdepend.
BackhomeintheU.S.,thelossofhabitatduetodevelopmentandlandmanagement
practicesarehavingwidespreadimpacts.
Andinwhatmaybethemostdamagingofall,chemicallyaidedagricultureintheUnited
StatesandCanadaiskillingbothmonarchsthemselvesandthehostplantsthatarecriticalto
theirlifecycle.
Geneticallymodifiedseedsusedinindustrialagriculture,especiallycornandsoy,are
engineeredtowithstandwidespreadapplicationoftheherbicideglyphosate(soldunderseveral
tradenames,includingRoundup).
Theherbicideisnonselective,meaningthatitwillkillallplantswithwhichitcomesinto
contact(otherthanGMOcornandsoy),includingournativemilkweedplants.
Thisiscatastrophicformonarchs,astheyonlylaytheireggsonmilkweedplants.
Withoutmilkweed,onwhichtheylaytheireggsandwhoseleavesexclusivelyfeedtheirlarvae
(caterpillars),monarchscannotsurvive.

producinghundredsofmilkweedsplants,someofwhichweresoldatBrandywinesAnnual
Wildflower,SeedandNativePlantsaleinMayandatanativeplantsaleatOhiopyleStatePark
theremainderofthemilkweedmadeitswaytotheMonarchMigrationStation.

TopurchasehandcollectedandhandcleanedBrandywineConservancymilkweedseeds
aswellastheseedsofmanyotherterrificnectarplants,visittheBrandywineRiverMuseumof
