betterunderstandingofthecriticalactivitiesthatactuallydelayedTYECsworkandhenceenablea
properdelayanalysistobeputtogethertosupporttheirfullEoTclaim.

TYEC Delay Analysis

FollowingreceiptoffurtherdocumentsfromTYEC,Naviganthavebrieflyundertakenaninspection
ofthedelayanalysis,alreadysubmittedandrebuffedbytheEngineer,andareoftheopinionthatit
doesnotfullysupportTYECsrequirementsforthefollowingreasons:

TheprogrammeisbasedonbothactualandforecastdatesafterJuly2012andthereforein
partbearsnorelevancetoactuallywhathappened.Bearinginmindthedelayanalysiswas
createdmonthsafterfinalcompletionamorerobustanalysisatthattimeshouldhavemade
betteruseofactualdatesandconsideredallotherdelayitems.
TheanalysisiftakenastruedemonstratedthatonlythekitchenandLVworkswereever
likelytohavebeencriticallydelayingtheworks.TheotheritemsreliedonbyTYECtherefore
becomeredundantunlesstheycanbelinkedbacktotheactualcriticalpath.Thishasnot
yetbeendonesuccessfully.
Thereexistssomelargelags(suchasbetweenpoweronandkitchenpoweron)withinhe
programmewhichrequiredfurtherexplanation.
Therearealsoseveralopenendswhichfailtolinkbacktothemaindrivingpaththroughthe
programme.Notwithstandingthisthedelayanalysisinanyeventisstandaloneandfailsto
demonstratehowtheseitemsactuallydelayedthemainprogrammeofworks.
Causeandeffecthasnotbeenestablishedgenerally

ItisclearfromtheEngineerslettersthattheyarealsoofasimilarviewandhenceanyfurther
analysisundertakenbyNavigant/TYECmustaddressalltheseissuesathand.Asimplesubmissionof
thesameisunlikelytorewardTYECwiththeresultsitisseeking.

Naviganthavesinceundertakentwodifferentreviewsoftheprogrammestoassistthemin
identifyingkeyareasforfurtherinvestigation.
ThefirstreviewwastoexaminewhattheTYECprogrammesunlamenteddefinedasthecriticalpath.
Wenotedinthemthatretainedlogicwastheschedulerspreferredoptionwhentheschedules
wereprogressed.Inourexperienceofthisoption,whensimilarbutstackedactivitiesarebeing
workedonatalllevelsandatalltimestheretainedlogicoptiondoesnotalwaysprovideanaccurate
forecast,especiallywhenthisclosetotheendofaproject.Thereforewehaverescheduledallthe
programmesanalysedusingtheprogressoverrideoptiontoseewhatpossiblealternative
activitiesthenbecomecriticaland/ordriving.Itisofinterestthenthatitemssuchassnagging,
lighting,flushing,T&Celectricalandmechanicalnowappearinthelistofitemsdrivingcompletion.
Inourviewthesearefarmorelikelytobethetruedrivingactivitiesoverthecurrentclaimedlistof
itemsandassuchrequirefurtherinvestigation.Tocompletethiselementofpreliminary
investigationwehavealsoundertakenamanualassessmentofthoseactivitieswhichareequallyas
criticalorsoneartocriticalthattheyshouldalsobeconsideredascandidatesforthetruecritical
path.Thispartoftheinvestigationhighlightedfurtherthebuildingcontrolinspectionandapprovals

alongwithfurtherelectricalandmechanicalwork.Theresultfromthispreliminaryanalysisofthe
programmesisattachedanditisclearthatanynewdelayanalysismustaddresstheelectricaland
mechanicalcompletion,testingandapprovals.
TakingthisastepfurtherpleasealsoseetheattachedA3documententitledOverviewSummary.
Thissummaryhasbeenproducedusingthemonthlyprogrammerecordedactivityprogress.It
providesanindicationinwhichmonthsactualprogresswasmadetotheactivitiesasshown.We
sayindicativeaswehavenowayofvalidatingtheaccuracyoftherecordedprogressandwhether
anyrecordingbiaswasusedforcommercialpurposes.Forpreliminarypurposesanywaytherecords
asprovidedareallwehavetouseandinanyeventthesummarygraphiccorrelateswiththeoverall
progressgraphaboveinthattherearestillthreedefinedperiodsoftimewiththeirowntypical
characteristics.
Period1:goodprogressismadewitharoundamonthslippagerightatthestartwhichiscurrently
unexplained.
Period2:UptoDecember2012thereappearstobealargeamountofmajorelectricaland
mechanicalworkbeingundertakenwhichmustbyinspectionbeonornearthecriticalpathofthe
project.DelaystotheseelementshavenotyetbeenexplainedbyTYECandtheengineerhas
highlightedthisfailingtoexplainthesedelaysinhisletter.Theprogrammesalsorecordthe
completionofmanyapprovalsaroundDecember2012thatthengetrecantedwithinmonths.Again
thisapprovalandchangeinprogrammestatusneedstobeexplained.Therearethenacoupleof
monthswherenotalothasbeenrecordedtohavehappenedbeforeMarch2013.Atwhichpoint
therethenappearstobeaconcertedefforttocompletetheprojectthroughtoJuly2013.
