A Bench of Justices K.S. Radhakrishnan and Dipak Misra said proliferation of arms and
ammunition, licensed or not, in the country disrupted the social order and development, vitiated
law and order, and directly contributed to lethality of violent acts which needed to be curbed.
Stressing the importance of awarding at least the minimum sentence under the law three
years Justice Radhakrishnan said the legislature had felt the increased need for stringent
punishment to curb unauthorised access to arms and ammunition, especially in a situation
where we are facing the menace of terrorism and other antinational activities.
The Bench said: A person who is found to be in possession of a countrymade barrel gun with
two rounds of bullets and 50 grams of explosive without licence, must in the absence of proof to
the contrary, be presumed to be carrying it with the intention of using it when an opportunity
arises which would be detrimental to the people at large.
