REGULATION ORDINANCE NO. 2013-063


AN ORDINANCE ESTABLISHING PRIORITY SEATS FOR SENIOR
CITIZENS, PERSONS WITH DISABILITIES AND PREGNANT WOMEN
INSIDE PUBLIC UTILITY JEEPNEYS
Authored by Councilor R Leone N. Gerochi and in unanimous
accord of all Members present
WHEREAS, Section 16 of the Local Government Code of the Philippines provides, to
wit:

"General Welfare - Every local government unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as the powers
necessary, appropriate, or incidental for its efficient and effective governance,
and those which are essential to the promotion of the general welfare. Within
their respective territorial jurisdictions, local government units shall ensure and
support, among other things, the preservation and enrichment of culture, promote
health and safety, enhance the right of the people to a balanced ecology,

encourage and support the development of appropriate and self-reliant scientific


and technological capabilities, improve morals, enhance economic prosperity and
social justice, promote full employment among their residents, maintain peace
and order, and preserve the comfort and convenience of their inhabitants. "

WHEREAS, senior citizens, persons with disabilities and pregnant women are expected
to encounter difficulty in riding public utility jeepneys because of their physical condition;
WHEREAS, there is a need to provide reasonable privileges to persons with disabilities,
senior citizens and pregnant women such as priority seating in public transportation so as to
mitigate the difficulties encountered by said persons in the use of public utility jeepneys in Iloilo
City.
NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of
Iloilo:
Section 1. - That the front seats and the two seats on the left and the two seats on the
right side nearest the step board at the back portion of public utility jeepneys be established as
priority seating for senior citizens, persons with disabilities and pregnant women;
Section 2. - That the operators of the public utility jeepneys shall place stickers or signs
on the designated seats indicating that such seats are being designated as priority seating for
senior citizens, persons with disabilities and pregnant women;
Section 3. - That senior citizens, persons with disabilities and pregnant women shall have
the right to avail of and choose which of the designated seats they want to utilize, as long as all
passengers already riding in the public utility jeepney can be accommodated and seated
comfortably and properly;
Section 4. - That any operator who fails to install the required signs under this ordinance,
or any person, not qualified to avail of such privilege, who refuses to yield the designated
priority seats for senior citizens, persons with disabilities and pregnant women shall, after
conviction be fined of not less than Three Hundred Pesos (P 300.00) and not more than Five
Hundred Pesos (P 500.00);
Section 5. - That any person who misrepresents himself/herself to be a senior citizen,
persons with disabilities or pregnant women, when in truth he or she is not, for the purpose of
availing of the privilege provided under this ordinance shall, after conviction, be fined of not less
than Three Hundred Pesos (P 300.00) and not more than Five Hundred Pesos (P 500.00);
Section 6. - That this ordinance shall take effect fifteen (15) days after publication in a
newspaper of general circulation.
