The following specific data for the goods to be procured shall complement, supplement, or
amend the provisions in the Instructions to Bidders (ITB). Whenever there is a conflict, the
provisions herein shall prevail over those in ITB.

The power of Attorney to be submitted with the offer must be

authenticated by notary public office in the bidders country only
indicating that the person(s) signing the bid has (ve) the authority
to sign.

ii)

In case of contract negotiation and award the company so invited

must

present a power of Attorney certified by a public attorney

and duly authenticated by the Ethiopian Consular or Diplomatic

authenticated by the Ethiopian Consular or Diplomatic

business of the Company or partnership or, if a joint venture,
of each party thereto constituting the tender.

An official authorized document stating that the signatory of

the tender possesses the power to represent the tender for
this tender.

Local firms must submit VAT registration certificate and and

tax clearance certificate from Inland Revenue Authority in
addition to the above mentioned documents.

ii) The bidder should have been in business as a supplier for at

least five (5) years before the date of bid submission. The
bidder shall provide list of similar supply works of at least for
two (2) years to demonstrate its Experience in similar supply
works. The list should contain

description of supply, year of

supply, value of supply, country supplied, full address of client

and contact person;
iii) Bidders are required to submit five (5) Certificates, readable
with clear address, from their customers (out of which at least
two shall be from outside of their country) indicating the
satisfactory performance of similar supply works.
iv) The proposed manufacturer(s) should be at least ISO-9001
certified or Equivalent for the plant where the goods under the
bid are to be manufactured. The quality assurance certificate
should be attached in the offer; and also should have been in
business as a manufacturer for the last five years and shall
submit a three years of export experience
v) The offered values in the guaranteed value tables must be
supported by an independent test report. The type test report
shall be issued by an Independent ISO certified Laboratory and
should be submitted to EEP along with the Bid.
vi) In the case of a Bidder who offers to supply goods under the
contract that the Bidder did not manufacture or otherwise
produce, the Bidder shall be required to include with its bid,
documentation from the Manufacturer of the Goods, that it has
been duly authorized to supply, in the purchasers country, the
Goods indicated in its bid.
vii) The Bidder must have a minimum average annual turnover of
equivalent to 1.5 times the bid price, calculated as total
certified payments received for contracts in progress or

completed within the last 5 (five) years.

viii)

The Bidder must have a minimum worth (total assets, less

total liabilities) of equivalent to the bid price.
A duly certified copy of the latest balance sheet of the Bidder
by external auditor shall be attached to the Bid.

ix) The Bidder must demonstrate that he has access to, or has
available liquid assets, unencumbered real assets, lines of
credit, and other financial means sufficient to meet the supply
cash flow for a period of four (4) months estimated, net of the
Bidders commitment for other contracts.
In case of joint venture, sub-items vi, vii and viii above shall apply as
follows:

The lead partner shall meet not less than 50 percent of all
the qualifying criteria given in sub-items viii, ix and x;
The other partners shall meet not less than 25 percent of all the
qualifying criteria given in sub-items viii, ix and x.

The joint venture must satisfy collectively the criteria of subitems viii through x for which purpose the relevant figures for
each of the partners shall be added together to arrive at the
joint ventures total capacity

x) Litigation History
Bidders shall demonstrate that the Bidder has a history which is
free of litigation and arbitration or an absence of awards against
the Bidder in any court of law or arbitration.
xi) The Bidder shall submit the following additional documents in
its bid: Brochures and catalogues.

D. Bid Price and Currency

ITB 12.1

The prices shall be: (a) Fixed.

The unit rates and prices shall be quoted by the Bidder in the Schedules
separately in foreign currency and Local currency as indicated in price
schedule.
(a)

Plant and equipment to be supplied from abroad (further referred

to as foreign component) shall be quoted entirely in the freely
convertible currency of any such country;
(b) Plant and equipment to be supplied from within the Employers
country (further referred to as local component) shall be quoted
in Ethiopian Birr, further referred to as the local currency; and
Design and installation services shall be quoted in either foreign and/or
local currency, depending upon the currency in which the costs are to be
incurred.
The currency of the bid and payment shall be: any freely convertible
currency for the foreign component and Ethiopian Birr for the local

Source of exchange rate is Commercial Bank of Ethiopia.
Date of exchange rate: 28 days prior to the deadline of bid submission
date.

ITB 13.1

Bid security Amount no less than specified under for each lot or in a
freely convertible currency in one of the following forms:
(a)

A Fund guarantee or irrevocable letter of credit issued directly by

a reputable Fund counter guaranteed by Commercial Bank of

Ethiopia, in the form provided in the bidding documents, or A cashiers
or certified check.

The bid security must be counter guaranteed by the Commercial Bank of

Ethiopia.

ITB 14.1

The Bid validity period shall be six (6) months from the bid submission
deadline.

ITB 16.5

The sealed parcel to be delivered shall contain three (3) separately

sealed envelopes or packages, clearly identified as to Envelope number
and contents as follows:Envelope No. 1 - Technical Proposal
Envelope No. 1 shall contain one (1) original and two (2) copies of purely
technical information and documentation. The name and address of the
Bidder, a complete description of all materials and equipment being
offered, exceptions to any terms of the Bid Document.
Envelope No. 2 - Bid Guarantee
Envelope No. 2 shall contain the one (1) original and two (2) copies of
the Bid Guarantee.
Envelope No. 3 - Financial Proposal
Envelope No. 3 shall contain one (1) original and two (2) copies.
No Financial information shall be included in the Envelopes No. 1 and
No. 2. If financial information is included in Envelope No. 1 and No. 2
except Bid Security, the bid will be rejected. In case of discrepancy
between an original and its copies, the original will govern.

ITB 17.1

The Bids must be delivered at the address specified above (clause

16.2a) on or before 14:00 hours, local time on 4th of October, 2016.
Bids delivered after the stipulated time will be returned unopened

Bids will be opened in the presence of bidders representatives who

chose to attend at 14:30 hrs local time on 4th of October, 2016

F. Award of Contract
ITB 33

The amount of performance security shall be ten percent (10%) of the

contract price, counter guaranteed by the Commercial Bank of Ethiopia.

ITB 36

The maximum percentage by which quantities may be increased is: 15%.

The maximum percentage by which quantities may be decreased is: 15%.
