REGULATION ORDINANCE NO. 2015-407
AN ORDINANCE ESTABLISHING THE SOCIAL DEVELOPMENT FUND
IN THE ILOILO CITY URBAN POOR AFFAIRS OFFICE (ICUPAO)
UNDER THE CONTROL OF THE CITY MAYOR AND FOR OTHER
PURPOSES

Sponsored by Councilor Joshua C. Alim, duly seconded by all Members present,


WHEREAS, the IIoilo City Government, through the Iloilo City Urban Poor Affairs Office
(ICUPAO), has started the re-payment scheme in some relocation sites for the beneficiaries of the
Iloilo City's Socialized Housing Program;

WHEREAS, there is a need to strengthen the preparation of the Iloilo City Government of

l the impact of the unstoppable development of the City to those affected informal settlers;

WHEREAS, the Iloilo City Government, needs more funds for the purchase of lands for
relocation sites and for the development or upgrading of an already existing relocation sites;
WHEREAS, there is a need of fund for the operational expenses of the ICUPAO;

WHEREAS, there is a necessity to establish a Social Development Fund which will servicoe
as a trust fund to sustain and finance the above-cited need of the Iloilo City Government in order
to assist/help the plight of the qualified landless informal settlers oflloilo City;

Be it ordained, therefore, by the lloilo City Council that:


Section I. Title - This Ordinance shall be known as "AN ORDINANCE
ESTABLISHING THE SOCIAL DEVELOPMENT FUND IN mE ILOILO CITY URBAN
POOR AFFAIRS OFFICE (ICUPAO) UNDER THE CONTROL OF THE CITY MAYOR
AND FOR omER PURPOSES"
Section 2. Purpose. - It is the purpose of this Ordinance to establish a Socialized
Development Fund that will serve as a trust fund in order to sustain the program of the Iloilo City
Government on Urban Poor and :financed the operational needs of the Iloilo City Urban Poor
Affairs Office (ICUP AO) for the benefit of all qualified landless informal settlers in Iloilo City.
Section 3. Coverage. - This ordinance shall apply to all relocation sites of lloilo City's
Socialized Housing Program undergoing re-payment scheme.
Section 4. Definition ofTenns. - As used in this Ordinance, the term below shall have the
meaning ascribed to it in this section. Any words or terms not defined shall be given their plain
and customary meanings, unless the context requires otherwise, and shall be interpreted in a
manner consistent with the purpose and spirit of this Ordinance.
a) Social Development Fund- a fund coming from the repayment scheme of the
Iloilo City Government among the beneficiaries of Iloilo City's Socialized
Housing Program to serve as a trust fund in order to sustain and financed the
operational needs of the Iloilo City Urban Poor Affairs Office (!CUP AO) for the
benefit of the landless informal settlers of the City.
Section 5. Department. - The Executive Department or the Office of the City Mayor shall
have the full control in the implementation of this ordinance and shall have the power to order and
release of the Trust Fund at the office of the City Treasurer. The City Treasurer shall consider and
set aside the payment for the re-payment scheme in all relocation sites of Iloilo City as a Trust
Fund for the purpose of this ordinance.
Section 6. Separability Clause. If for any reason, any provision, section or part of this
ordinance is declared unconstitutional or not valid by a court of competent jurisdiction, or
suspended by competent authority; such judgment shall not effect or impair the remaining
provisions, sections or parts which shall continue to be in full force and effect.
Section 7. Repealing Clause. All other Ordinances inconsistent with the provisions of this
Ordinance are hereby repealed or modified accordingly.
Section 8. Effectivity. This ordinance shall take effect after its publication in a newspaper
of general circulation in Iloilo City.
