3rd Paragraph At around 9 oclock in the morning of the same
date, while Ensign Al Jezer Sinuto was the officer on watch of DRP Edsa
2, a small banca was spotted with three (3) persons on board paddling
towards Umapoy Reef, Sitangkai, Tawi-Tawi, and after approaching it,
he directed them to place the banca at the rear of the vessel.
Thereafter, when the trio were told to raise their hands, Ensign Sinuto
and Petty Officer Emilton Dela Rosa saw one of the persons, later
identified as the accused-respondent Ruben Unuk, with something
on his lap wrapped with t-shirt camouflage and put the same on the
floor of the banca before raising his hands. Petty Officer Dela Rosa

checked the thing placed on the floor of the banca and found it to be a
Caliber 45 bearing Serial Number 824139 with one magazine loaded
with six rounds of ammunitions.
