COMPLAIN AFFIDAVIT
I am Ben P. Aquino, of legal age, a resident of Brgy. Ongyiu, Butuan
City.
After having been duly sworn in accordance to law, hereby despose
and say the following through Question and Answer.
1- Question: What prompted you appeared this office?
1- Answer: To execute an affidavit voluntarily, and to divulge what
was happened on October 2, 2016 at about 7:00 oclock in the
morning at our residence at Brgy. Ongyiu, Butuan City.
2- Question: Why are you execute this affidavit?
2- Answer: To formally filed a Murder Case against Mr. Jayson , for
violation of Art.266 of the RPC.
ELEMENTS OF HOMICIDE: (249)
A. That a person was killed.
B. That the accused killed him without any justifying
circumstances.
C. That the accused had the intention to kill, which is presumed.
D. That the killing was not attended by any of the qualifying
circumstances of murder, or by that of parricide or infanticide.
3- Question: When and where did the incident transpired?
3- Answer : On October 2, 2016 at our residence at Brgy. Ongyiu,
Butuan City, at around 12:30 oclock in the morning.
4- Question: Can you please tell me how did raped happened?
4- Answer : On October 2, 2016 at our residence Brgy. Ongyiu,
Butuan City, at around 12:30 oclock in the morning, while im
staying in my house and i walk along street to buy something a
food and softdrinks. I saw my neighbor Jhon and Jayson. Jayson
was following to Jhon. After, how many minutes, i saw everything
what happened. Jayson and Jhon was already drunk. Jayson he see
me and he share what happened then i was leave. Jayson get angry
to Jhon its because he refused to drinks. When victim was
continuing walking the suspect get a sharp knife. The victim was
not knowing that the suspect was get angry to him. Then in a dark

street, the suspect attacked and stabbed to the different parts of the
victim. Until, Jhon was laying down in the land then the suspect
was continuing stabbing to the victim. After, he satisfying to
stabbed the victim. While I was on my way, I heard a commotion
at a near distance,which was followed by shouting and crying so i
hurriedly went to the place. Upon my arrival, I saw my friend lying
in the ground, bathe in her own blood, shouting and crying for
help. When i saw what happened i feel nervous and scared. I dont
know what should i do. Then the suspect attempted to escaped but
later on arrested.
5- Question: Finally, why did you executed this statement?
5- Answer: I executed this statement to attest the truthfulness of the
facts and to attest my formal complaint of Homicide Case filed
against Mr.Jayson B. Jumanoy
