AFFIDAVIT OF ADVERSE CLAIM

I, PERCIVERANDA R. VILLANUEVA, of legal age, widow and a resident of
1338 M. Hizon St., Sta. Cruz, Manila, hereby depose and states under oath that:
1. I am the wife of the late Bienvenido Villlanueva, the registered owner of a
certain parcel of land situated in the District of Sta. Cruz in the City of Manila,
covered by T.C.T No. 139212 of the Registry of Deeds of Manila.
2. That I sought the issuance of an owners duplicate copy of the
aforementioned Certificate after the demise of my husband, Bienvenido on
October 29, 1986, since the same went missing and can no longer be located
even with diligent efforts exerted.
3. That when I inquired and was claiming said owners duplicate copy from the
Register of Deeds, I was surprised to have been informed that T.C.T. 139212
had already been cancelled and apparently a new one was issued, T.C.T.
287608 in favor of one FLORENTINA BONSATO VILLANUEVA.
4. That I have not caused the conveyance of said parcel of land where our
family home is erected to anyone, more so to FLORENTINA BONSATO
VILLANUEVA, and neither did my deceased husband Bienvenido Villanueva
when he was alive. That is the reason why I was surprised to learn that a title
was issued late last year in her name.
5. That FLORENTINA BONSATO VILLANUEVA has since attempted to have me
and my family driven out of the residence we have been occupying and that
belonged to me and my husband ever since time immemorial, although apart
from T.C.T. 287608 which I suspect she was able to secure through fraud,
falsification and perjury, no other document was shown to support her claim
that she has bought the parcel of land covered by said title.
6. That I have requested the Register of Deeds of Manila to furnish me a copy of
the deed or instrument of conveyance that became a basis of the cancellation
of T.C.T. 139212 and issuance of T.C.T. 287608. I know there could be none.
And up to this time the Register of Deeds of Manila has not shown any
despite frequent follow-up. But, in case there appears one and if it appears
signed by either me or my husband, I am certain that such signature is a
spurious, falsified and forged.
7. That in the meantime, I want to protect my interest in case FLORENTINA
BONSATO VILLANUEVA attempts to sell, dispose, mortgage, or otherwise

dispose of the subject property using T.C.T. 287608 by, among others,
executing this Affidavit of Adverse Claim.
8. I am executing this affidavit to attest to the truth and veracity of the foregoing
statements and for the purpose of annotating this Affidavit of Adverse Claim
on T.C.T. 287608.
IN WITNESS WHEREOF, I have hereunto set my hand this 27 th day of
