Mr. D:
I have spent a good amount of time trying to research what a proper notice of appeal looks like in a Texas
administrative hearing of the type which resulted in the order to cease and desist. While I have found a number of
other examples, it appears that this agency has omitted any form of a request for an appeal or for a hearing. After
my unsuccessful research for this format, I finally drafted what I believe is requested in the order as necessary to
appeal and get a gearing.
As you know, I do not practice law in the state of Texas, nor can I advise you if this actually sufficient under Texas
law. As always, my recommendation is for you to obtain local counsel to represent you in this matter. However, I
understand that you do not wish to do that, and wish to proceed through the matter in a Pro per status.
The attached a proposed Notice of Appeal and Request for Hearing should be signed by one of one of the officers for
Core Advisory Group. As you know, this must be sent and received at their office in Texas, on or before Monday,
December 28, 2015. I have included a certificate of mailing which mirrors the form they used. It should should
signed by a staff person, with their name printed belw the signature, and then placed it in the mail. The envelope
should be addresssed to:
Commissioner Caroline C. Jones
Department of Savings and Mortgage Lending
Finance Commission Building
2601 North Lamar Blvd., Suite 201
Austin, TX 78705.
Let me know if you have any questions.
