Point by point answer to the 16 questions raised by

The Law Commission of India ............ By Arshad Mohsin
(The author is someone who has sued Modi, the BJP and the Election Commission of
India in the supreme court only to come to a forgone conclusion , i.e. the ruling Hindutva ideology is the antithesis of Islam and if you seek justice in this tyrant-system
youll end up getting what Ehsan Jafri, Akhlaq and the innocent Kashmiri children
have got, so chill ! )
QUESTION 1

: Are you aware that article 44 of the Constitution of India provides that the state shall endeavor
to secure for the citizens a uniform civil code through out the territory of India?

Answer : Man made laws are not only inferior to the divine (Sharia ) laws given to Mankind by Allah but also
detrimental as following them will lead a Muslim to apostasy and ultimately to the hell fire. The holy prophet (
Peace be upon him ) said He is not a believer whose neighbour is unsafe from his mischief. He (SAW) also said
He is not a believer whose stomach is filled while the neighbor to his side goes hungry. Therefor Islamic jurisprudence provides equality and the most human civil code to every human being including Indians.

QUESTION 2 : The various religious denominations are governed by personal laws and customary practices in
India on matters of family law, should the UCC include all or some of these subjects?

Answer :

All humans should be governed by the best laws sent down to us by our creator. And that is the
Holy Quran. Who knows the creature better than his creator ?

QUESTION 3: Do you agree that the existing personal laws and customary practices need codification and
would benefit the people ?

Answer : Quranic laws are mercy to mankind.Yes indeed, various existing practices in India are heretic in nature, and should immediately be replaced with the best practices of Sharia law to protect our women from rapes
and houses from robbery.

QUESTION 4 :

Will uniform civil code or codification of personal law and customary practices ensure gender

equality?

Answer : When we talk of gender equality , the UN treaty called The Convention on the Elimination of all
Forms of Discrimination Against Women (CEDAW) is the best non-Muslims can ever think of.The most shocking
of this heretic convention is that a girl under 18 can determine when and with whom can she have sex whereas
she cant legally marry before 18.And the convention further states that a girl over 18 is completely free from all
kind of guardianships including her father, brother or husband. This is called man-made law.Muslims are not going
to surrender their girls to such profane laws, come what may!
According to the holy Quran, men and women have the same spirit, there is no superiority in the spiritual sense
between men and women. [Noble Quran 4:1, 7:189, 42:11]
Whatever men earn, they have a share of that and whatever women earn, they have a share in that. [Noble
Quran 4:32]

QUESTION 5 :

Should the uniform civil code be optional?

Answer : The divine (Sharia ) laws are obligatory for Muslims and it can be made optional for others in India,
so that they may study and accept the gift Allah has bestowed upon every human being.

QUESTION 6 : Should Polygamy/Polyandry/Friendship-deed be banned ?

Answer : In Islam marriage is not made for the purpose of physical pleasure or procreation alone. The nobler
goal is always to support a woman in need.Establish new family relations with different clans and enlarge and
unite the community of faithfuls.Polygamy ensures a quicker and better care for widows and orphans mostly
during wars.Polyandry and friendship-deeds are acts of grave sin.But the greater sin promoted by the RSS govt.
in India is the live-in relationship based on adultery, it is abominable.Incest is another transgression so rampantly
found in Indian society. The only thing that can deter Indians from getting into such heinous crimes is the fear of
Allah the Almighty. The doors of Islam are open to all.

QUESTION 7 : Should the practice of TRIPLE TALAQ be abolished, retained or amended ?

Answer : Those who understand and interpret Quran and Ahadees are called Ulema and one requires the
mastery of at least 14 different branches of knowledge to understand the different dimensions of a Quranic injunction.Abolishing, retaining or amending an Islamic term is not up to someone who cant differentiate between
the creature and the creation.First lets decide whether Cow is an animal or God !

QUESTION 8

: Do you think that steps should be taken to ensure that Hindu woman are better able to exercise their right to property, which is often bequeathed to sons under customary practices?

Answer : Hindu women are our sisters and our equal in humanity. They certainly deserve their fare share in
property as enjoined by our creator Allah enjoins you concerning your children: for the male is the equal of the
portion of two females;---- The Holy Quran Ch.4:11 Woman before Islam had no rights of property; in fact, she
was part of the inheritance, and was taken possession of along with other property. She had no right to the property of her deceased husband or father. The Quran took her from this low position and raised her to a position of
perfect freedom as regards her property rights and her right to inheritance, a position which, among other nations, she has only partly attained, and that after centuries of hard struggle. There is good logic behind fixing the
share of a daughter at half that of a son. Islam makes the economic well being of a household the responsibility
of the man. Thus the son has to support his family with his inheritance and thus share it with his wife and children. The daughter gets her share without any such strings attached. She is the sole benefactor from her inheritance, as she has to be maintained by her husband. Under the circumstances, the share of the woman is generous. But in order to benefit from the glorious principle of Islamic justice one needs to bear witness to the unity of
Allah and the prophethood of Muhammad (SAW).Well, everyone is welcome to join the true religion.

QUESTION 9 : Do you agree that the two year period of wait for finalizing divorce violates Christian womans
right to equality ?

Answer :

Christian men and women have the right according to their religion to take as much time to finalize
whatever is contracted between them.Like the RSS took 90 years to understand the basic indecency of Khaki
shorts being worn by grown up men, did any one question their felony or their fascist way of life ?

QUESTION 10: Do you agree that there should be a uniform age of consent for marriage across all personal
laws and customary practices ?

Answer : I have never seen a more pathetic question than this one ! Did the Law commission mean a minimum age or a maximum age ? Puberty varies from person to person and so does the desire to get married. The
prophet of Islam (SAW) strictly prohibits a man from marrying a woman without her consent. Decision to marry
lies in the hands of the female.

QUESTION 11 :

Do you agree that all the religious denominations should have the common ground for di-

vorce ?

Answer : Mr.Modi has chosen not to tell the nation his ground for abandoning his wife, and depriving an Indian
women of motherhood.A consensual divorce could have given Jashodaben at least the privilege to be a mother.
This is a serious case of womens right violation, I advise the Law Commission to run a referendum on it and Im
sure majority of Indian women would like to ensure that justice is served to their unfortunate sister of Gujarat.

QUESTION 12 :

Would uniform civil code aid in addressing the problem of denial or insufficient maintenance
to women upon divorce ?

Answer : Allah The creator has chosen women to be loved and cared by men.He has enjoined upon men to
give women their rights as a father, as a brother ,as a husband and as a son.Its unbecoming of the so called petty law makers who themselves have abandoned their wives and have been caught raping and molesting woman
to talk about her rights.

QUESTION 13 : How can compulsory registration of marriages be implemented better ?

Answer : In every religion of India, marriages are consummated bearing witness to God.We believe its registered in the heavens. Why is the law commission so damn eager to interfere in the Godly affairs of two loving
souls ? Has India become swakchch Bharat yet ? By the way , Kiran Bedi is seeking dog shit to be included in
Swakchch Baharat Abhyaan, Any referendum on that ?

QUESTION 14 : What measures should we take to protect couples who enter into inter-religion and inter-caste
marriages ?

Answer : Allah says: O you who believe! Do not marry idolaters unless they believe So the scope of Muslims marrying Kuffar is ruled out in the first place. Next comes marriage among the believers of divine books.
There is no drawback for a Muslim man to marry a Jewish or Christian woman. The Islamic scholars agree on
this subject. It is written in the verse of Quran that: (Lawful unto you in marriage) are (not only) chaste women
who are believers, but chaste women among the People of the Book, revealed before your time,- when ye give
them their due dowers, and desire chastity, not lewdness, nor secret intrigues. Now as marriage requires chastity and cleanliness(Tahara) and for chaste people to consult Anjaas in their personal religious affair is out of question. So Chauhaan the Najas poking his nose in the holy affairs of the people of the Books is preposterous.

QUESTION 15 : Would uniform civil code infringe an individuals right to freedom of religion ?
Answer : Freedom is Gods gift to man.Islam frees believers from the shackles of man-made laws and takes
mankind under the cool shadow of divine injunctions. So salah (prayer), zakat, fasting, Hajj, speaking truthfully,
fulfilling ones trust, treating ones parents with kindness and respect, upholding the ties of kinship, keeping ones
promise, enjoining what is good and forbidding what is evil, striving in jihad against the kuffar and munafiqin, being kind to ones neighbours, orphans, the poor, wayfarers, slaves and animals, praying and making supplication
(dua), remembering Allah (dhikr), reading Quran, and other good deeds, all come under under the heading of
worship and freedom. Before dreaming of passing any draconian law, RSS and and his stooges must remember
the 1857 mutiny and the cause thereof.

QUESTION 16

: What measure should be taken to sensitize the society towards a common code or codification of personal law ?

Answer : The only prescribed method taught by the holy prophet (Peace be upon him ) for us believers to sensitize the society or mankind in general towards the blessed divine laws is through Dawah. I therefore invite the
members of man-made law commission to get rid of the darkness of man-made laws and move towards the glorious Islamic light of divinity, equality and freedom.
