Class Activity
You are a lawyer working in a big firm. Among the clients of your firm is RichMo, Inc., an engineering
consulting firm. Krystel Santos, an electrical engineer, has been working for the firm for almost two (2)
years. On July 4, 2016, Krsytel tendered her resignation to her superior, Mr. Edward Smith. Her
resignation letter stated in full:

Dear Mr. Edward Smith,
Please accept this letter as notice of my resignation from my resignation from my position as
electrical engineer. My last day of employment will be August 4, 2016.
The past 2years have been very rewarding. Ive enjoyed working for you and helping to manage
the team dedicated to a quality product delivered on time. Thank you for the opportunities and
for letting me swim alone, through that, I learnt a lot.
If I can of any help during the transition, please dont hesitate to ask.

The resignation was duly accepted by the company. Mr. Smith noted the acceptance on the face of the
resignation. The acceptance was also made on the same day, July 4, 2016.
Thereafter, or on July 13, 2016, Krystel retracted her resignation, saying that she did not mean to tender
her resignation. This retraction was relayed to her superior, Mr. Smith. Mr. Smith said that the retraction
will have to be approved by management.
The next day, or on July 14, 2016, Krystel expressed that she is no longer retracting her resignation and
instead, requested that her last day of work be moved to July 18, 2016. The HR manager said that her last
day could not be on the 18th but the same can be moved to the 22nd of July. Krsytel agreed to move her
last day on the 22nd.
On July 15, 2016, at around 4pm, Krystel was informed by her superior, Mr. Smith that it was her last day
of work and that she needs to pack up her stuff and leave at the end of the day. Mr. Smith explained that
this notwithstanding, she will be paid her salary until the end of July. Krsytel agreed.
At around 5:30, two (2) ladies, one from HR and another from legal, went to Krsytels cubicle and asked
her to pack up her stuff and leave. Krystel made a scene and claimed that she was being harassed.
Sometime August, the company received a labor complaint from Krystel. She alleged in the complaint
that she was: (a) constructively dismissed and (b) harassed.

Draft a legal opinion on whether the claims for Krystel are meritorious. Support your opinion with legal
and jurisprudential basis. Observe proper citations. This could be submitted in handwritten or typewritten
format.
Submit by October 17, 2016, Monday. The beadle shall collect all papers and submit it to the Deans
office no later than 5PM.
