Ouragencywillresorttonegotiatedprocurementdueto2failedbiddings(nosuppliers
participated).Iamconfusedwiththeproceduresforthenegotiatedprocurementdue
tocertainsimilaritieswithpublicbiddingandlackofspecificsintheIRRandmanual.

1)Itwasstatedinthemanual(GPMforinfra,goods,etc)that"theproceduresforthe
conductofpublicbiddingshouldbeobserved".Whatspecificprocedures?

2)Intheinvitationofatleastthreesuppliers,issendingaletterenoughproofaside
fromthePHILGEPSposting?
3)Howarethenegotiationsconducted?Doesitrequirethepresenceofthesuppliers
ormeetings?Canitbeonlydonethroughblackandwhitecommunications?
4)Itismyunderstandingthatthesupplier,uponsendingusthepriceoffer,shall
attachtheeligibilityrequirementsasrequiredinpublicbidding.
5)canyoupleasestate(inutmostsimplicityandinchronologicalorder)thestepby
stepprocessonhowtoconductnegotiatedprocurementdueto2failedbiddings.For
example,1)createresolution>2)posttheopportunity>3)invitesuppliers>4)
requireeligibilitydocumentsandpriceoffer>5)evaluateandpreparecontractand

Thespecificproceduresforpublicbiddingbeingreferredtointhequotedprovisionare

c)UponHOPEapproval,theBACshallsendinvitationtoa"sufficientnumber"of
suppliers"toensurecompetition."ShouldtheBACconsiders3asasufficientnumber,
thentheBACwillsendinvitation/requestforproposaltothosesuppliers,asidefrom
postinginthePhilGEPSandbulletinboards.Theinvitationmaycontainadatefor
initialnegotiationswithallthosewhichrespondedtotheinvitation.
d)Negotiationisthendonewiththosewhichresponded.Areasfornegotiationmaystill
includethespecifications,deliveryschedule,etc.
e)Aftereverythingisclarifiedduringthenegotiationstage,theBACwillnowfinally
requestsubmissionoffinaloffersfromallthosesupplierswhichremainedafter
negotiation.
f)TheBACwillopenallproposals/offersonthedatesetfortheopening.
g)Thefollowwillthenfollowthepublicbiddingprocedurethereafter.
