The Anti-Age Discrimination in Employment Act which seeks to promote equality at the
workplace by mandating companies and/or employers to hire not based on age but
based on the competence of the workers. The law covers all employees and job
applicants of all employers, including national and local governments, contractors, and
organizations.
It shall promote equal opportunities in employment for everyone and shall be policy of
the State to:
a. Promote employment of individuals on the basis of their abilities, knowledge,
The following acts are also regarded as unlawful on basis of age under the new law:
a. Declining an applicant
b. Providing less compensation and benefits
c. Denying promotions or training opportunities
d. Forced dismissal of older age workers
e. Imposing early retirement

Violators will be fined between P50,000 and P500,000, and will be imprisoned from 3
months to two years, at the courts discretion.

The intent is to observe the terms of a bona fide seniority system that is
not indicated to evade the purpose of this Act

The Department of Labor and Employment (DOLE) shall have the authority to
investigate and require the keeping of records necessary for the administration of
this Act. The Secretary of Labor and Employment shall formulate the necessary
Implementing Rules and Regulations (IRR) within 90 days from effectivity of the
law.
