Northern Kenya leaders condemn


Mandera attack

eaders from North Eastern have strongly condemned the Tuesday morning
attack in Mandera that left 12 people
dead and others injured. Reacting angrily to
the suspected Al Shabaab attack, the leaders sharply criticized the government for failing to curb insecurity and repeated terror attacks in the region.
In the latest raid, the assailants targeted a local hotel frequented by non-locals. Mandera

town has recently suffered similar deadly


attacks and leaders are now calling for
an end to what is seemingly seen as well
orchestrated attacks targeting non-locals.
Speaking in Marsabit town on Tuesday,
seven governors from the northern frontier counties condemned the horrific attack and sent condolence messages to

A high court in Machakos has quashed an application by a group of individuals seeking to


close down Akwana Sabaki Jamia mosque in
Machakos county.
Justice Oscar Angote sitting in the Machakos
Environment and Land Court refused to accept
the orders filed under certificate of urgency.
In the application the 21 individuals were seeking to temporary close down the Mosque pending determination of the main suit they filed
seeking orders to demolish the mosque which
was then nearing completion.
That the Horourable Court be pleased to issue
restraining orders barring the Ist defendant, its
agents, servant or those claiming under them
from using. Occupying and worshipping in the
mosque erected land parcel no 20606/88 pending the hearing of this application and of the
main suit, read the court documents seen by

The government should come out clearly


to address the existing concerns on extra
judicial killings and enforced disappearances as there are contributory drivers of
terrorism and radicalization.
The executive director of Haki Africa
Hussein Khalid told the government not
to disregard the growing concerns saying
they were leading to despondent youth to
join criminal groups.
In his remarks during the national workshop on violent extremism organized
by the Supreme Council of Kenya Muslims (SUPKEM), Hussein reiterated that
violating the rights of terrorism suspects
was not a solution to fighting terrorism
and urged the state to instead work together with civil society organization and

called for more robust measures to improve on the security situation.
It is unfortunate that despite their huge
presence in Mandera, the security forces
cannot deter such atrocities. This comes
barely two weeks after the previous attack
of similar nature, a clear indication that
there's laxity within the security cycle, he
said.
The governor asked Mandera residents to
share intelligence with security agencies
and further urged the government to post
300 national police reservists to help prevent attacks in the region.
Marsabit governor Ukur Yattani and Wajir
governor Ahmed Abdullahi urged security
agencies to make use of intelligence provided by locals. The two governors said cooperation between security agencies and
local community is key in the fight against
terror.
Lamu governor Issa Timamy added his
voice to condemn the carnage saying, We
are resilient and shall stand together and
ensure the perpetrators do not succeed."
Leading a group of legislators from the
region in addressing a media briefing in
Nairobi, Mandera senator Billow Kerrow
said failure by the government to secure
the Mandera-Somalia boarder has made it
easy for Al Shabaab militants to stage sporadic attacks against innocent people.
Fafi Member of Parliament Bare Shill said
local leaders have had enough of frequent
attacks that lead to loss of life and destruction of property. He blamed rampant corruption within security circles saying it is
time the government admits it has failed
the war against Al Shabaab.
The leaders said the attacks are a setback
for the regions development as many nonlocal professionals are fleeing the area as
a result of the frequent attacks.

county government of Machakos which
was listed as the second respondent requested the court more time to respond to
the suit.
Justice Angote found the request by the
county government justified allowing the
county government more time to respond
to the suit.
The judge argued that their input was important in determining the case. For now
worshippers of Sabaki will continue using
the Mosque for prayers and other activities.
The application to demolish the mosque
was filed in August 2016 by the group alleging that the construction of the mosque
will disrupt their peace and expose them to
public interference.
The mosque was constructed and funded
by a donor in partnership with the local
Muslim community

against the attack.
Meanwhile following the Tuesday attack,
the government imposed a 12-hour curfew in Mandera. Through a gazette notice
on Wednesday, Interior cabinet secretary
Joseph Nkaissery said the dawn to dusk
curfew will take effect from 27th October to
27th December 2016. Every person who
resides within the Sub- County shall except under, and in accordance with the
terms and conditions of a written permit
granted by the respective Deputy County
Commissioner for the affected areas, remain indoors in the premises at which they
reside or at such other premises as may be
authorized said Nkaissery.
The curfew will apply to Mandera town,
Omar Jillo, Arabia, Fino, Lafey Kotulo and
Elwak, and extend to 20km from the Kenya-Somalia border.

Yusuf urged the government to support
programmes to rehabilitate returnees saying that many of them had been misled
in joining criminal groups and they would
welcome efforts to reintegrate them in the
society.
On his part the, SUPKEM deputy secretary
general Hassan Ole Naado said the council will continue to engage with the government on best practices to implement the
amnesty offer granted to those who renounce violence.
He also called for cooperation between
civil society organizations and the government to address issues of social justice
and development.
There is need for a mechanism that allows
civil society to better cooperate and share
information within jurisdictions and serve
as an interface between the state and nonstate actors, he said.

Speaking at the event, the United States


ambassador to Kenya Robert Godec urged
the government to address grievances
which he said were contributing to violent
extremism.
The concerns include dissatisfaction over
land rights, difficulty in obtaining identification cards, and for some communities,
generations of frustration over perceived
or real discrimination. All of us must recognize the role these frustrations play in
opening recruitment opportunities for terrorist groups, he said as he stressed that
the grievances should under no circumstances be justified the use of violence.
The two day event brought together state
and non-state actors to discuss modalities of establishing a national civil society

mechanism.
It attracted officials from the Interior ministry, the National Counter Terrorism Centre,
civil society organisations, development
partners and representatives from Tanzania and Somalia.

Wajir Kadhi passes away


The resident Kadhi of Wajir Sheikh Abdulwahab Abdullahi Mursal passed away
on Monday after a short illness.
Sheikh Abdulwahab was known for his efforts in fostering peace among communities. During the celebrations to mark the
International Day of Peace last month, the
Sheikh was recognized by the government
and other agencies for his contribution to
peace building and conflict management
programmes in the county.
In the judiciary where he had served for
more than three years, he was an active
promoter of Alternative Dispute Resolution
(ADR) in the Kadhi court which helped in
reducing the backlog of cases in the courts.
Message of condolences poured forth
with many praising his efforts in fostering

peace and harmony in different sectors of


the society. He was one of the finest Muslim scholars of his time, a peace pillar and
a strong agent of cohesive co-existence
among communities of the larger Wajir.
May the Almighty Allah grant him jannah.
Inna Lillahi wa inna ilaihi raji'un, said Eldas
MP Adan Keynan.
It is sad losing an ambassador of peace
and a key figure in the transformation of
gender and social equity in the Wajir society, said the Kadhi of Kakuma Abbdulaziz
Kunyuk Tito while the Muranga Kadhi Abdilatif Malampu Silau described him as a
man who cherished peace and cohesiveness wherever he served.
Sheikh Abdulwahab was buried in Wajir on
Tuesday.

The Four Imams

Imam Malik The scholar of Madinah


The collection and codification of Islamic
law has historically been one of the most
important, and challenging, tasks that the
Muslim community has undertaken in 1400
years of history.
To be considered a faqih (an expert in Islamic law fiqh), one must have mastery of
the Quran, the sayings of Prophet Muhammad peace be upon him, other sources
of law, as well as other subjects such as
grammar and history.
One of the giants of Islamic law was the
8th century scholar of Madinah, Malik ibn
Anas. At a time when the Muslim community desperately needed the sciences of fiqh
and hadith (sayings and doings of Prophet
Muhammad peace be upon him) to be organized, Imam Malik rose to the occasion.
His legacy is manifest in his continued influence throughout the Muslim world, both
through his own works and the works of
those he helped guide on a path of scholarship and devotion to Islam.
Early life and education
Imam Malik was born in 711 in the city of
Madinah, 79 years after the death of Prophet Muhammad peace be upon him in that
same city. His family was originally from
Yemen, but his grandfather had moved to
Madinah during the reign of Umar ibn alKhattab. Both his father and grandfather
had studied religious sciences under the
Companions of the Prophet who still lived
in Madinah, and thus young Malik was
raised in an environment that was based
on Islamic scholarship, learning from his
father and uncle.
Imam Maliks uncle, Nafi, was an eminent
scholar in his own right, and narrated hadith from Aisha, Abu Hurairah, and Abdullah
ibn Umar, all companions who are noted
for their vast knowledge of hadith. Although
the political center of the Muslim world
shifted away from Madinah during the caliphate of Ali in the 650s, it remained the
intellectual capital of Islam. In this capital of
Islamic knowledge, Imam Malik mastered
the sciences of hadith, tafsir (interpretation
of the Quran), and fiqh.
The scholar of Madinah
After an immense amount of study that extended into his 20s and 30s, Imam Malik
became known as the most learned man in
Madinah at his time. He became a teacher,
attracting a huge number of students to
lectures, which he held in the mosque of
the Prophet peace be upon him.
He used to sit on the pulpit of the mosque
with the Quran in one hand and a collection
of hadith in the other and offer legal rulings
and opinions based on those two sources.
Students flocked to his lectures from all
corners of the Muslim world. Among his
more notable students were Abu Yusuf,
Muhammad al-Shaybani (they were Abu
Hanifahs two most important students as
well), and Imam al-Shafii.

The most unique aspect of Imam Maliks


methodology in fiqh was his reliance on the
practices of the people of Madinah as a
source of law. In the study of fiqh, there are
numerous sources that are used to derive
laws.
The first and second most important sources are always the Quran and Sunnah. After those two, however, the great scholars
of fiqh differed on the next most important
source of law. Imam Malik believed that the
practices of the people of Madinah should
be seen as an important source.
His reasoning for this was that Madinah
at that time was not far removed from the
Madinah of Prophet Muhammad peace be
upon him. It had been spared the political
and social upheaval that much of the rest of
the Muslim world dealt with. And the people
living in the city had been taught Islam by
their ancestors who had been Companions
of the Prophet peace be upon him or students of the Companions.
He thus reasoned that if all of the people of
Madinah practiced a particular action and it
did not contradict the Quran and Sunnah,
then it can be taken as a source of law. He
is unique among the four great imams of
fiqh in this opinion.
In order to ease the study of fiqh and hadith, Imam Malik compiled a book known
as the al-Muwatta. This was the first book
that attempted to compile only sound and
reliable sayings of Prophet Muhammad
peace be upon him into one book. Imam
Malik said that he showed his book to seventy scholars in Madinah, who all approved
it, thus he gave it the name al-Muwatta,
meaning The Approved.
Al-Muwatta was a landmark book. It helped
establish the science of hadith, particularly
the judging of chains of narrations for hadith. Imam Malik was so thorough in his selection of hadith that it has been placed on
the same level (and sometimes above) the
hadith compilations of Imams Bukhari and
Muslim. Imam Shafii even stated that there
is no book on earth, after the Quran, that is
more authentic than the Muwatta.
Imam Maliks work was so influential as
a book of fiqh that the caliph of the time,
Harun al-Rashid, demanded that it be
mass-printed and made the official book of
fiqh for the Abbasid Empire.
Imam Malik, however, refused. He knew
that no one interpretation of Islamic law
was perfect and all-encompassing. As
such, he refused to allow his fiqh to become official, even under threat of persecution and imprisonment.
Imam Maliks character
Besides being one of the greatest scholars of fiqh in history, Imam Malik was an
incredibly humble and meticulous Muslim.
Out of respect for the Prophet peace be
upon him and his words, he would refuse
to narrate a hadith while walking. Instead,

when asked about a hadith, he would stop,


sit down, and give the hadith the attention
it deserved, out of respect for Prophet Muhammad peace be upon him.
He would also refuse to ride any animal in
the city of Madinah, seeing it as unfathomable that he would ride on the same dust
that Muhammad peace be upon hims feet
walked on. This type of extra respect and
meticulousness out of respect for Prophet
Muhammad peace be upon him certainly is
not mandatory according to Islamic law, but
simply a sign of the emphasis Imam Malik
placed on the importance of Muhammad
peace be upon him.
Among Imam Maliks sayings are:
The Sunnah is the ark of Nuh. Whoever
boards it is saved, and whoever remains
away perishes.
Knowledge does not consist in narrating
much. Knowledge is but a light which Allah
places in the heart.
None renounces the world and guards
himself without then ending up speaking
wisdom.
When Imam Malik embarked on the study
of Islamic sciences with a teacher, his
mother advised him to learn from your
teacher his manners before you learn from
him his knowledge.
Imam Malik was held in very high esteem
by later day scholars and luminaries like
the succeeding Imams. Once in the later
years Imam Hanbal was asked about the
reliability of a narrator of Hadiths, to which
he replied that the narrator in question
must be a reliable reporter for he said that
Imam Malik had quoted Hadiths from him,
such was the Trust that later day scholars
put in him.
Imam Maliks ideology on fiqh developed
into the Maliki madhab (school). As Imam
Malik wished, it was not imposed on Muslims as the sole school of Islamic law. Instead, it complemented the other three
schools that took precedence in the Sunni
Muslim world the Hanafi, Shafii, and
Hanbali schools.
The Maliki school became very popular in
North and West Africa, as well as Muslim
Spain. Today it remains the main madhab
of North and West Africa.
Imam Malik died at the age of 85 in the
year 795. He was buried in the Baqee
Cemetary in Madinah.

And tell the believing women to reduce
[some] of their vision and guard their private parts and not expose their adornment
except that which [necessarily] appears
thereof and to wrap [a portion of] their
headcovers over their chests and not expose their adornment [Surah an-Nur,
24:31]
I will not sugar coat my words. That has
been done enough already. It is time that
we take the words of Allah seriously. Why
do we find it difficult to abide by the rules
of Allah? Why do we somehow choose a
middle path which looks alright to us on the
surface but deep down, we know that it is
not OK?
Hijabi but not hijabi
The ayah mentioned in the beginning is
very clear. There is absolutely no ambiguity- Cover yourselves such that you do not
reveal anything. But we being the smart
generation have changed the definition of
reveal. Let us take a sneak peak at the
various trends in the world of hijabis today
and find out if we are the Hijabi Barbie :
1.We have covered ourselves!
We find sisters, covered from head to
toe, with nothing other than their face and
hands visible. You may ask, What is the
problem? The issue is that they can be referred to as being covered with clothes, but
subhanAllah, the tightness of their clothes
leaves nothing to the imagination! Every
feature of their body is displayed wrapped
in tight clothes. And these sisters are quick
to retort, We are not revealing anything!
The underlying problem seems to be that
most of us feel that simply covering our hair
with a piece of cloth is called hijaab. No,
this is not true.
Take some time and look at how Allah has
used words to describe the hijaab for women. He does not simply say dress modestly, but has also outlined the type of clothes
we should be draped in. If you think deeply
about the reason for this, you will realize
that the definition of modesty varies from
culture to culture.
Let us take a simple example from the
Asian Sub continent to illustrate this. An
Indian woman wearing a saree may consider a girl in a mini skirt as immodest,
while forgetting that the saree she herself
has draped reveals her entire midriff, back
and chest area. But that is the culture of
her country and she finds nothing wrong in
it! In fact, the saree is a modest dress according to her.
This is how our mind functions and Allah,
al-Alim, knows our limitations. He has
therefore used specific terms such as
khimar, jilbab and hijaab to describe the
dress code for the Muslimah.
2.Hijab and Haya
Another misconception that people usually
have about the hijab is that it is something
physical. This is not true either. Hijab is the
veil that has to be drawn over our body, our

behavior and our speech. If we observe the
proper physical rules of hijab, yet have no
constraint on our deeds and actions, and
involve in haraam activities, what purpose
has the covering served?
3.The camel hump trend
1.I immediately remember my cousin when
this topic is raised. She was visiting the
Gulf and the first thing she told me was;
Now I understand what the camel hump is,
which the Prophet salallahu alayhi wa sallam referred to in his hadith. Abu Hurairah
relates that the Prophet salla Allahu alayhi
wasallam said, There are two categories
among the inhabitants of Hell whom I have
not encountered. The first are people who
carry whips like the tails of cows and beat
the people with them. The second are
women, clothed yet naked, drawn to licentiousness and enticing others to it, their
heads like the swaying humps of camels.
They will neither enter Paradise nor even
smell its fragrance, though its fragrance
can be found to a great distance. (Sahih
Muslim)
We need to ask ourselves the question that
who are we trying to please, Allah or others? The humps on our head get higher,
the makeup gets heavier, the perfume gets
denser, the clothes get tighter, yet we claim
we are in hijaab. Is our hijaab making every
glance turn in our direction? Is our attire
dissuading people to look at us or is it inviting them? There is no special jury verdict
required for this question!
Our hijaab should automatically create a
sense of haya in us. We are not an item

on public display for people to look and


admire. Allah has blessed us with internal
and external beauty to preserve and not to
be tarnished. If we are truly dressed in the
sense Allah has instructed us to, both internally and externally, people will refrain
from even looking at you, let alone harm
you. The reasons may differ some out of
respect, some out of disinterest and some
out of contempt but at the end, the purpose is served. You remain protected like
a pearl in its shell, beautiful, mesmerizing,
radiant and untouched.
Allah highlights another purpose of hijaab
in Surah al-Ahzaab, you will be known.
This is quite interesting. Ibn Katheer in his
Tafseer says that, it will be known that
they are free, and that they are not servants or whores.
Allah has shown us the precise yet subtle manner of being the ambassador of Islam. The hijaab is our uniform, our badge
of honor, our pride.2 We have to hold onto
this badge with love, commitment and sincerity and let the world know that we are
not suppressed but choose to cover ourselves modestly.
I leave you with this simple question which
I need to answer as well:
If we claim that our hijaab is modest
enough and that we are covered appropriately, then why do we put on the loose
jalaabeeb before we stand for Salaah? Is
Allah watching us only during our Salaah?
Do we forget that He continues to watch us
even when we leave our homes as Hijabi
Barbies?

Northern counties form economic bloc

Seven counties in the former norther frontier district have formed a regional economic bloc that is aimed at boosting trade and
investment for development in the region.
Marsabit, Lamu, Garissa, Mandera, Wajir,
Isiolo and Tana River counties on Tuesday
formed the Frontier Counties Developmental Council (FCDC) in Marsabit town.
Marsabit governor Ukur Yattani who hosted
the governors for the launch said the economic bloc aims to address socio-economic challenges, common investment plans,
resource mobilisation and policy advocacy
in the region so as to benefit from intercounty trade, investment and services.

who is the chairman of the blocs steering
committee said the objective behind the
formation of the bloc is to address developmental challenges the marginalized counties have faced for decades.
The objective of this bloc to mainly address developmental challenges which are

common in all these counties. These counties have remained marginable for ages
but devolution has presented an opportunity to change things around, Gulied told
The Friday Bulletin.
He said besides trade and investment cooperation, the bloc will come up with strategies to address challenges in the sectors of
education, health, security, infrastructure,
water, food security and perennial drought
in the region.
Guleid hailed the formation of the bloc as
a milestone noting that he is optimistic that
the seven counties will realize the desired
development.
The regional bloc will also address matters
of peace and harmony among the ethnic
communities for regional cohesion and integration and collaborate to address radicalization and terrorism.
Projects to be undertaken in the bloc include tarmacking of Isiolo-Mandera road
which already has been approved by the
World Bank, Off-grid energy solar power
project and construction of fiber optic.
Besides the World Bank, other developmental partners brought on board are
UNDP, Swiss Development Agencies, EU
and USAID.

Anything done in accordance with Allah's
Law and the Sunnah[way]of His Beloved
Messenger Muhammad [peace be upon
him] it is classified as Ibadah[worship]! A
Muslim student puts his Trust in Allah when
facing the tests of this world and seeks Allah's help whilst following the prescribed
means. While preparing himself fully in
every permissible way for the exams that
lie ahead, he should always endeavour
to be obedient to the Commands of Allah.
Here are some useful tips to assist in preparing for the exams:
During the exams:
Stay calm. Relax. Stay focused.
Choose a good place to sit during the
exam.
Keep your back straight, and sit on the
chair in a healthy manner.
Have confidence in yourself.
Begin with the name of Allah.
Write clearly the examiner cannot mark
what they cannot read! Leave a line space
between your main points/ paragraph to
help the examiner mark your work.
Look over the exam first. Studies advise
spending 10% of the exam time in reading
the questions carefully, noting the important words and dividing one's time between
the questions.
Answer the easy questions first, then the

Answer questions according to importance. Start by answering the easy questions which you know

make them feel optimistic by saying good
words as prescribed in Islam.
Relax -Take breaks eg. Salaah[prayer]

Don't hurry-Take your time to answer, for
the Prophet (peace and blessings of Allah
be upon him) said: "Deliberation is from Allah and haste is from the Shaytaan." ( Saheeh al-Jaami).
Multiple choice-Think carefully about the
answer and choose the right answer when
answering multiple-choice questions. Deal
with them in the following manner. If you
are
sure that you have chosen the right answer, then beware of waswasah (insinuating whispers from the Shaytaan). If you
are not sure, then start by eliminating the
wrong or unlikely answers, then choose the
correct answer based on what you think is
most likely to be correct.
If you guessed at a correct answer then do
not change it unless you are sure that it is
wrong - especially if you will lose marks for
a wrong answer. Research indicates that
the correct answer is usually that which the
student thinks of first.
Written exams: In written exams, collect
your thoughts before you start to answer.
Write an outline for your answer with some
words which will indicate the ideas which
you want to discuss. Then number the ideas in the sequence in which you want to
present
them.Write the main points of your answer
at the beginning of the line, because this
is what the examiner is looking for, and he
may not see what he is looking for if it is in
the middle of the page and he is in a hurry.
Review-Devote 10% of the time for reviewing your answers. Take your time in
reviewing, especially in mathematical problems and writing numbers. Resist the desire to

hand in the exam papers quickly, and do


not let the fact that some people are leaving early bother you. They may be among
the people who have handed in their papers too early.
Accept the will of allah- After the exam
make dua in gratitude to Allah and that He
grants you success. If you discover after
the exam that you answered some questions incorrectly, then take that as a lesson
in the importance of being well prepared in
the future, and not rushing to answer questions. Accept the will and decree of Allah
and do not fall prey to frustration and despair. Remember the hadeeth of the Prophet (peace and blessings of Allah be upon
him), "If anything befalls you, do not say, 'If
only I had done such and such.' Rather say,
'Qadar Allah wa maa sha'akaan (the decree of Allah and what He wills happened),'
for saying 'if only' opens the door for the
Shaytaan." (Hadith-Saheeh Muslim).
Cheating-Note that cheating is haraam.
The Prophet (peace and blessings of Allah
be
upon him) said, "Whoever cheats is not one
of us." It is wrongdoing and it is a haraam
means of attaining a degree or certificate,
etc., that you have no right to. The consensus is
that cheating is a kind of cooperation in
sin and transgression. So do without that
which is
haraam, and Allah will suffice you from His
bounty. Reject all offers of haraam things
that come to you from others. Whoever
gives up a thing for the sake of Allah, Allah will
compensate him with something better.
Remember : Your obligations to Allah- Salaah, reading Quran , Dhikr etc. Dont miss
your Salah no matter what!

Management training Programme for Jamia staff


To build the capacity of its staff, Jamia
mosque recently organized a one-day
management training workshop for its senior staff and committee members.
Among other objectives, the training programme aimed at improving the management and supervisory skills of its staff to
better serve the ummah in service delivery.
The training programme undertaken by
management consultant Abdulrahman
Wandati areas covered which included
management and supervisory skills as well
as organization and communication skills.
At the same time, the Jamia Mosque Committee effected some management changes to streamline its services to the Ummah.
Sheikh Juma Amir apart from serving as
the deputy Imam of Jamia, also serves as
the director of Information centre.
Sheikh Muhammad Abdallah is now the director of Dawa while Muhammad Sheikh
Ishaak takes his former position as the
Dawa officer.

Ahmed is now the head of media overseeing the print and electronic media outlets of
Jamia mosque.
Enow Muhamoud is the principal of Jamia Training Institute while Jaffar Mustafa
serves as the administrator at the institution.
In the ICT department, Bilal Murila has
been appointed as the manager.
Abdallah Wesamba is the supervisor while
Nuria Abukar was appointed as the lady supervisor to oversee the female staff.
Also brought on board in the new management structure is Fatma Guyo as the assistant accountant and Farah Mansoor Bagha
as the administration assistant while Amyra
Obuleko serves as the secretary.
These changes are aimed at improving
professionalism and service delivery for the
betterment of the ummah, said the secretary general Abdulbary Hamid.
In all, Jamia Mosque Committee has a staff
member of 82 employees.

Muhuri chairs life in danger, rights groups say


Human rights groups have read malice in
the break in of the home of the board chairperson of the Muslim for Human Rights
(MUHURI) and called on the government
to immediately investigate the matter.
The Nyali home of Khelef Khalifa was broken into on Tuesday morning by yet to be
known intruders who made away with mobile phones.
At the time of the incident, Khelef was out
of the country, however other family members were at home.
In a statement, the human rights groups
said the robbery could be part of a campaign to silence Khelef who has been vocal against human rights abuses.
In the recent week, Khalifa has received
threats on his phone, on social media and
publicly by senior police officers, and he
has expressed concerns over his life due
to his demand for accountability by the police for their response to the growing threat
of terrorism and radicalization in the Coast,
that have included enforced disappear-

ances and extra judicial killing of Muslim


clerics and youths, said the organisations
who included the London based Amnesty
International, HAKI Africa, Independent
Medico-Legal Unit (IMLU) and Kenya Human Rights Commission (KHRC).
The right groups called on the government
to desist from the acts of harassment and
intimidation of Muhuri officials.
Commenting about the incident on his Facebook page, Khelef who has been vocal
against police excesses in the campaign
against terrorism described the incident as
an intimidation against human rights workers. Someone is sending a message that
they can get me and that I am not safe, he
said as he blamed security agents for creating fear against human rights activists.
The Muhuri chairman was recently on a
collision course with coast security officials when he maintained that the three
women accused by police of attempting to
bomb the Mombasa Central Police Station
were innocent.

KNCHR holds inquest on coast insecurity


The Kenya National Commission on
Human Rights (KNCHR) has kicked
off a three month -long public inquiry
on insecurity and human rights at the
coast region.
The inquiry, conducted in partnership
with the Independent Policing Oversight Authority (IPOA) will be conducted in the counties of Mombasa, Lamu,
Kwale and Tana River.
Of major interest to the commission is
the increased cases of extra judicial
killings and enforced disappearances,
human rights violations and historical
injustices such as land ownership.
Commission chairperson Kagwiria
Mbogori said the commission was
looking at insecurity because it negatively impacts of peoples lives and
their enjoyment of human rights. The
public inquiry will seek to unearth and
analyze the human rights impacts of
insecurity in these areas. Prevalence
of insecurity, the impact and the cost of
impact of insecurity in terms of disruption of livelihoods, she said.
Speaking at the opening of the first
inquiry in Mombasa, Mvita Member of
Parliament Abdulswamad Shariff Nassir urged Mombasa residents whose
rights have been violated as a result
of been victims of security agencies to
come out and take part in the exercise.
Abdulswamad said the exercise is crucial in unearthing the impacts the violations have had on their lives saying the
findings will help address and prevent
insecurity and the violations in the future.
I appeal to the public to come forward
and share their story on security. But
we must be honest with ourselves people will not come out because they are
afraid of the police, he said.
The MP criticised government policies

in the fight against terrorism and the crackdown on dissent voices especially from media
and human rights organisations. You cannot
fight an ideological war with bullets and force.
Rounding up people en masse and criminalizing everyone on the streets is not a solution
but rather creating chaos and bloodshed, Abdulswamad added.
The legislator said he will see to it that the
Anti-Torture Bill 2016 and the National Police
Amendment Bill are enacted in the National
Assembly.
After concluding the inquiry the State human
rights watchdog will present the recommendations and findings to the relevant government
bodies for implementation.
KNCHR will at a later date move to North
Eastern region to hold a similar public inquiry.

While the police described the three girls as


terrorists, MUHURI and other rights groups
called for thorough investigations including
independent postmortem of the bodies to
ascertain the cause of their death.
In March last year, the offices of the organization were broken into and two weeks later, the Inspector General of Police through
a Kenya Gazette listed MUHURI and another human rights organisation Haki Africa
among 85 organizations and individuals as
"terrorist entities" under the Prevention of
Terrorism Act (2012). The operations of the
organizations were crippled after their accounts were frozen.
MUHURI and Haki Africa moved to court
challenging the legality of the administrative
obstacles, and the Mombasa High Court
ruled in their favor.

Life after Prison

Ummah Foundation in its support to the released inmates


focuses on reformed and aging people in prisons, many of
whom are long-termers convicted of serious crimes.
Many of these human beings have transformed their lives
and developed skills and abilities they lacked before incarceration. They could be released from prison with no threat to
public safety. Yet many are denied release, often for political
reasons, and needlessly remain imprisoned into old age.
Thanks to the power of mercy that the President many were
released on Mashujaa day and can now go back to their communities different. Such a process will drastically reduce the
soaring population of incarcerated elders and people who
could give a positive impact to the society.
Ummah Foundation through the Prisoners Rehabilitation
Program has managed to rehabilitate many of the inmates at
Kamiti Maximum, Naivasha Maximum, Shimo la Tewa e.t.c.
and through this, many were able to qualify to come before
the parole board and be able to get their freedom after so
many years. By submitting our recommendations through the
Officers Incharge, we should all appreciate the fact that many
have finally gone home.
For many, life after prison is a constant battle for survival, so
its no wonder the national recidivism rate in Kenya is over
40%. With no resources or support, many of those who dont
end up returning to prison are forced into poverty and homelessness.
Here at Ummah Foundation we believe that people coming
out of prison should be able to reintegrate into society and
succeed. These ex-prisoners should be able to vote, work,
support their families, have access to public services and live
fulfilling lives. They should be given the chance to live a normal life again, absent of discrimination.
These are the people that struggle under the life-long stigma
that comes with the label ex-convict.Ummah Foundation in
its wisdom has always been able to identify the skills achieved
during their terms and upon release we give them support in
terms of tools and equipments of their working expertises to
help them start a new life. We also give some seed funding
to make the start easy. This has yielded a lot of good results
in the end and many who are of these categories have finally
got a base to make a new life after prison.
In the Kenya, many employers have policies that flat-out
refuse to hire anyone with a criminal record, no matter how
qualified a person is for the position. Gainful employment is
a necessity for an ex-prisoner trying to get back on his or her
feet; it helps prevent recidivism by providing legal income and
giving a person a productive role in society.
But because of discriminatory hiring practices, many ex-prisoners are forced to resort back to criminal activities to support
themselves and their families.
It is high time we came out these mentalities and helped our
sisters and brothers gain meaningful existence in the society.
Ummah Foundation alone cannot shoulder the whole load
and we therefore appeal to all to work with us in providing a
hospitable and friendly environment for our former inmates to
thrive and grow.
