ORDER DENYING MOTION TO CHANGE HEARING VENUE, ORDER DENYING


MOTION TO SHORTEN TIMEFRAME TO RESPOND TO INTERROGATORIES, and
ORDER FOR MOTIONS HEARING
This matter involves Complainants allegation that the activities of the
Commission on Judicial Performance, members of the Colorado judiciary, and related
individuals and groups, violated Colorados fair campaign practice laws. The hearing is
set to begin November 4, 2016 at the Office of Administrative Courts.
Order Denying Complainants Motions
To date, Complainant has filed two forthwith motions. One motion asks the ALJ
to change the hearing venue from the Office of Administrative Courts to the Old
Supreme Court Chambers at the State Capitol. Complainants justification for the
request is that, due to the number of respondents, a larger venue is necessary. The
motion is denied.
The second motion asks the ALJ to shorten the timeframe for Respondents to
respond to Complainants interrogatories. That motion is also denied.
Order for Motions Hearing
Respondents have filed two motions to dismiss. Complainant has not yet filed
responses. Given the pending dispositive motions, the ALJ deems it prudent to conduct
a motions hearing prior to a hearing on the merits. The motions hearing will be held at
the Office of Administrative Courts on November 4, 2016 at 9:00 a.m. If one or both
motions are denied, a new date for the merits hearing will be selected. Because the
merits of the complaint will not heard on November 4th, only the parties legal
representatives need attend. Witnesses and individual respondents need not attend.
All discovery is stayed pending the outcome of the motions.
