Respectfully Sheweth:-

1. That suit for recovery of maintenance Mst. Rizwana Aziz VS

Sarim Mehmood Faisal, is pending before, Miss. Mehwish
Shahzadi judge Family Court Rawalpindi and next date is
fixed on 15-02-2016.
2. That similarly the petition under Section 25 Guardian and
Wards Act, titled Sarim Mehmood Faisal Vs Rizwana Aziz, is
pending before Mr. Jawad Alam Qureshi, Guardian Judge
Rawalpindi, and next date is 11-02-2016.
3. That initially both cases were pending adjudication before Mr.
Jawad Alam Qureshi, Judge Family Court Rawalpindi. In
which both the cases have been consolidate and evidence of
the petitioner has partially recorded. But later on by an
administrative Order the suit for recovery of maintenance etc,
title Rizwana Aziz Vs Sarim Mehmood Faisal, has been

transfer to Ms. Mehwish Shahzadi, Judge family Court

Rawalpindi.
4. That both the cases are interlinked and matters in issues is
directly and substantially same and if both cases are tried in
two different courts then it will be the chance of conflicting
judgment.
5. That even otherwise the petition under section 25 of
Guardian and wards Act can be heard and decided only by
notified Guardian Judge.
