losinghislicensetopracticemedicine.
Neighborsorestrangedfamilymembersmayreportafamilydespitethelackofgroundstosupportanyallegationsof
abuse.
ParentswithasickchildseekingasecondopinionhavebeenreportedtoCPSbyhospitalormedicalauthorities.
SincemoreparentsareexperiencingavisitfromCPSthaneverbefore,andsince
sometimesthosevisitshaveresultedinthequickremovalofchildrendespite
nogroundstoallegationsofharmorabuseitiscriticallyimportantforeveryparent

IworkedforCPSinSDforalmost6years,anditwasadifficultjob,ifwedidntcomewithlaw
enforcement,wewerenotgoingtoremovekids,andsometimeifwedidbringlawenforcementdueto
pasthistorywedidntremovechildren.Ithinktherearealargeamountofreferralsthatcomeinthatare
screenedoutevenwithreportsofobviousdangertochildren.Iknowitwasadifficultjobformetodo,
aftermyexperienceinanotherstate,whenIwasanewmom!Ihadachildthatwasveryhyper,and
notverycoordinated,thestateworkertheremadejokesabouttheallegations,andwhensheleft,she
hadstatedthatmydaughterwasabused,therecordshavesincebeendestroyed,buttheexperience
stillstayswithme!Itwasactuallyreportedbyneighborsthatdidntlikeus,andtheywereabusiveto
theirownchildrenanditwasknownbyotherstoo.Wedidwhatweneededtodotogetitoffofour
recordbutitstillangersmealot!!!

Apoliceofficerdoesnotneedawarranttoenteryourhouseiftheybelieveanoccupantisinimminentdanger.
IassumeCPSmightoperateunderthesameframework.Howeveranyevidencecollectedoractiontaken
withoutawarrantunderthepremiseofimminentdangermusttosupportedbyfactsthatthechildisin
imminentdanger.TheburdenofproofwouldbewithCPStoproveimminentdangerexisted.Itisbesttobe
polite,butsayaslittleaspossible.Justasifyouweredealingwiththepolice,withtheexceptionthatpolice
willbebettertrainedandmoreknowledgeableofthelawthanyouraverageCPSworker.

IhaveafollowupquestiontoyourcommentyoustatethatifCPSaskstoseeyourchildandyouhave
nothingtohide,thenallowingthemtoseethatchildisfinewillworkoutinyourbestinterest.Doesthat
includeneedingtoallowthemintothehome?OrcanIjustcallmychildtothedoor(giventhattheyareold
enoughtocomethemselves)orclosethedoor,getmychild,andcomebacksothattheycanseethatthey

firstthepoliceinvolved,andthenwhentheirinvestigationwasclosedasunfounded,shethencontacted
CPSandwehadtogothroughanentireinvestigationwiththem.Itwasalldropped,butitwasstressfuland
scary,andIworryaboutitbeinganissueagain,wheneverhermotherfeelsshehasanotheropportunity.

workinandunderstand.Withthatsaid,thisismyhumbleopinionandcomesfromsomeonewhoisnotafanofDHS,
andmyfamilyandIareantivaccine.
IampostingthisbecauseIthinkalotofmisinformationspreads,butIalsothinkthereisvalueinthinkingofand
addressingtheseissuesaddressedabove.
*InordertokeepthisshortandonpointIamgoingtosummarizelawandomitthelevelsofDHSinvolvement,ranging
from:initialcall,shelterhearing,jurisdiction,andterminationofparentalrights.
About95%ofcasesDHSbecomesinvolvedinareegregious.WhenIsayegregiousthinkofdrugaddictedparents
passedoutleavingtheirchildrenunattended.IfDHSreceivesacallthey,DHS,mustdecidewhetherthecallwarrants
a24hourresponseoruptoa10dayresponse.Theimmediacyofharmdictatestheresponsetime.So,simply
becausesomeonerefusestovaccinatetheirchildshouldneverbethesolereasonthatDHSiseverinvolved,except
mandatoryrespondingtoanallegationofabuseorneglect.Asothershavestatedfalsecallsoccur,butifareporter
weretocallinbecauseachildisnotvaccinatedthatwouldlikelywarranta10dayresponseornoresponseatall
(centralDHSmaycloseitwithoutanyinvolvement).Unlessunvaccinatedisonlyasmallpartofalargerneglectand
abusecaseDHSwouldnotremovethechild.They,DHS,doesnothavetheresourcesnordotheywanttoseparate
families,especiallygoodfamilies.Aparentneednotbeagoodparent,butmustbeminimallyadequate.Minimally
adequateisaVERYlowbartomeetandsimplynotvaccinating,whennotcompoundedbyotherissues,wouldnot
causeusasparentstofallbellowthatthreshold.So,ifsomeoneweretocallDHSbecausemychildrenarenot
vaccinatedthatreportwouldeitherbeclosedbeforeDHScametomyresidence,ortheywouldshowup,see
everythingisok,andclosethereportasunfounded.
Thereareexceptions,butthoseexceptionsarefew.Ihaveheardofafewspecificallyfromonecountyinourstate,
buteventhosehaveneglectorabuseamountingtowaymorethannotvaccinating.So,whileIthinkwedoliveina
societyofhypersensitivity,simplynotvaccinatingcausesmezeroworryaboutDHSinvolvement.
Becausethestandardrequiredtoremoveachildrequiresproofofimmediatethreatofharm,notvaccinatingdoesnot

satisfythecriteriaandwouldnotcauseremoval.Ifremoved,thechild,absentmoreproofofneglect,wouldbe
returnedwithin24hoursattheshelterhearing(inourstateashelterhearingmustoccurwithin24hoursofachild
beingremoved).
Asfaraspoliceinvolvement:somecountiesoperatewithpoliceforeachinvestigation.ThatmeanstheDHS
employeecomingtoinvestigatewillhaveapoliceofficertheretoassistifneeded,butthepoliceofficerdoesnot
necessarillyhaveawarrantorreasonablesuspiciontoenter.OthertimesDHScomeswithoutpolice.TheDHS
employeeisaddressingthereportthatcameinandlookingtoseeifimminentorimmediateharmispresent.Absent
thattheyhavenogroundstoremovethechild.WhileIdonotprovidelegaladvice,onlyopinion,Iwouldnotbehostile
towardsDHSorthepolice.Bothhaveahardjobandneitheragencywantstotakecustodyunlesstheyhaveto.So,
unlessIhadcrackpipesinreachofmychildren,hadaneedlestickingoutofmyarm,orwaslivinginahoarder
house,Iwouldntreallyworryabouttheminvestigating.IfanythingIbelieveallowingthemtoinvestigateshowsyour
willingness,andofhavingnothingtohide.Ithinkweoftenbecomeoverlyvigilantinprotectingourrights,whichwe
arefreetodo,butsometimesexercisingthoserightssnowballsthesituation.Personally,Iwouldntcallalawyer
becauseifthey,DHS,camebecauseIchosenottovaccinatemykidsthereisnothingalawyercanreallytellthem
thatIcant.And,thatismoretimeforthingstoescalateandwilllikelyresultinthemhavingtoreturnanotherday
becausetheywerenotabletoproperlyaddressthesituationtoensurewhetheritshouldbeafoundedorunfounded
allegation.
MypersonalsuspicionsandanimosityofDHS,oranyothergovernmentagencyforthatmatter,hasnotbeen
validatedbymypositionworkingintherealmofdependencylaw.Ifanything,Ihavefoundthatmoreoftenthatnot
peoplewhoshouldnothaveaccesstotheirchildrenremainparents,DHSgoesaboveandbeyondofferingservicesto
tryandrehabilitatefamilies,andvaccinesarenotanissue.Thegrayareaofdependencylaw,thatbeingthecourts
attitudeandinabilitytoestablishmorebrightlinesofwhatsatisfiesneglect,aremoreproblematicthanDHS.But,that
couldchangetomorrowifoneofthose1inamillioncasescomesacrossmydesk.
Justmyhumbleopinion.And,sorryforturningthisintoanantivaccineissue,butthatiswhereIseealotofpeople
becomingmoreuneasy,butitisnotacauseofconcernthatIhavewitnessed,yet.

causeinmanyofthecases.Itsunfortunatethatgoodfamiliesgetdraggeddownbythis,butwhatconcernsmeis
howthefamiliesaredealingwiththestressasfarasthechildrenareconcerned.Youresupposedtobethesafetynet
foryourkids/grandkids,butmanyletthechildrenwitnessthestress,whichmightleadthechild/childrentothink
THEYcausedthetrouble.Somethingtothinkabout,howyouchoosetodealwithitdetermineshowachildwill.Inthe
caseofmyGoddaughter,hermotherdidntrealizethatheroutofcontrolbehaviorwashurtingherdaughter.Ittook
hergoingthroughthismessandhavingherdaughtertemporarilyremovedfromthehousetosnapheroutofthefog
shewasin.Seeinga6yearoldstresseatingatmidnight,barelysleeping,cryinginhersleepwhenshecouldsleep,
thatsnotgood.Itisntjustphysicalissuesthatgetreported,itsemotionalaswell,especiallyifachildisdisplaying
behaviorthatisntwhatisnormallyseen.Itssodifficultforbothsides,andIamnotdefendinganyoneside,butits
justnotsocutanddryasdontdothisorthat.Myadvicetofamiliesisthis:
1)Knowthelawsinyourstateandcounty.Eachisdifferent:exampleisNevadahasonesetoflawsbutClarkcounty
haslawsthatdifferenoughthatlivingthere,bothsetswereneeded.
2)Staytunedintoyourchildsactionsandbehavior.Regardlessofwhethertheyarehomeschooledornot,if
somethingiswrong,signswillshowupinbehavior,words,drawings,etc.Theremaybeanissuewithateacher,a
friend,afamilymember.Yesevenchildrencanhavetheseissues.
3)Dontbeafraidtoaskateacher,preacher,relative,whoevertowatchoutforconcerningbehavior.
4)Dontbeafraidtoaskforcounsellingservicesifneedbe.Overhalfofthecasesthroughworkwerebecausenoone
askedforhelpwhentheygotoverwhelmedandIfrequentlysawkidsnotbeingbathedindirtyclothesanditturnedout
thattherewasaterminalillnessinthefamilyandtheparentwastoostressedandthoughtsomeoneelsewasdoingit.
Manysocialworkerswanttohelp.Theyjustgoaboutitthewrongway.AndlikemyGoddaughtersmom,shewasnt

willingtoaskforhelpuntiltheworsthadhappened.
Therealityisthis:yescurrentsocietyishypersensitivetothetopicofabuse,withcaseslikeCaseyAnthony,itsnot
awonderastowhy.Justsomethingstothinkaboutfromtheperspectiveofaparent,teacher.OhandFYI:its
FederalLawthatrequiresteachersandmedicalprofessionalstoreportsuspectedabuse/neglect,itsnotapersonal
choice.Itsapartofourjobs.

ourhouseandmovedthefosterkids,whotheyhadintendedonlettingusadopt,andmovedthemtoanotherfoster
home.Wetookthemtocourt,andarestillfightingthem,eventhoughwewereawardedlegalcustodyofthekids.
Theyeventestifiedincourtthattherewasnoreasonforremovingthemandthatweweredoingawonderfuljobwith
thekids.Theywerespecialneedsalso.Theyendeduphavingaroughtimeinthenewfosterhome.Wearehoping

thatinthenextcoupleweeks,everythingwillbefinishedandwewillhavethechildrenback,andcpswillbeoutofour

Thatsagreatquestion.Idonthavealltheanswers,butIbelievedifferentstates,andevendifferentcounties,
couldhavedifferences.Also,somelocationshaveexcellentcaringstaffwhoarewillingtorespectandclear
parentswrongfullycharged.Thechallengeforparentsisknowingtheintention,character,andmotivesofthe
personwhocomestovisit.Ibelieveallparentsreadingthiswantthebestfortheirchildren.Thereisobviously
