EvidenceCodeSection776.Examinationofadversepartyorwitness
(a)Apartytotherecordofanycivilaction,orapersonidentifiedwithsuchaparty,
maybecalledandexaminedasifundercrossexaminationbyanyadversepartyatany
timeduringthepresentationofevidencebythepartycallingthewitness.
(b)Awitnessexaminedbyapartyunderthissectionmaybecrossexaminedbyall
otherpartiestotheactioninsuchorderasthecourtdirectsbut,subjecttosubdivision
(e),thewitnessmaybeexaminedonlyasifunderredirectexaminationby:
(1)Inthecaseofawitnesswhoisaparty,hisowncounselandcounselforapartywho
isnotadversetothewitness.
(2)Inthecaseofawitnesswhoisnotaparty,counselforthepartywithwhomthe
witnessisidentifiedandcounselforapartywhoisnotadversetothepartywithwhom
thewitnessisidentified.
(c)Forthepurposeofthissection,partiesrepresentedbythesamecounselaredeemed
tobeasingleparty.
(d)Forthepurposeofthissection,apersonisidentifiedwithapartyifheis:
(1)Apersonforwhoseimmediatebenefittheactionisprosecutedordefendedbythe
party.
(2)Adirector,officer,superintendent,member,agent,employee,ormanagingagentof
thepartyorofapersonspecifiedinparagraph(1),oranypublicemployeeofapublic
entitywhensuchpublicentityistheparty.
(3)Apersonwhowasinanyoftherelationshipsspecifiedinparagraph(2)atthetime
oftheactoromissiongivingrisetothecauseofaction.
(4)Apersonwhowasinanyoftherelationshipsspecifiedinparagraph(2)atthetime
heobtainedknowledgeofthematterconcerningwhichheissoughttobeexamined
underthissection.
(e)Paragraph(2)ofsubdivision(b)doesnotrequirecounselforthepartywithwhom
thewitnessisidentifiedandcounselforapartywhoisnotadversetothepartywith
whomthewitnessisidentifiedtoexaminethewitnessasifunderredirectexaminationif
thepartywhocalledthewitnessforexaminationunderthissection:
(1)Isalsoapersonidentifiedwiththesamepartywithwhomthewitnessisidentified.
(2)Isthepersonalrepresentative,heir,successor,orassigneeofapersonidentified
withthesamepartywithwhomthewitnessisidentified.
