SECTION 1: Legal Reasoning


Questions 1 to 4 have common set of principles as well as facts. Answer
them after applying these principles to the facts given.
Principle 1 Acts that are not expressly unlawful are lawful.
Principle 2 Acts include omissions as well.
Principle 3 Acts include a series of acts or omissions, and all such acts, if
similar, would constitute only one offence.
Principle 4 The Constitution of India has the sole power to declare an act
as unlawful.
Facts The Government of India bans all harmful liquids in an attempt to
curb the excessive consumption of liquor. To bring this ban into effect, a
constitutional amendment was brought in. What constituted a harmful
liquid was determined by the Government through its gazette that listed
numerous substances that could be considered to be harmful. Dr. Right, a
well-known toxicologist in India, published a report that stated that all of
Indias drinking water had high levels of chemicals in it. The municipalities
around India started implying that even drinking water shall now be banned
from consumption. The law enforcing authorities saw to it that people found
consuming water were charged and faced penalties.
1. Was the ban on drinking water as per the law?
a) No, water is essential and ours is a democratic state and we should be
free to consume what we like.
b) Yes, drinking water is harmful according to Dr. Rights report.
c) No, water hadnt been declared to be harmful.
d) Yes, drinking water has high levels of chemicals that are harmful and

Shamirpet, Aditya hits a student crossing the road who is severely
injured. The student Utkarsh sues Harshit.
a) Harshit will be liable as he is Adityas father.
b) Harshit will be liable as he is Adityas employer.
c) Only Aditya will be liable as he has injured Utkarsh.
d) It depends on the fact of whether Aditya was using the car for his
personal use or for a business meeting.
6. Principle If a dangerous thing is brought onto the land for non-natural
use of the land and this dangerous thing escapes, then the person who
brought it onto the land is strictly liable for any damage caused by this
dangerous thing.
Explanation If the act was done under statutory authority, strict liability
will not apply.
Facts Pavitra is a village situated at the Indo-Pak border and due to its
strategic location, it is often regarded as an area of strife. The Indian army
shifts its arsenal to the village and despite utmost care being taken, a
grenade drops out of the transport vehicle and an explosion occurs. A
villager Bajrangi is injured in the explosion. Bajrangi sues the Indian
Army.

agricultural lands. Agricultural lands of eight types are liable to be taxed
uniformly at a rate of 100 per acre. Some agricultural land owners claim
that this law is invalid as it fails to make a proper classification of
agricultural lands.

a) The principle given deals with right to uniform treatment and there
can be no claim for non-uniform treatment.

Facts Arvind gives property to his daughter Bindu on the condition that
Binda will give a portion of money to his (Arvinds) brother Chandu very
year. Bindu promises to Chandu that she will give him the sum yearly as
directed by her father. Arvind passes away after five years and when the
next payment to Chandu was due, Bindu refuses to give him the money.
Chandu sues Bindu for the money. Bindu claims that it was not a valid
agreement as no consideration was involved and hence, she is not liable
to pay anything to Chandu. Will Bindu be liable to pay him the amount?

a) No, the agreement had no consideration. Chandu did not give her
anything and hence, he cannot expect her to give him money without
any consideration.
b) Yes, Bindu might not have received property from Chandu but she did
so from Arvind in lieu of the promise she made to give Chandu money
every year.
c) No, Bindu is not liable. The property agreement was between Arvind

Principle 1 A person voluntarily causes an effect if he causes it by


intending to cause it or when while employing means to cause the effect, he
knew or had reason to believe that he would likely cause it.
Principle 2 Intended to means had a desire to cause.
Principle 3 Knowledge or reason means direct sensory perception of the
actual object/body causing the danger.
Facts Rahul, after being told by a classmate that Shashank suffers from a
knee dislocation and further damage to his knee would require him to
undergo an operation, jokingly trips Shashank after jutting his leg out while
the latter was passing by. Shashank fell on the ground and his knee got
further dislocated and he underwent an operation. Rahul was interrogated by
the police and it was found that he did not believe the classmate who had
told him about Shashanks condition. Further, Rahul believed that allopathic
diagnosis was a farce and that Shashanks condition was humbug.
9. Did Rahul voluntarily trip Shashank?
a) No, he was only jokingly tripped him.

because of that, I shall die. Ygritte replies, I dont care about you. Jon
Snow committed suicide after letting his direwolf on himself. Decide.

20.Principle Attempt to commit a crime is also a crime. It is punishable

accomplishment. Mere preparation is not a crime.

P1. In his third Independence Day address to the nation, Prime Minister
Narendra Modi was intent on coming across as an able doer, and not a mere
talker. Midway through his term, he was probably conscious that mere words

the desire to do right is at the critical moment, stronger within him that the
temptation. No, no, replies indeterminism, it is not that; he sometimes decides
against the stronger desire. Very well; can meaning what it does, tell us what
is the leaning or favourable disposition on the part of the ego, in a case of
undetermined willing toward the volition it adopts; what is that which
constitutes the egos initiative in that direction, - since it is not a wish? Shall we
say it is an approval or conscientious acceptance? Does this approval or
acceptance arise from the agents distinctive moral being? That is determinism,
quite as much as if you called the initiative a wish. But the indeterminist has
already answered in effect that there is no such initiative, or no effectual
initiative. The act of will causes the physical act but is not itself caused. This is
to deny the presence of power, according to its definition. How has it a meaning
to say in advance that I can will this way or that? The self, considering the
alternatives beforehand, is not in a position to say, if I feel thus about it, this
volition will take place, or if I feel otherwise, the contrary will take place; I
know very well how I shall feel, so I know how I shall will. The self now

existing has not control over the future free volition, since that may be
undetermined, nor will the selfs future feelings, whatever they may be, control

not I can at all. Nay, even looking backward, it is unable to say :I could have
willed otherwise, for that clearly implies, Had I been so disposed the other
volition would have taken place, which is just what cannot, according to
indeterminism, be said. Surely, to paraphrase a historic remark, our liberty
does not seem to be of very much use to us. The indeterminist is in a peculiarly
hapless position. The two things that he is most deeply mover to aver, that the
free volition is the act of the self and that the self can will one way or the other
these two things on his own theory fall utterly to pieces, and can only be
maintained on the view that he opposes.
The indeterminist conceives that according to determinism the self is carried
along by wishes to acts which it is thus necessitated to perform. This mode of
speaking distinguishes the self from the wishes and represents it as under their
dominion. This is the initial error. This is what leads the indeterminist wrong on
all the topics of his problem. And the error persists in the most recent writings.
In fact, the moral self is the wishing self. The wishes separate predilections to
be overborne by them; they themselves are its predilections. To fancy that
because the person acts according to them he is compelled, a slave, the victim of
a power from whose clutches he cannot extricate himself, is a confusion of
ideas, a mere slip of the mind. The answer that has ordinarily been given is
surely correct; all compulsion is causation, but not all causation is compulsion.
Seize a man and violently force him to do something, and he is compelled also
caused- to do it. But induce him to do it by giving him reasons and his doing it
is caused but not compelled.
