4. Conditions of membership:
4.1. You agree to the main rules
By making your monthly contribution to Vitality you accept that these rules and any
changes that we may make to the rules from time to time will apply to you and your
beneficiaries.
4.2. You agree to the benefit rules
You have the choice whether to use the Vitality benefits. If you choose to use them,
you are bound by the benefit rules and the business practices of the Vitality
programmes partners.

4.3. Who qualifies as a main member
To be a main member of Vitality, you must make a monthly payment (or consent to a
third party making the payment on your behalf) to Vitality for the Vitality programme
and be one of the following:
We may communicate any changes in your Vitality policy to you, including any
changes in your contributions or any changes/enhancements to the benefits you are
entitled to.
Discovery Vitality (Pty) Ltd and any entity within the Discovery Group as well as
contracted third party service providers will keep you updated on information about
any offers for new products Discovery may make available at any time. Please
contact us if you do not wish to receive any telephonic direct marketing from us.
You have the right to request a copy of the Personal Information we hold about
you. To do this, simply complete the Data Subject Request Form on
www.discovery.co.za and specify what information you would like. We will take all
reasonable steps to confirm your identity before providing details of your personal
information. Please note that any such Data Subject Request may be subject to a
payment of a legally allowable fee.
You have the right to contact and ask us to update, correct or delete your personal
information.
You agree that Discovery Ltd may transfer Your Personal Information outside the
borders of the Republic of South Africa if you provide an email address which is
hosted outside the borders of South Africa. We may also need to transfer your
personal information to another country for processing, storage or academic
research. We will ensure that anyone to whom we pass your personal information
agrees to treat your information with the same level of protection as we are obliged
to.
You agree that Discovery Ltd may retain Your Personal Information until such time
as you request us to destroy them (unless we are obliged by law to retain it,
regardless of such request) If Discovery Ltd becomes involved in a proposed or
actual merger, acquisition or any form of sale of some or all its assets, we may use
and disclose Your Personal Information to third parties in connection with the
evaluation of the transaction.
The surviving company, or the acquiring company in the case of a sale of assets,
would have access to Your Personal Information which would continue to be subject
to this Notice.
Discovery Vitality is also required to collect and retain information in terms of the
following legislation:
The Electronic Communications and Transactions Act (ECT)
The Financial Intelligence Centre Act (FICA)
The Financial Advisory and Intermediary Services Act (FAIS)
The National Credit Act (NCA)
The Consumer Protection Act (CPA); amongst others.
5. Fees
5.1. Monthly contribution you pay to Vitality
The monthly contribution will be calculated on the basis of the number of
beneficiaries on your Vitality membership.
For example, child dependants younger than 18 years may earn points only for
childrens activities that we have specified. We may change these specified childrens
activities at any time and will provide reasonable notice of such changes. In some
specified child activities, parents may earn points for the family membership on
behalf of the child.
In all other cases one person may not earn points for another person. See section
6.4: Transfer of rights to benefits or points.
If your child turns 18 before 1 October this year your Vitality points threshold will
increase for this year. However, if your child turns 18 between 1 October and 31
December your Vitality points threshold will only increase in January next year.
7.3. How many points members earn
The number of points you earn depends on factors such as:
The activity you are doing. See Summary of points benefit guide for details.
Your health goals and risk factors. We may adjust the number of points you
can earn for each activity depending on how important the activity is to your
health status.
7.4. Limits to the points you can earn
There are limits to how many points you can earn for activities and how many points
you can earn in each year for certain groups (or categories) or activities.
7.4.1. Limits for activities
Many of the activities have limits. See Summary of points benefit guide for details.
7.4.2. Maximum points per year: fitness points and bonus fitness points
There are limits to how many Vitality points you can earn through fitness-related
benefits. Fitness-related benefits include Virgin Active, Planet Fitness, Curves,
Run/Walk For Life, Handicaps Network Africa, Outdoor Sporting Events, parkrun,
accredited fitness facilities, devices, the Discovery app, the Vitality Fitness
Assessment or the Online Fitness Assessment and accessing the Vitality Points
Machine. The most important limits are:
A limit on fitness points. Members earn fitness points for using any of the
fitness-related benefits. The yearly limit is currently 15 000 for each main
member, spouse and dependant aged 18 years and older.
A limit on bonus fitness points. Members earn bonus fitness points for
healthy activities that we recommend. The yearly limit is 24 000 for each main
member, spouse and dependants aged 18 years and older.
Points will only be awarded for one fitness activity a day. If you complete two
fitness activities in one day, then the higher points between the two will be
awarded.
Child dependants under 16 years only earn fitness points for parkrun and
Outdoor sporting events as well as working out with a fitness device.
7.5. Impact on your status
From 2014 we will no longer carry-over points from year to year. The points will only
be valid in the calendar year you earn them. You will still carry over your Vitality
status from one year to the next.
7.6. Claiming points
If you earn points in one year and claim them in another, you have only three
months to claim your points. For example, if you earn the points on 1 December,
you must claim them by 1 March. If you do not claim the points within this period,
the points will not be awarded.

It takes up to four weeks for Vitality points to reflect on the above platforms.
8. Vitality status
8.1. The level of benefits sometimes depends on Vitality status
Some benefits depend on your Vitality status. If your Vitality status changes the rules
relating to the benefits may also change.
8.2. How Vitality status is worked out
8.2.1. Moving from one status to another
As a new member you will commence your membership on Blue Vitality status. The
more points you earn, the higher the status you will reach. The different levels are:
Blue, Bronze, Silver, Gold and Diamond Vitality status. To move up a status, you will
need to accumulate a sufficient number of points to reach the relevant status
threshold. See Summary of points benefit guide for details on how many points are
needed for each status.
8.2.2. Reaching Diamond Vitality status
If you have earned enough Vitality points to reach Gold Vitality status for three years
in a row, you will be awarded Diamond Vitality status in the following year (the
fourth year that you reach Gold Status). If you carry over Gold Vitality status into one
of the years but do not earn enough Vitality points to retain Gold Vitality status that
year, you will not qualify for Diamond Vitality status and the requirement to achieve
gold for three consecutive years will then apply again.
8.3. Vitality status is guaranteed for a set time only
Your Vitality status will remain in place from the time you earn the relevant Vitality
Status until the end of the following calendar year unless changes are made:
To your membership;
To the make-up of your membership. See point 9 below,
To the point structure of the Vitality status levels; or
You will also lose your Vitality status if you do not earn enough points to maintain it.
(See Summary of points benefit guide for details).
For example, if you reach Gold status in 2013, you will stay on Gold for the whole of
2014, during which time you must earn enough points to keep Gold status for 2015.
If you do not earn enough points to maintain Gold status, your Vitality status will
drop according to the number of points you may have earned.
9. Changing policies and having a break in membership
9.1. If your Vitality membership changes
As mentioned in point 8 above, any change to the structure of your Vitality
membership may affect your Vitality status. Changes to your Vitality membership
may occur if:
You add a spouse
You add a dependant
A child dependant becomes an adult dependant
A child dependant turns 18 years
You remove a dependant
You change a dependant to a member, or member to dependant
You change a member to spouse or adult dependant, or the other way
around.
Your Vitality status might be affected in the following way:
1. The Vitality status thresholds may fluctuate. The points needed to reach each
Vitality status will change depending on whether, as the main member, you
are an individual member or part of a membership with two or more adults.
2. Overall points for the membership may fluctuate. For example, if there is a
new dependant on the membership, the points (s)he earns in the calendar
year during which (s)he joined the membership are added to the membership
total. If a dependant leaves the membership, the points (s)he earns during
the calendar year are deducted from the total number of points earned by
the membership. Any adjustment is made on the date that the membership
is changed.
9.2. If you move to another Vitality membership
If you move to another Vitality membership without a break in membership of more
than a month, one or both of the following may occur:
1. The points you earn during the calendar year in which you move are added to
the membership total of the new membership. These points will be added to
the new membership on the date that you join the new membership.
2. If you become the main member on the new Vitality membership you will
carry the Vitality status you earned on the previous Vitality membership to
the new Vitality membership.
9.3. If you have a break in membership
A break in membership occurs when a person is not a member of Vitality for a
period of time.
If you have a break in membership of more than one month, the number of points
allocated to the new membership will be zero (irrespective of whether the points
were earned in the same calendar year).
If you have a break in membership of less than one month, the memberships
Vitality status will remain the same as it was before the break (unless there was a
change to the membership).
9.4. Vitality points and status when moving to a brand new policy in the third
year on Gold Vitality status
The points earned by the specific person (entity moving to the new policy) in the
current year will be moved to the new policy. The same Vitality status on the old
policy will also be carried across to the new policy unless the total points on the new
policy qualify for a higher status. A Points Transfer and Status Query will need to be
logged for the points and status to be transferred to the new membership.
Example:
1. Main member (PP), spouse (SP) and adult dependant (AD) are all on one Vitality
membership. They have been on Gold status for three consecutive years, with a
total of 120 000 points. PP has 45 000 points, SP has 35 000 and AD as 40 000.
2. The adult dependant leaves the membership to start a new membership from 1 July;
and will take the points as well as the Gold status* to the new membership.
3. From 1 July 2013, the adult dependant will be on an own membership, on Gold
status with 40 000 points and the threshold will be for a single member. i.e. 45 000
points needed to be on Gold status.
4. From 1 July 2013 the main member and spouse will remain on the Gold status (if this
is the carry-over status) with 75 000 points and their threshold will adjust to main
member plus one adult (90 000 points). To stay on Gold status, if it was earned in
the current year, log a Points Transfer and Status inquiry for a status override on the
old policy*. The member has to contact us to do this.
5. For members on both these memberships (old and new) to move to Diamond status
the required points for Gold status must be earned by 31 December of the current
year. If they do not earn enough points to stay on Gold status, their Vitality statuses
will change.
*A status override is effective until the end of the current year. If a member earned
points in the remainder of the year, the status override will need to be removed to
move to the higher status. A Points Transfer and Status Query inquiry will need to be
logged for this. The member has to contact us.
10. Changes to the rules
We may change these rules and the benefit rules from time to time. Generally,
changes take effect from 1 January, although we occasionally implement changes to
the rules during the calendar year. We will give you advance notice of any intended
changes to benefits and fees within a reasonable time. If we are terminating a
benefit altogether we will provide you with reasonable notice.
Any changes to these rules will be approved by the Vitality Executive Committee.
11. Ending the membership or benefits
11.1. When membership or benefits terminate
11.1.1. If you no longer qualify
We will terminate your membership if you no longer qualify for a Vitality
membership. (See section 4.3: Who qualifies as a Vitality member)
11.1.2. If we do not receive payment
We will terminate your membership if you do not pay the full monthly contribution
fee to Vitality.
11.1.3. If we believe there is inappropriate or fraudulent use
We will terminate any right you have in the Vitality programme if we believe that you
are abusing the benefits or privileges of the programme. We may terminate your
membership should you breach any of our rules.
11.1.4. For employees of a policyholder of a LIFE PLAN
We will terminate your membership if your employer, as a policy holder of a
Discovery Life Group Life Plan fails to retain the required number of policy holders
