NOTIFICATION

No.PAP-Legis-2(69)/2011/375. The Punjab Land Revenue (Amendment) Bill 2011, having been passed by the Provincial Assembly of the Punjab on 31 March 2011, and assented to by the Governor of the Punjab on 9 April 2011, is hereby published as an Act of the Provincial Assembly of the Punjab.

THE PUNJAB LAND REVENUE (AMENDMENT) ACT 2011

further to amend the Punjab Land Revenue Act, 1967.

Preamble.– Whereas it is expedient further to amend the Punjab Land Revenue Act, 1967 (XVII of 1967), for purposes hereinafter appearing; It is enacted as follows:-

1. Short title and commencement.–(1) This Act may be cited as the Punjab Land Revenue

(Amendment) Act 2011.

(2) It shall come into force on such date as the Government may, by notification in the official Gazette, specify.

2. Substitution of section 5 of Act XVII of 1967.–In the Punjab Land Revenue Act, 1967

(XVII of 1967), hereinafter called the said Act, for section 5, the following shall be substituted:

5. Province to be divided into Divisions and Districts.– (1) The Government may, by notification, create Divisions in the Province. (2) A Division shall consist of two or more Districts as may be specified by the Government. (3) The Government may, by notification, declare as many Districts in the Province, with such limits and such areas, as it deems appropriate. (4) The Government may, by notification, vary the number or limits of a Division or a District.”

3. Substitution of section 6 of Act XVII of 1967.–In the said Act, for section 6, the following

shall be substituted:-

6. Districts be divided into Sub-Divisions.– (1) The Government may, by notification, divide a District into Sub-Divisions or Tehsils. (2) A Sub-Division may consist of one or more Tehsils, and the Government may, by notification, specify the territorial limits of a Sub-Division. (3) The Government may, by notification, vary the number or limits of Sub-Divisions or Tehsils.”

4. Substitution of section 7 of Act XVII of 1967.–In the said Act, for section 7, the following

shall be substituted:-

Classes of Revenue Officers.– There shall be the following classes of Revenue

Officers:-

(a)

Board of Revenue;

(b)

Commissioner;

(c)

Collector;

(d)

Assistant Commissioner;

(e)

Assistant Collector of the first grade; and

(f)

Assistant Collector of the second grade.”

5. Substitution of section 8 of Act XVII of 1967.–In the said Act, for section 8, the following

shall be substituted:-

8. Appointment of Commissioners and Collectors.– The Government shall appoint a Commissioner of a Division and a Collector of a District.”

6. Substitution of section 9 of Act XVII of 1967.–In the said Act, for section 9, the following

shall be substituted:-

9. Additional Commissioners and Additional Collectors.– (1) The Government may appoint an Additional Commissioner of a Division, who shall, subject to the general control of the Commissioner, exercise any of the powers and discharge any of the duties conferred or imposed on the Commissioner.

(2) The Government may appoint an Additional Collector of a District, who shall, subject to the general control of the Collector, exercise any of the powers and discharge any of the duties conferred or imposed on the Collector.”

7. Substitution of section 10 of Act XVII of 1967.–In the said Act, for section 10, the

following shall be substituted:-

10. Assistant Commissioners and Assistant Collectors.– (1) The Government may appoint in a District as many Assistant Commissioners and Assistant Collectors of the first and second grade as it may deem expedient.

(2) The Government may place the revenue administration of a Sub-Division in the charge of an Assistant Commissioner and confer any of the powers of the Collector on such officer under sub-section (1) of section 16.

(3) The Government may confer any of the powers of the Collector on an Assistant Collector of the first grade under sub-section (1) of section 16.

(4) In case any of the powers of a Collector are conferred on an Assistant Commissioner or an Assistant Collector, he shall exercise such powers subject to the control of the Collector of the District.”

8. Substitution of section 11 of Act XVII of 1967.–In the said Act, for section 11, the

following shall be substituted:-

11. Tehsildars.– (1) The chief officer entrusted with the local revenue administration of a Tehsil shall be called the Tehsildar.

(2) A Tehsildar shall exercise such powers and discharge such duties of any Assistant Collector as may be conferred by or under this Act.”

9. Amendment of section 13 of Act XVII of 1967.–In the said Act, in section 13, for sub-

sections (3) and (4), the following shall be substituted:-

“(3) Subject to the general control of the Board of Revenue, a Commissioner shall control all other Revenue Officers in the Division.

(4) Subject to the general control of the Board of Revenue and the Commissioner, the Collector of the District shall exercise control over the Revenue Officers in the District.”

10. Amendment of section 14 of Act XVII of 1967.–In the said Act, in section 14, in sub-

section (2) and sub-section (3), for the words “an Executive District Officer (Revenue)”, and the words “the Executive District Officer (Revenue), wherever occur, the words “a Commissioner” and the words “the Commissioner” shall respectively be substituted;

11. Amendment of section 16 of Act XVII of 1967.–In the said Act, in section 16–

(1)

in sub-section (1), for the words and brackets “an Executive District Officer

(2)

(Revenue)”, the words “a Commissioner” shall be substituted; and in sub-section (3), for the words and brackets “Executive District Officer (Revenue)”, the word “Commissioner” shall be substituted.

12. Amendment of section 60, 63, 69, 84, 89, 92, 101, 102, 103, 104, 107, 108, 123 and 162

of Act XVII of 1967.– In the said Act, in sections 60, 63, 69, 84, 89, 92, 101, 102, 103, 104, 107, 108, 123 and 162, for the words “Executive District Officer (Revenue)”, wherever occur, the word “Commissioner” shall be substituted;

13. Amendment of section 161 of Act XVII of 1967.– In the said Act, in section 161, in sub-

section (1)–

(1)

in clause (b), for the words and brackets “Executive District Officer (Revenue)”, the word “Commissioner” shall be substituted; and

(2)

in clause (c)–

 

(i)

for the words and brackets “an Executive District Officer (Revenue)”, the words “a Commissioner” shall be substituted; and

(ii)

in proviso (ii), for the words “Executive District Officer (Revenue)” the word “Commissioner” shall be substituted.

14. Amendment of section 163 of Act XVII of 1967.– In the said Act, in section 163–

(1)

in sub-section (1), for the words and brackets “An Executive District Officer (Revenue)” the words “A Commissioner” shall be substituted; and

(2)

in sub-section (2)–

(i)

for the words “an Executive District Officer (Revenue)” the words “a Commissioner” shall be substituted;

(ii)

for the words and brackets “the Executive District Officer (Revenue)”, the words “the Commissioner” shall be substituted; and

(iii)

in the proviso, for the words “Executive District Officer (Revenue)”, wherever occur, the word “Commissioner” shall be substituted; and

15. Amendment of section 164 of Act XVII of 1967.– In the said Act, in section 164–

(1)

in sub-section (2), for the words and brackets “An Executive District Officer

(2)

(Revenue)”, the words “A Commissioner” shall be substituted; in sub-section (3), for the words and brackets “Executive District Officer (Revenue)”,

(3)

the word “Commissioner” shall be substituted; and in sub-section (4), for the words and brackets “an Executive District Officer (Revenue)” the words “a Commissioner” shall be substituted.
