    InalandmarkdecisionofsortsinthecaseSarbajitRoyvsDERC,theCentralInformation
    Commission,reaffirmedthatprivatizedpublicutilityauthoritiesalsofallwellwithintheambit
    oftheAct,andareobligatedtodisclosureofinformationasrequestedbythecitizen.This
    meansthatprivatebodieswhichperformapublicfunctionwillcomeundertheRTIAct.
    Secondly,Section2(f)definesinformationasanymaterialinanyform,includingrecords,
    documents,memos,emails,opinions,advices,pressreleases,circulars,orders,logbooks,
    contracts,reports,papers,samples,models,datamaterialheldinanyelectronicformand
    informationrelatingtoanyprivatebodywhichcanbeaccessedbyapublicauthorityunder
    anyotherlawforthetimebeinginforce.

    HRD.IftheministryofHRDcanaccessinformationrelatedtosaythequalificationsofthe
    teachersinthatcollege,evenyoucangettheinformationundertheRTIAct!rtiforprivate

    How to get this information?


    Fallingunderthepurviewofprivateentitiesaremainlyprivateschools,colleges,coop
    societies/banks,privatesectorbanksandinsurancecompanies,public/privatetrusts,private
    serviceprovidersandpubliclimitedcompanies.
    Firststepisforthecitizenrequiringtheinformationtodohisresearchandfindoutthe
    governmentdepartmentunderwhichtheparticularprivatebodyisregistered.
    ThewebsiteoftheDepartmentwillprovidetothecitizenthePublicInformationOfficer
    (PIO)whohastobecontacted.ThecontactdetailsoftheconcernedPIOwillbeavailable
    onthewebsite.
    Thestepsfollowingthisaresimilarinproceduretothosethathavetobefollowedincaseofa
    normalRTIApplicationfiledtoapublicauthority.
    TheApplicationhastobefiledasperthefeesandtheformatprescribedbythatGovernment
    (CentralorState).TheFeedetailshavetobeaccompaniedbythemodeofpaymentand
    postalordernumbersoranyothersuchimperativedetailsasmayberequired.The
    informationrequiredwillbefurnishedbytheconcernedPIO,asGovernmentdepartmentscan
    summoninformationfromprivatebodiesundervariouslawsofthestate.
    ItmustalsobenotedbyApplicantsthattheinformationbarredfromdisclosureunderSection
    8and9oftheRTIActcannotbeobtainedunderthisSectioneither.
