WARRANT

FOR THE SPECIAL TOWN MEETING


JUNE 22, 2010
TOWN OF AQUINNAH
COMMONWEALTH OF MASSACHUSETTS

County of Dukes County, ss


To either of the Constables of the Town of Aquinnah:

GREETINGS:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify
and warn the inhabitants of the Town of Aquinnah who are qualified to vote in elections
and town affairs to meet at the Aquinnah Old Town Hall in said Town on the Twenty-
second day of June 2010, at 7:00 PM, then and there to act upon the articles of this
Warrant.

ARTICLE ONE
Planning Board

To see if the Town will vote to update the Aquinnah Zoning Bylaw accordingly, as
required by the Federal Emergency Management Agency, to replace Sec. 10.2-1 and
Sec.10.2-1A with the following language and to re-label Sec. 10.2-1B as Sec.10.2-1A:

10.2-1 Purpose
The Town of Aquinnah, recognizing the dangers inherent upon coastal
flooding at times of hurricanes or severe storms and as a means of protecting
its citizens and their property, hereby establishes a series of Flood Plain
Overlay Districts and Zoning Regulations for construction of structures and
for the use of the land within these districts. Such districts are defined and
include all special flood hazard areas within the Town of Aquinnah designated
as Zone AE or VE on the Dukes County Flood Insurance Rate Map (FIRM)
issued by the Federal Emergency Management Agency (FEMA) for the
administration of the National Flood Insurance Program. The map panels of
the Dukes County FIRM that are wholly or partially within the Town of
Aquinnah are panel numbers 25007C0152H, 25007C0154H, 25007C0156H,
25007C0157H, 25007C0158H, 25007C0159H and 25007C0166H dated July 6,
2010. The exact boundaries of the District may be defined by the 100-year
base flood elevations shown on the FIRM and further defined by the Dukes
County Flood Insurance Study (FIS) report dated July 6, 2010. The FIRM and
FIS report are incorporated herein by reference and are on file with the Town
Clerk, and Building Inspector, and Planning Board.
Two-thirds vote required for passage.

ARTICLE TWO
Board of Selectmen

To see if the town will vote to amend the Personnel Bylaw Section 1-5 (c) to read:
Full time employee shall mean an employee working 30 (thirty) or more hours per
week for 52 (fifty-two) weeks a year, minus authorized leaves provided for in these
Personnel Bylaws.

Note: These amendments will affect only employees hired after June 30, 2010.

ARTICLE THREE
Board of Selectmen

To see if the Town will vote to amend the Personnel Bylaw Section 1-5 (d) to read:
Part time employee shall mean an employee working less than 30 (thirty) hours per
week for 52 (fifty-two) weeks a year.
Two-thirds vote required for passage.

Note: These amendments will affect only employees hired after June 30, 2010.

ARTICLE FOUR
Board of Selectmen

To see if the Town will vote to amend the Personnel Bylaw Section 8.3 (a) by adding the
following:

Except full time employees who work a regular schedule less than 5 (five) days per week
will be paid on a prorated (5 day) basis for the purpose of calculating holiday benefits.
Arrangements must be made with the employees supervisor to schedule compensatory
substitute holidays and must be used during the same fiscal year.
Two-thirds vote required for passage.

ARTICLE FIVE
Board of Selectmen

To see if the Town will vote to raise and appropriate the sum of $12,628 (Twelve
thousand six hundred twenty-eight dollars) to be added to the Fiscal Year 11 Town
Operating Budget, Treasurers Salary Line, or take any other action relative thereto.

ARTICLE SIX
Board of Selectmen

To see if the Town will vote to transfer from free cash the sum of $2,500 (Two thousand
five hundred dollars) to be added to the Fiscal Year 11 Town Operating Budget, Tax
Collectors Wage Line, or take any other action relative thereto.

ARTICLE SEVEN
Police Department

To see if the Town will vote to transfer from free cash the sum of $5,448 (Five thousand
four hundred forty-eight dollars) to purchase a new rescue trailer for the police
emergency all-terrain vehicle, or take any other action relative thereto.

And you are hereby directed to serve this warrant by posting up attested copies at the
Schoolhouse Library and Town Hall in said Town, at least fourteen days prior to time of
said meeting. Hereof, fail not, and make due return of this warrant with your doings
thereon to the Town Clerk at the time and place of said meeting.

Given under our hands this seventh day of June in the year of our Lord Two Thousand
