DAY, } Defendant, ‘The Defendant is accused by the Grand Jury of the County of Marion and the State of Oregon, by this indictment of the criminal offenses of: Count | - ORS 166.270 FELON IN POSSESSION OF A FIREARM (C Felony) Count 2- ORS 162.415 OFFICIAL MISCONDUCT IN THE FIRST DEGREE (A Misdemeanor) Count 3~ORS 166.270 FELONY IN POSSESSION OF A FIREARM (C Felony) Count 4 ORS 162.415 OFFICIAL MISCONDUCT IN THE FIRST DEGREE (A Misdemeanor) committed as follows: Count 1 - On or between November 18 ~ December 31, 2013, the defendant, with the intent to facilitate the commission of the crime of Felon in Possession of a Firearm, did unlawfully aid and abet the unlawful possession and control of a firearm by Brian Shehan, who previously had been convicted of a felony. The State further alleges that the defendant was a public officer and employee from November 1, 2013 - ‘November 1, 2016, and the offense is based on misconduct in office. Count 2 - As part of the same act or transaction as alleged in COUNT 1, on or about November 18 ~ December 31, 2013, the defendant, being a public servant, did unlawfully and knowingly perform an act which constituted an unauthorized exercise of his official duties, with intent to obtain a benefit. The State further alleges that the defendant was a public officer and employee from November 1, 2013 - November 1, 2016, and the offense is based on misconduct in office. Count 3 - In an act of same or similar character as alleged in COUNT 1 and part of a common scheme or plan as alleged in COUNT 1 and COUNT 2, on or between January 1 - January 12, 2014, the defendant, With the intent to facilitate the commission of the crime of Felon in Possession of a Firearm, did unlawfully aid and abet the unlawful possession and control of a firearm by Brian Shehan, who previously had been convicted of a felony.
