orgrossnegligence,orthecorruptorpersistentviolationofthelawordisregardofwellknown
legalrules.
Theactsofmisrepresentinghimselftobeauthorizedtoenterintoacontractoflease,andeven
receivingthebenefitsofthesaidcontractconstitutegrossmisconduct.Therefore,thelawyercan
befoundliable.

Question:Ms.CorazonNevadadeliveredtoAtty.Casugapiecesofjewelriesworthmorethan
P300,000.00inthecourseofherdealingswithhim.Sheaskedhimtosellthemonherbehalf.
However,despiterepeateddemands,Atty.CasugafailedtodeliverbacktoMs.Nevadathe
jewelriesortheproceedsofthesale.
CanMs.NevadafileadisbarmentcaseagainstherAtty.Casugaevenifthereisnolawyerclient
relationshipbetweenthem?
Answer:Yes.Rule16.03oftheCPRdemandsthatalawyershallholdintrustallmoneysand
propertiesofhisclientthatmaycomeintohispossession.Thelawyerwasdutyboundtoreturn
them upon demand. The absence of a lawyerclient relationship between Atty. Casuga and
Corazon does not exonerate the former. Both the CPR and case law penalize not only
malpracticeanddishonestyintheprofession,butalsogrossmisconductnotconnectedwiththe
professionaldutiesofthelawyer.
Therefore,Atty.Casugacanbeheldaccountableforbreachofhisfiduciaryduty.

Answer:Yes.Lawyersmustatalltimesfaithfullyperformtheirdutiestosociety,tothebar,to
thecourtsandtotheirclients.Thefactthatthelawyerobtainedtheloanandissuedtheworthless
checksinherprivatecapacityandnotasanattorneyofthecomplainantisofnomoment.
Therefore,forissuingworthlesschecks,thelawyermaybeheldadministrativelyaccountable.

Question:Canalawyerborrowmoneyfromhisclientwithoutcrossingethicalboundaries?
Answer:No.Asageneralrule,alawyershouldnotborrowmoneyfromhisclient.Canon16.04
oftheCPRprovidesthatalawyershallnotborrowmoneyfromhisclientunlesstheclients
interestsarefullyprotectedbythenatureofthecaseorbyindependentadvice.

Answer:Yes.Adisbarmentcaseissuigenerisinnature.Thus,adisbarmentcasecanproceed
simultaneouslywiththecriminalcaseinstitutedagainstthelawyer.Tosustainaconvictionina
criminal case, the prosecution must establish his guilt beyond reasonable doubt while in a
disbarmentcase,onlypreponderanceofevidenceisrequired.

its interest, Sps. Amador asked Atty. Palaa to settle his obligation. The demands remain
unheeded. Can Atty. Palaa be held administratively liable for not settling his loan despite
persistentdemandfromthecreditorspouses?
Answer:Yes.Thecomplainantscouldnothavebeendefraudedwithouttherepresentationsof

Answer:Yes.TheCourtsaidthatitmustberememberedthataretainedcounselisexpectedto

Therefore, he is guilty of violating his fiduciary duty. Fiduciary duty includes the task of

Reason:Alawyerisfirstandforemostanofficerofthecourt.Assuch,heisexpectedtorespect
thecourtsorderandprocesses.Hemiserablyfellshortofhisdutiesassuchofficer.Hetrifled
withthewritofattachmentthecourtissued.Hewasremissinhisobligationoftakinggoodcare
oftheattachedcars.HealsoallowedtheuseoftheNissanSentracarbypersonswhohadno
businessusingit.Hedidnotinformthecourtoratleastthesheriffofthedestructionofthe

neglectofdutyisalessgrave.Section53ofthesameRulesallowsthediscipliningauthorityto
considermitigatingcircumstancesinfavoroftherespondent.Thecourtconsideredhislengthof
serviceintheJudiciary,acknowledgmentofinfractions,remorseandotherfamily
circumstances,amongothers,indeterminingtheproperpenalty.Hewasalsofoundtobe
