SwinderjitSinghrelatestopromotionbyLDCEwhereasthecaseofNaveenSharmapertainsto
promotiononthebasisofsenioritycumfitness.Videnotificationdated13.11.2014(AnnexureA1)
applicationswereinvitedforpromotionbyLDCEforvacanciesoftheyears201011,201112,2012
13and201314.However,videnotificationdated20.4.2015(AnnexureA2),LDCEwaslimitedto
vacanciesfortheyear201011.PostswerereservedforScheduledCastes(SCs)andScheduled

InthecaseofNaveenSharma,processforpromotiononthebasisofsenioritycumfitness
hasbeeninitiatedvidelettersdated10.2.2015(AnnexureA2)and15.7.201
5(AnnexureA3)
makingreservationinpromotion.ThesameareunderchallengeintheinstantO.A.withreliefof
consequentialdirections.

Officialrespondentsintheirwrittenstatementdefendedreservationinpromotionby
pleadingthatthereisshortfallofSCsandSTsCandidatesinthecadreofSDE(T)aspersummary
(AnnexureR1).ItisalsopleadedthattheO.A.isbadbecauseSC/STcategoriespersonshavenot
beenimpleaded.ReservationhasbeendefendedonthebasisofO.MsissuedbyDoPT.

Privaterespondentsno.7to9intheirwrittenstatementmainlyadvancedtheirgrievance
againstinterimorderissuedintheO.A.whichisharmingtheirinterestofpromotiononthebasis
ofLDCE.However,otherwisetheyhavealsoassailedreservationinpromotion.

Applicantsintheirreplicationcontrovertedthestandofprivaterespondentsand
reiteratedtheirownversion.

Wehaveheardcounselforthepartiesandperusedthecasefile.

Counselfortheapplicantsrelyingonjudgmentsinthecasesof
M.Nagraj(supra),Suraj
BhanMeena(supra),LachhmiNarayanGupta(supra)andalsoOrderdated08.09.2016ofthis

contendedthat
therecanbenoreservationinpromotionbecausetherespondentshavenotcollectedidentifiable
dataregardingbackwardnessoftheclassesandinadequacyoftheirrepresentationinpublic
employment.ItwasalsopointedoutthatSC/STWelfareAssociationofBSNLandOrs.hadfiledO.A.
No.392/JK/2010seekingremovalofshortfall/backlogofvacanciesforreservedcategories.
Respondents(BSNL)tookstandthereinthatO.M.dated10.8.2010hadbeenquashedbyHighCourtin
LachhmiNarayanGupta(supra)and,therefore,therespondentsweredisabledfromtakingstepsto
removetheshortfallinvacanciesforreservedcategories.Inviewthereof,thesaidO.A.was
withdrawnbytheapplicantswithlibertytofilefreshoneifneedbe.

Ontheotherhand,counselforrespondentsrelyingonjudgmentofHon
bleSupremeCourtin
2014(3)SCT618
RohtasBhankharandOrs.VS.UnionofIndiaandAnother
contendedthatlower
standardcanbeprescribedforreservedcategories.Referringtosummary(AnnexureR1),itwas
alsocontendedthatthereisinadequacyofrepresentationofreservedcategoriesinthecadreof
SDE(T).ItwasalsoreiteratedthatSC/STcategoriescandidateshavenotbeenimpleadedasparty
andtheO.A.is,therefore,bad.
12.
Counselfortheapplicantsrebuttedthatsincethereischallengetopolicyofreservation
inpromotion,itwasnotnecessarytoimpleadcandidatesofSC/STcategories.Moreover,theO.A.
wasfiledevenpriortoholdingoftheexaminationand,therefore,therewerenoidentifiable
candidatesofSC/STcategorieswhocouldbeimpleadedaspartytotheO.A.Itwasalsopointed
outthatsummary(AnnexureR1)relatestothevacancypositionason1.1.2015whereastheLDCE
inquestionheldon21.6.2015wasforvacanciesof201011forwhichnodatahasbeenplacedon
record.

Wehavecarefullyconsideredthematter.Itwasnotnecessarytoimpleadthecandidatesof
SC/STcategoriesaspartytotheO.A.becausetheO.A.wasfiledevenbeforetheexaminationwas
heldand,therefore,candidatesofthosecategorieswerenotidentifiableatthattime.Moreover,
thechallengeistopolicyofofficialrespondentsregardingreservationinpromotionandforthis
reasonalso,itwasnotessentialtoimpleadthecandidatesofthereservedcategoriesaspartyto
theO.A.Accordinglyobjectionofofficialrespondentstothiseffectisoverruled.
14.
Asregardsmerit,theapplicantsareentitledtosucceedinviewofjudgmentsinthecases
ofM.Nagraj(supra),SurajBhanMeena(Supra),LachhmiNarayanGupta(supra),RajeshShukla&
Another(supra),SukhwinderSingh(supra)andNarenderSingh(supra).Accordingtothese
judgments,therecanbenoreservationinpromotionwithoutcollectingquantifiabledataof
backwardnessofthereservedclassesandinadequacyoftheirrepresentationinpublicemployment.
Nosuchdatahas,however,beencollectedbytheofficialrespondents.Consequently,the

respondentscannotgrantreservationinpromotion.
15.
ContentionofrespondentsbasedonsummaryofvacanciesasgiveninAnnexureR1cannot
beaccepted.Firstlythesaidsummaryrelatestothepositionason1.1.2015andnotoftheyear
201011forwhichLDCEwasheldon21.6.2015.Secondlyevenaccordingtosaidsummary,ST
candidateswereoverrepresentedinthequotaofpromotiononthebasisofsenioritycumfitness
whereasSCcandidateswererepresentedalmostaccordingtotheirquota.Inthequotaofpromotion
byLDCE,ofcourse,therewasshortfallinbothreservedcategories.However,thereservationin
promotioncannotbepermittedmerelyonthebasisofshortfallinvacanciesofonecategoryorone
cadreofonedepartmentoroneentityorunitonly.Itwouldbecompletelyagainsttheletter,
spirit,purportandintentofM.Nagraj(Supra).Quantifiabledataregardingpublicemploymenthas
tobecollectedasperdictumofHon
bleSupremeCourtinM.Nagrag(Supra),butithasnotbeenso
done.BSNLisfollowingO.MsofDoPTandadmittedlyDoPThasnotcarriedoutanyexerciseto
collectidentifiabledataintermsofMNagraj(supra).EvenBSNLhasnotdoneso.Forthis
reason,BSNLsubmittedinthecaseofSC/STWelfareAssociation(supra)thattheyweredisabled
fromtakingstepstoremovetheshortfallinvacanciesofreservedcategories.However,official
respondentshavenowtakenUturnintheinstantcase.Thiscannotbepermitted.
Accordinglyweconcludethattherecanbenoreservationinpromotion.Actionoftherespondents
tothecontrarycannotbesustained.
16.
AccordinglyboththeO.As.areallowed.Notificationsdated13.11.2014(AnnexureA1)and
20.4.2015AnnexureA2)inthecaseofSwinderjitSingh&Ors.andlettersdated10.2.2015
(AnnexureA2)and15.7.2015(AnnexureA3)inthecaseNaveenSharma&Ors.arequashedtothe
extentofpermittingreservationinpromotiontothepostofSDE(T)byLDCEandonthebasisof
senioritycumfitnessrespectively.Respondentsaredirectednottoapplyreservationinpromotion
byLDCEoronthebasisofsenioritycumfitness.Respondentsarefurtherdirectedtomake
promotiononthebasisofresultofLDCEheldon21.6.2015andalsoanyotherLDCEwithout
applyingreservationinpromotionandalsotocarrypromotioninthequotaofsenioritycum
fitnesswithoutapplyingreservationinpromotion.Thisexercisebecompletedwithinthreemonths
fromthereceiptofcertifiedcopyofthisorder.Nocosts.M.A.No.060/01142/2015forvacation
ofstayisaccordinglydisposedofasinfructuous.
