This is to draw your kind and humble attention to the fact that even
after submission of Report on the CRC in respect of Cadre Restructuring of
Administrative Cadre of AIR & OD to the PH in the month of July 2015 itself
oy the constituent Committee headed by Shri Shyamal k. Sarkar, it is learnt
that the same has not yet been placed before the PB Board for its further
approval. This procrastination on the part of PB has been resulting into
state of stalemate since final decision is to be taken by the Ministry/DOPRT.
It is further most relevant to point out here is that the aforesaid
prolonged/undue pendency at the level of PB is a flagrant violation of the
time frame so prescribed, in this regard, by the DOP&T, New Delhi vide OMNo. AB.14017/37/2009-Estt. (RR) dated 8" October 2010 (copy enclosed]
vis
a-vis the Prasar Bharati (Broadcasting Corporation of India) Act 1990, It is
admitted fact that the Administrative Cadre of AIR/DD is still governed U/S
11(3) of the PB (BCI) Amendment Act 2011.
Under the foregoing factual matrix, we are humbly requesting you to
issue suitable direction for efficacious disposal of the pending issue in the
matter under reference so that the matter is further pushed up towards its
finality.

Subject: Time limit for framing of Rules and Regulations on conversion of
Government Department into PSUs/autonomous/statutory body
The undersigned is directed to refer to the above subject and to state that
the instructions on matters relating to regulation of service conditions of
Government employees on transfer to autonomous organizations have been
issued by the Department of Pension and Pensioners’ Welfare. The provisions
included in the relevant portion of Rule 37 (A) of the Central Civil Service
(Pension) Rules, 1972 refers.
2. This Department has examined issues pertaining to service conditions,
Ppromotion/confirmation, etc. in respect of the deemed depuiationists on a
reference received from the concemed administrative Ministries. It has been
decided that in such cases where there is a conversion of a Government
Department into PSUs/autonomous/statutory body, there must be a time frame
within which a new body shall frame its rules and regulations, At the end of
this period, all employees on deemed deputation should have opted cither to get
permanently absorbed in the new organization ot revert to the Goverment. A
maximum period of 5 years for framing of rules and another 2 years for phasing
oul repatriation to those opting to come back to Government has been
prescribed. All the Ministries/Departments are accordingly advised to adhere to
the time frame whenever a proposal for transfer of employees is considered as
above.
