Dear Mr. Swearingen,
As you know, on June 11th, 2014, I was involved and injured in an automotive
collision cause by your insured. The damages resulting from the collision include
medical and chiropractic and massage bills, out-of-pocket expenses, time, and pain
and suffering.
STATEMENT OF FACTS
On June 11th, 2014, at approximately 2:45pm, Scott Stavig, David Kravitz and I
were heading west bound on 199th St, traveling at an approximate speed of 45
mph, following all traffic and legal guidelines of the road. As we neared the
intersection of 199th St and 167th Ave, we noticed your insured drivers PT cruiser
entering the intersection. With no time to react or slow down our speed of 45mph,
we watched as the PT cruiser struck the drivers side of our car, pushing us into the
bank and causing the car to flip into the air, according to a bystander. Luckily our
car came to a stop right side up in the ditch and we were all three able to climb out
on our own. (Pictures and police report with diagram attached). First responders
showed up to the scene in what seemed like no time due to the fact that I had been
knocked unconscious for a period of time during the collision. In the police report,
your insured driver admitted he did not see V2 when he began driving north on
167th Ave, proving that his full attention was not on the road and that he was
putting other lives in danger with his negligence.

This incident happened after the final day of my senior year of high school with
my graduation two days later. A graduation for a high school student is arguably
the biggest moment in their lives, and I was just excited, as any high school kid
should be. Thankfully I, and both of my friends that were in the car with me on
June 11th, 2014, was able to walk for our graduation. This was undoubtedly a
miracle due to the severity of the accident described above. The families of those
involved were lucky enough to be celebrating accomplishments on graduation day
instead of being in grievance over a loss.
INJURIES AND TREATMENT
Following the accident, I was looked over by a doctor at a Vancouver clinic. I also
went to a local Chiropractor by the name of Dr. Croft who adjusted me a few times
but I still wasnt receiving the treatment that I needed, my back, hip and neck pain
was still agonizing. I switched to Back-to-Health chiropractic and massage and
was treated by them for my injuries. As shown in the attached X-Ray picture, my
spine was out of alignment. I was also diagnosed with neck sprain and strain,
thoracic sprain and strain, lumbar sprain and strain, closed dislocation of
unspecified cervical vertebra, closed dislocation of lumbar vertebra, closed
dislocation of thoracic vertebra. Attachment of bill included for proof of this
information.
OUT-OF-POCKET EXPENSES
Driving distance from my house to the Vancouver clinic for the one visit is 3.1
miles each way, total of 6.2 miles. At .55 cents per mile, this is equal to $3.41.
Time driven from my house to the clinic and back to my house was 1 hour of my
life I will never get back which is equivalent to $9.41 (Washington State Minimum
wage)
Driving distance from my house to Back to Health Chiropractic and Massage is
6.3 miles each way, total of 12.6 miles. At .55 cents a mile for 49 appointments
$339.57 to cover gas and millage added to my vehicle (wear and tear).
Driving time from my house to back to health chiropractic is 20 minutes average
each way, 40 minutes total for each trip. At $9.41 for each hour of my life spent

during treatment and during transportation to treatment, $307.39 to cover cost of


time spent in transportation to and from Back to Health Chiropractic.
Each appointment was approximately an hour long, including chiropractic and
massage. 49 appointments at an average of an hour per appointment at $9.41 for
each hour, $461.09 for time spent during treatment at Back to Health Chiropractic
and Massage.
Total out-of-pocket expenses: $1,120.87
PAIN AND SUFFERING
This whole event has been terrible. Before the accident, I was an injury free young
adult without any pain or discomfort to my back, hips, or neck area. The incident
caused by your insured has brought me physical discomfort while sitting in college
classes, driving, and while attempting to be active in what would otherwise be a
very active teenage and young adult life. Each and every day I feel discomfort in
my lower back and hips, which I know will only get worse the more my body ages
and deteriorates.
FUTURE PAIN AND SUFFERING
This accident happened when I was just 18 years old, giving me my whole life to
live with this pain. The average male in America lives to be 78 years old. That is
60 more years, on average, that I will have to suffer with this pain, and it will only
get worse the older my body gets. The original settlement offer of $26,504, which
comes to $11,860.17 after medical bills, equates to less than $200 a year, or $.02
an hour, for the next 60 years of pain. Although I would never accept currency in
trade for pain, the situation I have been placed in forces me to. However, I believe
that $11,860.17, after medical expenses, for the next 60 years of back, hip and
neck pain, is not an adequate amount.

similar insurance settlements with similar facts, I believe the amount of $51,245
(Fifty One Thousand, Two Hundred Forty Five Dollars) represents a fair
settlement offer for this case.
