Re: False and Misleading Statements
Dear Sir/Madam:
On behalf of the United States Environmental Protection Agency (U.S. EPA), I am
writing to inform you that we have been made aware of false and misleading statements
and the unauthorized use of the U.S. EPA logo in your promotional literature. In
particular, the cover page of a brochure created by K.A.E. Paving Consultants, Inc. states
EPA They Do, and includes a photo with the U.S. EPA logo. This literature was
distributed by the Town of Pomfret, Connecticut in July 2016.
In addition, literature distributed by Surtreat representatives states that Pavement
Dressing Conditioner is "Approved for use and application by US EPA. A larger copy
of the photo from the K.A.E. Paving Consultant, Inc. brochure is contained in this
literature with a prominent display of the EPA logo. This material was distributed in July
2016 to attendees at a public meeting in Pomfret, Connecticut.
The U.S. EPA does not certify, endorse, promote or recommend any coal tar based asphalt
sealants or rejuvenators. Accordingly, the statements and logo images included in your
literature are false and misleading. As a result, if the statements and U.S. EPA logos are
not removed, we will refer the matter to the Federal Trade Commission. Please have
these statements and logos removed immediately from your literature and advise me in
writing that it has been done.
