RechtsgeschichteisteineUnheilsgeschichte,
diemitdemhomosacerbeginntundzwangs
lufig in den Straf, Konzentrations und
Flchtlingslagern der Moderne in Kafkas
Strafkolonie endet. Doch weist Kafkas
ParabelVordemGesetzeinekomplexere
Struktur auf: Nicht pure Negativitt, sondern

Rechts liegt sein Scheitern und in seinem
ScheiternliegtseinErfolg.

negative context that Agamben presents to
us, the escape to freedom is open: (self)

cation to insatiably, in ever renewed
attempts, propagate distinctions which are
intendedtogetclosertothelawinthought
ful obedience. But what is the quality of
thesedistinctions?

tionalthoughorpreciselybecauseitcan
not be adequately rendered through words
(let alone through concepts).21 Thus the

the contrary, the duplication of meaning
