COMMENTS AND DEVIATIONS

For the preparation of the present bid, the CANDIDATE has counted on reference information from the main
supplier, General Electric (GE), who has not submitted a firm tender describing its scope of supplies and services
yet, so, the CANDIDATE cannot, at this time, fully assess the conformance of its bid with the requirements of AEC.
Under these circumstances, it is expected that further comments and deviations will be pointed out in the next future,
once a firm offer of main supplier is received from GE by the CANDIDATE.
In any case, we can anticipate a first set of comments based on the review of AECs bidding guidelines (Cahier des
Charges).
1.1

Technical Comments

(Addenda 3&4) The design does not include boiler bypass stack, since this device is considered not to be suitable
for units of the size of the present project. Experience shows that bypass stack for plants of this size produce
maintenance and operational problems such as thermal stresses on ducts, performance degradation and exaust gas
flow unstabilities that may affect gas turbine.
(Plan de Masse) The layout drawing included in the bid has been performed assuming certain graphic scaling ratio
that may need to be revised since AECs Plan de Masse did not precisely determined such scaling ratio.
(Pice IV, Cahier 1) The lube oil system and the control fluid system are separated systems. This ensures that
control fluid will not be contaminated from lubricating processes. In the single-shaft configuration oil systems of
both the steam and gas turbine are shared.
(Pice IV, Cahier 4) The bid has been prepared assuming three 50% condensate pumps.

The candidate

recommends as a design improvement to install 2x100% units. This design is simpler and more robust.
(Pice IV, Cahier 5) The bid has been prepared assuming that circulating water screen and filtering chains be sized
for 8,9 m3/seg, as required in bidding guidelines. The candidate recommends, as a design optimization, to reduce
this figure to 7-7,5 m3/seg, which is enough for the size of the plant and the required thermal increase of 10 C in
the circulating water.
(Pice IV, Cahier 7) The bid has been prepared assuming three 50% air compressors. The candidate recommends
as a design improvement to install 2x100% units.
(Pice IV, Cahier 9) It is not possible to assure without detailed calculations that the generator will be capable of
working in the frequency ranges requested.

(Pice IV, Cahier 9) It is difficult to achieve the exact shortcircuit ratio requested.The standard values are usually
lower. Further discission is needed.
(Pice IV, Cahier 9) The proposed secondary voltage of transformers for protection and measuring is 110 V.
(Pice IV, Cahier 9) Temperature increases requested are higher that those employed in our standard design
(maximum conductor temperature -105C, maximum envelope temperature - 80C).
(Pice IV, Cahier 9) The criteria for sizing the main transformer is to limit hottest point temperature to a value
lower than 98C for most of ambient temperatures, taking into account the power-temperature curve of the turbine.
No other margins are taken into account regarding the maximum oil or winding temperatures.
(Pice IV, Cahier 9) All cooling equipment of transformers will have redundancy, so that in case of failure of one
fan, pump or electrical infeed, no power will be lost. Redundancy of 20% of radiators surface has not been taken
into account.
(Pice IV, Cahier 10) No medium voltage backup diesel for black start will be provided.
(Pice IV, Cahier 10) Due to the single shaft arrangement, low voltage distribution board as per annexed one line
diagram are proposed.
(Pice IV, Cahier 10) Due to the single shaft arrangement the direct current system proposed is based on one 250
Vdc battery and two 125 Vdc redundant rectifiers/batteries, instead of three systems.
(Pice IV, Cahier 10) 20 to 25% of requested power and space reserve requierements for alternate and direct current
systems will not be complied with. Maximum a 10-15% is included.
(Pice IV, Cahier 10) For dc supplies fixed MCB are proposed, with no withdrawable cubicles.
(Pice IV, Cahier 10) Lead type batteries are commonly used in our standard design. If NiCD batteries are
requested further study is necessary.
(Pice IV, Cahier 11) The voltage rating of motors between 150 and 200 kW may be low voltage instead of 6 kV
(Pice IV, Cahier 12) Bare copper without lead cover will be impoyed in the underground earthing mesh.

Procurement, Construction and Startup of Power Plants).

1.1.- Definitions:
Montant de Seuil Contractor shall be entitled to appropriate adjustments in price or schedule, for changes resulting
of changes in Applicable Laws or Codes or other causes shall be reflected in a Contract Amendment. The price,
when applicable, shall be in Algerian or Foreign Currency depending of its cost nature.
Spcifications Techniques Other agreed documents, if the case, shall be included as part of these specifications
(Technical Proposal, Technical comments, etc)
1.7.- Other agreed documents, as Contract Amendments, Contractor Technical Proposal or Contractor Specifications
must be included in the list.
1.13.- The Contractor will do it best when possible, but can not guarantee that some Vendors will keep reluctant to
assign their rights in order to maintain their know-how.
2.1.- Prior to perform the works the full and continuous access shall be granted. The Contractor shall be sole
responsible of the site custody.
2.4.- (D) As payments are foreseen in a neutral cash-flow basis, the Contractor would like to discuss deductions on
payments.
3.2.- (B) No additional testing than those foreseen in Quality Plan shall permit reject part of the entire scope of
supply. Tests and inspections shall be held on the date scheduled by Contractor and shall be conducted by
Contractors personnel. Proprietary intervention should not affect the normal development of the projects activities
(C) English shall be allowed to technical communications or documents.
3.5.- Referent to Proprietary Representatives communications, the Contractor shall do his best to reach an
agreement.
4.1.- Contractor obligations shall be only for its Scope of Supply and keep the authority of the site in its side. (B)
The Proprietary shall provide operating personnel. Fuel gas and distillate are excluded of Contractor scope and shall
be provided for the Proprietary when required. Power, water and consumables for start-up and commissioning shall
be at Proprietary and Contractor expenses.
4.2.- The amount of the performance bond is considered excessive, a 10 % performance bond is proposed instead.
Further discussions on this section need to be held.
4.3.- As general comment about Permits and Authorizations of Contractor The Contractor would appreciate to
discuss the Annex 10 in good faith.
(B) The Contractor shall collaborate with Proprietary in its best way.

4.5.- (B) The Contractor wishes to reach an agreement and have a list of authorized subcontractors before the
Contract Signing. A new subcontractor to be included in this list shall be agreed with the Proprietary Representative.
The Contractor shall do its best to contracting with argelian companies but in a global sourcing frame. (G) The
Contractor understands as too long the term to refuse a subcontractor.
4.9 & 4.11.- The Contractor has relied on the limited information provided by the Proprietor in connection with
surface and subsurface conditions, and has not take the opportunity to conduct his own tests of the site. Assumptions
on the soil characteristics have been done as described in the Technical Proposal. Contractor shall not be responsible
for delays and/or costs related to unexpected natural or man-made surface or subsurface conditions. Proprietary shall
be responsible for demolitions and obstacles removal, if any, as well as for treatment and removal of hazardous
substances and related contamination of any nature, as well as for handling archaeological finds or other unusual
conditions. The Contractor shall be entitled to appropriate adjustments in price or schedule.
4.12 & 4.16.- The right of way shall be allocated on Proprietary responsibility. Services for construction as water,
electricity and phone trunk lines shall be boundary limit disposed. The necessary areas for construction shall be
granted to Contractor.
4.18.- (B) (3) Only for information and Proprietary convenience. The Contractor only guarantees the Provisional
Acceptance Date.
4.21.- (B) Please, see comment to clause 4.9.
5.1.- (A) Only for the scope of supply. Some know-how documents shall be maintained in the Contractor or Vendors
side. (C) (2) According to Contractor technical specifications and requirements (fuel characteristics, ambient
conditions, correction curves and other included in technical proposal). Performance, emissions and reliability test
procedures and criteria, dead bands, tolerances and test duration must be established in conformity with general
industry practises and international vendors standards and set forth in the Contract.
5.2.- (A) English shall be accepted for technical communications and documents. (C) Only some specified
documents shall be approved.
5.4.- Design and manufacturing of the main equipment shall be according to the Manufacturers standards

inspections shall be held on the date scheduled by Contractor and shall be conducted by Contractors personnel.

7.4.- Tests and inspections shall be conducted by Contractors personnel. Proprietary associated costs shall be at its
expenses.
8.3.- Contractor guarantees only Provisional Acceptance Date.
8.5.- The Contractor shall entitle to have an extension in the cases indicated in the Contract..
8.6.- (C) To be deleted.
8.7.- (C) Contractor costs arising from a suspension shall be paid from the first day of suspension.
8.8.- The amount of the daily penalty for delay is considered excessive and the terms of this clause need to be
discussed.
9.1.- (C) The effective date of Provisional Acceptance Certificate shall be that when conditions for acceptance are
reached.
9.2.- (A) & (B) To be deleted.
9.4.- To be discussed.
9.5.- Payment of liquidated damages is the only remedy to Proprietary. (C) To be deleted.
10.- The effective date of Provisional Acceptance Certificate shall be that when conditions for substantial
completion are reached even though punch list items which do not affect the safe operation of the plant remain to
be completed. The Contractor is likely to reach an agreement regarding this subject.
11.4.- The limit for any guarantee extension for any component shall be 5 years.
11.5.- (A) The terms to repair defects shall be agreed. (B) (2) & (3) To be discussed.
12.- Guaranteed performances shall be in new and clean conditions. Degradation curves shall be used, if necessary.
Annex 5 to be discussed at a next stage.
12.4.- (C) Liquidates damages accepted shall be the only remedy for Proprietary. To be agreed.
12.5.- This entire clause needs to be discussed.
15.- The Payment shall be accordingly to a Payment Schedule conditioned to some consecutives milestones will be
fulfilled. The first 10% payment shall not de reimbursable. As the payments will be scheduled in a neutral cash-flow
basis, deductions on payments shall not be allowed.

16.- The fault by the Proprietary in its obligations, payment or others, shall entitled the Contractor to have the right
to cancel the Contract. When the Proprietary cancel the Contract must pay to Contractor every amount pending and
those reflected on Cancellation Payment Schedule.
17.4.- The Contractor proposes to discuss this clause integrally.
18.- Insurances Clause to be discussed.
