COUNCIL AS A WHOLE
offered and moved adoption of the following ordinance:
TITLE: ORDINANCE OF THE MUNICIPAL COUNCIL OF THE CITY OF JERSEY CITY ADOPTING
AMENDMENTS TO THE CLAREMONT REDEVELOPMENT PLAN PERMITTING
RECREATION AND ENTERTAINMENT USES
WHEREAS, the Municipal Council of the City of Jersey City, adopted the Claremont Redevelopment Plan at
its meeting of Oecember 4, 1984; and
WHEREAS, the Local Redevelopment and Housing Law, NJSA 40A:12A-let seq. permits municipalities to
adopt and amend regulations dealing with areas declared to be in need of redevelopment; and
WHEREAS, the Municipal Council seeks to permit recreation and entertainment uses in the Plan area; and
WHEREAS, a copy of the amended text is attached hereto and made a par hereof, and is available for public
inspection at the Offces of the City Clerk, City Hall, 280 Grove Street, Jersey City, NJ.; and
WHEREAS, the following amendments to the Claremont Redevelopment Plan have been reviewed by the
Jersey City Planning Board at its meeting of June 15,2010; and
WHEREAS, the Planing Board voted unanimously to recommend adoption of these amendments by the
Municipal Council;
NOW, THEREFORE, BE IT ORDAINED by the Municipal Council of the City of Jersey City that the
recommended amendments to the Claremont Redevelopment Plan be, and hereby are, adopted.
A. All ordinances and par of ordinances inconsistent herewith are hereby repealed.
B. This ordinance shall be a par of the Jersey City Code as though codified and set forth fully herein.
The City Clerk shall have this ordinance codified and incorporated in the offcial copies of the Jersey
City Code.
C. This ordinance shall take effect at the time and in the maner as provided by law.
O. The City Clerk and the Corporation Council be and they are hereby authorizd and directed to change
any chapter numbers, aricle numbers and section numbers in the event that the codification of this
ordinance reveals that there is a conflct between those nùmbers and the existing code, in order to
avoid confusion and possible repealers of existing provisions.
E. The City Clerk is hereby directed to give notice at least ten days prior to hearing on the adoption of this
Ordinance to the County Planing board and to all other persons entitled thereto pursuant to N.J.S.
40:550-15 and N.J.S. 40:550-63 (if required). Upon the adoption of this Ordinance afer public
hearing thereon, the City Clerk is further directed to publish notice of the passage thereof and to fie a
copy of the Ordinance as finally adopted with the Hudson County Planing Board as required by
N.J.S.40:550-16. The clerk shall also forthwith transmit a copy of this Ordinance after fmal passage
to the Municipal Tax Assessor as required by N.J.S. 40:49c2.

This amendment wil permit recreation and entertinment uses in the industrial subdistrict of

Claremont Redevelopment Plan area and provides parking and sign standards for such uses.
To permit additional uses for currently vacant warehouse buildings and provide a location for
recreation and entertaiiunent uses.

C. CDverage-
The maximum amount of land covered by buildings shall not exceed seventy percent
(70%).
1. One (1) space per four hundred (400) square feet for offices;
2. One (1) space per five thousand (5000) square feet for warehouses;
3. One (1) space per one thousand (1000) square feet for manufacturing and
laboratories. However, a developer may present a parking needs analysis
prepared by a Professional Engineer or Planner in lieu of strict adherence to the
above requirements. Upon presentation of such analysis the Planning Board
may reduce the requirement for a particular development.
E. Building Height -
Maximum building height permitted shall be sixty (60) feet except on the south side
of Caven Point Road east of Commercial Street to the nort side of the Turnpike
right-of-way where the maximum building height permitted shall be seventy (70) feet
as measured from the finished floor to the average roof pitch (not including rooftop
mechanicals or mechanical sheds).

G. Landscaping -
A minimum of fifteen percent (15%) of any lot area shall be landscaped. This
amount may be reduced on site provided the applicant can demonstrate that land
constraints such as, but not limited to, topography, environmental hazards and/or lot
configuration exist and provided that an equivalent amount of off site landscaping be
provided by the applicant at the discretion of the Planing Board.
H. Signs-
Each building shall be permitted no more than two (2) signs; a primary and a
secondary sign. The primary sign shall not exceed 100 square feet or 10 percent of
the area of the front of the building, whichever is less. Signs shall be encouraged to
be attached to the building, and in no case shall a sign be located in a required setback
area. Thesign may be internally or externally iluminated but no glare from external
project identification sign may be located at each entrance of an industrial park
providing that such does not exceed sixty (60) square feet in area.
Recreation and entertainment uses greater than 60,000 square feet are permitted
one additional single free standing sign not to exceed 200 square feet in area and
not to exceed twenty (20) feet above the adjacent turnpike road surface, built on a
removable structure that is required to be removed when the entertainment or
recreation use is vacated. The Planning Board may require b011ding to assure
compliance with this requirement Such signs may be externally lighted with down
, lights. No external upward glare shall be allowed to escape from the lighting
fixtures to prevent "sky-glow."

ORDINANCE AUTHORIZING THE EXECUTION OF A RIGHTS OF WAY USE
AGREEMENT BETWEEN THE CITY OF JERSEY CITY AND LEXENT
METRO CONNECT, LLC TO PERMIT THE INSTALLATION OF FIBER OPTIC
CABLING THROUGH EXISTING INNERDUCTS LOCATED IN EXISTING
UNDERGROUND CONDUITS WITHIN CERTAIN PUBLIC RIGHTS OF WAY
FOR PURPOSES OF PROVIDING TELECOMMUNICATION SERVICES
WHEREAS, Lexent Metro Connect, LLC (Lexent), 90 White Street, New York, New York, is a
telecommunications carrier authorized to provide services such as dark fiber connectivity and high speed data
transmission by the New Jersey Board of Public utilities (BPU) and the Federal Communications Commission
(FCC); and
WHEREAS, Lexent has requested that the City of Jersey City (City) grant it permission to run fiber
optic cabling though existing innerducts located in existing underground conduits located in the public rights
of way for the purpose of ins taIlng, operating, repairig, and maintaining a telecommunications system (Project);
and
WHEREAS, Lexent agrees to execute the fort (40) year Rights of Way Use Agreement that is attched
hereto; and
WHEREAS, Lexent agrees to pay the City $1,500.00 to cover the admistrative expenses incurred by
the City for engineering and legal review of Lexents Project; and
WHEREAS, N.J.S.A. 48: i 7-10 and N.J.S.A. 40:67- i authorize the City to grant municipal consent for

commercial and industral citizens, for the City to grant consent to Lexent to use the public rights of way

RIGHTS OF WAY USE AGREEMENT
..
THIS RlGHTS OF WAY USE AGREEMENT ("Use Agreement") is dated
(The "Effective Date"), and entered into by and between the City of Jersey
City ("City"), a New Jersey municipal corporation, having its address at 280 Grove Street, Jersey
City, New Jersey 07302, and Lexent Metro Connect, LLC ("Lexent"), with offices located at 90
White Street, New York, New York.

WHEREAS, Lexent has requested that the City grant it permission to ru fiber optic

paricularly its commercial and industrial citizens, for the City to grant consent to Lexent to
WHEREAS, the granting of such consent is and shall be conditioned upon Lexents
compliance with all existing ordinances of the City and its entering into the attached Right of

meaning, any wires or cable placed therein and any replacement thereof
which are similar in construction and use.
The City hereby grants Lexent its municipal consent for the non-exclusive use ofthe
public rights of way within the City for the purose of owning, constrcting, installing, operating
and maintaining a telecommunications system, subject to the mutual covenants and obligations
as set forth in this Right of Way Use Agreement.
It is deemed to be in the best interests ofthe City and its citizenr, particularly including
commercial and industrial citizens, for the City to grant consent to Lexent to occupy said public
rights of way within the City for this purpose.
Lexent wil be ruing fiber optic cabling though existing innerducts located in existing
underground conduits located in the public rights of way as shown of Exhibit "A" attached
hereto. Any construction to be undertaken for the puroses described herein shall require prior
notice by Lexent to the City. Lexent shall fully describe the construction to be undertken in
plans and specifications submitted to the City, and shall obtain approval from, coordinate and
work with the appropriate Municipal Deparment(s) before scheduling and commencing any
construction.
Any and all rights expressly granted to Lexent under this Right of Way Use Agreement,
which shall be exercised at Lexents sole cost and expense, shall be subject to the prior and
continuing right of the City under applicable laws to use any and all pars of the municipal rights
of way exclusively or concurently with any other person or persons, and shall be further subject

to all deeds, easements, dedications, conditions, covenants, restrictions, encumbrances, and
claims of title of record which may affect such municipal rights of way. Nothing in this Right of
Way Use Agreement shall be deemed to grant, convey, create or vest in Lexent a real propert
interest in land, including any fee, leasehold interest, easement or any other form of interest or
ownership.
Subject to obtaining the permission ofthe owner(s) of and underground conduit, which
shall be the sole responsibility of Lexent to undertake and obtain, and subject to notice and
approval of the City as described in section 4 herein, the City hereby authorizes and permits
Lexent to enter upon the municipal rights of way and to attach, install, operate, maintain, remove,
reattach, reinstall, relocate and replace its telecommunications facilities, in underground conduit
owned by public utility companies located within the municipal rights of way as may be
permitted by the public utility company or propert owner, as the case may be.
Lexent shall comply with all existing ordinances of the City as may be amended from
time to time and with all futue ordinances as may be enacted.
Lexent agrees to pay to the City $1,500.00 to cover the reasonable costs incured by the
City for engineering and/or legal review, analysis and preparation of documents related to
Lexents request for municipal consent to its Project. Ifthe Project requires additional
engineering and/or legal review, Lexent agrees to pay the City's reasonable administrative
expenses that the City incurs.
The non-exclusive municipal consent granted herein shall expire fort (40) years from the
Effective Date of this Right of Way Use Agreement. Upon expiration of such consent, or at such
earlier date that Lexent ceases to maintain its facilities, it shall remove the facilities at its cost and

expense.
The City may terminate this Right of Way Use Agreement, or require modification
hereof, upon notice and opportunity of Lexent to be heard, where it is shown that the scope of use
hereunder is compromising the health, safety and welfare of the citizenr.
Section 9: Indemnification
Lexent, its successors, assigns, sub-contractors, agents, servants, officers, employees,
designees, guests and invitees, hereby indemnify, defend and hold harmless the City, its
successors and assigns, elected officials, officers, employees, servants, contractors, designees and
invitees from and against any and all claims, demands, suites, actions at law or equity or
otherwise, judgments, arbitration determinations, damages, liabilities, decrees of any person( s) or
entities claiming to be or being harmed as a result of Lexents actions under this Right of Way
Use Agreement and costs in connection therewith. This indemnification shall specifically
include, but not be limited to, any and all costs, reasonable attorneys fees, court costs and any
other expenses that may be incurred by the City in connection with any and all claims, demands,
suites, actions at law or equity or otherwise and/or arbitration proceedings which may arise in
connection with Lexents activities pursuant to the rights granted in this Right of Way Use
Agreement.
Other than in connection with the foregoing third-par claims indemnification, neither
the City nor Lexent shall be liable to the other for consequential, incidental, exemplar or
punitive damages on account of any activity pursuant to the consents granted hereby.

Lexent shall at all times maintain a comprehensive liability insurance policy with a
single amount of at least One Milion dollars ($1,000,000.00) covering liability for any death,
personal injur, propert damage or other liability arising out of the construction and operation
contemplated herein, and an excess liability policy (or "umbrella") policy in the amount of Five
Milion Dollars ($5,000,000.00).
Prior to the commencement of any work pursuant to this Right of Way Use Agreement,
Lexent shall file Certificates of Insurance with the City with endorsements evidencing the
coverage provided by said liability and excess liability policies.
The City shall notify Lexent within fifteen days (15) days after the presentation of any
claim or demand to the City, either by suit or otherwise, made against the City on account of any
of Lexents or its sub-contractors, agents, employees, officers, servants, designees, guests and
invitees, activities pursuant to the rights granted in this Right of Way Use Agreement.

Section 12. Successors and Assigns.
The terms and conditions herein contained shall be binding upon and inure to the
benefit of the successors and assigns of the parties hereto.
This Agreement contains the entire understanding of the paries hereto with respect to the
subject matter hereof, and no prior other written or oral agreement or undertaking pertaining to
any such matter shall be effective for any purpose.
This Agreement may not be amended or modified, nor may any obligation hereunder be
waived orally, and no such amendment, modification or waiver shall be effective for any purpose
unless it is in writing and signed by the par against whom enforcement thereof is sought.

offered and moved adoption of the following ordinance:
TITLE:
ORDINANCE REMOVIG THE AFFORDABILITY RESTRICTIONS FROM: 1) A
DEED DATED DECEMBER 31,1986 AN 2) A CORRCTORY DEED DATED
AUGUST 26, 1987 CONCERNING BLOCK 1986, LOT S-A ALSO KNOWN AS
240 BERGEN AVENUE OWNED BY FAIROUNT HOUSING CORPORATION
The Municipal Council of the City of Jersey City does ordain that:
WHEREAS, the City of Jersey City (City) transferred Block 1986, Lot 5-A a/a 240 Bergen
Avenue (Propert) to Fairmount Housing Corporation (Fairmount) for $1.00 by Deed dated
December 31, 1986; recorded in Deed Book 3676 at page I3 7, attched as Exhibit A to construct low
income housing; and
WHEREAS, the City of Jersey City (City) delivered a Correctory Deed for the Propert dated
August 26, 1987, recorded in Deed Book 3824 at page 9, attched as Exhibit B; and
I. Covenants to constrct thirt-eight (38) units of rental housing on the Propert by December
31, 1988 and immediately tent and continually re-rent such urts to persons only oflow or
moderate income and only for rent affordable to such persons for a minimum period of
fifteen (15) years.
2. Comply with all terms and conditions contained in Ordinance C-345 of the Jersey City
Municipal Council which Ordinance authorized the transfer.
3. Any profit realized by the Fairmount from the resale of these Properties was to be applied
to the costs of acquiring and developing other City-owned Propert for residential use for
low and moderate income persons.
WHEREAS, in addition to conveying the Propert, the City established an escrow account in the
amount of$10,000 to allow Fairmount to close on a construction loan because of judgment liens
which were recorded against the owners of the propert preceding the City tag title; and
WHEREAS, Resolution C-2266 approved on July 14, 1987 authorized the City Corporation
Counsel to set up the interest bearing escrow account with Trut Company Ban to be held by the
law firm of Ruskin, Kors, Meltzer, Rubin, Sta & Hoberman and to remain open until the
judgment liens were discharged or canceled; and
WHEREAS, Fairmount now proposes to sell the Propert for the sum of $240,000 and has
the sale (Exhbit C); and
provided the City with its payables list from the proceeds of
WHEREAS, in order to sell the Propert, Fairmount requires that the City releas~ the 15 year
affordability restrictions contained in the Deeds which has expired; and

WHEREAS, a statement of accounts dated Februar 29, 2000 indicated that the escrow balance
was $15,429.16; and
WHEREAS, Fairmount is uncertn as to when the State will retur the escrow monies to the
law firm, so the City has suggested a period of 6 months, which may be extended upon good
cause by Fairmount; and
WHEREAS, Fairmount has agreed that if they are unable to obtain the escrow monies directly
from the State ofNew Jersey, they will release from the fuds being held in abeyance the amount
that the paries determine to be owed to the City with interest to date; and
WHEREAS, it is in the best interests of the City to remove the affordability controls on the
Propert so that it can be sold to a private buyer in order to retur the Propert to the ta rolls.
1. Block 1986, Lot 5-A also known as 240 Bergen Avenue is hereby released from all of
the restrictions and covenants contaed in the Deed from the City of Jersey City to
Fairmount Housing Corporation dated December 31,1986 and recorded in Deed Book
3676 at Page 137.
2. Block 1986, Lot 5-A also known as 240 Bergen Avenue is hereby released from all of
the restrctions and covenants contained in the Correctory Deed from the City of Jersey
City to Fairmount Housing Corporation dated August 26, 1987 and recorded in Deed
Book 3824 at Page 9.
3. Fairmount shall keep the City of Jersey City informed regarding the Unclaimed Propert
Claim Inquiry for the escrow monies filed with the State of New Jersey on June 3, 2010.
6. The Mayor is hereby authorized to execute ths Ordinance and a Nota Public notarze
the acknowledgment contained herein in accordance with law so that same may be
recorded in the Hudson County Register's Offce.
A. All ordinances and pars of ordinances inconsistent herewith are hereby repealed.
B. This ordinance shall be a pci of the Jersey City Code as though codified and fully set
forth therein. The City Clerk shall have ths ordinance codified and incorporated in the
offcial copies of the Jersey City Code.

C. This ordinance shall take effect at the time and in the manner as provided by law.
D. The City Clerk and the Corporation Counsel be and they are hereby authorized and
directed to change any chapter numbers, aricle munbers and section numbers in the event
that the codification of this ordinance reveals that there is a conflct between those
numbers and the existing code, in order to avoid confusion and possible accidental
repealers of existing provisions.

Subject: 240 BerKen Avenue a/k/a Lot 5.A in Block 1986- Ordinance to
remove
In December i 986, the City conveyed 240 Bergen Avenue to Fairmont Housing Corporation
(Fairmount), a non profit corporation to constrct affordable housing. In 1986, the City delivered
a Deed and subsequent Correctory Deed to Fairmount which contained affordability restrctions to
remain on the property for a period of i 5 years. In the spring of 1987, Fairmount needed title
insurance in order to get constrction financing. In order for the project to proceed, the City's
Council passed Reso C-2266 on July 14, i 987 funding an escrow account to cover the judgment
liens. The City provided Fairmount's attorney with $10,000 to set up the interest bearing escrow
account. The judgment liens have expired but the escrow monies were not returned to the City.
Fairmount now desires to sell the propert for $240,000 to a private pary. In order to sell
the property, Fairmount requires that the City release the 15 year affordability restrictions on the
property from the Deeds. The City has advised Fairmount that the release ofthe controls are subject
to Fairmount returning the escrow monies to the
City. Fairmount's attorney has fied an Unclaimed
Propert Claim with the State of New Jersey for the escrow monies. The City has proposed that
Fairmount set aside from the proceeds of
the sale, the sum of $25,000 until the escrow monies are
returned from the State. Fairmount has agreed that if
they are unable to obtain the escrow monies
directly from the State, they wil release from the funds the $ i 0,000 with interest to date to the City.
The 15 year affordabilty period has expired so it is in the best interest ofthe Gity to release
the restrictions in the Deeds.

ORDINANCE
OF
JERSEY CITY, N.J.
COUNCIL AS A WHOLE
offered and moved adoption of the following ordinance:
CITY, IN THE COUNTY OF HUDSON, NEW JERSEY (not less than two-thirds of all
is hereby authorized to be undertaken by the City of Jersey City, in the County of Hudson, New
Jersey (the "City") as a general improvement. For the improvement or purose described in
Section 3 hereof, there is hereby appropriated the sum of $7,700,000 (including grants in the
total amount of $6,600,000, consisting of (i) a grant in the amount of $1 ,600,000 expected to be
received from the State of New Jersey, Departent of Environmental Protection pursuant to the
Green Acres Program, (ii) a grant in the amount of $3,500,000 expected to be received from the
Port Authority of New York/ew Jersey, (iii) a grant in the amount of $ 1,000,000 expected to be
received from the Hudson County Open Space Fund, and (iv) a grant in the amount of $500,000
expected to be received from the New York/ew Jersey Baykeeper) and including the sum of
$53,000 as the down payment for the improvement or purpose required by the Local Bond Law.
The down payment has been made available by virte of provision in the capital improvement
Section 2. In order to finance the cost of the improvement or purose not covered by
application of the down payment or otherwise provided for hereunder, negotiable bonds are
Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby
authorized to be issued pursuant to and within the limitations prescribed by the Local Bond,Law.
Section 3. The improvement hereby authorized and the purpòse for which the bonds
are to be issued is the acquisition by the City of real property and the improvements thereon
known as the Harsimus Embankent Park and Greenway Project, including, but not limited to,
approximately eight parcels of land, including two grade-level parcels and six stone
embankents, identified On the tax maps of the City as Block 212, Lot M, Marin Boulevard to
Manila Avenue, Block 247, Lot 50A, Manila Avenue to Erie Street, Block 280, Lot 50A, Erie
Street to Jersey Avenue, Block 317.5, Lot 50A,Jersey Avenue to Coles Street, Block 354.1, Lot.
50A, Coles Street to Monmouth Street, Block 389.1, Lot 50, Monmouth Street to Brunswick
Street, Block 415, Lot 50 (also known as Lot 50.PL), Bruswick Street to Newark Avenue and
Division Street and Block 446, Lot 18A, Newark Avenue to just west of the New Jersey.
Turnpike, and including all rights and interests therein and all work, materials and services
(b) The estimated maximum amount of bonds or notes to be issued for the
improvement or purose is as stated in Section 2 hereof. .
(c) The estimated cost of the improvement or purose is equal to the amount of the
Section 4. All bond anticipation notes issued hereunder shall mature at such times as
may be determined by the chief financial offcer; provided that no note shall matue later than
one year from its date. The notes shall bear interest at such rate or rates andbe in such form as
may be determined by the chief financial offcer. The chief financial offcer shall determine all
matters in connection with notes issued puruant to this bond ordinance, and the chief financial
offcer's signature upon the notes shall be conclusive evidence as to all such determinations. All
notes issued hereunder may be renewed from time to time subject to the provisions ofN.J.S.A.
40A:2-8. 1. The chief financial offcer is hereby authoried to sell part or all of the notes from
time to time, at not less than par and accrued interest, at public or private sale and to deliver them
to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest
from their dates to the date of delivery thereof The chieffinancial offcer is directed to report in
wrting to the governing body at the meeting next succeeding the date when any sale or delivery
of the notes pursuant to this bond ordinance is made. Such report must include the amount, the

description, the interest rate and the maturity schedule of the notes sold, the price obtained and
Section 5. The capital budget or temporary capital budget (as applicable) of the City
is hereby amended to conform with the provisions of this bond ordinance to the extent of any
inconsistency herewith. In the event of any such inconsistency and amendment, the resolution in
the form promulgated by the Local Finance Board showing full detail of the amended capital
budget or amended temporary capital budget (as applicable) and capital program as approved by
the Director of the Division of Local Governent Services is on fie with the City Clerk and is
Section 6. The following additional matters are hereby determined, declared, recited
and stated:
(a) The improvement or purpose described in Section 3 of this bond ordinance is not.
a curent expense. It is an improvement or purpose the City may lawfully undertake as a general

permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the
purose or improvement.
(e) The City reasonably expects to commence acquisition and/or constrction of the
project described in Section 3 hereof, and to advance all or a portion of the costs in respect
thereof, prior to the issuance of bonds or notes hereunder. To the extent such costs are advanced,

the City further reasonably expects to reimburse such expenditures from the proceeds of the
bonds or notes authorized by this bond ordinance, in an aggregate not to exceed the amount
of
bonds or notes authorized in Section 2 hereof.
Section 7. Any grant moneys received for the purpose described in Section 3 hereof,
(including grants in the total amount of $6,600,000, consisting of (i) a grant in the amount of
$1,600,000 expected to be received from the State of New Jersey, Departent of Environmental
Protection pursuant to the Green Acres Program, (ii) a grant in the amount of $3,500,000
expected to be received from the Port Authority of New York/ew Jersey, (iii) a grant in the

Section 8. The full faith and credit of the City is hereby pledged to the punctual
payment of the principal of and the interest on the obligations authorized by this bond ordinance.
The obligations shall be direct, unlimited obligations of.the City, and the City shall be obligated
to levy ad valorem taxes upon all the taable real propert within the City for the payment of the

hereby directed to publish the full text of the bond ordinance, together with the notice set forth

WHEREAS, Moishe's Moving and Storage was founded 25 years ago with one trck and has since
grown into the largest and most trusted moving and storage company in the New York Tri -State Area
with locations in Chicago, Los Angeles, San Francisco, Miami, Atlanta Philadelphia, and
Washington, D.C. Their Corporate Headquarers is located at 227 Coles Street in Jersey City; and
WHEREAS, Moishe's Moving and Storage offers a combination of old-fashioned, quality
customer service backed by cutting-edge technology and equipment. Their world-class moving and
storage solutions include mobile storage, self storage, full-service moving locally and internationally,
document storage, inventory management, wine storage and white-glove fine ars handling; and
WHEREAS, Moishe's Moving and Storage has created a long list of substantial contributions to
the quality of life in the cities of which they operate as well as around the world. Their employees
are encouraged to donate their time to worty causes; and
WHEREAS, Moishe's Moving and Storage's chartable efforts are diverse and include The New

deems it fitting and proper to honor Moishe's Moving and Storage by dedicating that Coles Street
between 10th Street and 13th Street also be known as Moishe;s Way.
A. All ordinances and pars of ordinances inconsistent herewith are hereby repealed.
B. This ordinance shall be a par of the Jersey City Code as though codified and
fuly set forth therein. The City shall have this ordinance codified and
incorporated in the offcial copies of the Jersey City Code.
C. This ordinance shall take effect at the time and in the maner as provided by law.
D. The City Clerk and the Corporation Counsel be and they are hereby authorized
and directed to change any chapter numbers, aricle numbers and section numbers
in the event that the codification of this ordinance reveals that there is a confict
between those numbers and the existing code, in order to avoid confsion and
possible accidenta repealers of existing provisions.

ORDINANCE
OF
JERSEY CITY, N.J.
COUNCIL AS A WHOLE
offered and moved adoption of the following ordinance:
WHEREAS, The City of Jersey City has over the years passed though a process oflegislative
change common to many Amencan communities; and
WHEREAS, legislation must be available and logically aranged for convenient use and must
be kept up-to-date; and
WHEREAS, because ofthe rapid development and changes within the City of Jersey City, the
Vehicles and Traffic Code of the City was not in final form for codification at the time the
present Miucipal Code was re-codified; and
WHEREAS, the Vehicles and Traffic Code has now been thoroughly revised and presented to
the Mayor and Council for adoption and codification as Chapter 332, Vehicles and Traffic, of the
Jersey City Municipal Code; and
NOW, THEREFORE, BE IT ORDAINED by the Miucipal Council of the City of Jersey City
that:
1. Chapter 332 Vehicles and Traffc, attached hereto and incorporated herein, is hereby
adopted;
2. Chapter 26, Vehicles and Traffc, Sections 26-1 through 26-1)6, are hereby repealed in
their entirety;
3. Chapter 332, Vehicles and Traffic, shall become effective upon adoption and publication
as required by law; provided, however, that any sections of this chapter which require the
approval ofthe New Jersey Deparent of Transportation shall become effective upon
receipt of such approval.

Chapter 332
ARTICLE I
General Provisions
§ 332-1. Definitions.
A. Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them
in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words
and phrases used herein.
B. In addition, the following terms, when used in this chapter, shall have the meanings indicated:
COMMUTER VEHICLE - A motor vehicle, other than the ones described herein, parking in a
residential zone.
EMPLOYEE VEHICLE -' A motor vehicle parked in a residential zone wherein the owner of said
vehicle is an employee of a business located within said zone.
HOLIDAY - Any of the following days or the day on which any of the following are celebrated:
(10) General Election Day, the Tuesday after the first Monday in November.
Date specific holidays fallng on Saturday are 0 bserved on Friday; date specific holidays fallng on Sunday
are observed on Monday.
PERSON - A natural person, joint-stock company, partnership, association, club, company, corpo-
ration, business, trust, organization or the manager, lessee, agent, servant, offcer or employee of any of
them.
RESIDENTIAL ZONE - A contiguous or nearly contiguous area containing public streets and
highways or parts thereof.
TRANSIENT VEHICLE - A motor vehicle, other than a resident vehicle, which has been issued a
temporary residential parking permit pursuant to this chapter.
ARTICLE II
Traffc Regulations
A. Traffc control signals shall be installed and operated at the intersection of those streets described
below.

B. The traffc signal installations shall be in accordance with the provisions of An Act Concerning Motor
Vehicles and Traffc Regulations, Subtitle 1 of Title 39 of the New Jersey Statutes Annotated, and
shall conform to the design and shall be maintained in operation in accordance with the Act.
A. Installation.
(1) The City of Jersey City hereby determines to install and utilize a traffc control signal monitoring
system (System) at various intersections within the City of Jersey City as approved by the
Commissioner of Transportation pursuant to the Act
(2) The System to be installed shall be approved by the Governing Body by resolution.
(3) The City of Jersey City shall have the authority to enter into a contract, following a lawful
procurement process, for the installation of the System. Any
contract that shall contain provisions
contrary to the Act shall not be deemed invalid but rather reformed to conform to the Act
(4) The signs notifying drivers that a System is being utilized shall be approved by the Municipal
Engineer, and shall be placed on each street converging into the affected intersection as required
by the Act.
(5) The Municipal Engineer shall inspect and certify the System at least once every six (6) months
from the date of its installation
B. Issuance of a Summons. The Police Department of the City of Jersey City shall review the recorded
images produced by the System, to determine whether suffcient evidence exists demonstrating that a
traffc control signal violation has .occurred and shall issue a Summons when appropriate in accor-
dance with the rules of the Court.
(1) Except as otherwise provided in this section, the recorded images produced by the System shall be
available for the exclusive use of the Police Department for the purpose of discharging his or her
duties under P.L. 2007, Ch. 348.
(2) Any recorded image or information produced in connection with the System shall not be deemed
a public record under N.J.S.A. 47:1A-I et seq., or common law. The recorded images shall not be:
(i) discoverable as a public record by any person, entity, or governmental agency, except upon a
subpoena issued by a grand jury or a court order in a criminal matter, or (ii) offered as evidence in
any civil or administrative proceeding not directly related to a traffc control signal violation.
(3) Any recorded image 01" information collected in connection with a traffc control signal violation
shall not be retained after sixty (60) following the collection of
any fine or penalty.
(4) If a summons is not issued within forty (40) business days following the traffc control signal
violation, all recorded images and any information collected with respect to the traffc control
signal violation shall be removed by the Police Department within two (2) business days.
(5) The City of Jersey City shall certify compliance of this Section by filing a report to with the
Commissioner of Transportation in accordance with the Act.
The speed limit for traffc along the streets, or parts thereof, listed below are hereby established at the
rate of speed indicated.

No-passing zones are hereby established and shall be maintained along those streets or parts of streets
listed below.

§ 332-15. Driveways.
The driveway locations listed below are designated as entrances and exits only. No person shall drive
a vehicle upon such driveway, except as designated.
A. If the Municipal Engineer shall find that a safety problem exists for ingress and egress to any public or
private school for the provision of recreational facilities for children attending such school, or both,
due to lack of a suitable area surrounding the school, he may close, by regulation, any portion of any
street within the block upon which such school is located to the use of through traffc during such time
as he shall determine, not to exceed one. (1) hour between 7:30 am and 10:00 am, two (2) hours between
11:00 am and2:00 pm and one (1) hour between 2:30 pm and 4:30 pm, ori any days upon which such
school is in session.
B. Such street or portion thereof may be used during said hours for ingress and egress to such school, and
for use by the pupils for recreational purposes under proper supervision, and the Director shall
provide adequate police facilities for such supervision and for the control of traffc upon such street.
C. Proper warning signs shall be posted in said street indicating that it is so closed and the purpose
thereof during the time when it is so closed.
D. In accordance with the provisions of N.J.S.A. 40:67-16.7 and 40:67-16.9 and 3-54(C)(14) of the Code
of the City of Jersey'City, a Manual of Regulations authorizing the closing of streets or portions
thereof within school areas to through traffc is hereby adopted.
E. The list of School Streets shall be incorporated in the Chapter 332 Manual-Traffc and Transpor-
tation. The current list of School Streets authorized by Ordinance and/or Regulation within the
Chapter 332 Manual-Traffc and Transportation is available for irispectìon iri the Division of
Engineering, Traffc and Transportation and/ or the Offce of the City Clerk.
The provision of this Chapter and other applicable provisions of the Code shall apply to the driver of
any vehicle owned by or used in the service of the United States Government, this State, any other State,

any Territorial or Federal District, any County, municipality or other political subdivision of the United
States. No driver shall violate any provision of this Chapter or other applicable provision of the Code,
except as otherwise permitted therein or by New Jersey State statute.
The Municipal Engineer shall place and maintain, in accordance with State statutes, traffc control
signs, signals, and devices, when and as under the provisions of this Code, and may place and maintain
such additional traffc-control devices and barriers as he may deem necessary to regulate, to guide or warn
traffc.
The Municipal Engineer shall develop, revise and publish a manual on procedures and practices
necessary in establishing temporary traffc control measures to be used in conjunction with partial or full
closures of all City rights-of-way. He shall have the responsibility to approve or disapprove all requests for
of each closure for its duration. The
temporary street and sidewalk closures and to maintain a record
Offcial Traffc Barricade Manual within Chapter 332 Manual~ Traffc and Transportation is available
for review in the Division of Engineering, Traffc and Transportation and/or in the Offce of the City
Clerk.
The Municipal Engineer may order a reduction of the regular speed limit for periods not to exceed
seventy-two (72)hours on segments of roadways during maintenance and repair operations. The Munic-
ipal Engineer may order said reduction of speed when he finds the regular speed limit exceeds a safe limit
for a maintenance or construction zone. The Municipal Engineer shall place one or more signs indicating
the reduced speed limit along the affected roadway and shall conform to all other requirementsofN.J.S.A.
39:4-98.2.
ARTICLEJII
Parking, Standing and Stopping
The provisions of this Article imposing a time limit on parking shall not relieve anyperso~ of the duty
to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 332-'25. Parking prohibited for sale or repair of vehicles or parking in front of disabled access ramp
prohibited.
A. No person shall park a vehicle upon any street or other public way for the principal purpose of
displaying such vehicle for sale or repairing such vehicle, except when necessitated by an emergency.
For the purposes of this section, "repairing" shall mean:
B. Except when necessary to avoid conflict with other traffc or in compliance with the directions of a
traffc officer or a traffc sign or signal, no operator of a vehicle shall stand or park a vehicle in front
of any disabled access ramp in any street or sidewalk.

No person shall park a vehicle upon any of the streets or parts thereof listed below except at the angle
designated.
A. In accordance with the provisions of N.J.S.A. 39:4-197(3)a, band § 3-54C(6) of the Code of the City
of Jersey City, a listing of Regulations Designating Bus Stops, Taxi Stands and Loading Zones shall
be incorporated in the Chapter 332 Manual-Traffc and Transportation.
B. The listing of all Bus Stops, Taxi Stands and Loading Zones of the City of Jersey City shall be
incorporated in the Chapter 332 Manual-Traffcand Transportation. The current list of Bus Stops,

§ 332-28 JERSEY CITY CODE
Taxi Stands and Loading Zones authorized by Ordinance and/or Regulation within Chapter 332
Manual-Traffc and Transportation is available for inspection in the Division of Engineering, Traffc
and Transportation and/or the Offce of the City Clerk.
C. All regulations designating bus stops, taxi stands and loading zones promulgated by the Municipal
Engineer and approved by resolution of the Municipal Council shall be transmitted to the City Clerk,
who shall keep them on fie for public inspection.
A. In accordance with the provisions of N.J.S.A. 39:4 1 97(2)(c) and § 3-54(C)(l0) of the Code of the City
of Jersey City, a listing of Regulations Designating Reserved Parking Spaces for the Disabled shall be
incorporated in the Chapter 332 Manual-Traffc and Transportation.
B. The listing of all Reserved Parking Spaces for the Disabled of the City of Jersey City shall be
incorporated in the Chapter 332 Manual-Traffc and Transportation. The current list of Disabled
Parking Spaces authorized by Ordinance and/or Regulation within Chapter 332 Manual-Traffc
and Transportation is available for inspection in the Division of Engineering, Traffc and Transpor-
tation and/ or the Offce of the City Clerk.
C. All regulations designating reserved parking spaces for the disabled promulgated by the Municipal
Engineer shall be transmitted to the City Clerk, who shall keep them on file for public inspection.
§ 332-30. Parking of trucks, omnibus, road tractor, semi-tractor, truck tractor or any commercial
motor vehicles.
A. No person shall park any truck, omnibus, road tractor, semi-tractor, truck tractor or any commercial
motor vehicle upon the streets of the City on any day of the week between the hours of 9:00 pm and
5:00 am.
B. No person shall park any trailer, semitrailer or tractor upon any public street or public way while it is
detached from its component unit, except when such trailer or semitrailer is in a continual process of
loading or unloading goods, wares or merchandise.

No person shall stand on or in proximity to a street or other public way for the purpose of soliciting
the watching or guarding of any vehicle while it is parked or about to be parked.
Nothing in this Article shall be construed as prohibiting the city from providing for bus stops, taxicab
stands and other matters of a similar nature, including the loading or unloading of trucks, vans or other
commercial vehicles.

B. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have
been plowed suffciently and to the extent that parking will not interfere with the normal flow of
traffc.
§ 332-35. Posting of signs.
A. Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where
temporary emergency no-parking signs are displayed. The Chief of Police, or in his absence the

ranking police offcer, is authorized to declare an emergency and to direct the posting of said
emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or
require the avoidance of hazards or other conditions which interfere with the free flow of traffc.
B. The posting of "EMERGENCY NO PARKING" signs shall be deemed to be notice to the owner
and/ or operator of any parked motor vehicle.
Any unoccupied vehicle parked or standing in violation of this Article shall be deemed a nuisance and
a menace to the safe and proper regulation of traffc, and any police or parking enforcement offcer may
provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession of the vehicle.
A. The signs to be used as above set forth shall conform to the Manual on Uniform Traffc Control
Devices (MUTCD).
B. The effectiveness of this Article is contingent upon signs being erected as required by law.
ARTICLE V
Buses
A. All operators of buses, when discharging or picking up passengers at a bus stop, shalI cause the bus to .
be driven to the curb at the bus stop in such a fashion as not to impede or obstruct traffc.
B. Whenever there are any prospective passengers waitingat a bus stop, all operators of buses shall stop
to pick up said passengers and shall not pass them by unless the bus is filled to legal capacity with
passengers.
§ 332-39. Enforcement.
A. The provisions of this Article shall be enforced by the uniform rnembers of the Police Depa~tment and
inspectors ?f the Division of Commerce.

parking meters requiring the payment of a fee for parking privileges on the days or hours specified on said
meters, failure to pay the prescribed fee for such parking privileges shall be a violation of this Article,
subject to the penalties as provided herein.
On city streets and properties owned, leased, operated or controlled by the Parking Authority, upon
which the Authority has rented parking space for a prescribed fee and has issued permits to persons
authorized to park at such designated off-street or on-street parking spaces, parking within such parking
spaces without a valid permit shall be a violation of this Article, subject to the penalties as provided herein.
The summonses issued under this Article shall be in the form of the uniform traffc ticket or such other
summonses as may be from time to time designated by the Director of the Division of Motor Vehicles of
the State of New Jersey as the uniform traffc ticket.
A. In addition to any other penalty provided by law, any motor vehicle parked in violation of this Article
and Article III and any motor vehicle whose owner has failed to appear in response to three (3) or
more parking tickets and has received failure to appear notices from theJersey City Municipal Court
may be:
(1) Booted; or
(2) Towed from its parking space and impounded by the Jersey City Parking Authority.
B. No motor vehicle which has been booted or towed away and impounded shall be released until all of
the charges in connection with booting or towing and impounding have been paid.
C. The Jersey City Parking Authority is authorized to establish a schedule of charges for booting,
impoundment and storage of motor vehicles parked in violation of this Article and Article III. Such
schedule shall be fied with the offce of the City Clerk.
§ 332-44. Towing away and booting of vehicles whose owners have failed to appear in response to
traffc tickets. *
A. Notwithstanding any other penalty provided by law, or any previous authorization given to the Jersey
City Parking Authority, no motor vehicle parked in violation of Articles iV and V, or parked in
violation of any other law, regulation, or ordinance, including but not limited to the City's zone
parking ordinances, may be booted; or towed from its parking space and impounded by the City or the
Parking Authority unless the owner of the vehicle has three (3) or more outstanding parking tickets
and has received failure to appear notices from the JerseyCity Municipal Court on such parking
however, that this limitation does not apply within Parking Authority Zones Three
tickets provided,

(3) and Eight (8) and also provided, however, that any vehicle may be towed in an emergency, or when
the vehicle is unreasonably impeding vehicular or pedestrian traffc, or when the vehicle is deemed a
hazard to persons or property.
B. No motor vehicle which has been booted or towed away and impounded shall be released until all of
the charges in connection with booting or towing and impoundment have been paid.
C. The Jersey City Parking Authority is authorized to establish a schedule of charges for booting,
impoundment and storage of motor vehicles as described above. Such schedule shall be filed with the
offce of the City Clerk.
§ 332-45. Signs on off-street parking facilities operated by Jersey City Parking Authority.
Signs identifying this Article and the penalties for the violation thereof shall be placed upon all
Jersey City Parking Authority that are subject to this Article.

§ 332-46. Enforcement.
This Article shall beenforced by the Jersey City Police Department and Parking Enforcement Offcers
of the Jersey City Parking Authority, who shall issue summonses for violations of this Article.
ARTICLE VII
Metered Parking
§ 332-47. Definitions.
The following words and phrases, which are not defined in Subtitle 1 of Title 39 of the New Jersey
Statutes Annotated, shall have the meanings respectively ascribed to them in this section for purposes of
this Article:
BOOT - A locking device affxed to a motor vehicle to prevent its movement. The terms "booting"
and "booted" mean the act of attaching a boot.
PARKING METER - Any mechanical device or meter not inconsistent with this Article placed or
erected for the regulation of parking by authority. of this Article. Each parking meter installed shall
indicate by proper legend the legal parking time established by the city and, when operated, shall at all
times indicate the balance of legal parking time and, at the expiration of such period, shall indicate illegal
or overtime parking.
PARKING METER SPACE - Any space within a parking meter zone, which is adjacent to a
parking meter and which is duly designated for the parking of a single vehicle by lines painted or otherwise
durably marked on the curb or on the surface of the street or lot adjacent to or adjoining the parking
meters.

PARKING METER ZONE - Any restricted on-street parking area ør off-street parking lot upon
which parking meters are installed and in operation.
PARKING SPACE - Any space within an off-street or on-street nonmetered parking zone that is to
be used for parking purposes.
The Jersey City Parking Authority is hereby directed and authorized to provide for the marking off of
individual parking spaces in the parking meter zones designated and described below, said parking spaces
to be designated by lines painted or marked on the curbing or surface of the street or lot. At each space so
marked off, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely
within the limits of the space so designated. When a parking space in any parking meter zone is at right
angles or diagonal to the curb, sidewalk or island, any vehicle parked in such a parking space shall be
parked with the front of the vehicle facing such meter.
A. On-street parking meter zones. Parkingor standing a vehicle in a parking meter space in the on-street
parking meter zones described below shall be lawful during the hours specified only upon the deposit
of such amount as is indicated for each specified period of time:

A. In said parking meter zones, the Jersey City Parking Authority shall cause parking meters to be
installed upon the curb, sidewalk or area immediately adjacent to the parking spaces provided in this
Article. No parking meters shall be installed in areas where parking is prohibited pursuant to the
provisions of N.J.S.A. 39:4-138. The Jersey City Parking Authority shall be responsible for the
regulation, control, operation, maintenance and use of such parking meters. Each device shall be so
set as to display a signal showing legal parking upon the deposit of the appropriate coin, lawful money
of the United States of America, for the period of time prescribed in this Article. Each device shall be
so arranged that upon the expiration of the lawful time limit, it wil indicate by a proper, visible signal
that the lawful parking period has expired, and in such case the right of such vehicle to occupy such
space shall cease, and the operator, owner, possessor or manager thereof shall be subject to the
penalties hereinafter provided.
B. No parking meter shall be installed in any area in conflict with the provisions ofN.J.S.A. 30:4-138
which prohibits vehicles to stand or park in certain locations.

sidewalk, no person shall park or permit the parking of any vehicle in such parking space in any
other
position than with the foremost part of such vehicle nearest to the parking meter; when a parking meter
shall have been installed at the head of and immediately adjacent to any parking space on a municipal
off-street parking lot, no person shall park or permit the parking of any vehicle in such parking space in
any other position than with the foremost part of such vehicle nearest to the parking meter; provided,
however, that in municipal off-street parking lots, signs shall be erected indicating that head-on parking
only is permitted. In any event, a vehicle shall be parked within the lines marked on the pavement
measuring such parking space.
§ 332-52. Violations.
It shall be unlawful and a violation of the provisions of this Article for any person to:
A. Cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to
be parked overtime or beyond the period of legal parking time established for any parking meter
zone as herein described, or to deposit in any parking meter any coin for the purpose of parking
beyond the maximum legal parking time for the particular parking meter zone.
B. Permit any vehicle to remain or be placed in any parking space adjacent to any parking meter
while said meter is displaying a signal indicating that the vehicle occupying such parking space has
already been parked beyond the period prescribed for such parking space.
C. Park any vehicle across any line or marking of a parking meter space or in such position that the
vehiCle shall not be entirely within the area designated by such lines or markings.
D. Deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any
parking meter installed under the provisions of this Article.
E. Deposit or cause to be deposited in any parking meter any slug, device or metal substance or other
substitute for lawful coins.
F. Park or permit the parking of any vehicle in arty parking meter space where the meter does not
register lawful parking.
G. Park any vehicle in anyone (1) parking meter space in an off-street parking meter zone for a period
of longer than the maximum time limit as specified on the adjacent meter time dial, during the
hours from 9:00 am to 9:00 pm, prevailing time.
i. Park any vehicle in any parking space in an off-street nonmetered parking zone for a period longer
than eight (8) hours, during the hours from 9:00 am to 9:00 pm, prevailing time.
1. Park a vehicle other than having the front of the vehicle face a meter in any parking meter zone
where the parking meter space is at right angles or diagonal to a curb, sidewalk or island.
K. Operate a vehicle on any driveway of an off-street parking zone in a manner contrary to the
restrictions as set forth for such driveway.
L. Park a commercial vehicle with a combined weight, truck and load, in excess of four thousand
(4,000) pounds, in any of the off-street parking zones (metered or nonmetered).
M. Park a truck, tractor, trailer or a vehicle moved by human or animal power in any of the off-street
parking zones (metered or nonmetered).
N. Park a vehicle not equipped with pneumatic tires properly inflated in any of the off-street parking
zones (metered or nonmetered).
O. Wash, grease or make any repairs, except those of any emergency nature, to any vehicle, in any
space in any of the off-street parking zones (metered or non-metered).
A. It shall be the duty of the Police and Jersey City Parking Authority Parking Enforcement Offcers,
acting in accordance with instructions issued by the Chief of Police and Jersey City Parking Authority
Director of Enforcement, to report:
(1) The number of each parking meter which indicates that the vehicle occupying the parking space
adjacent to such parking meter is or has been parked in violation of any of the provisions of this
Article.
(3) That such vehicle is parked in violation of any of the provisions of this Article.
(4) Any other facts, a knowledge of which is necessary to a thorough understanding of the circum-
stances attending such violation.
B. Each such Police and Parking Enforcement Offcer shall also attach to such vehicle a notice to the
owner thereof that suth vehicle has been parked in violation of a provision of this Article, and
instructing such owner to report to the Municipal Court with regard to such violation.
Any vehicle left parked for a period exceeding two hours succeeding expiration of the maximum
parking time indicated during the hours of operation specified in the space in which the vehicle is parked
shall be towed, under the direction of the Jersey City Parking Authority to the contracted garage or any
other place designated by the Jersey City Parking Authority for impoundment, subject to redemption by
the owner upon payment of the reasonable cost of towing and a storage charge for each day or portion
thereof during which it remains in said garage or other place.

The coins required to be deposited in parking meters as provided herein are hereby levied and assessed
as fees to provide for the proper regulation and control of traffc upon the public streets and also the cost
of supervising and regulating the parking of vehicles in the parking meter zones created thereby, and to
cover the cost of the purchase, supervision, protection, inspection, installation, operation, maintenance,
control and use of the parking meters described herein.
It shall be the duty of the Jersey City Parking Authority to designate some proper person or persons
to make regular collections of the moneys deposited in said meters, and it shall be the duty of such person
or persons so designated to remove from the parking meters the locked containers therein containing the
coins so deposited in said meters and to deliver such locked containers to the bank depository, who shall
unlock them and count the funds contained in such containers and deposit such funds in the usual manner
provided by law.
The following public streets are established as on-street permit parking zones:
A. No person shall park a vehicle in excess oftwo (2) hours; between the hours of 8:00 am and 5:00 pm,
Monday through Friday, except public holidays, without a valid permit upon any of the streets or
parts of streets as described below.

D. The Chief Executive Offcer of the Jersey City Parking Authority (hereinafter "CEO") is hereby
authorized to issue a parking permit upon written application therefor. Each such permit shall be
designated by the CEO or his or her designee to state or reflect thereon the particular residential
permit parking zone as well as the license number of the motor vehicle for which it is issued. No more
than one (1) parking permit shall be issued to each motòr vehicle for which application is made. The
CEO is authorized to issue such rules and regulations not inconsistent with this chapter governing the
manner in which persons shall qualify for permits.
E. Parking permits shall be issued to motor vehicles only upon application by the following persons:
(I) A legal resident of the residential permit parking zone who has a motor vehicle registered in
his/her nameor who has a motor vehicle for his/her exclusive use and under his/her control.
(2) A person who owns or leases commercial property and actively engages in business activity within
a residential permit parking area or employee thereof (pay stubs shall be submitted for proof of
employment). However, no more than one (I) parking permit may be issued for each employee for
a motor vehicle registered to or under the control of such a person.
(3) A person whois a current student of an educational institution located in the residential parking
permit zone.
G. Proof of motor vehicle ownership or vehicle use and control shall be demonstrated in a manner
determined by the CEO.
H. Temporary residential parking permits may be issued for vehicles which are owned, rented or under
the operational control of any person who owns, leases property or attends school in the residential
permit zone or used in providing services to persons or property in the residential permit zone.
Temporary residential parking permits may also be issued to vehicles owned by temporary visitors
who aioe residing in the residential permit parking zones. Such temporary residential parking permits
shall have all of the rights and privileges of a regular permit. A temporary parking per-mit shall be
valid for no more than ninety (90) days from the date of issuance. No resident of a residential permit
parking zone shall be issued more than two (2) temporary parking permits at anyone (1) time. A
temporary residential parking permit issued to a vehicle providing services or to a vehicle owned by
temporary visitors shall be considered to be a temporary permit issued to the resident of the property
where the services are provided or the temporary visitors are residing.
1. No permit shall be issued to any person who has failed to pay any City of Jersey City municipal
parking fines until such fines, including any penalties thereon, are paid in full, under arrangementwith
the city or Parking Authority; to be paid in full or stayed or overturned by a court of competent
jurisdiction.

§ 332-59 JERSEY CITY CODE
The permit as issued by the Jersey City Parking Authority shall be placed unobstructed on the rear
driver's side of the subject vehicle, e.g., driver's side rear window or driver's side rear bumper.
A. A resident motor vehicle, employee vehicle or transient motor vehicle on which is displayed a valid
parking permit as provided for herein shall be permitted to stand or be parked in the residential permit
parking zone for which the permit has been issued without being limited by time restrictions or area
prohibitions established pursuant to this section. Said resident motor vehicle, employee vehicle or
transient motor vehicle shall not be exempt from parking restrictions or prohibitions established
pursuant to authority other than this section. All other motor vehicles other than vehicles where the
operator or the passenger being transported by said vehicle is physically disabled and the vehicle
displays a license issued under provisions of N.J.S.A. 39:4-205, parked within a residential permit
parking zone shall be subject to the time restrictions or area prohibitions adopted in this section.
B. A resident parking permit shall not guarantee or reserve to the holder thereof an on-street parking
space within the designated residential permit parking zone.
Upon the request of the Fire Chief, the CEO of the Jersey City Parking Authority or his or her
designee shallissue to the offcer in charge of a fire station within a residential permit parking zone, not
more the five (5) temporary parking permits for the use of members transferred to the unit on an
. emergency basis. The Fire Chief may issue rules and regulations on the use of said temporary permits not
inconsistent with this Article.
Each parking permit issued by the CEO of the Jersey City Parking Authority or his/her designee shall
be valid for not more than one (1) year. Permits shall be renewed annually on a date to be determined by
the CEO. Each application or reapplication for a parking permit shall contain information suffcient to
identify the applicant, his residence addressor address of real property owned or leased within a
residential permit parking and the license number of the motor vehicle for which application is made and
such other information that may be deemed relevant by the CEO.
The fee for a residential parking permit, temporary residential parking permit and transfer charge
shall be as provided in Chapter 160, Fees and Charges.
A. A residential area shall be deemed eligible for consideration as a residential permit parking zone if,
based on surveys and studies prepared by or at the direction of the Municipal Engineer or the Chief
Exeçutive Offcer of the Jersey City Parking Authority, objective criteria establish that the residential
area is impacted by commuter vehicles for any extended period.

B. In determining whether a residential area is eligible for designation as a residential permit parking
zone, the factors to be considered shall include but are not limited to the following:
(1) The extent of the desire and need of the residents for residential permit parking and their
wilingness to bear the administrative costs in connection therewith.
(2) Ninety (90) percent of the legal on-street parking spaces are occupied by motor vehicles during the
period proposed for parking restriction.
(3) Twenty (20) percent of the vehicles parking in the area during the period proposed for parking
restrictions are commuter vehicles rather than resident vehicles.
(4) The extent to which motor vehicles registered to persons residing in the residential area cannot be
accommodated by the number of available off-street parking spaces.
The CEO of the Jersey City Parking Authority is authorized to revoke the residential parking permit
of any person found to be in violation of this Article and, upon written notification thereof, said person
shall surrender such permit to the CEO of the Jersey City ParkingAuthority or his designee. Failure when
so requested to surrender said permit shall constitute a violation of this Article.
B. Proof of residency of within said on-street resident only permit parking zones shall be req uired prior
to the issuance of a resident only permit parking permit.
C. ,Said permit shall be valid only where authorizeç On-Street parking is available and within the
on-street resident only parking zone designated thereon; all other parking regulations prevailing.
D. No person shall park a vehicle without a valid permit on any of the streets designated as follows:

ARTICLE IX
Parking for the Disabled
§ 332-68. Parking for the disabled.
No person shall park a vehicle upon any of the streets or parts thereof described below, except those
persons with special parking permits as described in this Article. Schedule 25 shall be incorporated within
the Chapter 332 Manual-Traffc and Transportation and is available for inspection in
the Division of
Engineering, Traffc and Transportation and/or the Offce of the City Clerk.
A. The City of Jersey City may, for good cause shown, establish by ordinance restricted parking zones in
front of or near residences occupied by disabled drivers, provided that such parking is not otherwise
prohibited and does not interfere with the normal flow of traffc. No restricted parking zones wil be
established for persons who do not transport themselves and who do not possess a valid disabled
person identification card and placard or license plate issued by the State of New Jersey, Division of
Motor Vehicles, pursuant to N.J.S.A. 39:4-205 and 39:4-206 unless the Municipal Council determines
that:
(1) The nondisabled driver resides in the same household as the disabled person (documentation must
be provided).
(2) The disabled person needs to be transported at least five (5) days per week to work, school or other
educational or gainful activity (documentation must be provided detailing where, when and why
the disabled person is transported).
(3) The disabled person's disability is such that it would preclude the disabled person from waiting on
the sidewalk until the nondisabled driver arrives with the car or finds parking (documentation
must be provided detailing the extent of the disability).
(4) The parking conditions in the disabled person's immediate neighborhood warrant this exception;
and
(5) A reasonable person would deem it highly unusual and unjust to deny a restricted parking zone
even in light of the competing demands for parking spaces within a given neighborhood.
B. No restricted parking zones will be established for applicants who have a driveway, carport, garage or
off-street space available for their use unless the Municipal Council determines that:
(I) Such driveway, garage Or space cannot accommodate the driver's vehicle; Or
(2) The driver has need ofa specially equipped vehicle which cannot be reasonable accommodated by
such carport, garage or space.
. C. The term "disabled" means a condition wherein a person has lost the use of one (1) or more lower
limbs as a consequence of paralysis, amputation or other permanent disability or who is permanently
disabled as to be unable to ambulate without the aid of an assisting device or whose ambulation is
otherwise severely limited. In any case, the severity of the mobility disability shall be similar to or
approximate disablement by reason of amputation.
D. Notarized applications for the establishment of restricted parking zones shall be fied with the Jersey
City Division of Engineering, Traffc and Transportation, which shall investigate each application for
compliance with Subsection A. The application shall be accompanied bya medical evaluation form
completed by the applicant's personal physician. The personal physician shall include a certification
stating that the applicant has a mobility disability as described in Subsection 332-69 C. Application
forms and medical evaluation forms can be obtained from the Division. Thereafter, the Division shall

notify the applicant when and wnere to report for a medical examination or, in the alternative, shall
notify the applicant of the person to contact to arrange such medical examination. The examining
physicians shall be selected by the Municipal Council Committee on Parking for the Disabled. The
cost of examination shall be borne completely by the applicant. The applicant shall bring to the
examination any and all medical or other documentation which he or she believes relevant to the
applicant's medical condition. Such documentation may include, but will not be limited to X-ray
reports, C.T. scan reports, cardiograms, hospital and surgical records and attending physicians'
reports. If the examining physician does not possess adequate documentation to verify the applicant's
eligibility under Section 332-69 C and cannot by application alone verify such eligibility, the applicant
shall be rejected. An application filed by a tenant shall also be served upon the landlord.
E. If the City Council so approves, the Municipal Engineer shall establish a restricted parking zone in
front of or near the residence of the applicant and shall issue a permit which complies with N.J.S.A.
39:4-197.7. Only the motor vehicle for which a valid permit has been issued shall be parked in such
zone and only when the permit is properly displayed. Only one (1) permit shall be issued to the
applicant. No restricted parking zones, other than those granted by the Police Department in
emergencies, shall be approved except in the manner provided in this section.
F. No more than one (1) restricted parking space shall be granted at anyone (1) building address where
the building is comprised of six (6) dwelling units or less, and no more than two (2) disabled parking
space shall be granted at anyone (1) building address where the building is comprised of seven (7)
dwelling units or more. At any address from which a disabled parking space or spaces have already
been granted, any additional permits approved for that address shall bear the same permit number as
exists for the space already granted. Such space or spaces may be used by anyone possessing the
corresponding numbered permit on a first come, first served, basis. This provision shall apply only to
applications approved or denied after the effective date of this amendment.
in accordance with therequirements of this Article. A permit may be reviewed earlier if conditions
concerning the applicant change.
H. Any party denied a restricted parking zone shall have the opportunity to request reconsideration of
such decision. A letter requesting reconsideration must be received by the Division of Engineering,
Traffc and Transportation within twenty (20) days of the date of the notice of deniaL. The applicant
wil then be instructed to report for a reexamination with an examining physician and/or in
appropriate cases, the committee, or its designee, may hold a hearing to reconsider any relevant
evidence pertaining to the applicant's eligibility. As in the initial medical examination, costs for this
reexamination shall be borne by the applicant. It shall be the applicant's responsibility to bring to the
examination any and all documentation in support of his or her condition. The applicant wil be
notified by mail of the decision on reconsideration. No more than one (1) reconsideration wil be given
each applicant. Thereafter, the applicant may reapply after one (1) year has elapsed from the date of
the notice of deniaL.
i. Any party willfully presenting false information or documentation to the Committee or found to be
abusing any parking privileges granted under this Article shall be subject to loss and/ or denial of such
privileges.
All persons with existing restricted parking zones which do not comply with this Article are hereby
canceled six (6) months after the effective date of this article. The Municipal Engineer shall establish fair
and uniform procedures to assure that each holder of an existing permit is afforded an opportunity to
present evidence of compliance. Such procedures shall provide that notice of cancellation be sent to all
persons with existing restricted parking zones at least forty-five (45) days before the cancellation of such
permit.
A. The Municipal Engineer may, by regulation, establish restricted parking zones in front of schools,
hospitals and other public buildings and in public parking facilities and in shopping and business
districts for use by persons who have been issued special vehicle identification cards by the Division of
Motor Vehicles pursuant to N.J.S.A. 39:4-205 when using a motor vehicle on which is displayed a
certificate for which a special vehicle identification card has been issued.
B. All regulations establishing restricted disabled parking spaces pursuant to Subsection A above and the
location of such spaces are available for review in the Office of the City Clerk and in the Division of
Engineering, Traffc and Transportation.

ARTICLE
(3) Parking a vehicle on private property for forty-eight (48) hours or more without the consent of the
owner or for any period without license plates. A vehicle which is parked on a street or on 'public
property fopforty-eight (48) hours or more may be presumed to have been abandoned under this'
subsection.
A. The Police Department may tow away and impound or boot any vehicle under the following
circumstances:
(1) The vehicle has been abandoned as provided in the preceding section.
(2) The vehicle is parked in violation of any provision of this chapter or of Title 39 of the New Jersey
Statutes.

(3) The vehicle constitutes a danger or impediment to traffc or a danger to public safety.
(4) There exists outstanding warrants against the owner of the vehicle issued in connection with
parking offenses involving that specific vehicle.
B. Neither the'city nor its agents or employees shall be liable for the loss of any vehicle or for damage to
any vehicle which is booted or impounded and stored by the city or by an agent of the city, nor shall
the city be liable for the disposal of any impounded vehicle.
C. The Police Department may use the services of a private tower to enforce any of the provisions of this
Article.
A. When a police offcer removes a vehicle from a street or other public way, as authorized in this Article,
and the offcer knows or is able to ascertain from the registration records in the vehicle or in some
other way the name and address of the owner thereof, the offcer shall immediately give or cause to be
given notice in writing by registered mail to such owner of the fact of such removal, the reasons
therefor and the place to which the vehicle has been removed. In the event the vehicle is stored in a
public garage, a copy of such notice shall be given to the proprietor of the garage.
B. When a police offcer removes a vehicle from a street under this Article and does not know and is not
able to ascertain the name of the owner, or for any other reason is unable to give the notice to the
owner as herein provided, and in the event the vehicle is not returned to the owner within a period of
three (3) days, the offcer shall immediately send or cause to be sent a written report of such removal
by mail to the New Jersey State Division of Motor Vehicles, and shall file a copy of such notice with
the proprietor of any public garage in which the vehicle may be stored. Such notice shall include a
complete description of the vehicle, the date, time and place from which removed, the reasons for such
removal, and the name of the garage or place where the vehicle is stored.
A. Should any person abandon any motor vehicle on any street in the city or on property other than his
own, without the consent of the owner of said property, for a period longer than forty-eight (48)
hours, or upon discovery of any motor vehicle apparently abandoned in the city, or of any motor
vehicle that apparently has been involved in an accident and is a menace to traffc, the
police may take
such motor vehicle into its custody and cause the same to be taken to, stored or impounded in the place
or places designated as a motor vehicle pound.
B. There shall be no liability attached to the police for taking or impounding the motor vehicle or for any
damages to it while in the custody of the police.
C. The motor vehicle shall not be released or removed from the pound except upon the payment to the
city of the charges set forth herein for the taking, removal, towing and storage.
D. There shall be no charge for impounding motor vehicles which are not insured for theft, towing and
storage when such vehicle has been taken without the consent of the owner or stolen within the city
and then subseqûently recovered within the city. However, the charges wil not be waived when the
vehicle is stolen or taken at some point outside the city and then recovered within the city.
E. The charges for taking, removing or towing and storage of any impounded motor vehicle shall be as
indicated in Chapter 160, Fees and Charges.
A. The Police Department is hereby authorized to tow away, or have towed away by a commercial towing
service, any vehicle which:
(1) Is ilegally parked within any parking meter zone or parking space within an off-street metered
parking zone.
(2) Is ilegally parked in any place where such vehicle constitutes a traffc hazard, blocks the use of a
fire hydrant or a driveway or obstructs or may obstruct the movement of any emergency vehicle.
B. Vehicles towed away for illegal parking shall be stored away in a safe place and shall be restored to the
owner or operator of such vehicle upon payment of fees indicated in Chapter 160 Fees and Charges.
§ 332-77. Violations.
(1) Removing or attempting to remove an impounded vehicle without paying all of the storage
charges;
(3) Tampering with a boot, damaging or attempting to damage a boot fastened to a vehicle.
ARTICLE XI.
Titles 39, 40 Private Property
A. The following parking restrictions shall apply in the shopping areas designated:
(1) Hudson Mall (Block i 751, Lots 10J, M and N; Block 1746.5, Lot H-4.)
(a) Within sixty (60) feet of the curb1ine in front of the business places therein.
(c) At any other area not within the area designated by white parking place lines.
(2) Stadium Shopping Plaza (Block 1288-A, Lot 1-L/l-M). No person shall park a vehicle:
(a) Within thirty-five (35) feet of the curbline in front of the business places.
(c) At any other area not within the area designated by white parking place lines.
B. No person shall park any truck or bus within the following described areas unless the truck or bus is
in the process of delivering or picking up materials or passengers, in the case of public utilities, while
performing necessary functions thereon:
(1) Hudson Mall area known as Block 1751, Lots lOJ, M and N; Block 1746.5, Lot H-4, containing
approximately 48~98 acres and located on Route 440 in Jersey City and situated immediately west
of lands and buildings of Jersey City Leasing Corporation, commonly referred as "Hudson Mall."
(2) Stadium Shopping Plaza, known as Block 1288-A, Lot l-L/ 1 -M, containing approximately 19.00
acres and located on Route 440 in Jersey City.
A. The provisions of Title 39, Subtitle I, are hereby made applicable to Newport, including all roads,
streets, driveways, terraces, parkways, parking areas and other roadways within the area commonly
known as Newport, and open to or used by the public, tenants and employees for the purpose of
vehicular traffc.
B. The Newport Associates Development Company is hereby authorized to install and maintain a traffic
signal system at the public-private intersection of Washington Boulevard and the main entrance to
Target. The traffic signal shall conform to the same specifications as those regulating other local
intersections.
The provisions of Title 39, Subtitle I, are hereby made applicable to Port Liberte, including all roads,
streets, driveways, terraces, parkways, parking areas and other roadways within the area commonly
known as Port Liberte, and open to or used by the public, tenants and employees for the purpose of
vehicular traffc.
The provisions of Title 39, Subtitle I, are hereby made applicable to Society Hil, including all roads,
streets, driveways, terraces, parkways, parking areas and other roadways within the area commonly
known as Society Hill, and open to or used by the public, tenants and employees for the purpose of
vehicular traffc.
A. Pursuant to N.J.S.A. 39:4-138.4, the Municipal Engineer may issue to owners of private driveways and
to members of the same household permits authorizing the parking of private passenger vehicles in
front of the owner's driveway. The Director may require an owner to fie a completed application for
such a permit on a form provided by the Director. An owner of a private driveway shall be eligible to
apply for up to three permits for his or her own motor vehicles or for use by other parties authorized
by the owner to park in front of the private driveway. Each member of the owner's household who

owns a motor vehicle shall also be eligible to apply for a permit iSS1ed under this section. There shall
be a fee of $5 for each vehicle authorized to park in front of a private driveway. The Director may
require an applicant to provide evidence thatthe driveway was legally established in accordance with
the Jersey City Construction Code.
B. The permit shall identify the location of the driveway and the vehicle authorized to park in front of the
driveway. The permit shall be five and one-half (5112) by eight and one-half (8112) inches in size, shall
bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle
when it is parked so as to be seen from the middle of the street.
C. Provided that such parking is not otherwise prohibited and does not interfere with a normal flow of
traffic, it is an affrmative defense to prosecution for violation of N.J.S.A. 39:4-138(d) if:
(1) The parked vehicle and driveway where the vehicle is parked are owned by the same person; or
(2) The parked vehicle is owned by a member of the same household as the owner of the private
driveway; or
(3) The owner of the private driveway authorized the parking of the parked vehicle in front of the
private driveway.
D. This defense may be presented by form of affdavit as provided for in the New Jersey Court Rule
7:6-6(a).
E. No owner may permit any vehicle to park in front of the owner's driveway other than a vehicle
registered in the name of the owner or a member of the owner's household residing with the owner.
F. No owner may charge a fee for permitting anyone to park a vehicle in front of the owner's driveway.
G. The rights conferred upon an owner under Subsection C shall extend only to the street in front of the
driveway parallel to the curb.
H. This section confers no rights to park a vehicle on any part of the driveway which lies across the
sidewalk nor does it confer upon an owner the exclusive right to park a vehicle adjacent to any part of
the curb beyond the width of the driveway.
§ 332-83. Parking within designated properties of the Jersey City Housing Authority.
A. No person shall park a vehicle at any time upon any of the properties of the Jersey City Housing
Authority, or part thereof, listed below.
(1) Parking prohibited at all times. In accordance with the provisions of this section, parking is
prohibited on the following Housing Authority streets or parts thereof:
(a) The area"on Colden Street adjacent to the south end of Building No.8, from a point 50 feet
west of the Lehigh Valley Railroad overpass to a point 75 feet west.
(b) Fremont Street: east side, from a point 225 feet north of Colden Street to a point 250 feet
north.
(a) North driveway: north side, from a point 80 feet south of Pamrapo Avenue to a point 90 feet
south.
(b) North driveway: south side, from a point 765 feet west of Old Bergen Road to a point 755 feet
west.
(c) North driveway: south side, from a point 555 feet west of Old Bergen Road to a point 545 feet
west.
(d) North driveway: south side, from apoint 330 feet west of Old Bergen Road to a point 320 feet
west.
(e) North driveway: south side, from a point 70 feet west of Old Bergen Road to a point 60 feet
west.
(f) Parking Area No.1; south side, from a point 45 feet north of Merritt Street to a point 100 feet
north.
(a) West driveway: east side, from a point 260 feet north of Duncan Avenue to a point 330 feet
north.
(b) East driveway: east side, from Duncan Avenue to a point 465 feet north.
(c) West driveway: west side, from Duncan Avenue to a point 285 feet north.
HOLLAND GARDENS
(a) South driveway: north side, from its intersection with Erie Street to a point 90 feet west of Erie
Street.
HUDSON GARDENS
(a) In the small horseshoe shaped area adjacent to Parking Area No.1, at the south end of
McPherson Place.

TITLE:
WHEREAS, Pastor Erwin Lanier, Sr. is the founder and pastor of Good News Bible Mission Church and
Dean of Good News Bible Mission Institute. The church was established in 1969 with a few members and
was located in the Marion Gardens Community Center. Pastor Lanier's goal was to reach lost souls in the
community and surrounding areas; and
WHEREAS, Pastor Erwin Lanier has provided a ministry oflove, faith, and hope to the City of Jersey City
. and its surrounding areas for more than 40 years. The church is located at 36-38 Dales Avenue in Jersey City.
Under his leadership, Good News Bible Mission Church has become a staple in its community. Pastor Lanier
and church volunteers serve the congregation and community through specialized ministries which include
a Hospital Ministr, a Senior Ministry, a Prison Ministr, a telephone ministr and an aparent ministr;
and
WHREAS, Pastor Erwin Lanier is an honored role model and inspiration to alL. Ministers from all over
the tri-state area and beyond look to Pastor Erwin Lanier for instrction, guidance, direction, support and
friendship; and
WHREAS, Pastor Lanier was parered in mariage and in ministr to the late beloved Sis. Shirley
Lanier. He is the proud father of Erwin Jr., Errold, and Michael Lanier. He was with his seven
grandchildren, Errold Jr., Kiera, Emmanuel, Briana, Tyler, Maleka and Marquera.
NOW, THEREFORE BE IT ORDAINED, that the Municipal Council of the CityofJersey City deems
it fitting and proper to commemorate the name of Pas tor Erwin Lanier, Sr. as par of the civic heritage of the
City of Jersey City by dedicating that Dales Avenue between Logan Avenue and Broadway to also be known
as Pastor Erwin Lanier, Sr. Drive
A. All ordinances and par of ordinances inconsistent herewith are hereby repealed.
B. This ordinance shall be a par of the Jersey City Code as though codified and fuIiy set forth therein.
The City shaIi have this ordinance codified and incorporated in the offcial copies of
the Jersey City
Code.
C. This ordinance shall tae effect at the time and in the maner as provided by law.
D. The City Clerk and the Corporation Counsel be and they are hereby authorized and directed to change
any chapter numbers, aricle numbers and section numbers in the event that the codification of
this
ordinance reveals that there is a conflct between those numbers and the existing code, in order to .
avoid confusion and possible accidental repealers of existing provisions.
