On Remembrance Day in Canberra | was moved by the respect these serving military personnel showed for the Australian people by their conduct and immaculate presentation of the highest standard. I have today seen a copy of the Amendments to the High Court Rules 2004 incorporating the Name of the Queen on process. The Rules are still non-conforming with the Provisions we have made over time in the Judiciary Act 1903 (Cth) and Crimes Act 1914 ( Cth) and require further amendment. The Restrictive Access regime in place in the High Court Rules 2004 Rules 6.05,6.06 and the amended Rule 6.07 remain, and there is still no machinery available to activate $ 30 Judiciary Act 1903 (Cth). S 30 is made in these terms: SECT 30 Original jurisdiction conferred In addition to the matters in which original jurisdiction is conferred on the High Court by the Constitution, the High Court shall have original jurisdiction: (@) in all matters arising under the Constitution or involving its interpretation. (©) in trials of indictable offences against the laws of the Commonwealth We have legislated $ 13 Crimes Act 1914 ( Cth) into force in these terms, SECT 13 Institution of proceedings in respect of offences Unless the contrary intention appears in the Act or regulation creating the offence, any person may: (a) institute proceedings for the commitment for trial of any person in respect of any indictable offence against the law of the Commonwealth; or (b) institute proceedings for the summary conviction of any person in respect of any offence against the law of the Commonwealth punishable on summary conviction. A breach of Statute Law was always an Indictable Offence but without an effective means of instituting it, we as Legislators are sending our country broke, We are giving a subsidy of Billions a year to corporations including State Governments who have been and I believe continue to break the laws of this country. The Constitution is a peoples’ document and does not deserve to be made inoperative by insubordination of the highest order. The Queen is the keystone of the Constitution and while Her Name is now on the Process, the Revenue is still being denied the full benefit of the work of the Parliament. This is something you should discuss with the Governor General in Council and take appropriate steps to ensure good government. ‘As the Senate we are able to insist on the machinery to have our work mean something to the people of the Commonwealth. We call upon you as Governor General to do everything in your power to ensure the Laws of the Commonwealth are executed and maintained under S 61 Constitution. To be properly governed the provisions of High Court Rules 2004 must not have restrictive access rules, and punitive filing fees preventing all people from access to the Sovereign power of the Commonwealth. Since 1400 AD access to the Sovereign's court was absolutely free and provided almost half the Royal revenue into consolidated revenue. This is being presently denied despite laws providing for such revenue to be raised.
