By this application accused female of 30 years is seeking

relaxationsofthebailconditionofattendance&surety.

SPPAdv.Gharatopposedtheapplication.Adv.Jainfor

the applicant submitted that the applicant has sufficiently marked

herpresencewiththeIOandisreadytoremainpresentasandwhen
called by the IO. He further submitted that the applicant is in
difficultytoarrangeforthesuretyandassuchinadditiontothecash
bailamountoftheapplicanthebeorderedtobereleasedonbailon
herfurnishingsuretyofRs.15,000/only.

It is not disputed that the applicant has marked her

presence with EOW as per the bail order. The address of the
applicantisalsonotdisputedbytheinvestigationagency.Applicant
isalreadyreleasedonprovisionalcashbail.I.O.wasunabletosatisfy
astowhatpartofinvestigationwillbefrustratedif,bailconditionof
attendanceisrelaxed.Soalso,whatinvestigationisbeingcarriedout
withapplicantonthedayofherattendance,isalsonotshown.Even
otherwise applicant is bound to mark her presence as and when
called by the investigation agency. Hence, the condition of
attendancesoimposedonapplicantisrequiredtoberelaxed.

So also, the address of the applicant at Thane is not

disputed by the IO. Applicant is a female. In city like Mumbai or

ThaneitisdifficultforafemaletoarrangefortheSurety.Applicant
isalreadyonprovisionalcashbailonherdepositofRs.5Lacs.As
such,Iamoftheviewthatthebailorderofsuretyisalsorequiredto
berelaxed.Hence,theorder.

ORDER
1.

Bail condition of attendance of applicant is hereby

relaxedandmodifiedwithconditionthatapplicantshallmarkher
presencewiththeofficeofinvestigatingagencywiththeIOasand
whencalledbytheI.O.

2.

In addition to the cash bail amount of Rs.5,00,000/

already deposited by the applicant the applicant is ordered to be

releasedonherexecutingonelocalSBofRs.15,000/.
