Consequent on the budgetary changes in Finance Bill 2016 Chapter IX of the Customs
Act, 1962 stands amended. Accordingly, a new Regulation called the Private
Warehouse Licensing Regulations, 2016 has been issued vide Notification No. 71/2016
dated 14.05.2016.
In terms of the aforementioned Notification the following conditions are to be
fulfilled before issuance of the Licence.
(a) Provide an all risk insurance policy, that includes natural calamities, riots , fire,
theft, skillful pilferage and commercial crime, in favour of the President of India,
for a sum equivalent to the amount of duty involved on the dutiable goods
proposed to be stored in the private warehouse at any point of time;
(b) Provide an undertaking indemnifying the Principal Commissioner of Customs Or
Commissioner of Customs, as the case may be, from any liability arising on
account of loss suffered in respect of warehoused goods due to accident
damage, deterioration, destruction or any other unnatural cause during their
receipt, delivery, storage, dispatch or handling and
(c) Appoint a person who has sufficient experience in warehousing operations and
customs procedures as warehouse keeper.
Further, it is also requested that the application as prescribed in the Circular No.
26/2016 Customs dated 09.06.2016 may please be submitted to this Office for further
action at this end.

The Principal Commissioner of Central Excise, Bangalore I Commissionerate has
extended the validity of your Private Bonded Warehouse Licence bearing No. 98/2006
dated 12.06.2006 subject to the fulfillment of the conditions specified in Regulation 3 & 4
of the Private Warehouse Licensing Regulations 2016 within the time specified in
Regulation 9 ibid. The said Licence will be valid until and unless it is cancelled in terms of
the provisions under Section 58B of Customs Act 1962 or sub-regulation (2) of Regulation
8 ibid.
Further, the validity of the In Bond Manufacturing Sanction Order No. 98/2006
issued for the aforementioned Private Bonded Warehouse Licence No. 98/2006 has been
extended upto 18.05.2021 in terms of Section 65 of the Customs Act 1962.
Necessary endorsements have been made in the Original Licence and the Inbond
Manufacturing Sanction Order mentioned above.

The issue pertains to bonding of the Additional Premises located in the
jurisdiction of this Commissionerate, wherein the main Licence is located in the
jurisdiction of the Bangalore III Commissionerate. This was incongruity was due to
the fact of bifurcation of the Commissionerates during the year 2014.
The Joint Commissioner has directed me to inform you that application is
required to be filed in this Office for issuance of fresh Private Warehouse License for
the aforementioned premises subject to the conditions stipulated in the Private
Warehouse Licensing Regulations, 2016.
