ANACTtoprovideforthecertificationofdrivereducationproviders;toprescribecertainrecordkeepingandprogram
requirementsfordrivereducationproviders;toprovideforthecertificationofdrivereducationinstructors;toprescribe
thepowersanddutiesofcertainpersonsanddepartments;toprescribecertainfees;toestablishafundinthestate
treasury;toprescriberemedies,sanctions,andpenalties;andtorescindadministrativerules.

ThePeopleoftheStateofMichiganenact:
256.643Drivereducationinstructorpreparationprogram.
Sec.23.(1)Acollegeoruniversityorapersonapprovedbythesecretaryofstatemaypresentadrivereducation
instructorpreparationprogram.Acollege,university,orpersonshallnotoffertoengageorengageintheactivityof
presentingadrivereducationinstructorpreparationprogramwithoutthepriorapprovalofthesecretaryofstate.
(2)Acollege,university,orpersonmayapplytothesecretaryofstateforapprovaltoconductadriver
educationinstructorpreparationprogram.Acollege,university,orpersonseekingapprovalshallpresentsatisfactory
evidencetothesecretaryofstateasprescribedbythesecretaryofstatethatthecollege's,university's,orperson's
proposedprogrammeetstherequirementsofthissection.
(3)Thesecretaryofstateshallreviewandapproveadrivereducationinstructorpreparationprogramthatmeets
therequirementsofthissection.Thesecretaryofstateshallgivethecollege,university,orpersonrequestingapprovala
writtennoticeofthesecretaryofstate'sapprovalordenial,includingthereasonforanydenial.
(4)Thesecretaryofstateshallprepareadrivereducationinstructorpreparationprogramguideasamodelfor
howtoconductadrivereducationinstructorpreparationprogram.Themodelprogramguideshallidentifythecontentof
eachcourseidentifiedinsubsection(7).
(5)BeginningSeptember1,2007,adrivereducationinstructorpreparationprogramshallconsistofnotless
than4drivereducationpreparationcourses.
(6)Acollege,university,orpersonseekingapprovalofadrivereducationinstructorpreparationcourseshall
presentevidencesatisfactorytothesecretaryofstatethattheproposedcoursemeetstherequirementsofthissection.The
secretaryofstateshallreviewadrivereducationinstructorpreparationcourseanddeterminewhetherthatcoursemeets
therequirementsofthisact.Thesecretaryofstateshallprescribetheadministrationandcurriculumofadrivereducation
instructorpreparationcourse.Thesecretaryofstateshallgivethecollege,university,orpersonrequestingapproval
writtennoticeofthesecretaryofstate'sapprovalordenial,includingthereasonforanydenial.
(7)Adrivereducationinstructorpreparationprogramshallconsistofnotlessthan4drivereducationinstructor
preparationcourses.The4requiredcoursesshalleachconcentrateononly1ofthefollowingconcepts,andallofthe
followingconceptsshallbecoveredintheminimum4coursesrequired:
(a)Drivertaskanalysis.
(b)Developingclassroomandprogramknowledge.
(c)Developingvehicleoperationskills.
(d)Practicum.
(8)Adrivereducationinstructorpreparationcourseshallconsistofnotlessthan2semesterhourspercourseor
theequivalentofnotlessthan2semesterhourspercourseasapprovedbythesecretaryofstate.Adrivereducation
instructorpreparationcourseshallextendfornotlessthan3weeks.
(9)Aninstructorwhoteachesadrivereducationinstructorpreparationcourseshallmeetthefollowing
requirements:
(a)Haveamaster'sdegreeineducationfromanaccreditedcollegeoruniversity.
(b)Holdavaliddrivereducationinstructorcertificateissuedbythesecretaryofstate.
(c)Anyotherrequirementthesecretaryofstatedeterminesisnecessarytodetermineinstructor
qualifications.
(10)Acollege,university,orpersonapprovedbythesecretaryofstatethatoffersadrivereducationinstructor
preparationcourseshallincludeinthecourseregistrationmaterialinformationexplainingthedrivereducationinstructor
qualificationsrequiredunderthisact.
(11)Thesecretaryofstateshallrevieweachdrivereducationinstructorpreparationprogramapprovedunder
thissectionatleastonceevery3years.
(12)Adrivereducationpreparationcoursecreditearnedthroughacollege,university,oranotherentityin
anotherstatemaybeacceptedonthesamebasisastheequivalentcreditearnedthroughadrivereducationinstructor
preparationprogramconductedbyacollegeoruniversityorbyapersonapprovedbythesecretaryofstate,ifapproved

bythesecretaryofstate.Apersonseekingapprovalofadrivereducationcoursecreditearnedinanotherstateshall
presentsatisfactoryevidencetothesecretaryofstatethattheotherstate'scoursesubstantiallymeetstherequirementsof
thisstate.Thesecretaryofstateshallreviewadrivereducationpreparationcoursecreditearnedinanotherstateand
determinewhetherthatcoursecontentmeetstherequirementsofthisact.Thesecretaryofstateshallgivethepersona
writtennoticeofthesecretaryofstate'sapprovalordenial,includingthereasonforanydenial.
(13)Thissectiondoesnotapplytoanapplicantforadrivereducationinstructorcertificatethatislimitedto
thetruckdrivertrainingclassification.

256.645Conditionaldrivereducationinstructorcertificate;issuance;requirements.
Sec.25.(1)Apersonshallnotparticipateinapracticumcourseconductedbyacollegeoruniversityorbyaperson
approvedbythesecretaryofstateunlessthepersonpossessesaconditionaldrivereducationinstructorcertificate.
(2)Apersonshallapplytothesecretaryofstateforaconditionaldrivereducationinstructorcertificate.The
secretaryofstatemayissueapersonaconditionaldrivereducationinstructorcertificateafterthepersonpresents
satisfactoryevidencetothesecretaryofstatethattheapplicantcomplieswithbothofthefollowing:
(a)Meetsallofthedrivereducationinstructorapplicationrequirementsundersection17exceptfor
completionofapracticumcourse.
(b)Isenrolledinapracticumcourseconductedbyacollegeoruniversityorbyapersonapprovedby
thesecretaryofstate.
(3)Thissectiondoesnotapplytoanapplicantforadrivereducationinstructorcertificatethatislimitedtothe
truckdrivertrainingclassification.
