Let us register as voters to chart the

nations destiny
The election year is here with us and
as part of the preparation exercise, the
Independent Electoral and Boundary
Commission (IEBC) this week launched
a one-month long exercise to encourage
Kenyans to register as voters.
In all the Commission which is mandated to give Kenya a free and fair election
exercise expects to register more than
6 million voters in the exercise that runs
up to February 14.
Eager to boost their numbers and increasing their chances of winning the
August 2017 polls, the major political
parties are engaged in mobilizing their
supports to turn up in large numbers to
register as voters.
As it is evident from the current political
scenario, it is numbers which will make a

difference in the countrys political landscape

during the next general elections.
Political participation is part and parcel of the
leadership nature of this ummah. Islm by its
nature is a very dynamic way of life, which
motivates Muslims to have a positive impact
on their societies, regardless of where and
amongst whom they live. Whatever Islm
calls for, be it in the social sphere, spiritual
sphere, economic sphere, and so forth, it
provides benefits and solutions for all human
beings, Muslim and non-Muslims.
Political participation is one effective way of
creating and influencing change in the society. If we remain aloof and choose to stay
away, we will fail to contribute to positive
change in the country.
Muslims are part and parcel of the Kenya
fabric and like other Kenyans, they too have

a responsibility to choose leaders who capable of bringing positive change to the society.
Muslims no doubt comprise a significant
population in the country with projections
indicating that at least 30 percent of the
Kenya populace subscribes to the Islamic
faith. If a significant number register as voters, the community could as well play an
important role in influencing the outcome
of the elections not only for the top leadership position but also for other offices such
as Governors, Members of Parliament and
other electoral offices especially in areas
where they command a significant presence.
Further, galvanizing these numbers could
potentially turn the community into a poContinued To Page 2

Kadhi warns on divorces

adding that couples must not divorce as this brings harm to one
another and constitutes an act that demolishes this noble establishment.
The Quran demands time and patience in executing a divorce in
the hope of making the union possible knowing that the couple is
bound to have differences, Sheikh Shaaban said.
Addressing the Muslim faithful at Nambale Jamia Mosque in Busia
during an Islamic convention, he pointed out that divorce or separation between couples without just reason is one of the major

in senseless and reckless divorce instead of seeking to solve their
differences in an amicable manner. Sheikh Shaaban Issa Muhammad noted that marriage is a sacred bond that brings together a
man and a woman by virtue of the Islamic teachings thus each
partner in this sacred relationship must treat the same with dignity
and respect.
The Senior resident Kadhi decried over the increased cases of
triple divorce in one sitting stressing that Islamic teachings leans
more towards safeguarding marriage than dissolving it abruptly

tentially political force where it can play a
significant role in influencing the outcome
of the election.
Muslim organisations need also to embark
on initiatives designed to empower Muslims to increase their political capacity and
to turn up in big numbers to register as voters.
Perhaps, it might be prudent for Muslim
organsiations to work closely with IEBC
to set up registration centres in the vicinity of mosques and community centres to
encourage people to come out and register
as voters.
Imams should also use the mimbar (pulpits) especially on Fridays to urge those
who are eligible to vote on the importance
of voting and participation in the public life.
Young people who are typically under-represented on voter rolls and should particularly be encouraged about their civic process and ensure participation.

It is a matter of regret that in some Muslim dominated areas, there is indifference

towards the electoral process and this has
seen few people registering as voters and
a similar situation is evident on voting day
where few appear to exercise their right to
choose leaders.
Often times, the end result of this state of
aloofness has been bringing into leadership people who are corrupt, seldom stand
up for the needs of the people and in some
instances who have no desire to protect
the rights of Muslims.
In our society, standing up for what is right
entails speaking out about issues, discussing with other citizens and voting. By staying away from participating in this process,
you are disempowering the Ummah and
denying yourself the opportunity to influence change and fight for justice in the
country.
In this country, politics has an influence on

Lamu Women Rep protests over poor roads

Lamu County women representative Shakila Abdalla has protested over the poor conditions of roads in the region and called on
the national government to rectify the situation. She lamented that for many years the
conditions of roads have remained to be in
a dire state inconveniencing travellers who
are left stranded during rainy season.
The Women Rep said despite several
promises by President Uhuru Kenyatta and
his deputy William Ruto to upgrade and
tarmac the roads in the county, so far no
meaningful actions to remedy the situation
have been taken.
We were expecting President Uhuru Kenyatta to commission Lamu road during his
recent Coast tour but instead Mr. President
decided to use the opportunity to launch
the controversial footbridge project at Bux-

ton, Mombasa, she said.

Because of poor road network, Lamu has
continued to remain a county of past present where todays newspaper is read a
day after in the offices, the Women Rep
added. She termed what she said were
the empty promises by the government to
tarmac the road as another culmination of
series of injustices and indignities that continue to exist in Lamu County.
Shakila noted more than 50 years after
independence, Lamu remains among the
few areas in the country without tarmac
roads adding that modernizing the road
infrastructure will leave a legacy for President Uhuru Kenyatta who will be remembered for promoting development and restoring the vision of equality for the people
of Lamu County.

Kakamega Jamia Mosque construction starts

Muslims in Kakamega have a cause to
smile after a local non-governmental organization, the Muslim Group for Development
[MGD] commenced the reconstruction of
the Kakamega Jamia Mosque and Islamic
Centre. The construction work commenced
this week after the demolition of the former
structure that was built in 1975 to pave way
for a multi ultra-modern Masjid that will be
an architectural landmark in the town.
The proposed four storeyed complex is estimated to cost over Sh40 million and will
consist of prayer halls for both men and
women, spacious conference hall, ablution
facilities and administration offices among
other facilities. According to the chairman Board of Trustee, Kakamega Jamia
Mosque and Islamic centre, Prof Hassan
Were the first phase of the project is expected to take ten months to complete.
Prof Were further noted that the proposed
masjid when completed is expected to improve the capacity and handle more than
4500 worshippers at a time. He hailed the

Page 2

organization for the construction and assured that the Muslim leadership would do
the needful for the success of the project to
benefit the Muslim community.
Prof Were appealed to various individuals,
business community and the local Muslim
community to support the efforts and initiative being made by his committee for the
benefit of the Muslims. Built 42 years ago,
Kakamega Jamia Mosque and Islamic centre is among the most reputable and important center of Islamic practice in the region.
But owing to the growing number of worshippers and the sorry state of the old
structure, the mosque is unable to cater for
the large number of worshippers especially
during Fridays and the month of Ramadhan where of worshippers are at times
forced to conduct the prayers under the
scorching sun and in a rainy environment.
The Board of Trustee has secured an alternative site at Masjid Tawakal Lutonyi
where prayers will be conducted during the
construction period.

social development and through the voting

process, the community could assert itself
politically and claim its rightful share of resource allocation, enjoy human rights and
plays a determination factor in the direction
of state hood.
It is important to understand that voting is
a right for every citizen who has attained
the age of 18 and it is important for Muslims to understand that if you give up your
rights voluntarily, no one will come and give
it back.
Registering as a voter is an obligation
and a right as a citizen of this country. It is
therefore prudent that for those who are eligible to vote to troop to registration centres
to be registered as voters. In this way we
will have an opportunity to also play a role
in charting the way forward for our nation.

Ummah Foundation partners

with Aga Khan in health camp

To help improve on the healthy wellbeing

of the community, Ummah Foundation has
partnered with Aga Khan University Hospital in a medical camp exercise.
The camp will involve comprehensive
health checkups which are aimed identifying a persons current health status and
risks and in the event of any problems,
doctors will provide information on treatment plans and ways to prevent the health
issues from intensifying.
The checkups also help to minimize the
risk of potential health issues thereby lowering the risks for surgery or more expensive medical care in the future.
Most of the ailments which in most cases
end up in surgery or expensive medical
treatment could be treated or lessened if
they were identified early, said the Ummah
Foundation CEO Fauz Qureishi.
For deserving cases who are not in position to afford the costs of the health
checkup, the Foundation will provide the
checkup at no cost. The camp to be carried
at Aga Khan University Hospital Clinic Mutithi Road in Westlands will involve various
health checkup which include liver and kidney function test, cholesterol level checks,
full hemoglobin and vitamins deficiency
among others.
At the same time, a special rate of Sh14,
000 for the comprehensive checkup is also
on offer for other cases. In normal instances, the cost comes at Sh50, 000.
The exercise will run till January 31.
For deserving cases and those who would
like to benefit from the special rate can contact Umma Foundation on 020-2680610/3

Protecting the Muslim marriage: Dont play dare with divorce

Ustdh Ali Hammuda

You do know not, perhaps Allah will
bring about after that a different matter.
(Surat Talaq (65): 1)
Do not rush in making a decision. For
some, the mentioning of divorce is always at the tip of their tongues. With
every fall-out, the topic of divorce has to
be brought up.
It is very common for one to receive two
text messages from the same person.
The first message is one of fury, where
an immediate divorce is being demanded
at this very moment in time without delay! One then clicks the next text message which was sent minutes after which
reads, Please ignore the first message.
Alamdulillah, everything is now ok.
Worse still, there have been documented
cases of divorce that were the product of
one football team that defeated the other.
Her team defeated his, she had a laugh
at him and so he issued a divorce.
Allh has placed the reins of divorce in
your hands, my brother, for a great reason. Thus, do not abuse this responsibility which Allh has chosen to give you.
Similarly, my sister, should you fall out
with your husband, do not challenge him
by saying, Go on, divorce me if youre a
man! I dare you! This is just as thoughtless and inconsiderate.
If life becomes unbearable, then Allh
has provided divorce as a way out, but
when is this made mention of? Most certainly not at the heat of the moment, but
after time has passed, after you have
prayed abundant Istikhra, after you
have consulted the people of knowledge,
after you have thought about the ins and
outs of such a decision.
I know of men who have divorced their
wives irrevocably and their only wish in
life is for them to return to their wives.
But, they cannot because he has divorced her three times and she now
needs to marry another person and consummate the marriage, without having
planned this, for them to get back together again. Had they applied this principle,
they would not have found themselves in
this predicament.
One judge mentioned that a man came
to him having divorced his wife for the
third time and was in an unimaginable
state of regret. He had spent a year visiting various scholars before him but they
told him that she could not return to him.
The judge tried to find a way out for him
and so began to investigate the circumstances of each of the three divorces.
After a thorough investigation and after
having conversed with both spouses, he
found that one of those three divorces
did not actually count for one reason or
another, so he told them as such and
warned him from ever returning to this
type of behaviour. The man asked again
in a state of disbelief, Sheikh! So is she
my wife? He said, Yes. The judge, describing this incident, said, They hugged

one another in front of me as they both

cried profusely.
It was clear that they still loved and wanted to be with one another. Why, then,
allow matters to reach this stage? Do not
rush in making drastic decisions, for you
do know not, perhaps Allh will bring
about after that a different matter.
Divorce is twice, then, either keep her
in an acceptable manner or release her
with good treatment.[Surah al Baqara
(2): 229]
There may be situations where divorce
is genuinely needed. It may be that one
strives to apply these principles to the
best of their ability, having displayed
much patience and engaged in every
possible endeavour to keep such a marriage alive but, at times, the couple may
truly need to walk separate ways. With
regard to this, Allh says, But if they
separate [by divorce], Allh will compensate both of them from His abundance.
[Surah an Nisaa (4): 130]
Divorce is indeed sometimes a way out
but, even in the situation where divorce
is resorted to, it is to be carried out honourably and fairly. Either keep her in an
acceptable manner or release her with
good treatment. Ibnu Kathr said, This
verse means to not be vile, to not swear
and to not be harsh, but rather, he should
divorce her in a beautiful manner. [Tafseer Ibn Kathir]
The effectiveness of applying the Islamic
mannerisms of divorce in keeping a marriage alive:
One can safely say that if the Islamic
methodology of divorce on its own was to
be applied by Muslims, 9 out of 10 problems would disappear before the divorce
becomes binding. Why is this? Ponder
over some of the Islamic mannerisms of
divorce and you will see why.
1 You are only allowed to issue the
words of divorce during a period of her
purity during which you had not had intercourse with her. Allah says, When
you divorce women, divorce them at their
prescribed periods. [Surat Talaq (65): 1)]
This rule on its own, if applied, will deal
with countless cases where divorce
would have otherwise been issued, since
he first has to wait until she menstruates
following their marital relations before issuing the divorce. If this rule is adhered
to, they will both almost inevitably have
cooled down by then. But, unfortunately,
this rule is rarely adhered to. A divorce
that takes place during a period of her
purity in which he had intercourse with
her or a divorce issued during her menses is referred to as Talaaq Bidi, an
innovated divorce, and one is sinful for
doing so.
Does it count as a valid divorce or not?
The majority of scholars are of the view
that it does count, whilst others like Ibnu
Taymiyya and Ibnul Qayyim say that it

does not.
If a husband cannot divorce his wife during
her menstrual period and neither can he divorce her during her periods of purity if he had
intercourse during it, and instead has to wait
until she menstruates and then becomes pure
before issuing the divorce, if need be, in the
majority of cases, the husband would have
changed his mind by then and the problem is
solved.
2 If a divorce is issued, the waiting period for
ones wife is in the marital home. Allh says,
and turn them not out of their (husbands)
homes, nor shall they (themselves) leave.[
(Surat Talaq (65): 1)]
The general rule is that the waiting period is
to be in the family home. The husband is not
allowed to kick her out nor is it permissible for
her to leave. Then, Allh told us of the wisdom
behind this, saying: You know not, perhaps
Allh will bring about after that a different matter!
This is an opportunity for them to reconsider
their stance as; perhaps, the husband may
decide to take his wife back. How long is this
waiting period?
Allh says, Divorced women remain in waiting
for three periods. [Surah al Baqara (2): 228]
As such, even after he has issued the divorce
during the correct moment in time, they are to
be around one another for three menstrual cycles until such a time as that divorce becomes
binding. That is, he issues a divorce then he
must wait until she menstruates, then becomes
pure, then menstruates a second time and then
becomes pure and then menstruates a third
time and then becomes pure.
During this period, the vast majority of men end
up taking back their spouses, except in rare circumstances where such a person is genuinely
convinced that he wants separation. What happens if she spends this waiting period in her
parents home? The gap between them only
widens.
3 Do not play with the topic of divorce
The Prophet (sall Allhu alayhi wa sallam)
said, There are three matters in which seriousness in them is serious and joking in them
is serious: marriage, divorce and taking back
ones wife. [Abu Daawood]
It may be that his wife defeats him in a game
of scrabble and he jokingly says, Thats it,
youre divorced. Such a joke is not funny in
the slightest.
The majority of scholars are of the view that
such a divorce is binding. Similar reports were
narrated from Umar b. Al-Khab, Al and
Ab Ad-Dard.
This is regarding a person who jokes about
divorce explicitly. As for a person who utters

The legacy of Hijab

Nawal Abdulrahman

Each time I look at myself in the mirror, the feeling swells inside
me until I cannot take it anymore. Ask me what feeling this is and
I cannot entirely describe it without a surge of pain flowing within.
I feel betrayed by both sides of the picture.
Worse yet, I am scared. Scared for my family and scared for what
will happen to the rest of my community. The day before yesterday
they came for my family friend, and yesterday they came for my
neighbours so I just wonder how long it is going to be before they
come for me.
I see myself perfectly donned in a hijab. It has been a part of
me since my childhood days. I would always wear it to look like
mummy and mimic her style. I would try different styles depending
on my mood and to some extent, I feel as though it made me more
artistic, an art I have never mastered.
But with each passing day, a new story unfolds, and the cycle of
emotions never seems to come to an end. Paris, Westgate, Garissa, Istanbul and the many more I havent mentioned. My heart
goes out to the mothers, brothers, sisters, and above all, human
beings like anyone else who were wounded, killed or bereaved.
But I too, may be a living victim of this malice. On one hand I feel
hurt by the actions of cruel people deciding to use the ideologies
I wholly believe in, to further their selfish motives. On the other, is
the constant battle to explain to authorities, my classmates, teachers and even to scrupulous strangers that Islam does not encourage violence. I have learnt to be a lawyer in defense of my choice
of belief, regardless of whether I am the offender or not.
I wonder if this is the case for my brother, who wears no hijab,
thus has no visible association to the image of terror. Life must
be easy for him, not having to bear with the accusing glances on
the street. I critically examine the creases on the hijab, trying to
fathom exactly what could bear resemblance with terror. I contrast
this with my own perceptions from childhood whereby the hijab
was a connection between mum and me. Every time I would stare
at myself in the mirror, I would be joyful because I would picture

myself brave, intelligent and loving as my mother. How is it that

other people view this image so differently?
After all, donning the hijab is a privilege, as my principal in Kenya
remarked. I thought it absurd that she termed it that way, but then
I thought this attitude would end once my high school days were
over. It was only the beginning of the hijabi journey that I am set to
embark on for as long as it takes. With laws dictating what I should
wear on the French beaches, I shudder at the thought of the possibility of having a law banning hijabs on the streets.
I should probably stop staring at myself in the mirror, and work
harder to get people to see the hijab differently. My quest for the
future is to show the beauty of hijab-to eventually make people
realize that the hijab is not a symbol of terror. Baby steps have
been made in my school where some students wore the hijab on
world hijab day to stand in solidarity with women who have faced
oppression as a result thereof.
The positives will eventually outweigh the negatives in this journey. As some nations put in efforts to ban the hijab, others are
making it part of their uniform in the police force.
I hope that someday people on the streets will realize that there is
a difference between Nawal who wears a hijab, and a person who
decides to selfishly deny the right of someone to live.

Exhibit good Islamic moral values, youth told

Muslim youths have a responsibility to protect and sustain Islamic moral values and
principles to promote Islamic ethics and
enhance on the image of Islam and Muslims.
The sentiments were made by the Nairobi
based Arahma Da'wah and Trust Organization chairman Khalid Kakai who stated that
maintaining an Islamic identity, high moral
character and discipline is an important element for Muslim youth to achieve success
in their lives.
Speaking in Kakamega County during a
feeding and Quran distribution exercise,
Khalid advised Muslim youth to exhibit
good Islamic moral characters so as to
reduce the existing prejudice and misconception against Islam and Muslims.
He noted that Muslim youth should devise
amicable avenues to respond to misconceptions and distortions against Islam and
Muslims, but what is needed is to portray
positive image and good Islamic characters.
Khalid emphasized that adhering to the
teachings inscribed in the Noble Qur'an
and the teachings of Prophet Muhammad
(peace be upon Him), explaining the correct teachings of Islam and portraying good
Islamic characters are the ideal methods
of clearing the misconceptions and distortions.
''Islam teaches us to exhibit good character

and forge mutual relations with all people

irrespective of their faith and this will not
only change the negative perception but
will reduce the stereotypes and attract nonMuslims to the religion,'' he said
The group's Organizing Secretary, Ali Khisa echoed the same sentiments and called
on Muslim youth to be good ambassadors
through portraying good image of Islam to
people of other faiths.
''Through good conduct, Muslim youth can
be good example and play significant role

in reducing the mistrust toward Islam and

Muslims held by many people,'' Ali said.
Several Madrasas in Kakamega and Bungoma Counties benefited from the feeding
programme and Quran donations initiated
by the Nairobi based Arahma (check its
name) Da'wah and Trust Organization.
The organization also provided foodstuffs
and clothing to women and orphans selected from various madrasas within Kakamega and Bungoma Counties.

Ummah Medical Camp

Ummah Foundation in collaboration with Aga Khan University
Hospital- Nairobi is conducting a Medical Camp until 31st March
2017 at Aga Khan University Hospital- Muthithi clinic. The Camp
is a joint project of Ummah Foundation and Aga Khan University
Hospital at a very special rate of only Sh14,000 inclusive of doctors consultation. Normally these tests and consultations cost
more than Sh. 50,000 but for those who can afford to pay for this
offer, it will only cost Ksh. 14,000 as an offer negotiation for Ummah Foundation. Ummah Foundation will consider case by case
for those who cannot afford the subsidized cost.
These are Executive Check-up tests that include; full thyroid profile, full lipid profile cholesterol total triglycerides, urine,, liver function, kidney function, full haemogram and Vitamins deficiency.
For one to access the mentioned services with Ummah Foundation, you should first of all be poor and needy and your check-up
requirements should be within the specifics we mentioned herewith.
Over the years, we have been flooded with a lot of medical requests to meet the required medical charges from various hospitals where many of our brothers and sisters are admitted. The
extremes happen when we are asked to make payments for our
sick to get medical attention in India. The colossal amounts involved is a hard task that Ummah Foundation cannot accomplish
alone. A close look at many of the requests reveals that many of
them are checkups that can be done in Kenya. Not to mention
that the medical tourism has become a very lucrative business for
some individuals. Unknowingly many are duped into travels and
expenses for ailments that can be diagnosed locally. Interestingly
we have heard stories of how many patients have been referred
abroad only to be told that the problems they face are minor health
complications that can be cured at our hospitals. We therefore
partnered with Aga Khan University Hospital to bring a reprieve

to our patients. We believe if many of the patients are analysed

properly and come to know of the ailments then it is easy to be
treated at affordable expenses.
This is a joint venture that brings together Ummah Foundation and
Aga Khan University hospital to help the underprivileged sector
of our society. The mission is not just the money but to serve the
human community and accord them the opportunity to understand
the health challenges they encounter daily. It is a humanitarian
exercise where medicine turns divine. Incidentally we recognise
the fact that due to the growing global changes on our planet, for
example; decreased physical activity, obesity, smoking, alcohol,
drug abuse, unhealthy food habits and stress, which are associated with all age groups in both genders and the lifestyles that
are by choice, could be causes of all the diseases we suffer from.
Routine checkups and advices from medical professionals can
bring the remedies we all desire. Unfortunately the less affluent
class is generally deprived of this but now this team work has offered to the lower cadres the chance to understand themselves
medically.
We would like to bring to the attention of all that this is a medical
procedural camp and as we all understand instructions should be
adhered to so that the camp can yield its proper results. Applications are submitted to Ummah Foundation and after approval the
check up and consultation is done at Aga Khan University Hospital
along Muthithi road. We would therefore kindly request those who
fall within the aforementioned categories to come forward and apply to get the medical assistance that they deserve.
