NOTICE OF VOLUNTARY DISMISSAL AND MOTION FOR DISMISSAL

OF SMOKING EVERYWHERE, INC., FROM THIS APPEAL

Appellee Smoking Everywhere, Inc., through its undersigned counsel,

hereby notifies the Court that on June 15, 2010, it voluntarily dismissed in the

United States District Court for the District of Columbia all causes of action in the

Complaint against Defendants U.S. Food and Drug Administration and U.S.

Department of Health and Human Services. See Notice of Dismissal of Complaint,

attached hereto as Exhibit A.

Smoking Everywhere’s presence before the Court is therefore moot, and it

hereby moves this Court for an Order dismissing it from this appeal.

Pursuant to Rule 41(a)(1) of the Federal Rules of Civil Procedure, Plaintiff Smoking

Everywhere, Inc., hereby dismisses without prejudice all causes of action in the Complaint

against Defendants U.S. Food and Drug Administration and U.S. Department of Health and

Human Services.

Neither Defendant has filed an Answer to the Complaint or a Motion for Summary

Judgment. Dismissal under Rule 41(a)(1) is therefore appropriate.
