ORDINANCE NO. 17-02
AN ORDINANCE OF THE TOWNSHIP OF TOWAMENCIN, MONTGOMERY
COUNTY, PENNSYLVANIA SETTING FORTH AN AMENDMENT TO THE CODE OF
TOWAMENCIN TOWNHIP, AS HERETOFORE AMENDED, AMMENDING PART |:
“ADMINISTRATIVE LEGISLATION’BY ADDING A NEW CHAPTER PROVIDING FOR
THE COMPENSATION OF THE BOARD OF SUPERVISORS.
WHEREAS, Article VI, Section 606, of the Pennsylvania 2 Class Township Code,
provides that supervisors may receive compensation in an amount to be established by
ordinance and based upon population; and
WHEREAS, the Towamencin Township Board of Supervisors adopted Ordinance
Number 86-5 on January 3, 1987 establishing the per annum compensation of $2,600 for
each supervisor based on the then population of the Township being 13,500; and
WHEREAS, according to the 2010 United Stated census, Towamencin Township
contains a population of 17,578 residents; and
WHEREAS, the 2” Class Township Code, 53 P.S. Section 606, allows for a maximum
salary of $4,125 for each individual supervisor serving a population of 15,000 to 24,999.
AND NOW, THEREFORE, the Board of Supervisors of Towamencin Township hereby
enacts and ordains, and it is hereby ENACTED and ORDAINED as follows:
SECTION 1. Chapter 2 (‘COMPENSATION OF THE BOARD OF SUPERVISORS’) is
hereby established within the Towamencin Township Code:
Chapter 2. Compensation of the Board of Supervisors
§2-1 Compensation Designated.
The annual compensation of the members of the Board of Supervisors shall be the
maximum amount as permitted by applicable laws of the Commonwealth of
Pennsylvania as the same may be amended from time and/or the population of the
‘Township grows all in accordance with the laws of the Commonwealth of Pennsylvania.
‘As of the date of the enactment of this amendment and with the population of
Towamencin Township being between 15,000 to 24,999 individuals, the compensation
for each Supervisor is initially set at $4,125 per annum effective January 1, 2017 with
said salary being automatically amended to the maximum amount as permitted by law
without the necessity of further ordinance adoption. Said salary shall be payable
monthly or quarterly as determined by a majority vote of the Board of Board of
Supervisors.§ 2-31 Compensation for present term.
All current members of the Board of Supervisors who are presently serving a term in
office at the passage of this amendment shall continue to receive the salary now being
paid, unaffected and not increased by the provisions of this amendment, for the
remainder of his or her current term in office. Each supervisor of Towamencin Township
elected or appointed after the adoption of this article shall receive compensation as a
supervisor in the maximum amount permitted as the General Assembly may from time
to time determine, except as restricted by the provisions of Section 606 of the Second
Class Township Code, 53 P.S. § 65606.
SECTION 3.
It is hereby declared to be the legislative intent that if a court of competent jurisdiction
declares any provision of this Ordinance to be invalid or ineffective in whole or in part,
the effect of such decision shall be limited to those provisions which are expressly
stated in the decision to be invalid or ineffective, and all other provisions of this
Ordinance shall continue to be separately and fully effective
SECTION 4.
The provisions of this Ordinance shall become effective at the expiration of five (5)
days from its adoption.
