AFFIDAVIT OF COMPLAINT
I, PEARL MARJORIE JONES MACASOL, 52 years old,
Filipino, married to Justinio Luz Macasol, with residence and
postal address at Summerhill Subdivision, Pasonanca, Zamboanga
City, after having been sworn to an oath in accordance with law,
hereby depose and say that:
1. I am a businesswoman personally managing me and my
husbands restaurant business located in KCC Mall,
Zamboanga City. Apart from this restaurant, my husband
manages a hardware store located at the town proper, this
city.
2. My husband and I have been married for 22 years without
any child of our own whether legitimate or illegitimate nor
any adopted child.
3. My husband and I lived together in our own house with
two house helpers and a niece of mine from the province
who came here to pursue her college education.
4. Due to the success of our businesses, my husband and I
are living a relatively comfortable life. However, about two
years ago, my husband had gotten himself heavily into
gambling and the hardware business he personally
manages is currently in bad financial shape.
5. Due to my husbands addiction to gambling, our finances
are greatly affected. The hardware is not anymore earning
as much as it had earned before. Because of this, my
husband would demand significant amount from the
income of the restaurant just so he could continue his
gambling activities. This has always been our source of
quarrel many times over. I beg for him to stop gambling
before we lose everything we have worked for very hard.
However, all of my pleadings have been ignored.
6. About three months ago in October, my husband
demanded 3 million pesos from me which according to
him, he will invest in a new business since his hardware
business is losing much. Hesitant and untrusting, I refused

to give him the amount. He was very mad, shouted at me,


called me names and almost hit me. A few days after, I
learned from a common friend of ours that my husband is
heavily under debt to a certain Mr. Go. That was not
enough. He also owed some money to three more people.
All of these because of his addiction to gambling. This is
the reason why he was demanding the 3 million pesos.
7. In December, thru a text message from an unknown
number, my husband received a threat telling him that if
he will not pay, he would kill us all in the house including
my niece. I was very afraid and took the threat seriously
that I decided to give my husband the three million pesos
just so he could pay all his debts and we can all live in
peace. Afterwards, my husband asked for forgiveness and
promised not to gamble anymore.
8. However, on the night of January 4, I found out that my
husband did not really quit gambling and argument
ensued between us. I was very upset and angry especially
when I found out that he did not pay the 3 million pesos
that I gave him. To aggravate the situation, he used the
money to gamble more, lost it and acquire additional
debts. I told him that I will never give him any money
again and that he must solve his problem on his own. He
was silent all those times I was shouting at him. I sensed
that perhaps he had realized his mistakes and will now do
something to rectify whatever wrongs he had done.
9. After that argument, I noticed that my husband would
seldom leave the house. He stayed home most of the
time. I was happy because it could mean that he was not
gambling anymore. On the night of January 8 at about 9
in the evening, we were watching TV together and just as
we were about to sleep, he offered me some milk which
was unusual because he normally does not do that to me.
Thinking that my husband was just trying to show that he
was sorry and had repented, I gladly accepted his offer.
From the kitchen, he came back to the sala with a glass of
milk. I took a sip and after a few seconds took some more
until the glass is about half of its contents. But as soon as
I was about to put down the glass of milk, I felt an
excruciating pain in my stomach. I grabbed him for
support as I started to feel weak. He held me in my back
and after that I lost consciousness.

10. I woke up in the hospital at around 2 oclock in the


morning with my niece beside my bed. I learned that my
husband took me to the hospital after I lost consciousness
but went home afterwards. I was still experiencing
abdominal pain that time and vomited heavily. My niece
told me that the doctor ordered a blood test to check
whats causing my abdominal pain.
11. Around 5 oclock in the morning on the same day, my
doctor arrived. She told me that the result of my blood
test revealed that I was poisoned. She immediately
ordered another test, this time a urine test and it revealed
the same result.
12. Based on the foregoing facts, I firmly believe that it was
my husband who deliberately tried to poison me thru the
milk that he gave to me that night. The fact that he
personally made and offered the milk to me and there was
nobody else in the kitchen except our housemaid at that
time made my belief stronger. I believe that my husbands
motive is to cause my death so that he can inherit from
me after my demise, use our property freely as he desires
to and free himself from the threats he has been receiving
by paying off his debts thru the money and property he
would inherit. This is so especially because I have refused
to give him any amount after I learned that he misspent
the three million pesos I gave him last December.
13. In connection with this, I would like to file a case of
attempted parricide against my husband based on the
foregoing circumstances.
