Commissioner vl Kee e renee erence eee ee x Promulgated: Ostober 5s 2015 RESOLUTION N@. 1°" The Commission on Elections, by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, Republic Act No. 7941, and all other pertinent statutes, rules, and regulations, hereby RESOLVES to promulgate the . following RULES AND REGULATIONS FOR THE CONDUCT OF RAFFLE OF ACCREDITED PARTY-LIST GROUPS TO DETERMINE THE ORDER OF THEIR LISTING ON THE OFFICIAL BALLOT: SECTION 1. Who Shall Participate.—The following party-list groups, organizations, and coalitions shall be allowed to participate in the raffle for purposes of determining their order of listing on the official ballot: (1) Those existing party-list groups, organizations, or coalitions whose registrations were retained by the Commission,! and which have filed their Manifestations of Intent ta Parlicipate in the Party-List Elections not later than 08 May 2015. istration andl february : relation fo RESOLUTION No. 9932, In the Matter of the Cancellation of Delisting of Party-List Groups or Organizations under the Party-List System ( 2015), Page 2uf 7 Resolution No, 100°" (2) Those party-list groups, organizations, or coalitions duly registered and accredited by the Commission, and which have filed their Manifestations of Intent to Participate in the Party-List Elections not later than 08 May 2015. (3) Those party-list groups, organizations, or coalitions which have filed their Manifestations of Intent to Participate in the Party-List Elections not later than 08 May 2015, but whose registration and accreditation were cancelled by the Commission and were able to secure a status quo ante order from the Supreme Court. (4) Those party-list groups, organizations, or coalitions which have filed their Manifestations of Intent to Participate in the Party-List Elections not later than 08 May 2015, but whose Petitions for Registration have been denied by a Division of the Commission and have filed a motion for reconsideration with the Commission En Banc, which remains pending as of the scheduled date of the raffle, and is approved for inclusion in the raffle by the Commission En Bane, (6) Those party-list groups, organizations, or coalitions which have filed their Manifestations of Intent to Participate in the Party-List Elections not later than 08 May 2015, but whwse Petitions for Registration have been denied by the Commission En Bane and were able to secure a mandatory injunction from the Supreme Court. SECTION 2. Date of Raffle.—The conduct of the raffle shall be on 05 December 2015, 10:00 AM, at the Commission En Bavic Session Hall. SECTION 3. Notice.—The Office of the Clerk of the Commission shall, not later than ten days before the scheduled conduct of the raffle, give notice of the date, time, and place ol the same to all party-list groups, organizations, or coalitions which are allowed to participate, through publication in two newspapers of general circulation. 30f7 Resolution No. 10001 SECTION 4. Authorized Representatives for the Conduct of the Raffle,—Each party-list group, organization, or coalition shall be entitled to only one (1) representative during the conduct of the raffle, who shall be required to present a written authority undec cath. No person, including counsel, shall be allowed to represent more than one party-list group, organization, or coalition during the raffle. Only authorized representatives shall be permitted inside the venue during the raffle. Party-list groups, organizations, or coalilions who fail or neglect to send any representative during the conduct of the raffle, or whose representatives fail to produce the wrillen authority under oath, shall be considered to have waived their right to participate and observe the proceedings. SECTION 5. Protocols to be Observed.—(1) The raftle shall be considered a Special Session of the Commission En Banc. Any person or persons guilty of unruly, inappropriate, or offensive behavior so as to obstruct or interrupt the proceedings may be adjudged in contempt of the Commission in accordance with Rule 29 of the Commissions Rules of Procedure and, suppletorily, Rule 71 of the Rules of Court. (2) At least two members of the Commission shall be present during the proceedings. (3) Only accredited media personnel with appropriate documentation from the Education and Information Depaitiuent shall be allowed to attend and take photographs of the proceedings? Interviews shall not be allowed inside the venue during the conduct of the raffle. (4) Accredited citizen’s arms and other election stakeholders may attend the proceedings, subject to the limitations under Sectivii 4 of this Resolution (5) Unruly, inappropriate, or offensive behavior by the authorized representatives of party-list groups, organizations, or coalitions which are allowed to participate in the raffle shall cause the forfeiture of their order of listing, if it has already been determined, otherwise, they shall be considered to have waived their right to participate in the raffle. Conduct of the Raffle.—(1) The party-list groups, organizations, or coalitions in attendance shall first be shown all the equipment, peripherals, and components to be used for the conduct of the automated raffle, all of which shall be properly sealed, as far as practicable. (2) An alphabetical listing of all eligible party-list groups, organizations, or coalitions shall thereafter be shown and displayed ona projector screen. Where appropriate, notice shall be made by the Clerk of the Commission or by his or her authorized representative of any prior forfeiture in the order of listing of any party-list group, organization, or coalition pursuant to Section 7 (10) of this Resolution (3) The program or application to’be used for the conduct of the raffle shall then be initiated by one of the Commissioners present or in their stead, the Clerk of the Commission or other authorized personnel of the Commission. (4) After the program or application has randomized the listing of all eligible party-list groups, organizations, or coalitions, the officer in-charge or other authorized personnel shall print the said list, which he or she shall afterwards sign on each and every page together with the Clerk of the Commission. The randomized listing, shall be displayed on a projector screen. (5) The authorized representatives, in the order of their listing, shall also sign their consent and/or acknowledgment of the order of their listing on the official ballot, in a form to be provided by the Commission. Where appropriate, notice shall be made by the Clerk of the Commission or by his or her authorized representalive of any forfeiture in the order of listing of any party-list group, organization, or coalition pursuant to Section 5 (5) of this Resolution. (6) Refusal or inexcusable failure by the authorized representatives to sign the aforementioned consent anu/or acknowledgment form shall be considered as a waiver of their listing in the raffle. Consequently, these party-list groups, organizations, or coalitions shall be placed last in the list, in alphabetical order. Resolution No. 12007 Page 5 of 7 (7) Subject to the provisions of Sections 5 (5), 6 (6), and 7 (10) of this Resolution, the Clerk of the Commission, through the Education and Information Department, shall cause the publication of the final listing to appear on the official ballot, within 10 days after the conduct of the raffle. (8) No appeal, motion for reconsideration, or motion to re-raifle shall be entertained by the Commission. SECTION 7. Program Source Code Review.—(1) The automated raffle or selection program to be used shall be subject to source code review by the authorized representatives of the party-list groups, organizations, or coalitions. (2) Interested party-list groups, organizations, or coalitions may begin with the source code review on 03 November 2015, and must finish 30 days thereafter (3) Party-list groups, organizations, or coalitions interested in conducting a source code review shall signify their intent in writing not later than 15 October 2015. These party-list groups, organizations, or coalitions shall submit the methodologies which they intend to use as well as the naines of their representatives, which shall not be more than three, together with their letter of intent for the approval and confirmation of the Commission En Banc. (4) Party-list groups, organizations, or coalitions who intend to conduct a source code review shall execute a non-disclosure agreement before proceeding with the review. (5) The Commission shall provide a secure and enclosed facility or location for the conduct of the source code review. All persons who enter and exit the said facility or location shall be properly recorded. (6) The Commission will provide a read-only copy of the source code, which shall be viewed in a workstation inside the secured facility or location. (7) The source code or any copy or part thereof shall not be taken out of the secured facility or location, 10001 Resolution No. ee Page 6 of 7 (8) Any electronic device, including but not limited 19 laptops, mobile phones, cameras, USB drives, and other storage devices, are prohibited and shall not be allowed inside the facility or location (9) Party-list groups, organizations, or coalitions who conducted a source code review shall submit a report to the Commission within ten days from the completion of their review. (10) Any violation of the foregoing provisions of this Section shall cause the forfeiture of the order of listing drawn for the concerned party-list group, organization, or coalition and they shall be placed last in the list in the same manner as provided under Section 5 (5) of this Resolution. This shall be without prejudice lo any other penalties which the Commission may legally impose, including cancellation proceedings against the group, organization, or coalition pursuant to Section 6 (5) of Republic ‘Act No. 7941 for violation of election rules and regulations SECTION 8. Implementation.—(1) The Office of the Clerk of the Commission, in coordination with the Office of the Commission Secretary, the Education and Information Department, and the Information Technology Department, is hereby directed to implement this Resolution. (2) The Education and Information Department shall cause the publication of this Resolution in two newspapers of general circulation SECTION 9. Repealing Clause.—The provisions of Resolution No. 9467, as amended by Resolutions Nos. 9572, 9577, 9591, and 9604, are hereby repealed or amended insofar as they are inconsistent with the provisions of this Resolution. SECTION 10. Separability Clause.—If, for any reason ot reasons, any part or provision of this Resolution shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and eflect. of Resolution No, 10601 Page 7 of 7 SECTION 11.
