ANEWCASTLEUniversitystudentallegedlytoldtospeakEnglishduringadisputewithalecturerhashada
firstroundwinagainsttheuniversityinaracialdiscriminationcase.

TheAdministrativeDecisionsTribunalhasrejectedauniversityapplicationtodismissacaselaunchedby
studentDrFuYu,rulingonThursdaythatthestudentsallegationswerenotvexatious,frivolousorlackingin
substance.

DrYu,whowasstudyingpharmacymanagement,allegedhewasdiscriminatedagainstbecauseofhisrace
whenalecturerfailedtoprovidehisexaminationresultsoversevenmonths.

Heallegedsubsequentexammarkswereadversebecauseofracialdiscrimination.

DrYuallegedthatduringadiscussionaboutthedelayedexaminationresultsinSeptember2009,thelecturer
demandedDrYuspeakEnglish.

DrYutoldthetribunalhehadgainedaMastersofPhilosophyStudiesatGriffithUniversityandaPhDatthe
UniversityofOtagoinNewZealand,bothstudiedinEnglish,beforestudyingatNewcastleUniversity.

HeworkedasahealthcareinterpreterforHunterNewEnglandHealth.

Ittoldthetribunalthatin13coursestakenbyDrYubeforethelecturersinvolvement,hehadfailedonecourse
andattainedmarksofbetween50and60percentinfiveothers.

ItconfirmedtherewasasevenmonthdelayinDrYusexaminationresults,becauseofadministrative
oversight.

Thecasehasbeenreturnedtothetribunalfordiscussionofafullhearingdate.
