CONTRACT

THIS CONTRACT entered into the 10th day of May, 1955, by and between John R. Roberts and Mary
Roberts of 422 Karen Court, Madison, Wisconsin, hereinafter called the "OWNERS", and George Mason, 346
Monona drive, Madison, Wisconsin, hereinafter called "CONTRACTOR",
WITNESSETH, That the Owners and the Contractor for the consideration hereinafter named, agree as
follows;
1. SCOPE OF THE WORK. The Contractor shall furnish all the materials and perform all the work necessary
for the construction of residence building and which material and work are shown in the Drawings entitled,
Residence for Mr. and Mrs. Roberts and dated 4/21/55, and in the specification set forth on FHA form #2005
addressed to John R. Roberts and dated 5/10/55, and shall do everything required by this agreement,
specification, and drawings.
2. TIME OF COMPLETION. The work to be perform under this contract shall be commenced by May 23,
1955 and shall be substantially completed by September 24, 1955.
3. THE CONTRACT SUM. The owners shall pay the contractor for the performance of the contract, subject to
addition and deduction hereinafter provided and subsequently to in writing, the sum of Seventeen Thousand
Two Hundred Fifty Dollar, ($17,250.00).
4. PROGRESS PAYMENT. The owners shall make payments on account of the contract as provided herein,
said payments to be equal to 90% of the total due the Contactor and to be made when information stated in
paragraphs (a), (b), (c) below is presented by the Contractor. Between the 1st and 15th days of each month, the
contractor shall present to the First National Bank of Madison, at its banking quarters, (a) a list showing the
quantity and price of materials incorporated in the works and materials suitably stored at the site thereof during
the previous month, together with paid invoices of the sellers thereof, or other information requested by the said
bank, (b) a receipted statement from each subcontractor setting forth the charges made by said subcontractor for
work perform under the contract during the previous month, (c) a statement showing names, address of each of
the Contractor's employees and the hours of labor of the contractor and the labor spent during the previous
month in performance of the contract.
5. FINAL PAYMENT. The contractor shall give written notice to the Owners and to The First National Bank of
Madison, that the work is completed and shall submit evidence satisfactory to The First National Bank in the
form of receipted bills for all materials furnished, waivers of liens from subcontractors, and in such other form
as may be required of said Bank that all payrolls, material bills and other indebtedness connected with the work
have been paid. The Owners and said Bank shall have the right and opportunity to make a final inspection of
said work and materials within ten days after receipt of notice f completion of the work, and evidence of
payments of all potential lien holders, and upon acceptance thereof by the Owner and said Bank payments shall
be made of the remaining balance due the Contractor. Such acceptance shall not be unreasonable withheld and
in the event of Owners or said Bank refuse to accept, the Owners shall within said ten day period notify the
Contractor n writing of such refusal and shall specify the reasons thereof. The Contractor shall within the next
ten days take appropriate steps to remedy any deficiencies set forth as reasons for refusal and upon completion
thereof shall be entitled to prompt payment of any remaining balance due him.
6. SETTLEMENT OF DISPUTES. In the event of any disputes arising here under as to whether the work
complies with the plans and specifications or whether payment is properly due and the same is not settled within
ten days, then either party may request that the dispute submitted for decision to three arbitrators, one of whom
shall be chosen by the Owners and one by the Contractor. The said two arbitrators shall choose a third arbitrator
and the parties shall proceed with the arbitration in accordance with the provincial of the Wisconsin Arbitration
Act.
IN WITNESS, THEREOF, the parties hereto have executed this agreement the day and year first above written.
