OVERVIEW

On Janu3f'/ 3, 2015, at approximately 0654 hours OHicor G. LBigh 11050 and R. IVll<ins #1319 ol tha HPD..,. dispatched 10
located \\i1hin 1he City o1 HenderSQ"I, State of Nevada i1 reference to an assist lire call. Oispa.'ch advised that a 48 year
old woman, lalar idenrlfied as Susan \'/imers (DOB ), was 001 consclo!.1$ and"' breathing.

According ro ttie Hendersm f".-e Department records. arriving medical personnel arrived on scene at 0654 hours and contacted Wflters at
0655 hcuts. At Iha time of fitsl comact, Iha raOOtds indicata lhat Wln!J!rs was unrasponsM! and not bn>athlng. An EKG of Wintara Indicated
Asystole, meaning that he1 heart was not beating, commonfy relerred to as 11at line," and she V.'as in lull cardiac arrest. Additionaly, the
pupils in both her eyes ware fixed and dilated. A$ EM Ts worked to s.ave V/inlers's life. Gregory Brent Dennis. \'/inler'$ husband, told them
thal he found Win1ers unrespcm,ive about ten (10) minutes before they arrived at the residence. Dennis related Iha.I his wife had been
depmssed and threatened 10 commit suCide. Oenttis spea.daled that his wife may have ingested anti-depressant dl\.93 and antifreeze.
Wlnters's bowels had reteased and a pool of diantiea was on tha lloor near tha bed. Ylhile Oemis was speaking to Sgt S. Labinsky #1109
of the Henderson Polee Dapartmant, madtcal parsoonoll ""'" abla to get a pulse. Winters was transported to the ho~al. At 14, \'lintars
was prOOOlllCed dead by medcal petSonnal al St Rosa Hospital.

While OeMs clalmed \'lif\1ers may have ilges!ed antifreeze and dn.igs, there was no phystal evidenoe in the bedroom to give Dennis any
indication Winters committed suicide.

Late1 that day, after 1800 hours, HPO crime scene analysts exposed limited photos of the bedroom and &qoining bathroom. There were no
medi.:ation bottles on the ~1Sland or anywlhare in the bedroom. Llke'A1lse, rhere Y>'&re no antifreeze bottles In the bedroom or the house.

Oxyoodone. Final)', lrrve$1igatof Borgia reported that she did rd find a suicide note. Records 1rom Nevada Prescription Monitoring Program,
from 20122015, r&f!9C1 that neilhM Oetns nor Winters had a prescr1'!lon tor Oxytodone.

While EMTs \\'ere admristering aid, Sgt. l.a.binsky contacted Dennis, who mads tha follolA'ilg statements:

stated that Winters curmntty was taking antidepressants including Xanax due lo depression. Dennis did not specitica!lystate that W"l'lters

On the same date, the Clark County Coronets Office no1ified the HPO ot a deatn they llad responOOd 10 at St. Rose Siena Hospital. Coronet
Investigator R. Borga and Oei.ect!ve Chad tdltehell responded to Iha residenoe several hours after \Vnters death to inte:wiew Dennis who
was al the OOme alone. Dennis was visibly upset and under the influence of an Ul'lltnown SLC:stance.

Dannis stated that~ the day cd January 2, 2015, he and Willlers \\'ere drinking: and he suspected that she was mixing her drinks
with her anxie1y medicine. The t\\o had~ periods where they would argue atnA tha stale ot their marriage. Dennis also stated that
Winters was upsel as stie did no1 lhink her da.ughlers cared f0t her arry longer.

AJ approximatefy 1800 hours, Dennis left Iha house with his daughters and \\'Ml to The Dlstrld shopping center. lNtlen ltley letl the house.
V/lnters was asleep and stlOtiig loudly. Al approunatefy 2230 houfl, Dennis returned from the dstri:t and he found Winters stl asleep il
the master bedroom bed. Dennis got onto the oomputer and found the inlemet was opened to a page about poisonilg y<:M'Selt with
antifreeze. Dems S'laled that he confronted Winters abool this, yet she wcUd not speak to him a.boot it Dennis stated that Wimars stiownd
symptoms ol chlking, yst he navcr sa11 any symptoms Iha.I would kt.ad him to beUeve she inge$1ed an1ifreeze, so he was nol concerned.
Dennis tetl. Winters kl sleep and he eventually tel asteep next lo her. 'Nhen ha 111cn1 to bed. Wiruars was sli11 snoring.

At approximately 0645 hours. Dennis woke up and toled over 10 much Vllni&rs. As he touched her, he realized that she had umated on
herself and was nonresponsi\e, Dennis called tor his daughters and began CPA. 9 11was called and Heodetson paramedics responded.
Henderson paramcci:s de1ermined that they would 1rat1spo11 Wln1ers kl $1. Rose Siena ti:>spital for further treatment. Winters later died al
the hospital.

Detectiv8 C. Mitthcl #949 asked Dennis aboul Win1ers's mental stale. Dennis 51ated Iha! \'/inters was being treated for anxiety and
depres$0l and she takes medication to~ her cope. Dennis also stated that Winters 111iH drink alcohol 111h1le ta~ her mecta:abOn:S.
Dennis S1atod that he has never known Winle1S kl have attempted suicide. ye1 that she does threaten kl kill herself on a regular basis.
Dennis s1ated Iha.I because ol this. he had S1opped paying attemion to the ltlmats belev!ng they \\'Gre Jus.t ways to get attention.

Detective M!tchell asked Dennis abou1 where \'~inters would have gotten the antHreeze and he said the garage. Oonnis deNed knowing that
they even o;i.ned an&freeze and speCIJated that It li\'as left by the previous owner. Dennis took Detecb\e Mllthell to the garage W showed

Delecti\le Mltchell as~ Oenrws ~ he could examine the family computer and he consented. On the col1l>Uler, Oelective kl ~chel found
several searthes related to the ingestion of anti-freeze oone on January 2, 2015. The only other seardl done on Iha! day was an inquiry to
Chase Bank. Detective ~IItchel had CSA M. Cromwel respond kl the residence, photograph its cond~ion, the antl.fmeze bottles and the
webpagas. At the conclusion of the &e31th and lnle-rview, Oelective Mltthe!I pended the iwestigalion 8'-''affing the results from autopsy.

Atlet Wlncers's death, Dennis lold V/irrters:'s mother that she should not view \l/intars's remains because he caused damage to Winte1S's tace

positWa for a lethal level of Ethylene Gtyool (AntiFreeze) and Oxvcodona. The hospital blood satl1)ie which was draMI upon her arrival al
the hoopHat et 0739 hours relleoted te1hal levels of Ethylene Glycol, Oxyeo~ne and a ve<y lo< l.,,el ot Morphine. Wrnle vmters was
pl'O\ided Morphine while in the hospjlal, there is no record which rollects l;!orphina being provided prior to her arrival al lhe hospital. On
February 4, 2015, Dr. Alane Olson of the Clartr County Coroners Ollioe ('CCCO') determined Iha! the cause of death was ocmbined
eth)4ene glyeol poisoning and oxycodooe intoxication. Or. Olson opined that the manner ol death "''as suicide. V/hie Dr. Olson \\'as
provided some information fr<rn 1he daughlers of \Vi'llers to $upport the condusion, the main basis rel!ected in the reoorcts ol the CCCO for
the determiiation ol suicide \\'819 the statements ct Dennis on the evening ol Winters's death. During both the original ilvestigation by the
HPO and the coroner, ltle parents an::I other relatives of Winters raised numerous questions about the investigation and suspicious
circunstances ot the <ath ot V/lntetS; hO\\'e'Ver, no ad:ltlonal inveSligatioo was condue1ed.

After the detennination of the cause and manner of death, Avis and Dan Winters, Win1:ers's parents, retained the firm of Patti, Sgro, Lewis
and Roget to lnmllgate and fie a clvl action againsl Dennis related to the dea1h ol their child. The tawsuH does no1 seek damages to,,,.
parents. but essentially asks lhal Dennis not rec:Me Bir'/ ot tha estate ol Winters.

oonducled on JarlJil.ty 2. 2015 by Winters '4'hi::h caused him to confront her 800ul drinking arriifreeze. There is substantial evidence to

attempts by Winters to contact Dennis, allot v.1hich want 10 volcemail, Oennis's phone connected to a tower Iha! seNiced his business,

While the phone was in Boulder City, at 0833 hours, the phone sent thme oulP>g tOJ<t messages to (702) . Those phone records

After 0840, the next activity on Oennis's phone demonstrates that he returned kl the are.a of BCl;IH. At 1001 hours, Oennis's J:bone sent at1
outgoing Iext to Crosby's phcne that did not have a corresponding incoming text reftectiig a response. Af 121 Shours. OeMis's phone made
an outgoing call to Crosby's phone that doos not appear 10 have been ans'.\'ered. That call began on the BCGC tower on lt\e 1Aes.1 taelng
amema and en:led on the scr.tH tower lacing soulh. lmmediatety thereaher. Oemis's phone called The Orieans Hotel's main nurmer tor
a;iproxinately 1minute and 28 seconds. That cal bagan on the BCMH to"-er facing soulh but ended et1 the BCGC lO'.t.>er racing west

By 2023 hours, Oennis's phone v.as cn::e again connected to a tO\\-er lhal serviced his home where~ appears 10 have remained unti 0001
hour on January 3, 21lt5. Beginning al 0248 hours, 1here were iw.nty (20) 1ext messages belween Oenn~s phone and Crosby's phone
m1il 0315 hours. At 0315 hours, Oennis's phone was connected 10 a tower that services The Otteans Hotel and Casino. By 0332 hours on
January 3rd. OerDs's phone was once again connected lo a tO'Ner whidl services his residence on Moorevie'N.

The phone records n:ticate lhat Dennis me1 with Lynn on the morning od January 2, 2016 in Boulder City, and then retumed in the earty
afternoon lo his residerce. On his way back to the resdence, he spoke to Crosby. When he got to the residence. he had numerous
contacts with Lynn, and then contacted Crosby. After speaking 10 Crosby il the eaity evening. he drove to The Orleans casino to meet with
his cocaine dealer. After spending some amount of tine at The Orleans, Dennis returned home. His phone records rellecl no activity
between 1807 hours and 2023 hours. Begirring at 2023 klurs, until 2044 hours, Dennis's phone made ~ outplg ca!ls 10 numbers
for Vttiich I d:1 no1 have subscriber illormation. Al 2103 hours. the ittone called an automated phone number associated with Bancfirst, a
bank in Oklahoma Shortly after the Bancfirst call, al 21 13 hours, OeMis's phone began taxiing Lynn's phone again. Tho$e teK'!s ~r to
have gone unanswered until after the 9 11 call associated with \1/irrters's death.

After an incoming cal and cormSJX)rldng outgoing cal to Oennls's phone, !tier& was no more activity on Oennis's r;llone l.lll1il the eatty
morning hours ol January 3, 2015. As dscussed above. beginning at 0246 hours on January 3, 2015, Ocnnis's phooe began taxiing
