Marking of Assessments

Assessment tasks will be marked by your trainer or another qualified assessor. We will
endeavour to mark these assessments within two weeks of submission. You may be
required to re-submit assessment tasks and will be notified in writing via email if this is
the case. You have 2 weeks to re-submit your assessment task. Candidates who submit
assessment tasks after this period will be deemed not competent unless there is a
special need that CBD College is made aware of during this period.

Requirements for Competency


To be deemed competent, you will need to provide evidence that shows competency
against all the performance criteria.
Assessment Outcomes
If you are assessed as Not Yet Satisfactory (NYS) in any of the assessments, then the
outcome on your checklist will be further evidence required and you will be advised
what evidence remains to be submitted.
Resubmissions
After the initial assessment, CBD College will allow a further two resubmissions before a
$199 fee will be charged each time a student wishes to be given a further chance to
resubmit their work.

Literacy and numeracy

Candidates will need to have sufficient numeracy and literacy skills to read and
comprehend instruction for referencing legislation, preparing reports, completing
assessments and searching the internet.

Please discuss any language, literacy or numeracy issues with us prior to attending. This
will enable the college to organise appropriate support facilities, for example we can
arrange to conduct assessments orally rather than in the written form, or extra tuition, as
appropriate.

Scenario Additional information

Congratulations! Management at ABC Steel are very happy to announce an


extension of your contract and promotion toHealth and Safety Manager. They are
very happy with the work you have done so far and this has laid a good
foundation for the company to explore and develop their obligations to work,
health and safety further.

ABC wishes to improve their knowledge about certain areas of WHS/OHS


legislation and how it has an effect on their business. Management have
forwarded you a list of questions for you to complete in a comprehensive
manner.

You will need to research and explain fully the relevant sections of any relevant
Commonwealth and state or territory WHS/OHS Acts, regulations, codes of
practice, standards and guidance material that may be applicable to each
question. Sections of legislation may be directly quoted using the method in the
example below;

LEGISLATION QUESTIONING

1.1 Health and Safety legislation exists with other applicable laws and
regulations of which ABC Steel needs to be aware of. From a health
and safety perspective, list other Acts & Regulations that
management will need to be aware of. Then, give a brief
description of how each piece of legislation applies to ABC Steel.

There are a number of safety related legislation that promotes the idea of
maintaining a safe workplace environment at ABC Steel. The following sections
of legislation are critical in ensuring both employers and employees comply with
safety requirements.

OHS Act 2004:

1) Division 2- Main Duties of Employers, 21. Duties of employers to employees (1) An


employer must, so far as is practicable, provide and maintain for employees of the
employer a working environment that is safe and without risks to health.

This element is critical as the legislation clearly states that the employer is
ultimately responsible for his employees at ABC Steel and must have clear
evidence that he/she is doing everything in his power to maintain a safe work
environment. It is the employers duty of care to manage, facilitate and ensure
the safety management system is being adhered to at ABC Steel. The manager
can delegate safety responsibilities to such people as the OHS manager, Safety
Representatives, supervisors and leading hands to ensure this safety goal.

(e) Provide such information, instruction, training or supervision to


employees of the employer as is necessary to enable those person to
perform their work in a way that is safe and without risk to health.

ABC Steel will develop a verification of competency program for each piece of
high risk equipment. Develop risk assessment and procedures on work processes
and only allow competent staff with high risk work licences to operate high risk
machinery such as overhead cranes and forklifts. This system can be further
enforced in the initial induction training. This system can be further enforced by
the supervisor to ensure only competent staff are operating various equipment
at ABC Steel (e.g. guillotines, plate rolling machines etc.).

Division 4- Duties of employees, Whilst at work an employee must (a)


must take reasonable car for his or her own health and safety and (c)
co-operate with his or her employer with respect to any action taken by
the employer to comply with requirements imposed by or under this act

or the regulations.

ABC Steel has a structured safety management system, this section states that
the employee must follow safety instruction given by the employer. For example
during the operation of a guillotine one of the strict safety guidelines during the
VOC training process is the employees must not place their hand near moving
machinery equipment, and never remove guards from machinery. It is the
employees responsibility to ensure that they follow these rules set out by the
employer of ABC Steel. If there is still no co-operation by the employee and they
are endangering themselves then the disciplinary process will commence by the
employer.

OHS Regulation 2007

High Risk Work Licence, a person must not do any high risk work
unless he or she holds and appropriate high risk work licence in relation
to the work

At ABC steel there are a number of high risk work processes that must be done
by employees. Examples of high risk work include using the overhead crane,
forklifts and scaffolding. It is the responsibility of the employer to ensure that
employees do not conduct any of this high risk work until their high risk work
licence has been verified and a in-house VOC competency programme has been
completed to ensure they are completely competent on that piece of equipment.
Further enforcement and audits/inspection will ensure that the employee is
operating the equipment safely. For example checking to ensure forklifts are not
speeding inside the workshop, adhering to a strict 5km/hr speed limit.

Code of Practice Noise:

Division 1- Duties of designers, manufacturers and suppliers of plant


3.2.1 Designers A designer of plant must ensure, by taking noise
emission and exposure into account, that the plant is so designed that
its sound power level is as low as is reasonably practicable

It will be inevitable that the machinery and equipment used at ABC Steel such as
guillotines, plate rolling machines, welding and blasting equipment will create
high levels of noise. It is the duty of care of the manufacturer to provide relevant
recommendation regarding risk control techniques such as mandatory wearing of
Ear muffs/plugs in these areas. Also barriers to acoustically control noise
exposure. The employer of ABC Steel must ensure that all staff abide by these
requirements set out by the manufacturer.

1.2 Due diligence as expressed in Health and Safety Legislation.

With regard to the Health and Safety legislation in your State/Territory,


list where there is reference to the following: (You need to give a brief
overview of the legislative requirements of each one).

(1.2 a) duties of PCBUs (employers) or their officers


OHS Act 2004: Division 2, 21. Duties of employers to employees: (1) An
employer must, so far as is reasonably practicable, provide and maintain for
employees of the employer a working environment that is safe and without risks
to health.
(a) Provide or maintain plant or system of work
(b) Make arrangement for ensuring, as far as is practicable safety and the
absence risk to health in connection with the use, handling storage or
transport of plant or substances
(c) Maintain, so far as is practicable each workplace under the employers
management and control in a condition that is safe and without risk to health
(d) Provide, so far as is reasonably practicable, adequate facilities for the
welfare of employees at any workplace under the management and control of
the employer;
(e) Provide such information, instruction, training or supervision to employees
of the employer as is necessary to enable those persons to perform their work
in a way that is safe and without risks to health.

The key emphasis of this section of the legislation is stating that the employer is
ultimately responsible for the employees on site and must facilitate in providing
adequate level of training on risk. Therefore he/she must ensure a safe work
environment by providing a safety management system and to ensure this
system is followed at all times. He can provide representatives to ensure that
this system is maintained and followed (e.g. safety officers, coordinators, safety
managers, OHS reps).
(1.2 b) duties of workers (employees)
Vic WHS Act 2004:
25. Duties of employees (1) While at work, an employee must (a) take
reasonable care for his or her own health and safety; and (b) take reasonable
care for the health and safety of persons who may be affected by the employee's
acts or omissions at a workplace; and (c) co-operate with his or her employer
with respect to any action taken by the employer to comply with a requirement
imposed by or under this Act or the regulations.

This section of the legislation clearly states that the employee also has a duty of
care to abide by the rules and regulations. They must also take reasonable steps
to ensure that such things as hazards, safety risks and incidents are reported
promptly to the supervisor.
(1.2 c) duties of inspectors
OHS Act 2004- Part 9: Inspectors and enforcement,
The primary role of Worksafe inspectors is to ensure duty holders (e.g.
employers) comply with health and safety legislation. They do this by:

Enforcing the law.

The primary role of the inspector is to enforce the Vic WHS Act 2004, and provide
guidance and support in relation to non-conformances. They also have the power
to provide infringement and prohibition notices in case a serious safety breach
has occurred on site that must be dealt with immediately. They also have the
power to enter the workplace without a permit and to investigate serious high
risk incidents such as workplace fatality.
(1.2 d) consultation, participation and representation
OHS Act 2004: PART 4DUTY OF EMPLOYERS TO CONSULT
36. How employees are to be consulted (1) An employer who is required to
consult with employees must do so by
(a) sharing with the employees information about the matter on which the
employer is required to consult; and
(b) giving the employees a reasonable opportunity to express their views about
the matter

This section of the act is stating the importance of consultation with all key
stakeholders and co-operating with each others discipline and knowledge to
eliminate safety risk and hazards in the workplace. This can be done through
various forums such as safety committees, toolboxes and pre-start meetings.
(1.2 e) discriminatory, coercive and misleading conduct
OHS Act 2004:
Division 9Discrimination against employees or prospective employees
76. Prohibition on discrimination (1) This section applies to (a) an employer
who dismisses an employee, injures an employee in the employment of the
employer or alters the position of an employee to the employee's detriment; and
(b) an employer who threatens to do any of those things to an employee; and (c)
an employer or prospective employer who refuses or fails to offer employment to
a prospective employee, or treats a prospective employee less favourably than
another prospective employee would be treated in offering terms of
employment.

This section of the legislation is detailing the importance of not engaging in any
misleading conduct. Under the act it specifically states that any discrimination
that occurs in the workplace will be dealt with seriously.
(1.2 f) workplace entry by WHS/OHS permit holders

Part 8- Authorised representatives of registered employee organisation
Division 2- Entry Permits

This section of the act states clearly that ABC steel has an obligation to ensure
that any contractors coming onto site must adhere to the permit to work system.
For example if they come into the workshop to conduct hot work, the relevant
hot work permit must be filled out and signed off by the supervisor or person in
charge.

The Act clearly states that everyone at ABC Steel has a duty of care, however the
act specifically states each of the key stakeholders responsibilities
(1.2 h) training needs of health and safety committee members

(3) The functions of a health and safety committee
are
(a) to facilitate co-operation between the employer and employees in instigating,
developing and carrying out measures designed to ensure the health and safety
at
work of the employees; and
(b) to formulate, review and disseminate (in other languages if appropriate) to
the
employees the standards, rules and procedures relating to health and safety that
are to be carried out or complied with at the workplace

The employer is required to establish a health and safety committee meeting


within 3 months as requested by an OHS rep, also at least half the members of
the health and safety committee must be employees to ensure that there is a
fair amount of mangers and shopfloor staff.

Prior to commencing the safety and health committee meeting, members should
be familiar with a number of elements these include:

Consider whether a HS Committee is the most appropriate consultation
arrangement for health and safety matters in your workplace
Determine the composition of the HS Committee, & ensure that different
workgroups are adequately represented
Consult and educate managers and workers to let them know the HS

It is beneficial to consider inviting sub-contractors and their workers to
observe Safety Committee meetings, particularly when common HS issues
arise
Committee members should be allowed to invite a delegate from a trade
union or employer association to a Committee meeting

1.3 Explain the concepts ofduty of care obligations that are referred

The duty of care in the workplace outlines that everyone has a duty of care to
provide and maintain a safe work environment. Duty holders under the Common
Law duty of care need to prove to the satisfaction of the court that the actions
that they have taken to protect others from risk are reasonable and practicable.
Duty holders need to clearly know what their duty is, what the implications are
for each group and what happens if they do not comply.

The duty of care obligations are developed through many forms such as the
primary VIC OHS act 2004, regulations and codes of practice. As well as through
the specific companys safety management system detailing clearing how safety
will be managed in the workplace, providing detailed information about key
stakeholders responsibilities.

1.4 What management techniques could be used to provide evidence


that compliance has been met with regards to Health and Safety
legislation?

There are a number of management techniques that could be used to provide


evidence of compliance these include:

Conducting various safety inspections of the work environment, providing the


results of these safety inspections as evidence that corrective actions have
been resolved
Thorough internal and external safety audit of site specific workplace policies
and procedures
Conduct a gap analysis: This would involve conducting a questionnaire on
shop floor staff including supervisors, safety representatives and leading
hands to get an idea if safety elements and legislation are being represented
on the shop floor.
Look at OHS committee meeting minutes to see what safety elements have
been discussed actioned and controlled

The key to effectively ensuring workplace risk assessments abide by key safety
legislation is by following the following strategies

Involve all key relevant stakeholders in the risk assessment process such as
supervisors, leading hands, employees involved with the risk, safety
representatives, managers and team leaders. Ensure all staff review and have
the opportunity to be involved in the process.
Ensure all staff receive the relevant instruction, supervision and training on
this document
Ensure that the risk assessment is reviewed and updated continuously,
especially if there is a change in the work environment, equipment or
processes that the risk assessment did not consider
Employers have a duty of care to provide training to staff on how a risk
assessment is correctly conducted

1.7 Management at ABC Steel has been made aware that they have a
duty of care to measure and monitor the health of workers at the
workplace. This includes mandatory monitoring as well as volunteer
monitoring programs.

The below regulations clearly state that it is the employers duty of care to ensure
that the health of their staff are monitored.
Victorian WHS Regulations 2007: Chapter 2 4.1.3
4.1.30 Health surveillance
(1) An employer must ensure that health surveillance is provided for an
employee if
(a) the employee is exposed to any hazardous
substance
(i) listed in column 1 of Schedule 3 to the National Model Regulations for
the
Control of Workplace Hazardous Substances (except asbestos); or
(ii) determined by the Authority to be a hazardous substance for which
health surveillance is required; and
(b) The exposure of the employee to the hazardous substance is such that
an adverse effect on the employee's health is reasonably likely to occur
under the particular conditions of work at the workplace.
(2) The purpose of the health surveillance is to monitor the employee's
health for the purpose of identifying changes in the employee's health
status due to occupational exposure to a hazardous substance.

These can include but are not limited to exposure to:


noise lighting chemicals, solvents vibration welding fumes radiation
synthetic fibre confined Spaces dust metal fumes asbestos lead
hydrocarbons breathing air quality thermal comfort hazardous substances

Health monitoring initiatives that can be carried out may include:

Occupational health testing and sampling of work area
Providing controls advice
Delivering training
Specialist intervention
Consultation with work force

ABC Steel has asked you to give them an overview of their current work health
and safety consultation and information management status.

You will first have to review the effectiveness of current consultation


processes, establish the desired forms of consultation at ABC Steel and then
redesign the consultation policy.

You will then have to explain the requirements of a suitable WHSMS/OHSMS


and information management system for the company including document
control strategies.

You have access to all relevant States WHS/OHS legislation and management
has also purchased four Australian/New Zealand Standards to help establish

Consultation is very important in the workplace. Consultation is a legal requirement


and an essential part of managing health and safety risks

Informal consultation could mean that both the groups could have a toolbox meeting
prior to work commences.

Formal consultation would be that both group need to read the staff noticeboard and
also speak to their HSR. The HSR needs to document the issue.
In the workplace consultation is vital throughout the workplace. It poses a risk in the

The morning tool box meetings suit my needs for consultation.

It appears that the morning toolbox meeting is not suiting everyones needs
for consultation. This gives an indication that the way the training is
presented may need to be revised. Peoples voices are not being heard.
Alternatively a change in the way the meeting is structured may improve
consultation. For example, having an open discussion with the team,
allowing staff to bring up any safety issues collectively. The minutes of the
meeting can also be recorded so that employees know that the hazards or
safety issues presented will be looked at formally and rectified. When staff
see value in the meeting they will bring up more issues. Also each meeting
can have a specific key safety topic to discuss, such as a safety share that
can be given by anyone in the group.

Consultation has removed hazards from my work area.

This areas still requires improvement, it appears that strengthening of


consultation measures needs to be put in place. Strategies to better achieve
this include:
Managers, supervisors, leading hands, safety representatives, team leaders to support
consultative approach- Build a strong relationship with employees.

I know who my safety officer is.

This is a cause for concern; the best way to ensure the safety officer is
known is through the following strategies
Prior to employee commencing in the workshop, the employee will be safety inducted in
this process the safety officer will be formally introduced

Safety officer to maintain daily dialogue, and open communication with all employees, via
walkthrough of the site- he/she needs to be visual in the workshop and easily identifiable to all
staff

Safety officer to be involved in all safety meetings and to facilitate dialogue between key
stakeholders

I find meetings have made me work safer.

Positive feedback presented in pie chart, the safety meetings need to


continue to occur as there is a lot of value in these forums. Ensure key
stakeholders attend the meeting including the supervisor, manager, safety
representatives, team leaders and safety officer/coordinator. Moving forward
ensure that meetings are still kept informative, up to date and always
include employees feedback to make the meetings better and more efficient.
For example safety legislation is always being updated the safety meetings
would be a great forum to present this information to staff and to keep them
informed.

I now report near misses.

A large degree of staff evidently are not reporting near misses which is a
legislative and company requirement. The issue regarding not reporting near
misses is that eventually this near miss in the workshop if not eliminated
and controlled will form into a more serious injury. The environment for
reporting of near misses needs to emphasize a no blame approach. Once

Create a Hazard Management Tool


As has been mentioned already, ABC does not have an appropriate hazard
management tool in place. At present, there is very little hazard identification being
carried out and no risk analysis of identified hazards. This means that basic control
identification, implementation and monitoring are also not being carried out.
To help achieve requirements of WHS/OHS risk management process, it has been
decided that you will need to create a hazard management tool for this purpose. The
hazard management tool should include scope for ABC Risk management process of
hazard identification, risk analysis and control measures to be implemented as well as
responsible persons required to finalise tasks and a time limit for implementation.
Once you have created your comprehensive hazard management tool, place it into the
space provided on page 36 and then completeit with as much detail as possible with
reference to the Incident Form on the next page.

The questions in assessment 5 will relate to the additional information
given below in the fall from heights scenario

Engineering

You are the health and safety manager at ABC Steel. The company has a large site
with three purpose-built buildings on the outskirts of the city. The company's hours of
operation are from Monday to Friday 7am to 4.30pm and Saturdays 8am to 1pm.
There is also scope for overtime when needed usually over the weekend and workers
can work up to 60 hours a week when they are busy. There are approximately 100
staff members. These include machinists, cutters, welders, painters, drivers, as well
as general labourers. There are times where workers are required to operate offsite,
delivering and installing finished steel products.

The workplace policy on rest periods states that staff takes fifteen minute
morning/afternoon breaks and a 30 minute lunch break. This also forms part of the
organisations fatigue management plan. This is sometimes overlooked by staff as
work is fast-paced and busy.

Employees are reasonably well-paid but work hard for long hours and are under
stress to finish jobs to strict time schedules.

On Friday 12th July at 6.30pm you were informed that there had been an incident in
building 1 and a worker has been taken to Edge Town hospital.

You arrive at the building 1 at 6.45pm. There are about 10 workers who are
wandering around. All have stopped work.

Carlos, the forklift driver, leads you to the scene of the incident (next to scaffolding
and silo in the middle of building 1 work area) and explains that a welder, Kelvin
Jones (47 years old), has slipped from the top of a silo and knocked himself
unconscious and looks like he has hurt his leg. That was at 6.00pm. The welding
equipment and bottles were also damaged in the fall and were secured by Steve at
the incident site.

There is a labourer who witnessed the incident, (Steve), who called for the assistant
manager, Gino, who is also the first aid officer, who administered first aid and called
an ambulance (6.03pm).

By the time the ambulance arrived (6.15 pm) Kelvin had regained consciousness and
the cut on his leg had been treated to stop the bleeding. He was obviously in a lot of
pain, going into shock and then taken to hospital (6.25pm). That is when they called
you.

You inspect the work area and notice that fall protection harnesses have not been
worn. When you ask Gino why this is so, he states We didnt have time to put the
harnesses on as we are too busy and it was only a five minute weld.

The following day the return to work coordinator has informed you that the injured

When the incident occurred, can you please describe what you saw?
I was on the fork at the back of the factory and didnt see it but heard a
crash.

Gino and Steve were there when I got there.

others prior to the incident?
Kelvin is always shouting with everyone. He is always stressed out.

What previous near misses or similar incidents have occurred?


I never work at heights so I wouldnt know for sure but some of the blokes
refuse to do it.

Steve Labourer
When the incident occurred, can you please describe what you saw?
Kelvin used a ladder to get himself up to the top of the scaffolding next to
the silo which is about three meters high. We had an Elevated Work
Platform (EWP) in factory 2 but couldnt get at it as the factory was shut
and factory manager had gone home with the keys. It was the same with
the harness. It was in the stores, locked away. We asked for it earlier but
were told to wait.

Who else was at the incident scene?


Gino gave first aid. I reckon he saved his life. Carlos turned up and phoned
an ambulance.

In your own words, what communication took place between worker and
others prior to the incident?
Same old, same old. Kelvin was always at odds with management who
were telling us one thing about safety then not allowing us to do the job in
the right manner. Never enough time etc, etc. I spoke to Kelvin in the day
and he was over it and thinking of quitting.

Too many.

I didnt actually see the incident as I had my back to it and was in the site office
anyway. I heard a crash and commotion. As I walked out of the site office I saw
Steve calling and waving to me. Thats when I noticed Kelvin on the floor.

Who else was at the incident scene?


Steve and Carlos.

What communication took place between worker and others prior to the incident?
I saw Kelvin arguing with Peter in the morning about doing the weld. He wanted
to get into a harness and do it straight away but was told to finish his other work
first.

What previous near misses or similar incidents have occurred?


We have had a few near misses as workers do not like to get the harness on as
they see it as a waste of time especially with quick welds. It had been mentioned
to Peter on a number of occasions and he had said we need to reintroduce
requirements into pre start meetings.

I didnt see the incident as I had left for the day.

I believe that Gino, Steve and Carlos were at the incident at the time.
